Abstract

In an increasingly connected digital era, personal data has become a strategic asset that is vulnerable to misuse. The mass media, as an important part of the digital ecosystem, plays a dual role as a manager and disseminator of information involving individual data. The enactment of Law No. 27 of 2022 concerning Personal Data Protection (UU PDP) is an important milestone in the Indonesian legal system, but its implementation raises complex problems in mass communication practices. The main legal issue in this article lies in the tension between the media's obligation to protect personal data and press freedom in conveying information to the public. This study aims to examine the legal impact of the PDP Law on the mass media by examining the challenges, implications, and needs for regulatory adjustments. The approach used is the normative legal method, with a qualitative analysis of national laws and regulations (UU PDP, UU ITE, UU Press), GDPR as an international standard, and related legal literature. The results of the study indicate that the PDP Law demands significant reforms in data governance by media institutions, including transparency, security, data subject consent, and protection of sensitive data. On the other hand, the disorder of norms and the absence of an independent supervisory authority create gaps in implementation. This study also offers strategic recommendations for mass media to adjust journalistic practices and digital business with the PDP Law, including harmonization of journalistic codes of ethics and the use of data anonymization technology. In conclusion, the success of the PDP Law in the media sector requires synchronization of regulations, strengthening institutions, and increasing media actors' awareness of the principles of digital privacy rights.

Abstract

This study aims to analyze the form of legal protection of the right to privacy of personal data in the face of hacking crimes according to Law Number 27 of 2022 concerning Personal Data Protection (PDP Law). The research method used is normative juridical with a statutory approach. The results show that the PDP Law provides a strong legal basis for the protection of personal data, including data subject rights mechanisms, data controller obligations, and administrative and criminal sanctions for violations. However, the implementation of this law still faces challenges, such as weak cyber law enforcement infrastructure and limited public digital literacy. Therefore, it is necessary to strengthen the institutionalization of supervisory authorities, increase the capacity of law enforcement officers, and educate the public to support the effectiveness of legal protection of personal data from hacking crimes.

Abstract

The Constitutional Court (Mahkamah Konstitusi/MK), as the guardian of the Constitution, plays a vital role in upholding the rule of law and protecting citizens' constitutional rights. One crucial aspect of judicial proceedings is the evidentiary process through witness testimony. However, the practice of reading out the official investigation report (Berita Acara Pemeriksaan/BAP) by investigators without the physical presence of witnesses in court raises legal issues, particularly regarding the principles of audi et alteram partem and due process of law. This study aims to examine the validity and legal implications of witness statements being read by investigators from a Constitutional Court procedural law perspective. The research adopts a normative and empirical juridical approach, analyzed through descriptive qualitative methods. The findings reveal that reading witness statements without their direct presence in court weakens evidentiary value and generates legal uncertainty. Although the Constitutional Court, through Decision No. 65/PUU-VIII/2010, expanded the definition of a witness, it did not eliminate the importance of direct examination in court. Compared to common law and continental legal systems, Indonesia’s legal system still requires reform to ensure the protection of defendants' rights. Therefore, clear legal standards and technical guidelines are needed to balance effective law enforcement with the protection of human rights.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap data pribadi dalam transaksi elektronik di Indonesia, khususnya setelah diberlakukannya Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP). Metode penelitian yang digunakan adalah studi literatur dengan pendekatan yuridis normatif, berdasarkan analisis terhadap peraturan perundang-undangan, literatur hukum, serta hasil-hasil penelitian sebelumnya. Hasil penelitian menunjukkan bahwa meskipun Indonesia telah memiliki dasar hukum yang kuat, implementasi perlindungan data pribadi masih menghadapi berbagai tantangan, seperti rendahnya kesadaran masyarakat, kurangnya transparansi pengelolaan data oleh pelaku usaha digital, serta lemahnya pengawasan dari otoritas yang berwenang. Oleh karena itu, diperlukan penguatan regulasi turunan, edukasi publik, dan pembentukan lembaga pengawas independen agar hak-hak privasi masyarakat dapat terlindungi secara optimal dalam era digital. Penelitian ini diharapkan dapat memberikan kontribusi akademis dan praktis dalam pengembangan hukum perlindungan data pribadi di Indonesia.

Abstract

This study aims to analyze the impact of personal data protection on consumer satisfaction in online transactions in the marketplace. Along with increasing attention to privacy, consumers are increasingly demanding better data protection policies from marketplaces. This research uses a qualitative approach with in-depth interview techniques and content analysis of the privacy policies of several marketplaces in Indonesia. The results show that an effective data protection policy has a positive effect on the level of consumer satisfaction. The main influencing factors are policy transparency, consumer awareness, and their experience with personal data management. However, there is still a gap between existing policies and implementation in the field. Marketplaces that successfully manage personal data well can increase loyalty and competitiveness in an increasingly competitive market. The research also highlights the importance of educating consumers about their rights to personal data and the urgency for marketplaces to improve supervision and compliance with existing regulations. Overall, personal data protection not only fulfills legal obligations, but also becomes a differentiation strategy that increases consumer trust and strengthens marketplaces' position in the market.

Abstract

AbstractThis community service activity aimed to critically evaluate the implementation of legal philosophy and professional ethics principles in Indonesia's correctional system, focusing on vulnerable groups (women and children). The study was conducted through site visits to the Tangerang Class II A Women's Correctional Facility and the Special Development Institution for Children (LKPA) Tangerang. Using a combination of direct observation, semi-structured interviews, and document analysis, the study assessed how rehabilitation programs align with restorative justice values and the ethical standards expected of modern correctional institutions. These values include equality of capabilities, the non-degradation principle, and agency recognition. The institutions were evaluated for their gender-responsive and child-centered innovations, such as trauma-informed care, arts-based therapy, adaptive education programs, and family mediation initiatives. However, structural issues like overcrowding, insufficient staff-to-inmate ratios, and infrastructure limitations were found to be significant barriers that hinder the realization of human dignity restoration, as mandated by Article 3 of Law No. 12 of 1995. The paper proposes strategic solutions, including institutional collaborations, programmatic innovations, and systemic reforms, to bridge the gap between normative ideals and the current realities of the correctional system. Ultimately, the findings contribute academic insight to support the advancement of a humane, just, and rehabilitative correctional framework in Indonesia. Keywords: restorative justice, vulnerable groups, human dignity. AbstrakKegiatan pengabdian masyarakat ini bertujuan untuk mengevaluasi secara kritis implementasi prinsip filsafat hukum dan etika profesi dalam sistem pemasyarakatan Indonesia, dengan fokus pada kelompok rentan (perempuan dan anak). Studi dilakukan melalui kunjungan lapangan ke Lapas Perempuan Kelas II A Tangerang dan Lembaga Pembinaan Khusus Anak (LKPA) Tangerang. Dengan metode observasi, wawancara, dan analisis dokumen, kegiatan ini menilai kesesuaian program pembinaan dengan nilai-nilai keadilan restoratif. Evaluasi ini berfokus pada tiga pilar utama dalam etika pemasyarakatan modern, yaitu kesetaraan akses rehabilitasi, perlindungan integritas psikologis, dan pengakuan partisipasi aktif warga binaan. Temuan menunjukkan adanya inovasi yang responsif terhadap gender dan usia, termasuk program berbasis potensi lokal, kurikulum edukatif adaptif, serta mediasi keluarga sebagai bagian dari proses restoratif. Meski demikian, keterbatasan struktural seperti kepadatan penghuni, rasio petugas yang rendah, dan minimnya fasilitas fisik menjadi hambatan dalam pencapaian restorasi martabat manusia sebagaimana amanat Pasal 3 UU No. 12 Tahun 1995. Rekomendasi strategis diajukan, antara lain kolaborasi lintas lembaga, pengembangan program non-residensial, serta integrasi pendekatan psikososial dalam pembinaan. Kegiatan ini memberikan kontribusi penting untuk memperkuat sistem pemasyarakatan yang lebih adil dan manusiawi di Indonesia. Kata kunci: keadilan restoratif, kelompok rentan, martabat manusia.

Abstract

Percepatan konversi sertifikat fisik ke kode respons cepat (QR code) oleh ATR/BPN sejak 2022 bertujuan menekan biaya, mempersingkat waktu, dan menurunkan pemalsuan. Sistem validasi elektronik yang menjadi penentu sahnya pencatatan nyatanya tidak mendeteksi sertifikat ganda, inkonsistensi data spasial, maupun perubahan status hukum lahan. Kelemahan ini memicu sengketa kepemilikan. Penelitian bertujuan mengidentifikasi kelemahan prosedur validasi elektronik dan merumuskan model penyempurnaan berbasis kepastian hukum. Ruang lingkupnya meliputi prosedur konversi di Kantor Pertanahan Kabupaten Bogor, Kota Depok, dan Kota Bekasi periode 2022–2024. Metode yuridis normatif digunakan melalui analisis peraturan, tiga putusan pengadilan terkait, wawancara dengan 12 pejabat ATR/BPN, 6 notaris, 8 pengguna layanan, serta 215 dokumen konversi. Sistem validasi hanya mencocokkan teks tanpa verifikasi ulang spasial. Integrasi real-time antara Basis Data Pertanahan Nasional, Sistem Informasi Administrasi Kependudukan, dan Sistem Informasi Pajak Bumi dan Bangunan belum terbangun, sehingga status tanah tertinggal. Konversi tanpa pemeriksaan fisik menyebabkan sertifikat atas lahan yang telah dialihfungsikan tetap aktif. Setidaknya 34 sengketa tercatat karena ketidaksesuaian QR code dengan kondisi lapangan. Operator tidak berwenang membatalkan konversi ketika ditemukan kejanggalan. Kelemahan mendasar terletak pada ketiadaan standar integrasi lintas sektoral dan absennya validasi lapangan. Model penyempurnaan mencakup validasi spasial otomatis berbasis citra satelit, kewajiban pemutakhiran berkala oleh pemda, dan pembentukan tim khusus pengecekan lapangan sebelum pencetakan QR code.

Abstract

Oceanarium s are popular tourist destinations in Indonesia. This article discusses digital transformation in designing the latest Oceanarium. The research method involves surveys and observations to 2 major Oceanarium locations in Jakarta, one Oceanarium in Singapore and one in Bangkok's Siam Paragon, to get an overview of operations, and the implementation of digital technology. In addition, this research also integrates the author's experience as a public aquarium designer and for 20 years as a manager in one of the public aquariums in the Jakarta area. The current approach needs to involve the integration of IoT technology for aquatic environment monitoring, smart energy management system. The results show that the implementation of interactive technology in several places can create an interesting and memorable learning experience for visitors. One of the technologies that is interesting and preferred by visitors is the use of hologram technology, visitors can feel the sensation of being in the sea and interact with marine animals in a realistic virtual environment. This enhances their understanding of marine flora and fauna and the importance of preserving the marine environment. This digital transformation not only improves the operational efficiency of the Oceanarium, but also enriches the visitor experience through the application of interactive technology. By implementing this strategy, Oceanarium s in Indonesia are expected to continue to grow, make a positive contribution to the preservation of the marine environment, increase public knowledge of marine biology, and provide a high-quality experience for visitors.

Abstract

Inheritance disputes in Indonesia are often prolonged due to legal pluralism involving Islamic law, customary law, and the Civil Code. In response, the Supreme Court mandates mediation in all civil cases, including inheritance disputes, under PERMA No. 1 of 2016. This study examines mediation practices in inheritance cases at Religious Courts and District Courts, and identifies factors influencing their effectiveness. Using a qualitative comparative case study approach, data were collected through in-depth interviews with judges, mediators, court clerks, and disputing parties, supplemented by case document analysis. Findings reveal that mediation at Religious Courts is normative and educative, constrained by the rigid principles of Islamic inheritance law (faraid), limiting negotiation space. In contrast, District Courts allow more flexible, problem-solving approaches under civil law. Despite differences, both courts emphasize empathy, family reconciliation, and cultural sensitivity. Success depends on mediator competence, parties’ psychological readiness, and socio-cultural context. The study concludes that differentiated mediation guidelines—tailored to the substantive legal basis of each case—are essential to transform mediation from procedural formality into a meaningful, just, and humane dispute resolution mechanism.

Abstract

The increasing rate of divorce in Indonesia directly impacts the protection of children's rights, particularly in the determination of custody. This study aims to analyze the application of the best interest of the child principle as well as the effectiveness of children's participation and supervision of custody decisions. Using a juridical-empirical approach with a qualitative method, this study examines religious court decisions and conducts interviews with judges and related parties. The results show that custody determinations are still formalistic, dominated by the rigid application of Article 105 of Law No. 1 of 1974, which automatically grants custody to the mother without a holistic consideration. Children's participation in the court process is almost non-existent, and there is no post-decision supervision mechanism. As a result, many decisions do not substantively reflect the best interests of the child. This study concludes that the family justice system in Indonesia has not fully prioritized children Reforms are needed through technical guidelines, judge training, and an integrated supervision system to ensure the real protection of children's rights after divorce.
