Abstract

The rapid advancement of digital technology has fundamentally transformed civil legal interactions, making electronic documents such as instant messages, online transactions, and digital contracts primary forms of evidence in many civil disputes. However, their admissibility in judicial proceedings remains fraught with challenges concerning formal and material validity. This study aims to identify juridical and technical obstacles in digital evidence and to formulate an ideal model for civil procedural law that ensures reliable electronic proof. A normative-juridical approach with qualitative analysis was employed, combining doctrinal research through legislative review, jurisprudence, and scholarly literature with case studies of court decisions involving electronic evidence, particularly in divorce disputes. The findings reveal that inconsistent judicial treatment stems from the absence of specific procedural rules in Indonesia’s civil procedure framework still rooted in colonial-era HIR and RBg alongside limited digital infrastructure and low technological literacy among judicial actors. In response, the study proposes an integrated legal construction model featuring explicit provisions in the upcoming Civil Procedure Code, adoption of the functional equivalence principle, institutionalization of digital forensic experts in litigation, and procedural safeguards for vulnerable parties. The research concludes that only through holistic reform of the evidentiary paradigm can Indonesia’s civil justice system guarantee fairness, legal certainty, and relevance in the digital era.

Abstract

The enforcement of civil court judgments in Indonesia frequently encounters obstacles due to parties’ bad faith conduct, such as covert asset transfers or groundless resistance to execution. Although the principle of good faith is a foundational tenet in civil law, its application in the enforcement phase remains inconsistent. This study examines the concept and legal status of the good faith principle in Indonesian positive law concerning civil judgment enforcement and analyzes the legal consequences of its violation. A normative juridical method is employed, utilizing library-based research on primary and secondary legal sources. The findings reveal that while good faith is recognized in substantive civil law, it has not been explicitly incorporated into civil procedural law. Consequently, bad faith actions during enforcement rarely incur clear procedural sanctions. Theoretically, this underscores the need to integrate ethical principles into civil procedure doctrine; practically, it calls for regulatory reforms to embed good faith as a binding procedural obligation in judgment enforcement.

Abstract

Penelitian ini mengkaji kebutuhan hukum terhadap pengesahan Rancangan Undang-Undang Perampasan Aset sebagai instrumen pemberantasan korupsi di Indonesia. Objek penelitian adalah urgensi mekanisme perampasan aset tanpa putusan pidana melalui pendekatan pembuktian terhadap harta. Tujuan penelitian ini adalah menilai kesesuaian mekanisme tersebut dengan asas hukum, khususnya asas praduga tidak bersalah dan perlindungan hak milik, serta menilai kebutuhan sosial dan institusional terhadap pembentukan regulasi baru. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, yang diperkuat data empiris berupa diskursus publik dan forum lembaga negara. Hasil penelitian menunjukkan bahwa perampasan aset tidak bertentangan dengan asas praduga tidak bersalah apabila diperlakukan sebagai tindakan terhadap objek dan disertai pembuktian berlapis serta pengawasan peradilan. Penelitian menyimpulkan bahwa rancangan undang-undang ini merupakan kebutuhan mendesak untuk memperkuat pemulihan aset dan menutup kekosongan hukum dalam pemberantasan korupsi.

Abstract

This study aims to analyze the legal responsibilities that can be imposed on online lending platform organizers for the misuse and illegal distribution of consumer personal data. With the rapid development of the online lending industry, the issue of protecting consumer personal data has become a very important issue. Misuse of personal data can have serious impacts on consumers, including identity theft and financial loss. Therefore, this study examines the forms of legal responsibilities that can be applied, such as administrative, criminal, and civil responsibilities, as well as the obstacles faced in their implementation. This study uses a normative approach with an analysis of applicable regulations, namely the Personal Data Protection Law (UU PDP), the Electronic Information and Transactions Law (UU ITE), and other related regulations. Data were obtained through a literature review covering relevant laws and regulations, journals, articles, and case studies. The results of the study indicate that online lending platform organizers can be subject to three forms of legal responsibilities. Administrative responsibilities include sanctions imposed by supervisory authorities such as the Financial Services Authority (OJK) and the Personal Data Protection Agency (BPDP). Criminal responsibilities can be in the form of imprisonment and fines for those who violate provisions related to personal data protection. Civil liability gives consumers the right to file a lawsuit for losses caused by a breach of their personal data. This study also identified various obstacles in implementing legal liability, such as lack of awareness of organizers, difficulties in supervision, and legal loopholes in user agreements.

Abstract

The Constitutional Court of Indonesia is a judicial institution with the authority to review laws against the 1945 Constitution of the Republic of Indonesia, resolve disputes between state institutions, decide on the dissolution of political parties, and adjudicate election result disputes. In exercising its authority, the Constitutional Court functions not only as the guardian of the constitution but also as a protector of human rights. This article aims to analyze how the procedural law of the Constitutional Court, as regulated under Law Number 24 of 2003 and its amendments, serves as a crucial instrument to ensure fair, transparent, and accountable proceedings in cases involving constitutional rights. This study adopts a normative juridical approach by examining legislation, legal doctrines, and Constitutional Court decisions that have had a significant impact on the protection of human rights. The analysis reveals that several rulings of the Court have expanded interpretations of human rights, although challenges remain regarding the consistency of procedural application and the effectiveness of decision enforcement. Therefore, strengthening the procedural law of the Constitutional Court is essential for ensuring the substantive and sustainable protection of human rights in Indonesia.

Abstract

The integration of the Taxpayer Identification Number (NPWP) with the National Identity Number (NIK) has heightened the sensitivity of taxpayer data, obliging the Directorate General of Taxes (DJP) as data controller to comply with Indonesia’s Law No. 27 of 2022 on Personal Data Protection (PDP Law). However, the September 2024 breach of 6.6 million NPWP records raises legal accountability concerns. This study examines (1) the legal framework for NPWP data protection under the PDP Law and (2) DJP’s liability for the breach. Employing a normative juridical method with statutory and conceptual approaches, primary and secondary legal sources were analyzed qualitatively. Findings confirm that NPWP constitutes specific personal data, and DJP violated its accountability obligation under Article 47. Such violation warrants administrative sanctions per Article 57, yet no enforcement has occurred. The study concludes that DJP bears juridical responsibility and must be sanctioned to uphold the rule of law and protect citizens’ constitutional right to privacy

Abstract

Law No. 27 of 2022 on Personal Data Protection mandates the establishment of an independent supervisory agency to ensure the effective implementation of data protection norms in Indonesia. However, as of the end of 2025, this agency has not yet been established, creating an institutional vacuum that has serious implications for the effectiveness of data protection officers and the accountability of data controllers. This study aims to analyse the legal impact of the absence of a supervisory agency on data protection officers and its implications for the responsibilities of data controllers and processors. Using a normative juridical approach with a legislative approach, this study shows that without a supervisory agency, data protection officers are in a vulnerable position: they are operationally responsible but not legally protected. They are burdened with strict normative obligations but do not have formal protection mechanisms in the event of data breaches. On the other hand, the obligations of data controllers as stipulated in Article 47 of the PDP Law become immeasurable and declarative because there are no effective verification, enforcement, or dispute resolution mechanisms. The findings indicate that the legal architecture of the PDP Law is incomplete without an independent supervisory agency. Furthermore, the absence of a supervisory agency hinders the development of professional standards, technical guidelines, and non-litigation dispute resolution forums. The research recommendations include accelerating the establishment of a supervisory agency and issuing a Government Regulation that guarantees independence, competence, and legal protection for the data protection officer as a key actor in national personal data governance.
