Abstract

This study aims to identify and analyze the arrangements regarding rebel groups in the perspective of international law to analyze the legal consequences for Indonesian citizens who join as rebels according to international law as well. In this study, the type of research used is a type of normative legal research using a statutory approach (statute approach), case approach (case approach), and the conceptual approach (conseptual approach). The sources of legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. The legal material collection technique used is a document study technique through library sources that are relevant to the issues discussed by analysis techniques of legal material obtained either in the form of primary legal material or secondary legal material which is analyzed qualitatively which will then be evaluated and interpreted and then argued carried out by researchers to provide a description of right or wrong and what is legally appropriate for the events that occur. The results of this study indicate (1) that in international law arrangements regarding rebels is regulated in additional protocol II of the 1949 Geneva Convention, but every party that takes a role in armed conflict including rebels has not been recognized as a subject of international law but is required to comply with international legal rules and (2) legal consequences for citizens who are involved as rebels is still not clear enough, so strict rules with severe sanctions are needed to prevent and punish the actions of the rebels and provide a deterrent effect to anyone involved in these activities.

Abstract

This study aims to determine: (1) law enforcement against perpetrators of criminals acts of babies disposal in the jurisdiction of the Buleleng Regency, (2) Efforts to overcome the occurrence of criminal acts of babies disposal in the jurisdiction of the Buleleng Regency. The location of this research was carried out in Buleleng Regency, namely at the Buleleng Resort Police, State Prosecutor Buleleng, and The Singaraja District Court Class 1B. This type of research is empirical legal research. The sampling technique used in this research is a non-probability sampling technique in a way that used in determining the research subject is the purposive technique sampling. For data processing analysis techniques, using the qualitative research result show that law enforcement against the perpetrators of the crime of illegal logging have gone well, which carried out with the investigation process, the investigator will continue with the arrest, prosecution and execution before a court with refers to Pasal 181 KUHP about Dead Conditions As for the efforts overcoming the occurrence of criminal acts of babies disposal in the jurisdiction of the Buleleng Regency is to instill moral and formally, providing counseling, and enforcing relevant regulations used to the fullest.

Abstract

This study aims to understand and analyze the mechanisms and regulations of international law that apply in providing protection and settlement as well as legal constraints faced against the case of catching traditional Indonesian fishermen, East Nusa Tenggara in Pualu Pasir which is Australian sovereignty. The research method used is normative legal research using 3 approaches, namely the approach to legislation, history, and cases that are processed with descriptive techniques that produce legal arguments. The results showed that legal protection against the fishing of traditional fishermen is regulated in three bilateral agreements between the governments of Indonesia and Australia: MoU BOX 1974, MoU BOX 1981, and Agreed Minute 1989. The purpose of this agreement is to ensure the rights of Indonesia's traditional fisheries. In the realm of international law, Article 51 paragraph (1982) of the Convention on the Law of the Sea (UNCLOS 1982) also clearly outlines the rights of traditional fishermen related to fisheries, but there is still a need for amendments to the bilateral agreement, as well as the main obstacles related to views on traditional fishers including differences in territorial boundaries, fishing gear used, and the economic sustainability of fishermen. The solution involves strengthening national regulations, legal recognition of traditional fishermen's rights, boundary agreements, and protection of marine resources in the area. However, differences in views, efforts to maintain traditions, pressure on resources, and economic challenges remain obstacles in addressing abuses committed by traditional fishermen in the Sand Island region.

Abstract

This research is based on the issue of the rampant cases of child sexual violence occurring in Buleleng Regency. The questions to be answered as the objectives of this research are: (1) how are the legal regulations governing the role of traditional villages in efforts to combat child sexual violence?; and (2) what is the role of traditional villages in efforts to prevent child sexual violence in Buleleng Regency? The research method used is empirical legal research of a descriptive nature. The data and data sources used in this study are primary and secondary data. Data collection techniques used in this study are document study, observation, and interviews. The sample determination technique used in this study is non-probability sampling with purposive sample as the sample type. The data collected in this study is further constructed qualitatively and presented descriptively. The results of this study found that: (1) the regulation regarding the role of traditional villages in efforts to prevent child sexual violence is not explicitly regulated in the Child Protection Act, the Sexual Violence Act, and related regulations at the provincial and Buleleng Regency levels; and (2) the role of traditional villages in efforts to prevent child sexual violence in Buleleng Regency is not very significant. This is due to the lack of specific legal basis regulating the role of traditional villages in preventing child sexual violence.

Abstract

Genocide is one of the crimes that are included in gross violations of human hights where this crime is related to ethnic cleansing which is also included in crimes against various political groups because it is difficult to identify which causes an international problem in a country. The crime of genocide in international criminal law is an extraordinary crime and is a prohibited act which was later included in the 1948 Genocide Convention, the statutes of the International Criminal Tribunals for the Former Yugoslavia (ICTY), the statutes of the International Criminal Tribunals for the Rwanda (ICTR) and the 1998 Rome statute. This study is intended to analyze the crime of genoside in the perspective of international law. This study found that the analysis and discourse of genoside in intersected with human rights theory and state responsibility. Genocide also highlighted as international crimes that are included in 4 (four) international crimes, namely genocide, crimes against humanity, war crimes, and crimes of aggression. In the Indonesian National Law Regulation, the Law of the Republic of Indonesia Number 26 of 2000 concerning the Human Rights Court in Article 7 states, the Crime of Genocide is a grave violation of human rights.

Abstract

In an armed dispute, the protected persons include combatants and the civilian population. Combatants who have horse de combat status must be protected and respected in all circumstances. Combatants who fell into enemy hands gained the status of prisoners of war. Protection and rights as prisoners of war are regulated in Geneva Convention III of 1949. Meanwhile, civilians are entitled to protection as regulated in Geneva Convention IV of 1949. The legal protection given to children is more focused on the consequences of armed disputes that will affect or affect children. As part of the civilian population, children who do not participate in hostilities receive general protection without any adverse distinction based on ethnicity, nationality, religion, or political opinion, and are intended to alleviate the suffering caused by war

Abstract

This study aims to find out (1) the implementation and constraints as well as the supporting factors for holding restorative justice for traffic accident criminals in the jurisdiction of the Karangasem Police, (2) the discretionary process for traffic accidents at the Karangasem Police based on Law Number 22 of 2009 concerning Road Traffic and Transportation. This type of research uses empirical juridical methods. The sampling technique used was purposive sampling. The techniques used in this research are document study techniques, interview techniques and observation techniques. The data collected were analyzed descriptively qualitatively. The results of the study show (1) the application of retorative justice is an effort to divert from the criminal justice process out of the formal process to be resolved through deliberation and the obstacles faced in implementing restorative justice are that all Polsek in Karangasem Regency do not all have accidents, so if there is an accident managed directly by the Karangasem Police, the supporting factors for holding a retorative justice are that both parties involved, both the victim and the suspect, want to hold a retorative justice, (2) based on an interview from Mr. Gusti Lanang Putu as Head of Traffic at the Karangasem Police, stated that the discretionary process for criminal acts The traffic accident at the Karangasem Police Station was the first for both parties to make a letter of peace, the two parties wanted peace through the penal mediation route.

Abstract

Overcoming illegal racing through penal means is one of the functionalizations of penal policy, especially at the application stage (judicative policy) carried out by law enforcement officials, one of which is the police. Efforts to tackle illegal racing in Singaraja City through penal facilities focus more on the repressive nature after illegal racing occurs which is an effort to prosecute and enforce the law against perpetrators of illegal racing in accordance with applicable laws and regulations. Through Non-Penal Means Efforts to deal with illegal racing through non-penal means are more focused on the nature of prevention before wild racing occurs, namely through pre-emptive efforts and preventive efforts. The implementation of these pre-emptive and preventive efforts is based on the Obedient and Sympathetic Operation Plan (RENOPS) of the Buleleng Police. RENOPS Compliance and Sympathy of the Buleleng Police is carried out by prioritizing pre-emptive activities through traffic education and counseling, and preventive actions through regulation, guarding, escorts and traffic patrols to prevent activities that disturb Traffic Traffic Traffic, one of which is illegal racing.

Abstract

Marriage does not only unite a man and a woman in a house/family. Marriage always carries legal consequences for the wife and husband who are legally married. Based on the legal requirements of a marriage above, we can see that the validity of a marriage according to the Marriage Law is based on the religious laws and beliefs of each. However, all events that occur in the family that have legal aspects need to be recorded and recorded, so that both the person concerned and other interested parties have an authentic deed regarding the event. Thus, the legal position of a person becomes clear and firm. If we look at the consequences of not having a marriage certificate as authentic proof in a marriage, then we can say that a marriage certificate has a very important role/meaning in household life. In accordance with the focus of the problem and the purpose of this activity, the method used in carrying out this activity is the method of dissemination and internalization to members of the public with a ball pick-up system. This activity is a terminal activity in order to increase the knowledge and insight of the people of Sidetapa Village in understanding legal regulations and legal awareness of the regulations governing the registration of marriages (Marriage Law) in order to obtain a marriage certificate. In its implementation, this activity refers to a synergistic pattern between experts and practitioners from the Ganesha University of Education and related agencies, namely the Office of Population and Civil Registration. On the other hand, this program is directed at creating a collaborative and democratic climate of cooperation between the world of higher education and society at large under the coordination of related agencies. As for the things that were achieved in the implementation of this Community Service in an effort to increase the legal awareness of the people of Sidetapa village regarding the urgency of registering marriages to obtain a marriage certificate, namely: a. There has been a positive change in the knowledge regarding public awareness in terms of the correct procedures for registering marriages. b. There has been a positive change in the knowledge of the village community in general and youth in particular about the importance of marriage certificates and they have begun to register marriages in an orderly manner, by seeking more in-depth information on the process of registering marriages.
