Abstract

Money laundering is a growing global problem that has a significant negative impact on the economy and financial system of a country, including Indonesia. Despite the existence of regulations that provide clear guidelines, the implementation and application of the elements of the crime of money laundering in the Indonesian legal system still faces various challenges. This study aims to analyze the application of the elements of money laundering in Indonesian jurisprudence, as well as identify the main challenges in the evidentiary process, especially in terms of demonstrating the link between the laundered funds and the original criminal act. The research also aims to evaluate the role of relevant agencies, such as PPATK, in supporting the legal process of money laundering cases and how they collaborate with other law enforcement agencies to strengthen law enforcement. With the increasing complexity of techniques used by money launderers, as well as technological limitations and inter-agency coordination, efforts to tackle money laundering require more effective strategies and better systems. This research is expected to contribute to the understanding of the application of the law in money laundering cases, as well as identify the obstacles faced in the Indonesian justice system. The results of this study are expected to provide useful recommendations for strengthening law enforcement and prevention of money laundering in Indonesia, as well as increasing the effectiveness of collaboration between relevant agencies in handling these cases.

Abstract

The implementation of the Job Creation Law in Indonesia has changed the regulatory landscape regarding layoffs. This regulation brings flexibility in the labor market, but is often perceived as reducing worker protection. Using a normative juridical approach, this research explores the impact of regulatory changes on workers' rights and the challenges of implementation. Constraints such as weak legal supervision, declining role of labor unions, and uncertainty of legal procedures are highlighted. The research also suggests strategies based on “flexicurity” and social dialogue to balance the interests of companies and the rights of workers in order to create a more equitable and sustainable labor market.

Abstract

This research discusses the impact of changes in wage regulations for Fixed-Term Employment Agreement (FTEA) workers in Indonesia following the implementation of the Job Creation Law (Law Number 11 Year 2020). The main objective of the law is to create labor market flexibility and improve economic competitiveness, but the changes have created significant problems for FTEA workers, especially in terms of unfair wages and uncertainty regarding their rights. The removal of several wage provisions that previously provided protection, as well as reduced oversight of fair wage implementation, worsened the bargaining position of FTEA workers. This research also evaluates the legal impact of these new regulations on workers' rights and suggests the need for strengthened oversight and more proactive policies to protect FTEA workers from exploitation and wage injustice.

Abstract

Expired food is a serious problem that threatens public health and violates consumer rights. This research explores the challenges in implementing consumer protection regulations against the circulation of expired food in Indonesia. Using a normative juridical approach, this study analyzes existing regulations, barriers to their implementation, and factors that influence the effectiveness of legal protection. The results show that weak supervision, low consumer literacy, and lack of coordination across sectors are the main obstacles. Strategic recommendations include strengthening regulations, increasing the capacity of supervisory institutions, consumer education, utilizing technology, applying strict sanctions, and cross-sector collaboration. These strategies are expected to improve consumer legal protection in a sustainable manner, creating a safer and fairer market.

Abstract

The principle of good faith is a fundamental principle in treaty law that plays an important role in ensuring fair and ethical implementation of contracts. This research aims to examine the application of the principle of good faith in the implementation of agreements using a legal literature approach. The background of this research is based on the existence of default cases arising from violations of the principle of good faith, thus creating legal uncertainty in the settlement of contract disputes. With a focus on Indonesian civil law regulations and international practices, this research explores the effectiveness of the principle of good faith in overcoming complex legal issues in contract implementation. The results show that the application of the principle of good faith in Indonesia still faces challenges in the form of a lack of clear definitions and operational guidelines. This study highlights the importance of integrating the principle of good faith in the pre-contractual stage up to dispute resolution to create substantive justice in contractual relationships. The study concludes with a recommendation to develop a more structured guideline for the implementation of the principle of good faith to reduce potential disputes and increase the parties' confidence in the execution of contracts.

Abstract

The phenomenon of name lending agreements in banking credit in Indonesia is increasingly common, where an individual uses the name of a third party to obtain a credit facility without the consent of the party whose name is lended. This practice poses significant legal and financial risks, especially for the party whose name is used, who may be trapped in credit repayment obligations they did not make. Statute 1873 of the Civil Code of Indonesia provides that such agreements are deemed null and void in the absence of the consent of the named lender. Nonetheless, the implementation of legal protection for the injured party often faces obstacles, such as the lack of formal evidence and legal awareness of the party whose name is used. This study aims to analyze the application of Statute 1873 of the Civil Code of Indonesia in protecting the rights of the party whose name is used in a name lending agreement as well as explore the role of banks in preventing the practice. The results are expected to contribute to policy development and better legal protection for customers.

Abstract

Business competition in the digital era presents new challenges for startups in Indonesia, such as the dominance of large platforms, algorithmic discrimination, and the lack of digital infrastructure. Law Number 5 of 1999 as the legal basis for business competition has not fully accommodated technological developments such as algorithms, big data, and the digital ecosystem. This research analyzes the application of competition regulations to startups in the digital era, focusing on challenges such as market access inequality and the lack of legal education. Additionally, this research explores opportunities such as the use of disruptive technology and collaboration between startups and regulators. With a normative-empirical approach, this research examines the relevance of current regulations and provides strategic recommendations to create a fair and sustainable digital business ecosystem. The research results indicate that revising regulations to be responsive to the digital era is essential to support healthy competition and innovation in the startup sector.

Abstract

This study examines how digital labor structures and automation technologies are reshaping the conditions for vertical social mobility, particularly among informal workers and young professionals. Through a qualitative literature-based approach, the research explores how gig platforms, algorithmic labor markets, and technological displacement are transforming traditional trajectories of advancement. The findings reveal that the erosion of stable employment, the rise of opaque performance metrics, and the spread of precarious digital work have significantly weakened conventional pathways to economic elevation. Informal workers face structural barriers intensified by algorithmic governance, while young professionals encounter diminishing returns from educational investment. The promise of flexibility and entrepreneurial independence often masks the persistence of inequality and institutional inertia. The study demonstrates that new determinants of social status—digital reputation, access to technology, and platform fluency—have emerged, but remain unevenly distributed. These dynamics call for a reevaluation of how mobility is conceptualized in the context of digitally mediated capitalism. By synthesizing insights from labor sociology, political economy, and technology studies, this research contributes to a more nuanced understanding of social stratification in the twenty-first century.

Abstract

This paper investigates the complex relationship between legal frameworks and the sustainability of digital platform business models, with a focus on application-driven start-ups in emerging digital economies. By employing a qualitative literature study and thematic synthesis, the research dissects how statutes addressing consumer protection, personal data management, and competition law affect the operational certainty and continuity of digital enterprises. Findings reveal that most legal systems are still evolving, struggling to reconcile the unique characteristics of digital commerce with outmoded legal paradigms and fragmented regulatory oversight. Inadequate harmonization, resource scarcity, and gaps in institutional capacity further exacerbate these issues, imposing substantial burdens on start-up compliance and inhibiting technological innovation. The research demonstrates that sustainable solutions require not only legislative renewal and harmonization but also active collaboration between stakeholders, ongoing capacity building, and adaptive regulatory innovation. Recommendations include modular reforms, increased emphasis on technology-driven oversight, stakeholder-inclusive policy processes, and development of regulatory sandboxes to bridge the gap between innovation and public interest. The outcomes highlight the necessity for flexible, knowledge-based, and principle-driven governance structures that support both entrepreneurial dynamism and societal protection in the rapidly shifting digital economy

Abstract

ebersihan lingkungan merupakan kebutuhan mendasar bagi masyarakat dalam menciptakan kehidupan yang sehat, nyaman, dan terbebas dari risiko penyakit maupun bencana alam seperti banjir. Salah satu masalah yang kerap muncul di wilayah pedesaan maupun perkotaan adalah tersumbatnya saluran air atau gorong-gorong akibat penumpukan sampah rumah tangga, dedaunan, dan sedimen lumpur. Kondisi ini menyebabkan aliran air menjadi terhambat dan menimbulkan genangan yang berpotensi menurunkan kualitas kesehatan lingkungan. Kegiatan pengabdian masyarakat ini bertujuan untuk mendeskripsikan peran individu dalam menjaga kebersihan lingkungan melalui kegiatan pembersihan gorong-gorong di Desa Ngingas, Kecamatan Waru, Kabupaten Sidoarjo.Metode yang digunakan adalah pendekatan partisipatif mandiri, di mana kegiatan dilakukan oleh dua individu yang berinisiatif membersihkan gorong-gorong tersumbat dengan menggunakan alat sederhana. Hasil kegiatan menunjukkan adanya peningkatan kualitas lingkungan berupa kelancaran aliran air, berkurangnya genangan saat hujan, serta tumbuhnya kesadaran sebagian warga sekitar untuk menjaga kebersihan. Kesimpulannya, meskipun dilakukan dalam skala kecil, peran individu mampu memberikan kontribusi positif dalam menjaga lingkungan dan dapat menjadi inspirasi bagi masyarakat lain untuk berpartisipasi.
