Abstract

Percepatan konversi sertifikat fisik ke kode respons cepat (QR code) oleh ATR/BPN sejak 2022 bertujuan menekan biaya, mempersingkat waktu, dan menurunkan pemalsuan. Sistem validasi elektronik yang menjadi penentu sahnya pencatatan nyatanya tidak mendeteksi sertifikat ganda, inkonsistensi data spasial, maupun perubahan status hukum lahan. Kelemahan ini memicu sengketa kepemilikan. Penelitian bertujuan mengidentifikasi kelemahan prosedur validasi elektronik dan merumuskan model penyempurnaan berbasis kepastian hukum. Ruang lingkupnya meliputi prosedur konversi di Kantor Pertanahan Kabupaten Bogor, Kota Depok, dan Kota Bekasi periode 2022–2024. Metode yuridis normatif digunakan melalui analisis peraturan, tiga putusan pengadilan terkait, wawancara dengan 12 pejabat ATR/BPN, 6 notaris, 8 pengguna layanan, serta 215 dokumen konversi. Sistem validasi hanya mencocokkan teks tanpa verifikasi ulang spasial. Integrasi real-time antara Basis Data Pertanahan Nasional, Sistem Informasi Administrasi Kependudukan, dan Sistem Informasi Pajak Bumi dan Bangunan belum terbangun, sehingga status tanah tertinggal. Konversi tanpa pemeriksaan fisik menyebabkan sertifikat atas lahan yang telah dialihfungsikan tetap aktif. Setidaknya 34 sengketa tercatat karena ketidaksesuaian QR code dengan kondisi lapangan. Operator tidak berwenang membatalkan konversi ketika ditemukan kejanggalan. Kelemahan mendasar terletak pada ketiadaan standar integrasi lintas sektoral dan absennya validasi lapangan. Model penyempurnaan mencakup validasi spasial otomatis berbasis citra satelit, kewajiban pemutakhiran berkala oleh pemda, dan pembentukan tim khusus pengecekan lapangan sebelum pencetakan QR code.

Abstract

Inheritance disputes in Indonesia are often prolonged due to legal pluralism involving Islamic law, customary law, and the Civil Code. In response, the Supreme Court mandates mediation in all civil cases, including inheritance disputes, under PERMA No. 1 of 2016. This study examines mediation practices in inheritance cases at Religious Courts and District Courts, and identifies factors influencing their effectiveness. Using a qualitative comparative case study approach, data were collected through in-depth interviews with judges, mediators, court clerks, and disputing parties, supplemented by case document analysis. Findings reveal that mediation at Religious Courts is normative and educative, constrained by the rigid principles of Islamic inheritance law (faraid), limiting negotiation space. In contrast, District Courts allow more flexible, problem-solving approaches under civil law. Despite differences, both courts emphasize empathy, family reconciliation, and cultural sensitivity. Success depends on mediator competence, parties’ psychological readiness, and socio-cultural context. The study concludes that differentiated mediation guidelines—tailored to the substantive legal basis of each case—are essential to transform mediation from procedural formality into a meaningful, just, and humane dispute resolution mechanism.

Abstract

The increasing rate of divorce in Indonesia directly impacts the protection of children's rights, particularly in the determination of custody. This study aims to analyze the application of the best interest of the child principle as well as the effectiveness of children's participation and supervision of custody decisions. Using a juridical-empirical approach with a qualitative method, this study examines religious court decisions and conducts interviews with judges and related parties. The results show that custody determinations are still formalistic, dominated by the rigid application of Article 105 of Law No. 1 of 1974, which automatically grants custody to the mother without a holistic consideration. Children's participation in the court process is almost non-existent, and there is no post-decision supervision mechanism. As a result, many decisions do not substantively reflect the best interests of the child. This study concludes that the family justice system in Indonesia has not fully prioritized children Reforms are needed through technical guidelines, judge training, and an integrated supervision system to ensure the real protection of children's rights after divorce.

Abstract

This study examines the legal consequences of informal polygamy particularly unregistered or siri marriages on children’s civil status and inheritance rights under Indonesian law. Triggered by recurring cases in areas such as Kedung Banteng Village, Sidoarjo popularly dubbed the “polygamy village” this research addresses how children born from non-formal polygamous unions face systemic legal uncertainty regarding civil recognition, birth registration, and inheritance. Using a normative juridical approach with qualitative document analysis, the study reviews relevant legislation, court decisions (including Constitutional Court Decision No. 46/PUU-VIII/2010), scholarly literature, and factual cases reported by the Indonesian Association of Sharia Lawyers (APSI) and media sources. Findings reveal that children from informal polygamous marriages are often denied “legitimate child” status under Article 42 of Law No. 1/1974 on Marriage, hindering their access to birth certificates that include the father’s name and limiting their legal standing as heirs. Although the Constitutional Court affirms biological fathers’ civil responsibility toward children born out of wedlock, practical enforcement remains constrained by costly DNA testing, bureaucratic barriers, and lack of legal documentation. In Islamic inheritance law, recognition depends on whether the siri marriage fulfills religious requirements, yet this is insufficient without state validation. The study concludes that informal polygamy undermines the principle of the best interests of the child and violates Indonesia’s commitments under the Convention on the Rights of the Child. Legal harmonization, simplified recognition procedures for non-marital children, and public legal education are urgently needed to protect vulnerable children from long-term socio-legal marginalization.

Abstract

This study examines divorce on the grounds of moral misconduct specifically habitual drunkenness, gambling, and adultery based on Article 39(2) of Law No. 1 of 1974 on Marriage and Article 116(f) of the Compilation of Islamic Law. Using a normative juridical approach and qualitative analysis, the research explores statutory provisions, court decisions, and factual cases. The findings reveal that such behaviors significantly disrupt marital harmony and are legally recognized as valid grounds for divorce. However, victims often face procedural and evidentiary challenges in court, particularly in presenting direct proof of misconduct. The study concludes that divorce due to moral deviation serves as a form of legal protection for victims in unhealthy marriages. Strengthening access to justice, improving legal literacy, and aligning legal norms with social realities are essential to ensure fair and effective protection.

Abstract

In an era of climate change and demands for environmental sustainability, office building facades face the challenge of responding efficiently to changing weather conditions. This research aims to integrate digital and mechanical sensor technologies in facades to create responsive systems, increase energy efficiency, and improve occupant comfort. Using a mixed methodology involving literature analysis, case studies, and computational simulations, this research explores the potential of dynamic facades in responding to environmental variables such as temperature, lighting, humidity, and noise. The results show that the integration of sensor and mechanical technologies enables the facade to dynamically adjust to external conditions, reduce the energy load on the building, and improve thermal and visual comfort for occupants. Furthermore, this research identifies design strategies that can be applied in the development of responsive office building facades, focusing not only on aesthetic aspects, but also on the function of adaptation and interaction with the environment. The conclusion of this research shows that the use of sensor and mechanical technologies in building facades is a significant step forward in digital architecture, with great potential to increase energy efficiency and improve the quality of life in office environments. This research makes an important contribution to the literature in the fields of digital architecture and sustainable development, offering new insights into responsive and adaptive building façade design. The implications of the findings point to new directions for the development of building facades that are more interactive and responsive to their surroundings.

Abstract

The development of digital technology accelerates the transformation of public services through population identity applications, but increases the risk of personal data vulnerability. This research analyzes the legal protection of population identity data in digital applications with a normative juridical approach, referring to Law No. 27 of 2022 on Personal Data Protection (PDP Law) and its relevance to Article 28G paragraph (1) of the 1945 Constitution which guarantees the right to privacy. The research aims to examine the effectiveness of the regulation in protecting user data and identify legal loopholes that could potentially be exploited by irresponsible parties. The scope of the research focuses on the implementation of the PDP Law in the context of digital population applications in Indonesia. The results show that although the PDP Law has provided a strong legal basis, three main challenges still hinder optimal protection, namely: (1) weak supervisory mechanisms, (2) low user awareness, and (3) unclear sanctions for violators. Research implications lead to policy recommendations in the form of strengthening supervisory institutions, socializing citizens' digital rights, and improving sanction provisions. The research conclusion emphasizes that the protection of population identity data requires a synergy between regulation, technology, and community participation.

Abstract

This research aims to analyze the comparison of the use of Drywall partition with conventional brick wall as room divider in apartment, focusing on efficiency, acoustic effectiveness, and structural load. The research method used is comparative with a quantitative approach, collecting data through surveys on apartment buildings that use both types of walls. The analysis was carried out through a comparison of costs, processing time, acoustic performance, and influence on structural loads. The results showed that the use of drywall partition provided significant advantages in terms of speed and cost reduction. Drywall partition is proven to be lighter in weight, reduces the structural load of the building, and speeds up the construction process. In terms of acoustics, drywall with proper insulation can match or even surpass the performance of brick walls in terms of soundproofing. The discussion also involves consideration of the sustainability and environmental impact of both materials. The conclusion of this research is that drywall partitions offer an efficient and effective alternative to room dividers in apartments, with the added benefits of easy installation and good acoustic performance. This research provides new insights for developers and architects in selecting optimal construction materials. Recommendations for future research include a deeper analysis of sustainability aspects and the choice of insulation materials to improve the acoustic performance of drywall.

Abstract

The implementation of personal data protection in information systems at financial services companies is an important issue in this digital era. This study aims to analyze the implementation of personal data protection in information systems at financial services companies in Indonesia after the enactment of Law Number 27 of 2022 concerning Personal Data Protection (UU PDP). The main focus of the study is to identify the level of company compliance with the principles of personal data protection, the challenges faced in its implementation, and the legal and business implications that arise. The research method used is normative law with a qualitative approach, supported by literature studies and analysis of related documents. The results of the study show that although the PDP Law has been enacted, the implementation of personal data protection in the information systems of financial services companies still faces various challenges, including system complexity, varying stakeholder awareness, and the need for significant technology investment. This study concludes that more comprehensive efforts are needed from all relevant parties to ensure the effective implementation of the PDP Law and provide concrete suggestions for future improvements.

Abstract

The rapid development of information technology in the digital era has presented new challenges in the protection of personal data. The government as the state administrator has a constitutional obligation to protect the rights of citizens, including the right to privacy. This study aims to analyze the form of government legal accountability in ensuring the protection of people's personal data amidst the increasing threat of information leaks and protection. The research method used is normative juridical with a regulatory-legislative approach as well as case studies and also the opinions of relevant experts. The research findings show that although there are legal instruments such as Law Number 27 of 2022 concerning Personal Data Protection, the effectiveness of its implementation is still limited by a number of factors, including weak supervision. The results of the analysis show that although regulations such as the Personal Data Protection Law have been present, implementation in the field still faces various obstacles, both in terms of law enforcement, public digital literacy, and transparency of permits. The government has a responsibility not only normatively, but also factually to protect personal data through policies that favor the public interest. The government is required not only to form regulations, but also to carry out supervisory and enforcement functions effectively and accountably, and sustainably in order to protect fundamental rights. Therefore, the government's legal responsibility must be realized through consistent real actions in ensuring the security of personal data in the digital era.
