Abstract

Penelitian ini dilatarbelakangi oleh maraknya penggunaan Pasal 27 ayat (3) UU No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE), yang mengatur tindak pidana pencemaran nama baik melalui media elektronik, namun dinilai mengandung norma samar yang berpotensi multitafsir. Penelitian ini bertujuan untuk menganalisis ratio decidendi hakim dalam perkara No. 202/Pid.Sus/2023/PN.Jkt.Tim serta menelaah perlindungan hukum terhadap kebebasan berekspresi dalam penerapan pasal tersebut. Metode yang digunakan adalah penelitian hukum yuridis normatif dengan pendekatan perundang-undangan, kasus, dan perbandingan hukum. Objek penelitian difokuskan pada putusan Pengadilan Negeri Jakarta Timur dan data dikumpulkan melalui studi kepustakaan dengan analisis dokumen sebagai instrumen utama. Teknik analisis data dilakukan secara kualitatif dengan pendekatan teori kepastian hukum, keadilan, dan perlindungan hukum. Hasil penelitian menunjukkan bahwa penerapan Pasal 27 ayat (3) UU ITE sering kali bertentangan dengan prinsip kebebasan berekspresi, terutama jika tidak disertai interpretasi hukum yang cermat oleh aparat penegak hukum. Ratio decidendi hakim dalam perkara terkait mengedepankan perlindungan atas kehormatan, namun belum seimbang dalam menilai motif dan konteks ekspresi. Penelitian ini memberikan kontribusi penting bagi pengembangan ilmu hukum dengan menawarkan solusi interpretatif untuk mencegah penyalahgunaan norma, serta menekankan pentingnya reformasi pasal agar selaras dengan prinsip demokrasi dan hak asasi manusia.

Abstract

This study discusses product liability in Indonesian business law, analysed through qualitative literature review. The legal framework is based on a combination of the Consumer Protection Law, the Civil Code, and various sectoral regulations such as those in the fields of health, food, and the environment. In this system, product defects including design, manufacturing, and information defects form the basis of a business's obligation to provide compensation in the form of refunds, replacement of goods or services, health care, or damages, with liability remaining even if the fault lies with another party in the distribution chain. While the Consumer Protection Law and the Civil Code provide the basis for lawsuits, sectoral regulations reinforce obligations in high-risk areas, supported by technical standards such as SNI and waste management regulations. Dispute resolution can be carried out directly, through the BPSK, or in court, including class action lawsuits. The effectiveness of this regime is highly dependent on the clarity of the definition of product defects, the integration of legal regulations, and the accessibility of compensation channels. Therefore, the study recommends strengthening the guidelines for evidence, increasing the capacity of dispute resolution institutions, and developing corporate risk management policies that are oriented towards product safety and consumer loss recovery.

Abstract

This community service activity was carried out to explore and encourage increased involvement of students, local communities, and the government in collective efforts to maintain environmental cleanliness, particularly in areas surrounding the campus. Gotong royong is an important tradition in Indonesia that plays a significant role in preserving environmental cleanliness and public health. However, its implementation is often influenced by various factors that affect the success and sustainability of cleanliness programs. This activity applied the Participatory Action Research (PAR) method as an approach that promotes the active participation of students, communities, and the government at all stages of the program, starting from planning and implementation to evaluation. The results of the activity indicate a significant increase in student and community participation in gotong royong activities. This improvement was influenced by several factors, including greater awareness of the importance of environmental cleanliness, support from the community, support from the local government, and the availability of adequate facilities. Therefore, it can be concluded that students’ contributions in promoting environmental cleanliness and sustainability have a real and significant impact. In addition to positively affecting environmental conditions around the campus, this activity also plays a role in shaping students’ character and fostering a sense of environmental responsibility.

Abstract

The problem of waste in the student environment is still a major issue due to low awareness and inconsistent waste management behavior. Students have a strategic role in building a clean campus environment through active and collaborative participation. This Community Service (PkM) activity aims to increase student awareness and participation in environmental management with an Asset Based Community Development (ABCD) approach. The activity was held on Friday, October 3, 2025 at the East Java Provincial Environment Agency (DLH) and the area around the Afvoer Kemamang waterway, Surabaya. The stages of activities include discovery, dream, design, define, and delivery to design and implement structured and sustainable environmental programs. The results of the activities show an increase in student awareness and involvement in environmental cleanup actions, social media-based waste management education, and the formation of environmental care groups at the faculty level. Students began to implement environmentally friendly behavior consistently. These findings confirm that strengthening asset-based social participation is effective in forming a culture of environmental care in the campus environment.

Abstract

Environmental cleanliness is a crucial factor in creating a healthy and sustainable quality of life. However, low public awareness of maintaining cleanliness requires an empowerment approach based on local potential. This community service activity involved 82 students who actively participated in raising public awareness through the application of the Asset-Based Community Development (ABCD) method. This method emphasizes mapping and utilizing local potential as a basis for developing sustainable environmental behavior. Through the process of identifying assets, developing community skills, and collaborating with local institutions and associations, students were able to create educational and participatory interactions in efforts to maintain cleanliness. The results of the activity showed an increase in environmental cleanliness and a strengthening of community social capital, marked by increased collaboration between residents, students, and educational institutions. It was concluded that student empowerment through the ABCD approach was effective in raising public awareness of environmental cleanliness and has the potential to be developed sustainably with the support of educational institutions and local governments.

Abstract

The issue of environmental cleanliness is still a serious concern, especially considering the fact that the culture of environmental care among students and globally is still relatively low. It is unfortunate, even though students actually have knowledge about the importance of preserving nature, but in their daily practice it still seems less than optimal. To overcome this problem, this article aims to analyze the implementation of the environmental cleanup program as an effort to build an eco-care culture, especially among students through the Asset Based Community Development (ABCD) approach. This method was chosen because it is participatory by emphasizing the mapping of internal campus assets, such as optimizing existing student potential and then developing it through field observation, documentation, and participatory reflection. The program implemented includes environmental cleaning activities and greening the campus area as well as collaboration with all elements of society as a form of service to the surrounding community. The results of this program show an increase in student participation in environmental cleanup actions, marked by more consistent involvement in routine activities and increased student initiatives in maintaining the cleanliness of the campus area. Observations and reflections indicate a shift in student attitudes, from simply understanding the concept of environmental awareness to more responsible, pro-environmental behavior. This program also strengthens collective awareness that environmental cleanliness is a shared responsibility. These findings emphasize that fostering ecological practices, collaboration among students, and institutional support play a crucial role in fostering a sustainable culture of environmental awareness. This article also recommends developing similar, more participatory, long-term programs that strengthen students' role as agents of change on environmental issues.

Abstract

Waste accumulation in urban areas, such as Rewwin village Waru District, Sidoarjo Regency, poses a significant environmental challenge, posing a risk of flooding, water pollution, and the spread of disease. This situation demands collective action and effective waste management. This collaboration focused on identifying students' concrete contributions to the effort to create clean rivers and streets in Rewwin Village. The goal was to foster shared awareness, instill clean living habits, and support the creation of a healthy and sustainable environment. The method used was Participatory Action Research (PAR), which involved the active participation of students and residents through observation and collaborative implementation of field actions. During the implementation phase, the collaborative river and street cleaning action demonstrated high community enthusiasm. The students' physical contributions, from cleaning up small plastic waste on the streets to extensively cleaning water hyacinths on the riverbanks, served as a concrete example and a driving force for cultural change. The result of this collaborative activity was clean streets and rivers, which went from dirty to clean. The conclusion of this activity was that the main objective of the physical street and river cleaning was successfully achieved, as evidenced by the successful collaboration and high level of community participation. This activity also succeeded in strengthening solidarity and fostering a sense of collective responsibility. It is recommended that similar activities be carried out regularly and periodically to maintain the sustainability of the program and further strengthen social bonds among residents.

Abstract

This literature study examines the effectiveness of Legal Aid Institutions (LBH) in providing legal assistance from the investigation phase to trial in Indonesia's criminal justice process. Employing a normative-analytical method, the research analyzes primary legal frameworks, including the Criminal Procedure Code (KUHAP) and the Legal Aid Law. The findings indicate that LBH possess a strong legal mandate to act as guardians of suspect/defendant procedural rights and as overseers of due process. Their effectiveness is evident in preventing procedural violations, filing pre-trial motions, and ensuring a balanced defense in court. However, this operational effectiveness is significantly constrained by profound structural and financial challenges. Chronic underfunding, disproportionate caseloads, reliance on unstable external grants, and a shortage of qualified legal personnel severely limit LBH capacity. These constraints lead to fragmented assistance, high staff turnover, and an inability to engage in strategic litigation. Furthermore, institutional resistance from law enforcement agencies, despite clear legal provisions, creates an adversarial environment that drains LBH resources. The study concludes that while the normative foundation for effective legal aid is robust, its realization is fundamentally hampered by systemic resource deficiencies and operational hurdles. The gap between law and practice underscores the need for sustainable funding models, enhanced institutional capacity, and improved synergy between LBH and state apparatus to truly actualize the right to legal counsel as a pillar of a fair trial.

Abstract

The management of domestic wastewater in densely populated areas is a critical issue situated at the intersection of public health policy and environmental law in Indonesia. This normative juridical research aims to analyze the legal construction of obligations for domestic wastewater management and the effectiveness of the environmental sanction system in fostering compliance within densely populated zones. The findings indicate that a comprehensive legal framework has been established through a regulatory hierarchy, beginning with the 1945 Constitution, Law No. 32 of 2009 concerning Environmental Protection and Management, Law No. 36 of 2009 concerning Health, and extending to various technical regulations such as Minister of Environment and Forestry Regulation No. P.68/2016 on Domestic Wastewater Quality Standards. Legal obligations are imposed reciprocally upon the state to provide systems and upon the community to comply. Regarding enforcement, a sanction system encompassing administrative, civil, and criminal penalties has been established under the Environmental Protection and Management Law. However, the effectiveness of this sanction system within the context of densely populated areas remains limited. This limitation is attributed to factors such as limited monitoring and evidentiary capacity, the absence of adequate alternative infrastructure, and prevailing socio-economic constraints within the community. This study concludes that successful sanitation law enforcement requires an integrative approach, combining sanction instruments with infrastructure provision, institutional strengthening of oversight, and sustained public education.

Abstract

This literature study aims to analyze the construction of the burden of proof and the evidentiary function of psychiatric/psychological reports (visum et repertum) in proving the psychological elements of noodweer (self-defense) and overmacht (force majeure) in Indonesian criminal law. Employing a normative juridical method with a qualitative literature review approach, this research examines primary and secondary legal sources. The findings indicate that the allocation of the burden of proof is not absolute. A layered model is identified: the defendant bears an initial burden to raise a credible allegation supported by prima facie evidence indicating a reasonable possibility of the justifying or excusing circumstance. Once this low threshold is met, the burden shifts to the public prosecutor to disprove the defendant's claim beyond a reasonable doubt. The study further reveals that the visum et repertum, while formally a valid piece of documentary evidence under the Criminal Procedure Code, possesses limited substantive validity in retrospectively determining a defendant's precise mental state at the time of the offense. Its determinative power is persuasive rather than conclusive, heavily dependent on the methodological quality of the examination and the judge's critical ability to assess expert testimony. The study concludes that a balanced and nuanced understanding of this proof mechanism is essential to uphold the presumption of innocence while ensuring a fair trial when psychological defenses are invoked.
