Abstract

Abstract

Interfaith marriage in Indonesia persists in inciting legal controversies due to disparate interpretations and implementations of regulations by the court. This article aims to analyze the legal framework regulating interfaith marriage in the Indonesian legal system, emphasizing statutory provisions and judicial decisions, while evaluating how discrepancies in the interpretation and application of these laws affect legal certainty and the protection of citizens' constitutional rights. This study utilizes normative juridical methodologies, incorporating legislative, conceptual, and case approaches, to analyze Law Number 1 of 1974 on Marriage, Law Number 23 of 2006 on Population Administration, Constitutional Court Decisions Number 68/PUU-XII/2014 and Number 24/PUU-XX/2022, as well as various district court rulings regarding the registration of interfaith marriages. The study's results reveal that, under Indonesian law, the validity of marriage is largely regulated by religious law, but the state retains authority over administrative issues to provide legal order and clarity. Prior to the implementation of rigorous judicial standards, the court used diverse interpretations, resulting in discrepancies in decisions and legal uncertainty. This conflict stems not from an absence of standards but from inconsistencies in legal enforcement. The Constitutional Court has affirmed that restrictions on interfaith marriage do not violate constitutional rights when based on religious beliefs and Article 28j of the 1945 Constitution of the Republic of Indonesia. The issuance of Supreme Court Circular Letter Number 2 of 2023 has improved normative legal clarity; nonetheless, the subsequent obstacle lies in the consistency of its application in judicial practice.

Abstract

This study aims to identify the da'wah values embedded within the Marsialapari culture practiced in Gonting Pege Village, Aek Bilah District, Tapanuli Selatan Regency. Marsialapari is a mutual cooperation tradition among the Mandailing community, primarily practiced during rice planting and harvesting activities. This study employs a qualitative method with an ethnographic approach, using observation, in depth interviews, and documentation as data collection techniques. Informants included a traditional leader, a religious leader, a Marsialapari practitioner, a village government official, and a youth participant. The findings reveal that Marsialapari culture embodies five interrelated da'wah values, namely ukhuwah or brotherhood, at ta'awun or mutual assistance, ikhlas or sincerity, amanah or trustworthiness and responsibility, and silaturahmi or the maintenance of social ties, each of which is reinforced through relevant verses of the Quran and hadith of the Prophet. Despite significant social change driven by agricultural technology and wage based labor systems, the Gonting Pege community continues to preserve this tradition, which simultaneously strengthens social relationships and family bonds. These findings indicate that Marsialapari functions as a form of da'wah bil hal, or da'wah through action, integrating Islamic teachings into daily life without displacing the local wisdom passed down across generations. This study contributes to the broader discourse on local culture based da'wah in Indonesia and underscores the importance of preserving such traditions amid ongoing modernization.

Abstract

Global challenges and technological disruption demand a transformation in the educational sector, where school quality heavily relies on the effectiveness of principal leadership. This study aims to fundamentally examine the decision-making mechanism of school principals, focusing on three main aspects: the core concept of the principal as a decision-maker, the spectrum of roles in policy-making, and the systematic stages of the decision-making process along with its influencing factors. The research method employed is a literature review (library research) analyzing 20 reputable scientific references (international and Sinta-indexed national journals) from the past ten years. The results indicate that the principal is no longer merely an administrative officer, but a chief executive executing rational cognitive processes based on managerial authority and administrative functions. The principal's decision-making role is reflected through the EMASLIM dimensions (Educator, Manager, Administrator, Supervisor, Leader, Innovator, and Motivator). Decision effectiveness in schools operates through a structured six-stage cycle that strictly integrates three core pillars: data-driven, ethically grounded, and participatory. The synergy between tactical firmness in emergencies and community collaboration in routine policies is proven to foster a positive school climate and continuously accelerate educational quality.

Abstract

The urgency of this research is based on the importance of optimizing the utilization of Dapodik as an educational information system that supports accurate, integrated, and sustainable academic data management. This study aims to analyze the utilization of the Basic Education Data System (Dapodik) as an educational information system in academic data management at SMA Negeri 12 Gowa. This research employed a descriptive qualitative approach with purposively selected informants consisting of Dapodik operators, teaching staff, and education personnel. Data were collected through semi-structured interviews and direct observation, then analyzed using data reduction, data presentation, and conclusion drawing techniques. The results showed that Dapodik has been utilized as an educational information system for managing academic data at SMA Negeri 12 Gowa. Its utilization improves data validity, administrative efficiency, report preparation, and data-based decision-making. However, several challenges remain, including limited internet connectivity, server maintenance issues, and delays in data updates. Therefore, improving operator competency, strengthening coordination among school members, and providing adequate technological infrastructure are necessary to optimize the use of Dapodik in academic data management. This study implies that effective utilization of Dapodik requires not only a reliable information system but also human resource readiness and institutional support to improve the quality of academic data management.
