Abstract

In a sale and purchase agreement via the internet, the transaction is not the same as a conventional sale and purchase agreement where the seller and buyer meet face to face. So that raises the question of when the agreement occurs. To answer this, we can use the Acceptance Theory which teaches that an agreement occurs when the offering party directly receives an answer from the opposing party. The agreement between the seller and the buyer occurs when the seller receives an answer from the buyer. This can be done by several methods, namely through a single click, "double click to three clicks. Basically, the provisions of Article 1458 of the Civil Code still apply. That an agreement is deemed to have occurred when one party agrees (agrees) on the subject of the agreement stated by the other party. This statement is the basis for the agreement (statement of will) of the two parties. The validity of a sale-purchase agreement through e-commerce is the same as a conventional sale-purchase agreement because of the fulfillment of the validity of the agreement stipulated in Article 1320 of the Civil Code.

Abstract

This research highlights the importance of resolving inheritance disputes in Indonesia through the Tashaluh method, an amicable approach that integrates the principles of sharia, adat and local traditions. The general background shows that inheritance conflicts often impose significant financial and emotional burdens and can disrupt family relationships. On the other hand, the specific background highlights the need for alternative methods such as Tashaluh in addressing the different interpretations of inheritance laws from customary, religious and national laws that are often the starting point of conflict. This research fills the knowledge gap by exploring the potential of the Tashaluh method in defusing inheritance conflicts and maintaining family harmony. Through a normative-empirical approach, this research uses deductive and inductive approaches to analyze the phenomenon of inheritance division in society. The main findings show that the Tashaluh method can be an effective alternative in resolving inheritance disputes by maintaining cultural and religious sustainability and enriching traditional means of conflict resolution. The implications of this research provide new insights for Islamic law practitioners and researchers in strengthening the legitimacy of resolving inheritance disputes in accordance with the cultural and social context of the community, as well as highlighting the importance of further research to explore the long-term impact of using the Tashaluh method on social stability, economy, and justice in the community.

Abstract

This study focuses on the phenomenon of equal inheritance distribution between male and female children in Ciheras Village, Cipatujah Subdistrict, Tasikmalaya Regency. This practice contradicts Islamic law, which stipulates that the inheritance division should be 2:1. The purpose of this research is to investigate the factors behind this practice, as well as the Islamic legal perspective on it. The research method used is qualitative, employing descriptive-analytical techniques with a normative-empirical approach. Secondary data comes from relevant literature, while primary data is obtained through direct observation and in-depth interviews with religious figures and local communities. The research findings reveal several factors contributing to the equal inheritance distribution: the economic conditions of the predominantly farming community, efforts to avoid family conflicts, long-standing traditions, and the relatively small amount of inheritance. This practice is applied to maintain family harmony, despite Islamic law not recognizing the faraidh principle. This study provides insights into social transformation and community values influenced by the application of Islamic inheritance law in rural areas.

Abstract

Interest in reading is one aspect that is the progress of the nation and state. Reading provides a cognitive experience that can stimulate the mind. The research was conducted at Mangkubumen Kidul Elementary School No.16 Laweyan District, Surakarta City. The purpose of the research conducted by researchers is to analyze the efforts made by teachers to increase students' reading interest. The research method used by researchers is qualitative research method with a case study approach. Data collection methods used are observation, interviews and documentation. The research subjects included school principals, teachers and students in class II and class V. The object of the study was the teacher's efforts to increase students' interest in reading at Mangkubumen Kidul Elementary School No. 16. The data validity technique used is data triangulation. Data analysis used is data reduction, data presentation and conclusion. The results and research findings include teachers having strategies by motivating students always read and creating an academic and literative environment. The obstacle experienced is the competition between reading books and current gadgets which greatly influences students to have a good character of interest in reading.

Abstract

Reading is a very important activity because it is used to disseminate information for learning. This is due to access to information and knowledge related to reading. This research aims to explore reading interest and the factors that influence reading interest in private elementary schools in Surakarta. This research uses a qualitative approach with a case study method. The informant selection technique in this research used several data collection techniques, namely observation, interviews, and documentation. The results of this research indicate that interest in reading in Surakarta private elementary schools is relatively low. Due to students' lack of reading ability, reading must be ordered by the teacher. Students often play during recess. The influencing factors are internal and external factors. Internal factors are factors that come from oneself, while external factors are from outside, such as the family environment, peers, gadgets, and libraries that are far from the classroom. In conclusion, the low interest in reading among Surakarta Private Elementary School students is influenced by several factors.

Abstract

Exclusive, intolerant, and radical da'wah content on various social media platforms is a challenge for Islamic da'wah in today's digital era. This qualitative study through a normative-philosophical approach aims to identify and explore the dimensions of multicultural Islamic education values in the fatwa of the Indonesian Ulema Council of East Java Province Number. 06 of 2022 concerning Da'wah Ethics in the Digital Era. The theory of multicultural Islamic education conceptualized by Azyumardi Azra becomes the theory of analysis of the subject matter of this study. Data analysis through reduction, presentation, and verification. This study shows the content of multicultural Islamic education values in legal provisions related to da'wah ethics in the dital room in the fatwa of the Indonesian Ulema Council of East Java Province, including the value of humanism education in the prohibition of the delivery of da'wah content that spreads hatred and insults even for the reason of amar makruf nahi munkar. Then, the value of tasamuh education in the recommendation of delivering pluralist da'wah content, which is able to respect Islamic beliefs that are still being debated. Furthermore, the value of peace education in advocating the delivery of nationalist da'wah content. Next, the value of wasatiyah education in recommending the delivery of da'wah content that maintains public conduciveness and stability. The theoretical implications of this study affirm that the mainstreaming of multicultural Islamic educational values can be internalized through religious social fatwas in Indonesia, as well as fatwas related to da'wah ethics in the digital space.

Abstract

This article aims to explain how the law of music is in the perspective of saddu dzara'i. The issue of whether music is haram or not is still an interesting discussion at this time. The Salafis consider that music is absolutely haram, while Ibn Hazm allows music to be used to invite goodness. This research is qualitative research which is carried out by collecting, analyzing, and interpreting the narrative comprehensively on visual data to obtain a complete, comprehensive, and holistic insight into the law of music in the perspective of saddu dzara'i. The results of this study show that a music has two law, there are halal and haram based on their respective reasons. Music becomes halal when it is used for good purposes and is not mixed with disobedience and Music becomes haram if it is used for a bad purpose and contains inadversity such as the designation of pornography.

Abstract

Kepatuhan wajib pajak dipengaruhi oleh beberapa faktor salah satunya adalah kualitas pelayanan, kesadaran wajib pajak dan penerapan e-system perpajakan. Tujuan penelitian ini adalah untuk mengetahui seberapa besar pengaruh kualitas pelayanan, kesadaran wajib pajak dan penerapan e-system perpajakan terhadap kepatuhan wajib pajak pada Kantor Pelayanan Pajak Pratama Makassar Selatan. Penelitian ini menggunakan data primer yang didapat dengan menyebarkan kuesioner kepada Wajib Pajak Orang Pribadi yang terdaftar di Kantor Pelayanan Pajak (KPP) Pratama Makassar Selatan. Teknik pengambilan sampel dalam penelitian ini adalah Purposive Sampling dengan jumlah responden adalah sebanyak 100 responden. Penelitian ini menggunakan pendekatan kuantitatif dengan metode Analisis Regresi Linier Berganda dan IBM SPSS Statistics 22 sebagai alat bantu. Hasil pengujian menunjukkan bahwa kualitas pelayanan berpengaruh positif tetapi tidak signifikan terhadap kepatuhan Wajib Pajak. Kesadaran wajib pajak dan penerapan e-system perpajakan memiliki pengaruh positif dan signifikan terhadap kepatuhan Wajib Pajak.

Abstract

Penelitian ini di latar belakangi karena rendahnya pemahaman analisis berpikir kritis siswa pada muatan pembelajaran IPS. Hal tersebut karena pembelajaran selama pandemi yang digunakan guru kelas masih kurang bervariasi serta kurangnya menggunakan media pembelajaran. Siswa hanya mengerjakan buku lks tanpa penjelasan dalam pembelajaran. Akibatnya siswa dalam pembelajaran hingga hasil berpikir kritis siswa rendah. Tujuan penelitian ini untuk meningkatkan berpikir kritis siswa pada pembelajaran IPS dengan metode penelitian tindakan kelas. Metode yang digunakan pada penelitian dengan model Problem Based Learning. Penelitian dilaksanakan dengan dua siklus. Setiap siklus terdiri dari empat tahap kegiatan yaitu, perencanaan, tindakan, observasi, dan refleksi. Subjek penelitian adalah siswa kelas V SD Negeri 3 Pandean dengan jumlah 28 orang. data penelitian ini menggunakan tes. Berdasarkan penelitian menerapkan model PBL diperoleh hasil yang memuaskan. Hal ini dilihat dari rata-rata ketuntasan mengalami peningkatan. Pada siklus I rata-rata siswa 68,96% meningkat menjadi 85,36% pada siklus II. Selain itu aktivitas siswa juga mengalami peningkatan pada setiap siklusnya. Hal tersebut dapat disimpulkan bahwa pembelajaran IPS di SD dengan menerapkan model PBL dapat meningkatkan keterampilan berpikir kritis siswa

Abstract

Kesulitan dalam mengikuti dan memahami materi IPS kelas IV serta kurang optimalnya pemanfaatan media pembelajaran berbasis teknologi oleh guru menyebabkan peserta didik kurang antusias bertanya jawab dan pasif dalam diskusi saat pembelajaran. Tujuan penelitian yang ingin dicapai yaitu meningkatkan hasil belajar IPS melalui media audiovisual berbantuan power point. Jenis penelitian ini adalah penelitian tindakan kelas dengan analisis data kualitatif. Teknik pengumpulan data pada penelitian ini adalah observasi dan tes. Hasil penelitian ini menunjukkan bahwa hasil hasil belajar kognitif peserta didik melebihi kriteria ketuntasan minimal yaitu 70, dari 10 peserta didik yang mencapai KKM pada pra siklus dengan persentase 42% menjadi 17 peserta didik yang mencapai ketuntasan karena sudah sama atau melebihi KKM pada siklus I dengan persentase 71% dan menjadi 20 peserta didik yang mencapai ketuntasan melebihi KKM dengan persentase 83% dari 24 peserta didik kelas IV. Hal ini berarti melalui media audiovisual berbantuan power point dapat meningkatkan hasil belajar peserta didik kelas IV SD Negeri Wonobodro 01 Tahun Pelajaran 2020/2021. Peserta didik tertarik mengikuti pembelajaran dan berusaha memperoleh nilai yang terbaik
