Abstract

Humans are social beings who have interests that they want to achieve. When an interest cannot be fulfilled, he will try to find someone who can fulfill his interests which will meet the interests of the other party which brings a good reciprocal effect, so an agreement is made. In order for there to be legal certainty in the agreement, the making of the agreement is carried out before a Notary. Notary is one of the officials who has the authority to make documents in the form of authentic deeds which are written evidence that has strong and absolute evidentiary power where if the parties do not recognize the authentic deed, both parties must provide evidence that denies the deed in accordance with what is written in Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning Notary Positions. Even though there is a governing law, we still often find Notaries who commit several violations that cause losses to clients as happened in one of the Holy District Court Decisions Number: 13 / Pdt.G / 2016 / PN.Kds where Notaries make Sale and Purchase Agreements as if and without an agreement between the two parties

Abstract

The issue of consumer protection has in fact become a hot topic that needs attention from various parties, especially considering that every business activity involves consumers and there are consumer rights that must be fulfilled by entrepreneurs based on Law Number 8 of 1999 concerning Consumer Protection. Cases that have been widespread include discriminatory practices carried out by PT Garuda Indonesia (Persero) Tbk in selling Umrah tickets, closing access to ticket reservations by Garuda Indonesia to 301 PPIUs (Umrah Travel Organizers), so that consumers cannot reserve tickets directly. This problem then invites the author to discuss further regarding consumer protection in this case and the implementation of legal protection that should be for consumers in discriminatory practices in business activities. This research uses a normative juridical research method using literature study and a legal approach. The research results show that in constructing consumer protection, you must actually look at legal principles, both in terms of legal certainty, legal protection and justice, as well as referring to the principles of Islamic law. In implementing legal protection referring to the Consumer Protection Law, it is necessary to take several steps, including collaboration in supervising entrepreneurs by utilizing technology, clear and integrated regulations and the imposition of strict and proportional sanctions, as well as education for entrepreneurs to can always uphold consumer protection values including transparency, fairness, openness, equality.

Abstract

The purpose of this research hopes to provide viewers further awareness and contributions that promote the abolishment of nuclear weapons. The issue the researcher has found include what are the legal applications and laws regarding the threat and use of nuclear weapons. The research method used is doctrinal legal research which aims to examine and analyze the norms that govern the threat and use of nuclear weapons based on existing laws. The findings of this research include various regulations and treaty’s such as the Non-Proliferations Treaty which establishes the recognition of nuclear and non-nuclear weapon states, as well as the limits on the use of nuclear weapons, The Comprehensive Nuclear Test Ban Treaty is an agreement which aims to limit the development and testing of nuclear weapons, and most recently the Treaty on the Prohibition of Nuclear Weapons which prohibits nuclear weapons. However, the results have shown that the current laws are insufficiently enforceable and mainly agreed upon under good faith. President Putin’s threats to nuclear warfare and the transfer and stationing of nuclear weapons to Belarus are evidence for further developments and amendments to the treaties in addressing this problem.

Abstract

The articles in the Tax Crime Act are legal affairs, which can be defined as tax- related criminal deed related to accountability of the aforementioned deed both as individual taxpayers and corporate taxpayers. This is further elucidated in the Circular Letter of Supreme Court (SEMA) no. 4 year 2021 regarding Corporate Responsibility in the Field of Taxation, which stipulate that every individual is defined as an individual and a corporation and efforts to resolve tax crimes. Tax crimes are further elucidated in Articles 38, 39, 39A, 40, 41, 41A, 41B, 41C, 43 and Article 43A. In those articles, it is described that the types of tax crimes in the form of negligent or (culpa) is deeds categorized as both unintentional and intentional or criminal (dolus).

Abstract

This research highlights the significant role of POJK Number 57/POJK.04/2020 in establishing a legal framework for equity crowdfunding in Indonesia, aiming to balance investor protection and transaction flexibility. Despite its progress, challenges remain, particularly with restrictions on stock trading and limited investor flexibility. Equity crowdfunding services are rapidly growing in Indonesia as an alternative funding source for micro, small, and medium enterprises (MSMEs). However, the implementation of related regulations, particularly the Financial Services, faces challenges in protecting the rights of investors, especially regarding the restriction on share trading, which can only occur twice a year. This study aims to analyze the implementation of the POJK in accommodating investor rights and evaluate the role of platform providers in safeguarding investors' interests. Using a normative-empirical legal research method, the results show that although the regulation provides protection for investors, liquidity limitations and transparency of project reports remain significant challenges. The study concludes that increasing trading flexibility, technological development, and enhancing financial literacy are necessary to strengthen the equity crowdfunding ecosystem in Indonesia.

Abstract

This article examines the legality and validity of electronic signatures in Indonesia, especially for crucial documents such as the Power of Attorney and Letters of Indemnity, in the light of digital transformation. In this study, a normative legal research method, more popularly known as doctrinal research, was employed, where an in-depth analysis of the legislative texts and available legal materials is needed to construct sound legal reasoning. Approach: The paper combines a conceptual analysis of legal principles with a statutory approach that analyzes whether there is harmony within the various legislative provisions. Various statutes and regulations in Indonesia are critically analyzed, including the Law on Electronic Information and Transactions, Government Regulation concerning the Execution of Electronic Systems and Transactions, and the Minister of Communication and Informatics Regulation on Electronic Certification. The discussion should be centered on what legal provisions must be in place for the acceptance of electronic signatures certified and those not certified. It, therefore, sets out the legal implications of the use of electronic signatures and gives comprehensive recommendations of the best practices as a means of ensuring legal certainty and legality in their implementation in Indonesia. The Journal is intended to assist businesses and lawyers to pass through those issues with ease. To this end, this journal will consider in great detail the legal framework for electronic signatures.

Abstract

A trademark, as part of Intellectual Property Rights, is an important element for business operators to differentiate their products from those of other business operators. Passing off is one of the most common forms of trademark infringement, occurring when a business imitates a well-known trademark identically to create confusion among consumers. Famous brands have a high reputation and a good image in society, but the protection against passing off for famous brands is still lacking. In Law Number 20 of 2016 concerning Trademarks and Geographical Indications, there is still no clear regulation regarding the passing off of well-known trademarks, resulting in legal uncertainty for the original well-known trademark owners. As a result, violations of well-known brands frequently occur, driven by economic factors and societal stereotypes that view well-known brands as symbols of social status.

Abstract

Akta Jual Beli merupakan suatu bukti otentik atas adanya peralihak hak atas tanah atau bangunan yang telah dibayar secara lunas oleh pembeli rumah yang dibuat di hadapan Pejabat Pembuat Akta Tanah. Akta Jual Beli termasuk ke dalam Protokol Pejabat Pembuat Akta Tanah yang harus disimpan dan dipelihara oleh setiap Pejabat Pembuat Akta Tanah. Jika Pejabat Pembuat Akta Tanah lalai dalam menyimpan Akta Jual Beli tersebut dan mengakibatkan kerugian kepada pihak lain maka Pejabat Pembuat Akta Tanah harus bertanggungjawab atas hal tersebut. Metode penelitian yang digunakan yaitu penelitian hukum normatif, penelitian ini bersifat studi kepustakaan, sumber data bersumber dari data sekunder. Dalam menjalankan jabatannya, Pejabat Pembuat Akta Tanah terikat secara langsung dengan Kode Etik Pejabat Pembuat Akta Tanah, yang diatur oleh Peraturan Menteri Agraria dan Tata Ruang / Kepala Badan Pertanahan Nasional Republik Indonesia No. 2 Tahun 2018 tentang Pembinaan dan Pengawasan Pejabatan Pembuat Akta Tanah. Seorang Pejabat Pembuat Akta Tanah yang tidak melaksanakan kewajibannya sebagaimana tersebut di atas karena alasan apapun; baik karena adanya kesengajaan (dolus) ataupun kelalaian (culpa) akan ditindak sesuai dengan Kode Etik Pejabat Pembuat Akta Tanah.

Abstract

Penelitian ini membahas tanggung jawab bank atas hilangnya dana nasabah melalui layanan aplikasi mobile banking, dengan fokus pada kasus Putusan Nomor 3/PDT.Sus-BPSK/2022/PN LSM. Dengan meningkatnya penggunaan mobile banking di Indonesia, permasalahan keamanan data dan kepercayaan nasabah menjadi perhatian utama. Melalui metode hukum normatif, penelitian ini menganalisis hubungan hukum antara bank dan nasabah serta penerapan prinsip kehati-hatian oleh bank. Kasus yang diteliti menunjukkan bahwa ketidakpatuhan bank terhadap prinsip kehati-hatian mengakibatkan kerugian bagi nasabah, yang dalam hal ini adalah Hasballah, seorang pegawai negeri sipil yang kehilangan dana akibat penipuan. Penelitian ini menemukan bahwa tanggung jawab bank dalam menjaga keamanan informasi nasabah sangat penting untuk mempertahankan kepercayaan masyarakat terhadap sistem perbankan. Oleh karena itu, diperlukan regulasi yang lebih ketat dan penerapan teknologi keamanan yang memadai untuk melindungi nasabah dari risiko kejahatan siber.

Abstract

This study examines several problems that arise in the establishment of BPI Danantara, such as the urgency of establishing BPI Danantara, the objectives of Danantara's legal policy, and the the strengths and weaknesses of establishing BPI Danantara. The writing method used in this writing is normative legal analysis. The study finds that the establishment of BPI Danantara is urgently needed to accelerate economic growth, eradicate extreme poverty, and fund downstream programs, yet its success hinges on upholding good governance, transparency, professional management, and the development of clear implementing regulations for investment management. The novelty lies in the proposed establishment of BPI Danantara as a strategic entity to address critical national economic goals, specifically through direct capital injection into downstream programs, a function previously reliant on foreign investment.
