Abstract

ABSTRACTIndonesia as an archipelago has an abundant of fish resources. Geographically, Indonesia is located strategically, for which this condition becomes a challenge, and it is our responsibility to maintain, guard, and conserve these resources. This strategic condition will automatically attract foreign ships to do illegal fishing, particularly in ZEEI (Indonesian Exclusive Economy Zone) in the Area of Fishery Management of the Republic of Indonesia. The result of the research showed that the consequence of the illegal fishing in the area of fishery management of the Republic of Indonesia by foreign fishermen is very big; it amounts to 30 quintillion rupihs each year. It is recommended that, in order to cope with the criminal act of illegal fishing in the Area of Fishery Management of the Republic of Indonesia, particularly in the Indonesia Exclusive Economi Zone, the government should be serious in enlarging the budget for the supervision and furnish equipment and infrastructure which are related to supervision.Keywords: Criminal Act of Illegal Fishing

Abstract

ABSTRACT Indonesia as a State Party in the Convention on the Rights of the Child governing the principle of legal protection for the child is obliged to provide special protection to children in conflict with the law. One of the forms of child protection is realized through special criminal justice system for children in conflict with the law. This is confirmed in the United Nations Standard Minimum Rules for the Administration of Juvenile Justice. The findings show that, the first is the legal protection of children as perpetrators of criminal acts is indispensable because it is useful for: 1) Children are not stablephysically and mentally, 2) To ensure the children freed from inhuman or demeaningpunishment, 3 ) To ensure the independence of the child, so as not seized unlawfully or arbitrarily, 4) To ensure that the criminal (penalty) applies only as an ultimumremedium; the second is the legal protection should be given to the child is the legal protection that covers several concepts as follows: 1) The concept of Restorative Justice; and 2) Concept of Diversy. The third isthe child criminal liability based on the judge's decision are as follows: Accepting an appeal from lawyer and public prosecutor of the child; strengtheningdecision ofMedan District Court No.:27/Pid.SUS.Anak/2014/PN.Mdn; Establish the length of children detained entirely deducted from the sentence imposed; Ordered the child remains in custody; Charge a second child in the case of judicial level, which is in the level of appeal for Rp.2.500,00 (Two thousand five hundred rupiahs).   Keywords : Legal Protection , Responsibility , Children Actors Crime.

Abstract

Abstract. The community is a portrait of life full of disputes, disputes, quarrels, feuds, or various types of conflicts between individuals, groups, families, ethnicities, even between nations that result in various forms of criminal offense including criminal acts both light and heavy as intended Article 351 sd Article 355 of the Criminal Code. For example, dangdut singer Murya Agung aka Dewi Persik, was found guilty of committing a minor offense against Julia Perez as charged with Article 351 paragraph (1) of the Criminal Code. In essence, the court ruling imposed the defendant Dewi Persik for 3 (three) months imprisonment and ordered the defendant to be detained. Apparently opponent play Dewi Persik, Julia Perez punished with the same punishment that is sentenced to prison for 3 (three) months in prison. From the above description, it is appropriate that the concept of restorative justice approach as an alternative to the settlement of criminal offenses is immediately applied in Indonesia as an effort to reform the law. This is because restorative justice is an approach that is more focused on the conditions of creating justice and balance between perpetrators of crime with the victim. The criminal justice-focused criminal justice mechanism and procedure is transformed into a process of dialogue and mediation to create an agreement on the settlement of a fairer and more balanced criminal case for both victims and perpetrators. Restorative justice has a meaning of restoring justice. In the criminal justice is currently known as restitution or compensation for victims, while restoration has a broader meaning. In this study tried to show that the criminal act of persecuting each other is equally harmful to the parties who litigation.   Keywords : settlement of cases; restorative justice; and criminal act of persecution.
