Abstract

This study examines the practice of fraud (ghisy) in buying and selling transactions within traditional markets and online marketplaces. Ghisy, linguistically meaning deception or concealing defects, is strictly prohibited in Islam as affirmed by the Prophet Muhammad's saying: "Whoever cheats is not one of us" (HR. Muslim). This research aims to identify three main forms of fraud in trade: concealing product defects, altering product facts (tahrif description), and cheating in measurements and false oaths. Employing a qualitative library research method, this study analyzes primary sources from canonical hadith collections (Shahih Bukhari, Shahih Muslim, Sunan Ibnu Majah) and secondary sources from contemporary Islamic legal literature on commercial ethics. The findings reveal that all three forms of fraud remain prevalent in both traditional and digital marketplaces, causing significant consumer losses and eroding Islamic commercial ethics. Additionally, the study identifies contributing factors including weak regulatory oversight, low trader awareness, and insufficient verification practices by buyers. This research concludes that every trader is obligated to uphold honesty in transactions, while buyers must exercise vigilance and conduct thorough verification before completing payments. The study recommends strengthening oversight mechanisms and enhancing Islamic ethical education for traders to combat commercial fraud effectively.

Abstract

This study examines the concept of gharar (speculation/excessive uncertainty) through a thematic hadith (ḥadīth mawḍūʽī) approach, focusing on its conceptual definition, the grounds of its prohibition, and its relevance to contemporary transactions. The central problem is the persistent gap between the normative prohibition of gharar established in the Prophetic traditions and the empirical reality of modern transaction models e-commerce, conventional insurance, financial derivatives, cryptocurrency, and digital financing that increasingly embed elements of uncertainty. This research aims to reconstruct the meaning of gharar from authentic hadiths and to formulate operational criteria for distinguishing prohibited (fāḥish) from tolerated (yasīr) uncertainty in present-day muamalah. The study employs a qualitative library research design using the thematic hadith method, complemented by content analysis of the matn and a maqāṣid al-sharīʽah reading. The findings show that the prohibition of bayʽ al-gharar in Ṣaḥīḥ Muslim and the sunan collections is grounded in the protection of property, justice, and consent, rather than in the rejection of risk per se. Accordingly, gharar is graded: excessive uncertainty that dominates a contract and exploits one party is forbidden, whereas minor and unavoidable uncertainty is tolerated. Applied to contemporary practice, the criteria of clarity of object, price, quantity, and time of delivery provide a robust instrument for screening digital and financial transactions for Sharia compliance. The study concludes that thematic hadith analysis remains a living source of normative guidance capable of addressing emerging transaction technologies.

Abstract

The issue of women’s leadership in Islam continues to be a subject of debate, particularly concerning the prophetic tradition stating that a people will not prosper if they entrust their affairs to a woman. This ḥadīth is often understood as a prohibition against women assuming leadership roles, while modern political realities demonstrate that women have actively participated in public and state leadership. This study aims to analyze the ḥadīth concerning women’s leadership through the approach of mukhtalif al-ḥadīṡ and to examine its relevance within the context of the modern public sphere. This research is a library research employing a ḥadīth approach and contextual analysis. The data sources consist of canonical ḥadīth collections, classical commentaries, and contemporary literature related to gender and women’s leadership. The findings reveal that the ḥadīth regarding the prohibition of women’s leadership is classified as ṣaḥīḥ; however, scholars differ in interpreting it. Some scholars understand the ḥadīth textually as a general prohibition, while others interpret it contextually based on the historical background related to the leadership of the Persian emperor’s daughter. The mukhtalif al-ḥadīṡ approach demonstrates that contextual interpretation is more relevant in addressing the dynamics of modern society, thereby allowing women’s leadership as long as it fulfills the principles of justice, competence, and public benefit.

Abstract

This study examines the principles of productive waqf from the perspective of the Prophet's hadith and analyzes its integration into strengthening the Islamic social business model. Using a thematic (maudhū‘ī) hadith approach, it explores the concept of ḥabs al-aṣl wa tasaddaq bi al-ṯamarah as the foundation of productive waqf. The findings reveal eight value indicators within the hadiths that form the basis for developing an Islamic social economy: retention of principal assets, sustainability and distribution of benefits, sharia compliance, trustworthiness and professionalism of the naẓir, social welfare orientation, freedom from haram elements, and sincerity of intention. These values, when integrated into Islamic social business practices, form three main pillars: financial independence, measurable social benefits, and trust-based governance that drives systemic change. This integration results in an economic management model based on maqāṣid al-syarī‘ah, balancing worship objectives with economic sustainability. Consequently, from a hadith perspective, productive waqf functions not merely as a religious philanthropic instrument, but as a paradigm for socio-economic transformation capable of building community independence and equitable wealth distribution.

Abstract

This study aims to examine the authenticity of Sahih Bukhari Hadith No. 2112 regarding the right of khiyar through a comprehensive takhrij method to ensure the validity of the evidence in muamalah policy. Additionally, this study examines the mechanism of transmitting legal texts without editorial changes and compares the ijtihad of the four schools of jurisprudence regarding time limits to provide consumer protection solutions in the digital age. The methodology employed is normative legal research using a descriptive-analytical qualitative approach through library research. Data collection techniques involved cataloging hadiths on khiyar from the Kutubus Sittah, identifying the structure of the isnad, and analyzing key vocabulary (mufradat). Data analysis was conducted through stages of isnad criticism to assess the quality of the narrators, systematic analysis of the matn, comparative analysis across schools of thought, and the synchronization of traditional principles with modern economic realities. The research results indicate that the hadiths on khiyar possess exceptional chain of transmission quality within the Silsilah adz-Dzahab tradition, ensuring the text’s accuracy free from distortion over fourteen centuries. Regarding the time limit for khiyar syarat, differing viewpoints were identified: the Shafi’i school limits it to a maximum of three days, while the Maliki school allows a duration of up to 38 days depending on the type of object. In conclusion, the principle of khiyar remains relevant in the digital economy through the transformation of the order cancellation feature as a manifestation of khiyar majelis, as well as the return policy as an application of khiyar aib and khiyar syarat. The implications of this research emphasize that the ethical values of khiyar can serve as a foundation for regulators in refining consumer protection laws to minimize information asymmetry and ensure full consent (antaradin) in every online transaction

Abstract

Penelitian ini bertujuan memetakan secara komprehensif ragam metodologi penyusunan kitab hadis yang berkembang sepanjang sejarah kodifikasi Islam, menganalisis karakteristik distingtif beserta implikasi epistemologis dari setiap tipologi, serta mengevaluasi relevansinya dalam konteks kajian hadis kontemporer. Penelitian menggunakan pendekatan library research dengan metode deskriptif, analitis, dan komparatif. Sumber data mencakup kitab-kitab hadis klasik sebagai sumber primer dan literatur akademik terakreditasi periode 2021–2025 sebagai sumber sekunder. Temuan penelitian menunjukkan bahwa tradisi kodifikasi hadis melahirkan beragam tipologi metodologis yang masing-masing memiliki orientasi dan prinsip organisasional yang berbeda secara fundamental. Tipologi Musannaf dan Muwaththa' berorientasi pada kebutuhan hukum-praksis, tipologi Musnad menopang perkembangan ilmu rijal al-hadis dan Jarh wa Ta'dil, tipologi Jami' menyajikan cakupan tematik yang paling menyeluruh, sedangkan tipologi derivatif seperti Mustadrak, Mustakhraj, dan Zawaid berfungsi melengkapi dan menyempurnakan korpus hadis yang telah ada sebelumnya. Setiap metodologi mengandung implikasi epistemologis yang berbeda terhadap aksesibilitas, sistematika, dan fungsionalitas hadis dalam tradisi keilmuan Islam. Di era kontemporer, metodologi-metodologi klasik tersebut mengalami revitalisasi melalui integrasi teknologi digital, pendekatan interdisipliner, dan transformasi kajian syarah hadis yang semakin adaptif. Temuan ini menunjukkan bahwa penguasaan metodologi penyusunan kitab hadis tidak hanya penting untuk pemahaman tekstual, tetapi juga berperan strategis dalam pengembangan kurikulum pendidikan hadis yang terstruktur dan inovasi metodologis berbasis digital yang relevan dengan kebutuhan intelektual Muslim modern. Kesimpulan penelitian menegaskan bahwa penguasaan menyeluruh terhadap metodologi penyusunan kitab hadis merupakan prasyarat epistemologis fundamental bagi pengembangan kajian hadis yang inovatif, kontekstual, dan responsif terhadap tantangan intelektual umat Islam di era modern.

Abstract

Perkembangan Program Studi Ilmu Hadis di Indonesia mengalami ekspansi yang pesat, namun menunjukkan ketimpangan struktural yang mencolok: dominasi terjadi pada jenjang sarjana, sementara jenjang magister dan doktor masih sangat terbatas. Penelitian ini bertujuan untuk menganalisis ketimpangan struktural tersebut, mengidentifikasi faktor penyebabnya, serta mengkaji implikasinya terhadap pengembangan keilmuan hadis. Metode yang digunakan adalah pendekatan kualitatif melalui studi kepustakaan yang dipadukan dengan analisis data kelembagaan berbasis PDDikti per 1 Mei 2026. Data diklasifikasikan berdasarkan jenjang pendidikan dan jenis perguruan tinggi, kemudian dianalisis secara deskriptif-analitis dengan menggunakan perspektif pendidikan tinggi. Hasil penelitian menunjukkan adanya ketimpangan signifikan dengan komposisi 81 program S1, 8 program S2, dan 1 program S3, yang mencerminkan orientasi pengembangan yang lebih bersifat teaching oriented. Kondisi ini berdampak pada terbatasnya kapasitas riset, lemahnya regenerasi akademisi, serta minimnya inovasi metodologis. Penelitian ini menegaskan pentingnya penguatan jenjang pascasarjana, pengembangan kultur riset, serta penyusunan roadmap nasional untuk mendorong pengembangan Ilmu Hadis yang lebih seimbang dan berkelanjutan.

Abstract

Penelitian ini bertujuan mengkaji peristiwa Musu Selleng dalam perspektif hadis, dengan menyoroti dimensi historis, etika, dan teologis dari proses Islamisasi Sulawesi Selatan. Pendekatan yang digunakan adalah kualitatif-deskriptif dengan analisis teks historis dan tafsir hadis normatif. Data diperoleh melalui telaah sumber primer seperti Lontara Gowa serta hadis-hadis sahih yang berkaitan dengan niat, kebebasan beragama, dan keadilan. Hasil penelitian menunjukkan bahwa ekspansi Gowa-Tallo dalam Musu Selleng tidak hanya bermotif dakwah, tetapi juga politik dan ekonomi. Evaluasi hadis menunjukkan bahwa niat dakwah yang bercampur ambisi kekuasaan kehilangan nilai moralnya, Islamisasi melalui paksaan bertentangan dengan prinsip rahmah, dan tindakan represif melanggar prinsip keadilan Islam. Dengan demikian, Musu Selleng merupakan contoh historis tentang ketegangan antara dakwah dan kekuasaan. Implikasi penelitian ini adalah pentingnya penerapan hadis sebagai kerangka etika dalam studi historiografi Islam Nusantara, sehingga sejarah tidak hanya dilihat sebagai kronologi kekuasaan, tetapi juga sebagai refleksi moral dan spiritual. Pendekatan ini membuka ruang baru bagi pengembangan studi etika Islam interdisipliner.

Abstract

Abstract The main problem in this study is how the role of the Ministry of Religion of Bima Regency in determining standards and validating the direction of the qibla in Lambu District, Bima Regency. From the main problem, it is divided into 2 (two) problem formulations, namely 1) How is the function of the Ministry of Religion of Bima Regency in determining or validating the direction of the qibla in Lambu District, 2) How are the obstacles and challenges faced by the Ministry of Religion of Bima Regency in the process of validating the direction of the qibla in Lambu District. The type of research used is a qualitative approach with a descriptive type of field research. Data was collected through, observation, interviews and documentation with information from the Ministry of Religion of Bima Regency, the Religious Affairs Office of Lambu District, and mosque or prayer room administrators. Data analysis is carried out through data reduction, data presentation, and conclusion drawn. The results of the study show that, 1) the role of the Ministry of Religion in validating the direction of the qibla needs to be strengthened through increased socialization and an active approach to the community, considering that there is still a low demand for measurement and trust in the doctrinal method. 2) It is necessary to improve the quality of human resources and provide more adequate facilities and infrastructure to overcome technical obstacles in the field. This research implies the need to increase public awareness of the importance of determining the direction of the qibla scientifically and strengthening the proactive role of the Ministry of Religion of Bima Regency through socialization, mentoring, capacity building of human resources in the field of astronomy, and the provision of supporting facilities for measuring the direction of the qibla Keywords: Qibla Direction, Role of the Ministry of Religion, Standards and Validation.

Abstract

This article examines the relationship between prophetic hadith and Pasang ri Kajang, the customary normative system of the Ammatoa Kajang community, through the framework of wilaayat al-amr in environmental governance. Situated at the intersection of hadith studies and Islamic constitutional thought, the study moves beyond textual interpretation to analyze how ecological hadiths function as sources of public authority in regulating collective environmental conduct. While previous scholarship has discussed Islamic environmental ethics and indigenous ecological traditions separately, their interaction as parallel normative authorities remains insufficiently explored. Using a qualitative normative-comparative method, this study analyzes selected ecological hadiths through dirāyah al-hadith, supported by maqashid al-shari‘ah and legal pluralism approaches. These findings are then compared with Pasang ri Kajang as a form of customary environmental law. The study finds that prophetic authority and Ammatoa customary leadership represent distinct yet functionally comparable forms of ecological governance. Prophetic authority operates universally, whereas Ammatoa authority functions locally as a socially autonomous institution that may also be recognized as a form of constitutional legitimacy within plural legal systems. This article argues that wilaayat al-amr should not be confined to formal state power alone, but may also include legitimate authority oriented toward public welfare (maslahah ‘ammah). By proposing the concept of authoritative ecological convergence, this study contributes to hadith studies, Islamic constitutional law, and environmental governance by offering a model through which religious norms and indigenous authority may coexist in promoting ecological sustainability. More broadly, the findings suggest that contemporary environmental policy should incorporate socially legitimate local authorities as strategic partners of the state in conservation governance. Such an approach may strengthen legal compliance, reduce jurisdictional conflict, and enhance the sustainability of environmental regulation.
