Abstract

Background: Before technology was widely used, transactions were carried out directly or non-electronically so that contracts in transactions were made in physical form. Due to the rapid development of the times, non-electronic transactions are now with a touch of technology turning into electronic transactions considering the many conveniences and cheapnesses obtained. As with direct transactions, sometimes in running a business, a contract agreement is needed. Aim: This study analyzed the implementation of electronic contract on B2B electronic transaction. Method: This study uses a normative legal research method with a normative juridical approach, while data collection techniques are carried out by exploring journals, books and applicable laws and regulations. The data obtained were then analyzed qualitatively and presented descriptively. Findings: The results of the study show that the implementation of electronic contracts in electronic transactions is based on the need to make long distance agreements while still fulfilling the legal requirements of the agreement including agreements, people who are adults and there are no obstacles to carrying out legal actions, certain rights and legal causes. So it can be concluded that the electronic contract is similar to a conventional contract, the only difference being that the electronic contract is created through an electronic system process while the conventional contract is created not through an electronic system process but is directly created orally or in writing on a special paper.

Abstract

Perkembangan pesat industri e-commerce di Indonesia telah membawa dampak besar terhadap pola konsumsi masyarakat, tetapi juga menimbulkan tantangan serius dalam hal perlindungan data pribadi. Kepercayaan pengguna menjadi faktor kunci dalam keberhasilan platform digital, dan salah satu elemen utamanya adalah jaminan terhadap keamanan serta privasi data pengguna. Penelitian ini bertujuan untuk menganalisis bagaimana perlindungan privasi dapat membentuk dan memperkuat kepercayaan pengguna terhadap platform e-commerce, serta menilai sejauh mana implementasi regulasi yang berlaku, khususnya Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP), telah diterapkan oleh pelaku industri digital. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan analisis deskriptif terhadap peraturan perundang-undangan, kebijakan privasi perusahaan, serta studi kasus terkait kebocoran data di beberapa platform e-commerce besar seperti Tokopedia, Shopee, dan Bukalapak. Hasil penelitian menunjukkan bahwa meskipun terdapat upaya dari platform dalam membangun sistem privasi yang lebih baik, pelaksanaannya masih belum merata dan banyak bergantung pada kesadaran serta kapabilitas masing-masing entitas. Selain itu, masih rendahnya literasi digital dan belum optimalnya penegakan hukum menjadi penghambat utama dalam menciptakan sistem perlindungan data yang komprehensif. Penelitian ini merekomendasikan peningkatan transparansi, edukasi publik, serta penguatan peran otoritas pengawas perlindungan data dalam rangka menciptakan ekosistem digital yang aman, bertanggung jawab, dan dipercaya oleh pengguna.

Abstract

The digital transformation of civil litigation through e-court and e-litigation systems has significantly improved efficiency and accessibility within Indonesia’s judiciary. However, this procedural acceleration also presents new challenges, particularly regarding the protection of third-party rights that may be affected despite not being primary litigants. Using a normative juridical method supported by conceptual and comparative approaches, this study examines the extent to which the current system accommodates third-party interests and identifies potential abuse of process arising from digital efficiencies. The findings indicate that although third-party intervention mechanisms are formally recognized under the HIR and RBg, their implementation within electronic proceedings remains limited due to technical barriers, unequal access to information, and risks of procedural or evidentiary manipulation. These issues highlight the need to strengthen technical regulations, enhance transparency of digital documents, and enforce stricter verification of electronic notifications and evidence integrity. Such improvements are essential to ensure that judicial digitalization not only accelerates procedures but also upholds substantive justice for all interested parties, including third parties.

Abstract

The digital transformation of Indonesia’s judiciary marked by the implementation of the e-Court system and the enactment of the Electronic Information and Transactions Law (ITE Law) has created a new legal space for electronic evidence in civil litigation. This article examines the legal standing of electronic evidence following the adoption of digital justice mechanisms, focusing on its admissibility, probative value, and practical challenges in courtroom application. Employing a normative juridical approach, the study finds that electronic evidence such as instant messages, emails, and digital documents is legally recognized as valid proof, provided it satisfies the principles of authentication, data integrity, and substantive relevance to the dispute. Nevertheless, its integration into the civil procedural framework remains hampered by regulatory misalignment between the ITE Law and classical civil procedure rules (HIR/RBg), the absence of technical guidelines for verification, and limited judicial capacity in digital forensic assessment. These findings underscore the urgent need for normative harmonization and enhanced technological literacy among legal practitioners to ensure a fair, efficient, and digitally responsive justice system.

Abstract

The implementation of the electronic court system in Indonesia has brought numerous benefits, such as increased transparency and accountability of the judiciary. However, this system also poses challenges regarding the protection of personal data contained in case documents. Public information openness must be balanced with strict regulations to protect the privacy of individuals involved in legal proceedings. This research analyzes the challenges and policy recommendations aimed at strengthening the balance between transparency and personal data protection in the electronic court system. The recommendations include the development of derivative regulations for the PDP Law, the implementation of secure document management systems, and training for court officials and the public regarding information access rights. This study also suggests further research on the impact of transparency on public trust and international comparative studies to improve the implementation of the electronic court system in Indonesia

Abstract

Law Number 27 of 2022 on Personal Data Protection introduces the mandatory appointment of a Data Protection Officer (DPO) as a key mechanism for accountability and compliance. This study critically examines whether Articles 53–54 of the PDP Law sufficiently guarantee the functional autonomy of the DPO in the context of Indonesia’s expanding digital economy and growing risk of data capitalism, where personal data is commodified for economic value. Using a normative-comparative legal method with the GDPR, the analysis demonstrates that although the PDP Law requires professionalism in DPO appointments, it lacks structural safeguards such as protection from interference, conflict-of-interest rules, and guaranteed access to resources—elements expressly regulated under GDPR Article 38. These gaps risk positioning the DPO as a symbolic compliance actor rather than an independent oversight mechanism. The contribution of this research lies in proposing the concept of an institutional firewall as an evaluative framework to assess and strengthen DPO autonomy in Indonesia. The findings imply the need for implementing regulations that institutionalize independence guarantees, reporting hierarchy, and enforcement mechanisms. Strengthening DPO autonomy is essential to ensuring effective privacy governance and realizing the constitutional right to personal data protection.ABSTRAKUndang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi memperkenalkan penunjukan wajib seorang Petugas Perlindungan Data (DPO) sebagai mekanisme kunci untuk akuntabilitas dan kepatuhan. Studi ini secara kritis mengkaji apakah Pasal 53–54 Undang-Undang PDP cukup menjamin otonomi fungsional DPO dalam konteks perekonomian digital Indonesia yang terus berkembang dan risiko meningkatnya kapitalisme data, di mana data pribadi dikomersialkan untuk nilai ekonomi. Menggunakan metode hukum normatif-komparatif dengan GDPR, analisis menunjukkan bahwa meskipun Undang-Undang PDP mensyaratkan profesionalisme dalam penunjukan DPO, undang-undang tersebut kekurangan jaminan struktural seperti perlindungan dari campur tangan, aturan konflik kepentingan, dan akses terjamin terhadap sumber daya elemen-elemen yang secara eksplisit diatur dalam Pasal 38 GDPR. Kekurangan ini berisiko menjadikan DPO sebagai aktor kepatuhan simbolis rather than mekanisme pengawasan independen. Kontribusi penelitian ini terletak pada usulan konsep “firewall institusional” sebagai kerangka kerja evaluatif untuk menilai dan memperkuat otonomi DPO di Indonesia. Temuan ini menyiratkan perlunya menerapkan regulasi yang menginstitusionalkan jaminan kemandirian, hierarki pelaporan, dan mekanisme penegakan. Memperkuat otonomi DPO esensial untuk memastikan tata kelola privasi yang efektif dan mewujudkan hak konstitusional atas perlindungan data pribadi.

Abstract

This community service research aims to analyze the forms of agrarian conflict and the effectiveness of non-litigation strategies in resolving land disputes in Pamijahan District, Bogor Regency. The case involves a landowner, Hlm, who purchased land in 1970 but lost control due to claims by a community organization (ormas) based on an MoU with Perhutani. Using a qualitative case study through interviews, document analysis, and field observation, the study found that mediation and negotiation are effective for restoring ownership rights despite limited formal evidence, emphasizing legality and administrative legitimacy. The study highlights the need to strengthen legal documentation and clarify jurisdictional authority. Its main contribution is offering an evidence-based, non-litigation advocacy model applicable to similar agrarian disputes in local communities.ABSTRAKPenelitian pengabdian masyarakat ini bertujuan menganalisis bentuk konflik agraria dan efektivitas strategi non-litigasi dalam penyelesaian sengketa tanah di Kecamatan Pamijahan, Kabupaten Bogor. Kasus ini melibatkan pemilik tanah berinisial Hlm yang memiliki bukti pembelian tahun 1970, namun tidak dapat menguasai lahannya karena diklaim organisasi kemasyarakatan (ormas) berdasarkan MoU dengan Perhutani. Metode penelitian menggunakan pendekatan kualitatif studi kasus melalui wawancara, analisis dokumen, dan observasi lapangan. Hasil pendampingan menunjukkan bahwa mediasi dan negosiasi dapat menjadi strategi efektif untuk memulihkan hak kepemilikan meski bukti formal terbatas, dengan menekankan aspek legalitas dan legitimasi administratif. Penelitian ini menegaskan pentingnya penguatan bukti hukum dan transparansi yurisdiksi. Kontribusi utama penelitian ini adalah memberikan model advokasi non-litigasi berbasis bukti yang aplikatif bagi penyelesaian konflik agraria serupa di tingkat masyarakat lokal.

Abstract

Perkembangan teknologi digital telah mendorong terjadinya pertukaran dan pengumpulan data pribadi secara masif, yang berimplikasi pada meningkatnya risiko pelanggaran hak privasi individu. Penelitian ini bertujuan untuk menganalisis perlindungan data pribadi sebagai bagian dari hak asasi manusia dalam perspektif hukum di Indonesia, khususnya melalui pengkajian terhadap Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP). Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan komparatif terhadap standar internasional, seperti GDPR Uni Eropa. Hasil penelitian menunjukkan bahwa UU PDP telah mengadopsi prinsip-prinsip perlindungan data pribadi yang sejalan dengan kerangka hak asasi manusia, antara lain pengakuan hak subjek data, kewajiban pengendali data, serta prinsip kejelasan tujuan dan keamanan data. Namun, implementasinya masih menghadapi berbagai tantangan, seperti belum terbentuknya lembaga pengawas independen, maraknya kebocoran data, serta rendahnya literasi digital masyarakat. Penelitian ini menyimpulkan bahwa perlindungan data pribadi di Indonesia telah memiliki dasar hukum yang kuat, namun masih memerlukan penguatan kelembagaan, pengawasan, dan peningkatan kesadaran publik untuk mewujudkan jaminan hak atas privasi secara efektif dan berkelanjutan.

Abstract

Perkembangan teknologi informasi telah mendorong transformasi besar dalam dunia perdagangan melalui sistem online marketplace. Namun, kemudahan transaksi digital ini diiringi oleh risiko pelanggaran privasi dan penyalahgunaan data pribadi konsumen. Penelitian ini bertujuan untuk menganalisis sejauh mana perlindungan hukum terhadap data pribadi konsumen diterapkan dalam sistem marketplace daring di Indonesia, dengan fokus pada implementasi Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP). Metode yang digunakan adalah pendekatan yuridis normatif dengan analisis bahan hukum primer dan sekunder, serta studi kasus kebocoran data. Hasil penelitian menunjukkan bahwa meskipun UU PDP telah memberikan kerangka hukum yang komprehensif, implementasinya masih menghadapi tantangan serius, seperti lemahnya sistem keamanan, rendahnya kepatuhan pelaku usaha, serta minimnya literasi digital konsumen. Untuk itu, diperlukan penguatan regulasi turunan, peningkatan pengawasan, dan sinergi antara pemerintah, pelaku usaha, serta masyarakat guna menciptakan sistem perlindungan data pribadi yang efektif dan berkelanjutan.

Abstract

Disputes containing both civil law and administrative law elements often generate a dualism of judicial jurisdiction due to the lack of clear boundaries between the general courts and the Administrative Court (PTUN), a situation exacerbated by normative inconsistencies, overlapping regulations, and divergent judicial interpretations, so that a single object of dispute may be examined under two legal regimes simultaneously and thereby create legal uncertainty. This study aimed to analyze the points of intersection between civil procedural law and PTUN procedural law, identify obstacles arising in mixed-element disputes, and formulate theoretical solutions for harmonizing jurisdiction. The research employed a normative juridical method with statutory, conceptual, and case approaches through the analysis of primary, secondary, and tertiary legal sources. The findings show that jurisdictional dualism primarily occurs in disputes over government contracts, procurement of goods and services, and revocation of business licenses, which simultaneously contain private and administrative aspects, while the lack of synchronization in evidentiary mechanisms and the differing orientations of dispute resolution between the general courts and PTUN reinforce the potential for dual forums. The study concludes that harmonization is required through the strengthening of rules on subject-matter jurisdiction, the application of limited forum prorogatum, the establishment of an integrated court model, and the consistent development of jurisprudence. The implications of this research affirm that the alignment of procedural laws is a crucial prerequisite for ensuring legal certainty, enhancing the efficiency of dispute resolution, and strengthening public trust in the judicial system.
