Abstract

Land is a crucial natural resource for human life, serving as a residence, a basis for economic activities, and a symbol of status. Effective land registration is vital for providing legal certainty and preventing disputes, particularly regarding the issue of overlapping certificates. This writing will discuss the role of electronic certificates as a solution to address this issue, considering that the increasing number of registered land parcels can trigger ownership conflicts. Although the existing legal framework provides a clear structure, challenges such as a lack of accurate data, complex bureaucracy, and high registration costs still hinder implementation. Electronic certificates are expected to enhance transparency and efficiency in land rights management; however, they do not guarantee the elimination of future disputes. Therefore, community education and improved oversight among relevant agencies are necessary to ensure the successful transformation of the land registration system in Indonesia

Abstract

Labor social security is a fundamental right guaranteed by the state to protect workers from social and economic risks, including unilateral termination of employment. However, in practice, many employers fail to comply with their obligations to provide social security benefits to workers who have been unilaterally dismissed. This non-compliance has severe consequences for workers' well-being and legal implications for employers. This study aims to analyze the legal implications of employers' non-compliance in providing social security benefits to workers affected by unilateral termination and examine the government's role in enforcing the law and protecting affected workers. The research employs a normative juridical method with a statutory and case approach. The findings reveal that employers' failure to pay labor social security contributions can result in administrative, civil, and criminal sanctions under Law Number 24 of 2011 on BPJS and Law Number 13 of 2003 on Manpower. Additionally, workers whose rights are violated can seek legal recourse through the Industrial Relations Court (PHI). The government plays a crucial role in ensuring employer compliance through supervision, law enforcement, and providing dispute resolution mechanisms and legal assistance for workers. This study concludes that enhancing regulatory effectiveness and monitoring employer compliance is essential to safeguarding workers' rights, maintaining economic stability, and promoting social welfare in Indonesia.

Abstract

Notaries as public officials who are authorized to make authentic deeds carry out their duties and authorities inseparable from the processing of Personal Data, both physical and electronic. Notaries process Personal Data not only for Personal Data subjects, namely Clients, but also for workers or interns, or third parties whose information is provided by the Client. Since the enactment of the PDP Law, Notaries as officials who make authentic deeds in processing Personal Data are not only obliged to maintain the confidentiality of Personal Data, but there are also several other obligations regulated in the PDP Law as an effort to prevent and eradicate potential cybercrime. In this study, the author will dissect the role and obligations of Notaries in the security of Personal Data based on the PDP Law. The study used a normative legal method with a statutory approach and a conceptual approach. Through this study, it is concluded that a Notary as an official who makes authentic deeds has a crucial role, namely as a Personal Data Controller who can determine the purpose and method of processing personal data. Notaries have several obligations as regulated in the PDP Law, including having a basis for processing, ensuring the security of personal data, assessing the impact of Personal Data Protection, recording all personal data processing activities, appointing Personal Data Protection officials, fulfilling the rights of personal data subjects, and others. The ultimate goal of this study is expected to provide knowledge and legal certainty related to Personal Data Protection in notarial practice.

Abstract

The Sale and Purchase Agreement is basically an assistance agreement that functions as a preliminary agreement and is free in form . In the making of PPJB in practice in the field, it is found that it is not uncommon for the parties to enter into a PPJB underhand as a preliminary agreement containing several agreements and there have also been many PPJB underhand there is a default from one of the parties who promised . This scientific article uses deductive analysis, as well as normative research types. PPJB made underhand is an agreement made by the parties themselves without any intervention from authorized public officials, and without a specific standard and only adjusted to the needs of the parties . If the parties do not deny and acknowledge their signatures in the agreement, then the PPJB underhand has legal force based on the principle of pacta sunt servanda.

Abstract

The purpose of this research is to find out clearly about the Legal Review of Issuing Blank Bilyet Giro. checks and giro bills in commercial transactions that can give rise to legal consequences. Depending on their nature, unlawful acts can be classified as criminal or civil offenses. Therefore, depending on the circumstances, the use of checks and giro bills in commercial transactions can be classified as a civil or criminal offense. The research methodology chosen is descriptive research (descriptif research), which is part of concept-based criminological research. Additional legal impacts may result in criminal and civil penalties. Reasons and Steps for Surrendering a Bilyet Giro. The interested bank is obliged to reject the Bilyet Giro offered by the holder if it turns out to be empty and the available funds are insufficient. The refusal must be accompanied by a Certificate of Rejection (SKP) which, among other things, must include the full name and address of the party making the withdrawal.

Abstract

This study aims to analyze the disharmony between norms and practices related to interfaith marriage in Indonesia, which has led to legal uncertainty and differences in interpretation in court. The method used is a normative juridical approach with a comparative analysis of regulations and court decisions. The results of the study show contradictions between Law No. 1 of 1974 concerning Marriage (jo. Law No. 16 of 2019), Article 28B paragraph (1), and Article 29 of the 1945 Constitution, as well as technical policies through SEMA No. 2 of 2023. Court decisions also differ, for example, South Jakarta District Court Decision No. 916/Pdt.P/2022/PN JKT.SEL, which granted the request, compared to Supreme Court Decision No. 1400 K/Pdt/1986, which rejected it. This difference causes inconsistency in the protection of citizens' constitutional rights. The novelty of this research lies in offering guidelines for interpreting national law as a uniform reference for law enforcement officials. These findings contribute to strengthening legal certainty, providing practical guidance for judges, input for regulators, and protection of the rights of the community in the practice of interfaith marriage. Thus, this research has direct implications for improving the governance of interfaith marriage law in Indonesia.   Penelitian ini bertujuan menganalisis disharmoni norma dan praktik terkait pernikahan beda agama di Indonesia, yang menimbulkan ketidakpastian hukum serta perbedaan tafsir di pengadilan. Metode yang digunakan adalah pendekatan yuridis normatif dengan analisis komparatif terhadap regulasi dan putusan pengadilan. Hasil penelitian menunjukkan adanya kontradiksi antara Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan (jo. UU No. 16 Tahun 2019), Pasal 28B ayat (1) dan Pasal 29 UUD 1945, serta kebijakan teknis melalui SEMA No. 2 Tahun 2023. Putusan pengadilan pun berbeda, misalnya Putusan PN Jakarta Selatan No. 916/Pdt.P/2022/PN JKT.SEL yang mengabulkan, dibandingkan dengan Putusan MA No. 1400 K/Pdt/1986 yang menolak. Perbedaan ini menimbulkan inkonsistensi dalam perlindungan hak konstitusional warga negara. Kebaruan penelitian ini terletak pada tawaran pedoman interpretasi hukum nasional sebagai acuan seragam bagi aparat penegak hukum. Temuan ini berkontribusi pada penguatan kepastian hukum, memberi panduan praktis bagi hakim, masukan bagi pembuat regulasi, serta perlindungan hak masyarakat dalam praktik pernikahan beda agama. Dengan demikian penelitian ini berimplikasi langsung terhadap perbaikan tata kelola hukum pernikahan beda agama di Indonesia.

Abstract

This research aims to determine, assess, and analyze the legal status of the Land Sale and Purchase Deed (AJB) compared to the Expired Building Use Rights Certificate, to investigate and analyze the role of a notary in land registration implementation and reconstruction, and to identify and analyze the latest provisions regarding land ownership rights. This research utilizes a normative juridical approach with a descriptive analytical research method. The data used in this research are the disputed land cases located in Kampung Bojong Menteng, Rawalumbu District, Bekasi City, referring to the Expired Building Use Rights Certificate based on Decision No. 571/Pdt.G/2021/PN.Bks jo Decision No. 591/PDT/2022/PT.BDG. Based on the analysis, it is discovered that Decision No. 591/PDT/2022/PT.BDG, issued on November 10, 2022, has invalidated Decision No. 571/Pdt.G/2021/PN.Bks, issued on August 8, 2022, by the Bekasi District Court. Several differences were identified, including: (1) differences regarding the disputed object; (2) differences regarding the parties involved in the dispute; and (3) differences regarding the principle of nebis in idem. These differences prove the existence of unlawful acts committed by PT. Bangun Tjipta Pratama as the owner of the Expired Building Use Rights Certificate, with unclear ownership rights over the land owned by Rekson Sitorus, and the unlawful act conducted by the Bekasi National Land Agency, which issued SHGB No. 7 as the rightful owner of the land in question.

Abstract

Abstract: The transfer of regulatory authority over financial-service cooperatives to the Financial Services Authority (OJK) through the Financial Sector Development and Strengthening Law (Law No. 4/2023, PPSK Law) represents a paradigm shift in Indonesia’s legal landscape. Cooperatives, historically governed under a separate regime and supervised by the Ministry of Cooperatives and SMEs, are now incorporated into the national financial regulatory system. This article examines the conceptual implications of the reform through a normative juridical method supported by statutory, conceptual, and comparative approaches. Primary legal sources include the PPSK Law, Cooperative Law, Financial Services Authority Law, and OJK Regulation No. 47/2024, while secondary sources comprise scholarly literature, expert opinions, and prior research. The analysis employs three conceptual frameworks: consumer protection theory, Maqāṣid al-Sharīʿah in Islamic economic law, and legal pluralism. Findings show that OJK supervision enhances legal certainty, protects members’ financial assets, and aligns cooperative consumer rights with those of bank customers, thereby advancing the Maqāṣid principles of protection of wealth (ḥifẓ al-mā), justice (‘adālah), and balance (tawāzun). Nevertheless, the reform raises concerns about potential erosion of cooperative autonomy and the risk of marginalizing small-scale or community-based cooperatives. These tensions highlight the need for proportional and collaborative regulatory design that accommodates cooperative values while ensuring accountability and stability. The discussion concludes that cooperative supervision under OJK can serve as both a safeguard and a challenge: it strengthens governance but may undermine cooperative identity if implemented rigidly. Future empirical research is recommended to assess the real impact of the reform across regions and cooperative models. Abstrak: Peralihan kewenangan pengawasan koperasi jasa keuangan kepada Otoritas Jasa Keuangan (OJK) melalui Undang-Undang Pengembangan dan Penguatan Sektor Keuangan (UU No. 4 Tahun 2023, UU PPSK) merepresentasikan perubahan paradigma dalam lanskap hukum Indonesia. Koperasi, yang secara historis diatur dalam rezim terpisah dan diawasi oleh Kementerian Koperasi dan UKM, kini masuk dalam sistem regulasi keuangan nasional. Artikel ini mengkaji implikasi konseptual dari reformasi tersebut melalui metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Sumber hukum primer mencakup UU PPSK, UU Perkoperasian, UU Otoritas Jasa Keuangan, serta Peraturan OJK No. 47 Tahun 2024, sedangkan sumber sekunder meliputi literatur akademik, pendapat ahli, dan hasil penelitian terdahulu. Analisis dilakukan dengan menggunakan tiga kerangka konseptual: teori perlindungan konsumen, Maqāṣid Asy-Syarīʿah dalam hukum ekonomi Islam, dan pluralisme hukum. Hasil penelitian menunjukkan bahwa pengawasan OJK meningkatkan kepastian hukum, melindungi aset keuangan anggota, serta menyelaraskan hak-hak konsumen koperasi dengan nasabah bank, sehingga memperkuat prinsip maqāṣid berupa ḥifẓ al-māl (perlindungan harta), ʿadālah (keadilan), dan tawāzun (keseimbangan). Namun demikian, reformasi ini juga menimbulkan kekhawatiran terkait potensi terkikisnya otonomi koperasi dan risiko marginalisasi terhadap koperasi kecil berbasis komunitas. Ketegangan ini menegaskan perlunya desain regulasi yang proporsional dan kolaboratif, yang mengakomodasi nilai-nilai koperasi sekaligus menjamin akuntabilitas dan stabilitas. Kajian pada artikel ini menyimpulkan bahwa pengawasan koperasi oleh OJK dapat berfungsi ganda: sebagai instrumen penguatan tata kelola, tetapi juga berpotensi melemahkan identitas koperasi jika diterapkan secara kaku. Penelitian empiris lebih lanjut sangat disarankan untuk menilai dampak nyata reformasi ini di berbagai daerah dan model koperasi.

Abstract

Diplomatic asylum represents a contentious area of international law, lying at the intersection of state sovereignty, territorial jurisdiction, and the humanitarian imperative to protect individuals facing persecution. This study explores the legal threshold for granting diplomatic asylum, focusing on the interplay between the rights of the host state and the obligations of the asylum-granting state. While the Vienna Convention on Diplomatic Relations (1961) establishes the inviolability of diplomatic premises, it provides no explicit provisions for asylum, resulting in a fragmented and inconsistent framework. The requirement for host state consent is analyzed as a critical factor in balancing sovereignty with humanitarian concerns, often leading to diplomatic tensions and breaches of international law. Moreover, the absence of enforcement mechanisms exacerbates the challenges in resolving asylum-related disputes.Through a detailed legal analysis, this study argues for the necessity of a multilateral treaty under the auspices of the United Nations to harmonize practices and establish clear norms governing diplomatic asylum. It also emphasizes the potential of regional cooperation in reducing conflicts and setting precedents for broader international frameworks. By addressing these gaps, this article aims to contribute to the development of a coherent legal regime that reconciles the competing interests of state sovereignty and individual protection.
