Criminal act often occur in Indonesia but not all criminal act can be subject to criminal law. Nooweer is one of the reason of criminal obliteration in criminal code section 49. The problem is how is the forced defence or forced plea creteria to be the cause for criminal obliteration? What is judge’s fundamental consideration in the judgement number 201/Pid.b/2013/PN-JTH and 57 PK/PID/2013?. The research is normative type, in which the assesment is based on law materials from literature and is a process to find the rule of law, legal principles, also legal doctrines. Law material source used in this undergraduate thesis is secondary law material which is the law materials that are obtained throught library research. The conclusions in this research are noodweer has specially arranged in criminal code section 49. In deciding, a judge must consider person worthiness or appropriateness based on evidences and strong judgement.

In everyday life humans are never free from the threat of disaster. This is where the importance of an insurance service as an investment. From the description of the background of the problem, the formulation of the problem in this study is How is the implementation of unit-linked life insurance at PT FWD Life Indonesia Denpasar Branch? What is the legal protection given to unit-link life insurance policy holders at PT FWD Life Indonesia Denpasar Branch? This type of research is a type of normative legal research. The source of legal material consists of primary legal material and secondary legal material. Methods of collecting legal materials using documentation and recording methods. Data analysis techniques use analytical techniques in a legal and descriptive interpretation. Conclusions from this study are unit-link life insurance implementation at PT FWD Life Indonesia Denpasar Branch conducted by fulfilling the requirements of Sales illustration and eSPAJ, Photo of identity card holder or main insured or insured, Complete account auto debit, Credit card auto debit, Signature confirmation form electronics and FNA (Financial Need Analysis) and RPO (Risk Profile Questionnaire) specifically for links in electronic form along with eSPAJ. Legal protection given to unit-link life insurance policy holders at PT FWD Life Indonesia Denpasar Branch is to fulfill the rights and obligations that should be owned by policy holders of PT FWD Life Indonesia Denpasar Branch and business people of PT FWD Life Indonesia Denpasar Branch. Legal protection can also be emphasized by providing compensation, resolving disputes and sanctions against companies that violate giving compensation to policy holders of PT FWD Life Indonesia Denpasar Branch

PKL problems are indeed difficult to solve, this is evidenced by the fact that there are still many street vendors who roam the roadside, say in Badung Regency precisely stricken by Jalan Raya Mengwitani, Mengwi District, Badung, almost along the road there are street vendors selling, even more in the afternoon the number of street vendors increased. The ability of street vendors to organize themselves is what makes researchers interested in conducting research into organizing by street vendors, so that they are able to organize themselves to deal with the pressures experienced. The formulation of the problem in this study are: 1) what is the arrangement of street vendors (PKL) who sell on the edge of the road that has a Circular Mengwitani Badung Regency? 2) What is the action of the Badung District Government in dealing with street vendors (PKL) who sell on the edge of the road that has Circular Mengwitani Badung Regency? The technique of collecting data is done by interviews and documentation. Data were then analyzed using qualitative descriptive analysis. The conclusions of this study are: 1) Arrangement of Street Vendors selling on the edge of the Circular Circular Highway in Badung Regency is regulated in Badung District Regulation Number 7 of 2016 concerning Public Order and Public Peace listed in Article 25 and Article 27. Under the control authority the street vendors are in the Regional Government. But in its implementation the Regent gave a mandate to other agencies namely the Order of Peace and the Badung District Civil Service Police Unit. In this case the Civil Service Police Unit was formed to enforce the Perda, 2) the action of the Badung Regency government in dealing with street vendors in Badung Regency who sell on the roadside by providing sanctions for administrative sanctions and criminal sanctions to violating street vendors. Administrative sanctions can be in the form of reprimand, written warning, revocation of permit, termination and / or demolition. While criminal sanctions in the form of imprisonment for a maximum of 3 (three) months or a maximum fine of Rp. 25,000,000 (twenty five million rupiah).

The Enactment of Law (No.) 30 of 2014 on Government Administration raises a new paradigm related to silence or neglect of agencies or officials of State administration where if within the specified time limit does make decisions or actions, then the application is deemed granted law and to obtain an acceptance decision the applicant must submit an application to the Administrative Court. As for the formulation of the problem in this case 1) What is the mechanism of a positive fictitious application in the event that a state administrative body or official does not issue a decision on a request submitted by its citizens? 2) What is the Judge's Consideration in completing the application at the Denpasar State Administrative Court? The method in this study is a type of normative juridical research that is by conducting a legal approach and case approach. The sources of legal material that will be used are sourced from research, the literature in the form of primary and secondary legal materials. The technique of collecting legal materials by means of inventory is then carried out identification and classification of legal materials. Legal materials are analyzed with systematic interpretations by applying inductive logic, which is trying to find legal rules, then do discussions to get answers to the problems under study. Regarding the mechanism for resolving positive fictitious applications set out in Supreme Court Regulation (No.) 8 of 2017. A positive fictitious application is an application for the issuance of a decision and or a new official governmental action, not a cancellation of existing decisions, because the formality of the application is not fulfilled as a fictitious positive application, then at such discretion the Assembly of Judges is of the opinion that the petition of the Petitioner is unacceptable.

The level of discipline and understanding of the rules and low courtesy of road users are things that need special attention in their efforts to solve problems in the field of traffic. Various efforts have been carried out by the government to improve traffic conditions in Indonesia but still have not been able to keep up with the rapid development of traffic. Based on the background of the problem above, the problem can be formulated as follows: how are the legal consequences for the perpetrator in a traffic accident whose victims died and how are the legal considerations for the perpetrators in criminal liability for traffic accidents. The type of research used is juridical empirical legal research because in this study, besides based on existing theories, it is also compared with research based on interviews and data in the field. The results of the discussion in this study: The legal consequences for the perpetrators in traffic accidents whose victims died were punished with a minimum prison sentence of 5 years. In accordance with Article 359 of the Criminal Code. Legal considerations for perpetrators in criminal liability against traffic accidents include elements of accident (negligence), never been punished, there is peace between the parties, giving information is not complicated, there are witnesses who lighten, then the threat of punishment can be lighter.

Tujuan nasional Bangsa Indonesia yang tercantum dalam Undang-Undang Dasar Negara Republik Indonesia salah satunya yaitu dapat terwujudnya derajat kesehatan setinggi-tingginya. Pelayanan kesehatan yang optimal membutuhkan tenaga kesehatan yang baik dokter dan perawat sebagai pemberi pelayanan kesehatan memiliki tugas dan wewenang yang berbeda, tidak semua tugas dokter menjadi tugas perawat, sehingga dalam penelitian ini perlu untuk membahas mengenai (1) Bagaimana pengaturan hukum profesi perawat dalam pelaksanaan praktik keperawatan sesuai pelimpahan wewenang oleh dokter? dan (2) Bagaimana bentuk pertanggungjawaban hukum profesi perawat akibat malpraktik atas dasar pelimpahan wewenang oleh dokter? Tipe penelitian yang digunakan dalam penelitian ini adalah penelitiuan hukum normatif dengan pendekatan masalah yang digunakan yaitu pendekatan undang-undang yang berlaku dan pendekatan konseptual, sumber bahan hukum yang digunakan adalah sumber bahan hukum primer dan sekunder dengan teknik pengumpulan bahan hukum kepustakaan. Hasil penelitian menunjukkan bahwa (1) dalam pelaksanaan praktik keperawatan perawat boleh melaksanakan tindakan medis yang menjadi tugas dokter apabila terdapat pelimpahan wewenang secara tertulis oleh dokter baik berupa delegatif ataupun mandat hal tersebut tertuang dalam pasal 29 dan pasal 32 Undang-Undang Nomor 38 Tahun 2014 tentang Keperawatan (2) dalam melaksanakan praktik keperawatan apabila terjadi malpraktik atas dasar pelimpahan wewenang oleh dokter maka perawat dapat dimintai pertanggungjawaban pidana, perdata maupun administratif.

Environmental damage in Indonesia is increasingly worrisome, even endangering every living creature, including future generations of life. In an effort to protect the environment in Indonesia, the government has issued Law No. 32 of 2009 concerning Environmental Protection and Management, which in principle follows the principle of the Strict Liability of the environment and how it is resolved. From the background, the problem can be formulated as follows: 1. what is the responsibility of criminal acts against environmental pollution? 2. How is the law applied to environmental pollution crime? The research method used is to use normative research. Legal materials used are primary legal material and secondary law. After all the materials collected are then processed using deductive logic and analysis of legal interpretation. Environmental pollution is a change in the environment that is not desirable because it can affect the activities, health and safety of living things. And it can be concluded as follows, the responsible parties are not only individuals, but also corporations, for example a business entity. Where the application of the law regarding environmental pollution crimes is is generally contained in laws and regulations relating to protection and management of the environment. It is suggested that the government be more assertive in demanding accountability for environmental pollution.

Apart from depenalization, actually the legal product for drug users in Indonesia has been published since 1971, in the form of a Presidential Instruction that still combines the prevention of narcotics hazards with other matters considered threatening state security. Up to several times the issuance of legal products, in the end Law No. was born. Concerning Narcotics UU no. 35 of 2009 concerning Narcotics is the addition of violence from the two previous Narcotics Laws. The formulation of the problem in this study is as follows: how is the regulation of depenization of narcotics addicts in positive criminal law at this time and how to regulate depenalization in the future for narcotics addicts. The type of research used in this study is normative legal research. The conclusions in this study are as follows: Criminal Code and Law No. 35 of 2009 concerning Narcotics as a positive law in Indonesia has not accommodated the depenalization of narcotics addicts explicitly, because there are several articles which are multi-interpreted. In Law No. 35 of 2009 concerning Narcotics ensnare narcotics addicts with criminal sanctions as determined in Articles 117 and 127 and actions in the form of mandatory rehabilitation specified in Article 54 of Law No. 35 of 2009. Where there will be a need to improve the RKUHP and Law No. 35 of 2009 by emphasizing the existence of provisions regarding depenalization of narcotics addicts. In conclusion, it can be accommodated in BOOK II CHAPTER XVII concerning criminal acts of Narcotics and Psychotropic abuse in the Criminal Procedure Code.

The problem of drug trafficking and abuse in Bangli Regency turned out to have entered at an alarming stage that must be taken seriously, because this could cause damage to the nation's buds found in the area. Therefore the vigilance of drug trafficking should begin to be improved, so in this case the police role is needed especially the Bangli Police Department which is assisted by all levels of society in the area. The government in this case is also very serious about the production, distribution, trafficking of narcotics and psychotropic drugs as well as overcoming them, we can see this in the Narcotics Law Number 35 of 2009. The problem statement is as follows: how is the police effort in dealing with the circulation and abuse of narcotics in the jurisdiction of the Bangli police station and what are the obstacles faced in dealing with the circulation and abuse of narcotics in the jurisdiction of the Bangli police station. The type of research used is empirical legal research. The conclusions in this study are as follows: Police efforts in tackling the circulation and abuse of narcotics in the jurisdiction of the Bangli Regional Police are as follows: Conducting pre-emptive measures, preventive actions, carrying out law enforcement actions (refresif) for people who are proven to circulate use drugs, Cooperate with relevant agencies in the jurisdiction of the Bangli Regional Police such as the District Narcotics Agency (BNK). Constraints faced by Bangli Police in an effort to cope with drug trafficking and abuse include: Internal constraints, namely constraints originating from within the Bangli Regional Police itself, including: Budget Funds, Operational Facilities, office infrastructure and human resources. External constraints are constraints originating from the ranks of the Bangli Police Station.

In realizing the national development mission, one of the efforts made by the Indonesian government is to maximize the source of funding in the form of taxes. The state is not categorized as a power state. One type of tax that has the potential to increase along with technological advances and the standard needs of secondary to primary is the motor vehicle tax. The problems of this research are 1) How is the imposition of administrative sanctions on motor vehicle tax receipts at the SAMSAT Renon Denpasar Office? 2) What are the implications of administrative sanctions on motor vehicle tax at the Renon Denpasar SAMSAT Office? The research method used is an empirical legal research method, with data sources using empirical sociological or juridical problem approaches in other words solving secondary problems first then primary. The results of the study can be concluded that: Imposing sanctions for motorcycle tax administration in the SAMSAT Renon Denpasar office can be said to be good, this is seen from the level of compliance of motor vehicle taxpayers in paying motor vehicle tax taxpayers aware of their obligations to pay Motor Vehicle Tax and timely payment Motor Vehicle Tax. Implications of imposing motor vehicle tax administration sanctions based on the results of a regression analysis that with the motor vehicle tax administration sanctions will increase taxpayer compliance
