Abstract

The research title is about the Implementation of Mudharabah Agreements in Sharia Financial Institutions. This type of descriptive or exploratory research describes and explains the implementation of mudharabah contracts in sharia financial institutions using a qualitative research approach. In this research, the Library Research method (library study) is used, the data sources come from official documents such as books and journals. The results obtained in this research explain that financing or the process of borrowing capital or providing capital is one of the sharia banking facilities that really helps customers. One of the interesting things is financing with the Mudharabah scheme. Mudharabah can be interpreted as a business cooperation agreement between two parties. The two parties are the fund owner as the first party who provides all the funds (100%) and the fund manager as the second party who acts as manager. In Mudharabah, business profits are shared according to the agreement of all parties written in the contract agreement. Then, if you experience a financial loss, the first party will bear it, but if it is due to the manager's negligence, it will be borne by the fund manager. The value of justice in a Mudharabah contract lies in the benefits and risk sharing of each party who is collaborating according to the portion of their involvement. The aim of this research is to determine the application of mudharabah financing, the principles of sharing business results and the application of justice in mudharabah financing in sharia banking.

Abstract

Penelitian ini bertujuan untuk mengetahui inovasi akad salam dan istishna’. Akad salam adalah akad jual beli dimana modal (pembayaran) dilakukan secara tunai (di muka) dan objek pesanan diserahkan kemudian dengan jangka waktu tertentu. Akad Istishna merupakan akad jual beli berjenis pesanan pembuatan barang dengan persyaratan dan kriteria tertentu yang telah disepkati oleh shani’ (penjual) dan mustashni’ (pembeli). Penelitian ini dilakukan dengan menggunakan pendekatan kualitatif dan metode uraian. Jenis riset yang digunakan adalah riset kepustakaan. Berdasarkan fatwa DSN-MUI No. 05/DSn-MUI/IV/2000 tentang jual beli salam, akad salam diaplikasikan pada salam paralel. Untuk pembiayaan pertanian dalam jangka waktu yang relatif pendek, yaitu 2 sampai 6 bulan. Salam paralel berarti melaksanakan dua transaksi salam antara bank dengan nasabah dan antara bank dengan supplier (pemasok) atau pihak ketiga secara simultan. Berdasarkan fatwa DSN-MUI No. 06/DSn-MUI/IV/2000 tentang jual beli Istishna’, akad Istishna’ di perbankan syariah diterapkan pada pembiayaan Istishna’ paralel. Dalam kontrak Istishna’, pembeli bisa saja mengizinkan pembuat menggunakan subkontraktor untuk melaksanakan kontrak tersebut.

Abstract

This study aims to critically examine the Sharia compliance challenges in the Islamic pawnshop industry in Indonesia, particularly within Rahn-based financial services. It focuses on key issues such as contract structuring, fee (ujrah) determination, collateral management, governance effectiveness, regulatory implementation, and customer-related factors influencing compliance. The research employs a qualitative descriptive approach combined with normative legal analysis and supported by limited quantitative surveys. Data were collected through in-depth interviews, direct observations, and document analysis of DSN-MUI fatwas, regulatory frameworks, standard operating procedures, contracts, and financial reports. Additionally, stakeholder perspectives were gathered through questionnaires involving management, operational staff, Sharia Supervisory Board members, regulators, and customers. A case study was also conducted at an Islamic pawnshop institution in Makassar to provide contextual insights. The findings reveal that the implementation of Rahn and Ijarah contracts in Islamic pawnshops generally complies with DSN-MUI Fatwas, particularly No. 25/2002, No. 26/2002, and No. 92/2014, and successfully avoids explicit elements of riba. However, several critical challenges persist. These include the improper calculation of administrative and storage fees based on loan value rather than actual costs, which potentially introduces elements of riba. Furthermore, the use of multi-contract schemes (e.g., Qardh–Ijarah combinations) creates ambiguity and raises concerns regarding prohibited hybrid contracts. Issues of gharar are also identified in certain pricing and discounting practices. Additional challenges include inconsistencies in collateral management, uneven effectiveness of Sharia governance, and limited staff competency. From the demand side, while customer religiosity supports the adoption of Islamic pawnshop services, low levels of Sharia financial literacy contribute to information asymmetry, potentially masking non-compliance and affecting trust and satisfaction. This study highlights the need for strengthening Sharia governance frameworks, including more rigorous auditing and monitoring mechanisms. It underscores the importance of implementing cost-based ujrah calculations, enhancing regulatory clarity on multi-contract structures, and improving transparency in pricing and disclosure practices. Furthermore, capacity-building programs for staff and systematic efforts to improve public literacy in Islamic finance are essential to ensure sustainable compliance. Policymakers and regulators are also encouraged to develop standardized compliance metrics and enforce more consistent supervision across the industry. This research offers a comprehensive and integrative analysis of Sharia compliance challenges in the Islamic pawnshop sector by combining legal, operational, and behavioral perspectives. It contributes to the literature by bridging the gap between normative Sharia principles and practical implementation, particularly in the context of Rahn-based financial services in Indonesia, and provides actionable insights for enhancing both compliance and institutional credibility.

Abstract

This study aims to examine the implementation of sharia marketing strategies at PT. Yotta Berkah Mulia by utilizing SWOT analysis as a strategic evaluation tool. The research adopted a descriptive qualitative approach, with data collected through observation, interviews, questionnaires, and documentation. The findings show that PT. Yotta Berkah Mulia has successfully applied the four fundamental characteristics of sharia marketing, namely Theistic (Rabbaniyyah), Ethical (Akhlaqiyyah), Realistic (Al-Waqi’iyyah), and Humanistic (Al-Insaniyyah), in its marketing activities. The SWOT analysis was conducted to identify the company’s strengths, weaknesses, opportunities, and threats. Based on the results of the IFAS and EFAS matrices, the company is positioned in Quadrant II, indicating that it possesses strong internal capabilities despite facing several external challenges and threats. This position suggests that a diversification strategy is the most appropriate approach to maintain competitiveness and support future business growth. Furthermore, the results of this study are expected to contribute to the development of sharia-based marketing practices and serve as a reference for MSMEs in formulating more effective, adaptive, and sustainable marketing strategies.

Abstract

This study aims to analyze the compliance of culinary business operators with halal certification regulations among street food vendors in Somba Opu District, Gowa Regency. The research focuses on the effectiveness of government literacy and educational inclusion programs, the level of vendors’ understanding and access to certification obligations, the implementation of compliance throughout the production–distribution–sales chain, and the supporting and inhibiting factors affecting compliance. This study employs a qualitative approach using a phenomenological method. Data were collected through in-depth interviews, non-participant observations, and documentation involving ten street food vendors and three key informants from the Halal Product Assurance Organizing Agency (BPJPH). Data analysis was conducted using the interactive model developed by Miles and Huberman. The findings indicate that the level of compliance remains low, both administratively and substantively. Literacy and inclusion programs, such as the Free Halal Certification Program (SEHATI) and the SIHALAL digital system, have not yet optimally reached their target groups due to digital literacy gaps, limited direct technical assistance, and perceptions of procedural complexity. Vendors’ understanding of halal certification remains normative and intuitive and has not yet met the procedural accountability standards required by the Halal Product Assurance System (SJPH). The main supporting factors include religious awareness, market pressure, and affirmative government programs, while the inhibiting factors consist of limited digital infrastructure, bureaucratic complexity, and regulatory uncertainty. This study concludes that improving compliance requires a shift from a compliance-driven approach toward an enablement-driven approach through procedural simplification, strengthened field assistance, and the development of inclusive service designs. Such an approach is consistent with the Islamic principles of taysir (facilitation) and maqashid al-shariah (the objectives of Islamic law).

Abstract

Islamic microfinance is an important instrument in supporting the development of Micro, Small, and Medium Enterprises (MSMEs) by providing access to capital in accordance with Islamic principles. This paper aims to explain the concept of Islamic microfinance, the definition and functions of Baitul Maal wat Tamwil (BMT), the financing products offered, and the socio-economic role of BMT in society. The study employs a literature review method by examining various relevant references related to Islamic microfinance and BMT. The findings indicate that Islamic microfinance operates based on the principles of justice, partnership, and the prohibition of usury (riba) through contracts such as mudharabah, musyarakah, murabahah, ijarah, and qardhul hasan. As an Islamic microfinance institution, BMT performs two primary functions: a social function (baitul maal) through the management of zakat, infaq, sadaqah, and waqf funds, and a business function (baitut tamwil) through the collection and distribution of funds to the community. The presence of BMT plays a significant role in improving access to financing for MSMEs, reducing dependence on moneylenders, promoting economic equity, and enhancing community welfare through Sharia-based economic empowerment programs. Therefore, BMT serves as a strategic instrument in strengthening the Muslim community’s economy and fostering equitable economic development.

Abstract

Waste management in Makassar City is an increasingly pressing issue along with rapid population growth and urbanization. In this context, the main challenges faced are low public awareness, limited waste management infrastructure, and weak enforcement of regulations related to waste processing. This study aims to provide a better understanding to the public about the importance of sustainable waste management and to study waste management policies and practices in Indonesia and Malaysia. Through community service activities including field observations, interviews with stakeholders, counseling, and preparation of recommendations, it is hoped that applicable solutions can be found to overcome waste management problems. One of the proposed solutions is the development of a Waste Bank which functions as a means to manage and recycle waste more effectively. The results of the study indicate that active community participation, government support, and collaboration between various parties are essential to create a sustainable waste management system. The recommendations produced include increasing public awareness, utilizing technology in waste management, and strengthening policies that support community initiatives.

Abstract

The purpose of this study is to find out how the concept of a decent/prosperous life is in Islamic economics. The research method used is literature research. Data collection techniques come from different literature, then use a normative descriptive approach and are analyzed according to problems related to the topic and title of the research paper. The results of his research are the concept of Islamic economics, as well as the principles of Islamic economics and the concept of a decent life in Islam.

Abstract

This study focuses on the implementation of the Annesang (Muzara'ah) system based on the Maslahah concept to improve the welfare of farmers in Batulohe Village, Bulukumpa District, Bulukumba Regency. The phenomenon of profit-sharing cooperation between landowners and rice farmers is important because of income inequality and the risk of injustice in the distribution of harvests, and highlights the spiritual aspect that has so far received little attention. This study uses a qualitative phenomenological approach with observation methods, in-depth interviews, questionnaires, and documentation of 30 farmers. The CIBEST (Center of Islamic Business and Economic Studies) model is used as a multidimensional measuring tool that assesses welfare and poverty from a comprehensive material and spiritual aspect. The results of the study indicate that the implementation of the Maslahah-based Annesang (Muzara'ah) system and the CIBEST model significantly improved the welfare index of farmers in Batulohe Village, particularly in terms of higher income, economic resilience, spiritual satisfaction, and a more balanced quality of life. Challenges encountered included the implementation of oral contracts, unclear capital participation, and risk management that requires a more professional and legal approach. The implications of the study emphasize the importance of strengthening the Maslahah-based Annesang system as a model for fair, sustainable agricultural cooperation, and integrating the spiritual values ​​of agrarian communities. The CIBEST model is recommended as a holistic welfare evaluation instrument that facilitates the formulation of integrated economic and socio-spiritual intervention policies and programs. Regulatory support, facilitation of contract legalization, farmer capacity building, and legal protection by the government and related institutions are expected to ensure that this profit-sharing practice runs effectively, transparently, and is able to improve the welfare of the community as a whole

Abstract

This study aims to describe and analyze housing financing transactions based on sharia contracts, the form of legal protection provided to consumers by the developer in the Graha Tata Persada Gowa housing complex, and the factors influencing the implementation of housing financing transactions from the perspective of Islamic law. The study employs a qualitative method with a sharia-based approach and a phenomenological approach. Data were collected through observation, interviews, and documentation, using both primary and secondary data sources. The findings show that, based on the transaction mechanism and the financing process applied, housing transactions at Graha Tata Persada Gowa have been carried out in accordance with sharia principles, reflecting the application of the istisna’ contract in the procurement and construction of housing. Furthermore, in terms of home ownership financing, the mechanism used indicates a clear sale-and-purchase transaction between the bank, the developer, and the consumer, with the price and payment obligations agreed upon in advance. This is consistent with the principles of the murabahah contract. However, the implementation of consumer protection in housing financing transactions has not fully met the principles of justice and the fulfillment of consumer rights under Islamic law. The researcher proposes four stages of a mechanism that is in line with Islamic law, namely: identification and determination of defects (‘aib), affirmation of the developer’s responsibility (mas’uliyyah), granting the consumer the right of choice, and resolution through deliberation (musyawarah).
