Abstract

This research aims to explain the application of the Principle of Piercing The Corporate Veil in resolving corporate responsibility cases in Indonesia. The method used in this research is normative legal research, using a statutory approach. The results of the research explain that based on Article 3 paragraph (1) of Law Number 40 of 2007 concerning Limited Liability Companies, it is stated that the shareholders of the company aren’t personally responsible for the agreements made on behalf of the company and aren’t responsible for the company's losses exceeding the shares they own. However, the doctrine in corporate law recognizes the existence of the Principle of Piercing the Corporate Veil which can break through the limited liability of the company's shareholders into unlimited liability up to their personal assets. Although the Principle of Piercing the Corporate Veil has been regulated in Law Number 40 of 2007 concerning Limited Liability Companies, there have been major cases in which the shareholders of the company were responsible up to their personal assets but only limited responsibility for the shares they owned. These major cases include the PT Lapindo Brantas case in 2006 and the PT Bank Century case in 2008.

Abstract

This research aims to analyze fund raising and distribution activities based on the Mudharabah concept at Bank Nagari Syariah Solok. Bank Nagari Syariah is a financial institution based on Islamic Sharia principles which aims to improve community welfare through improving economic business performance. This research uses a qualitative descriptive approach by collecting data through interviews and documents from Bank Nagari Syariah. The results of this research show that the number of customers collecting funds through savings, deposits and current accounts continues to increase in the 2019-2023 period. This reflects the high level of public trust in Bank Nagar Syariah Solok. In addition, the increase in the number of customers who share money through mudharabah products for both investment and working capital shows the important role of Bank Nagari Syariah in supporting the real sector and micro, small and medium enterprises. (UMKM) Based on the results of the research conducted, it can be concluded that the mudharabah concept implemented at Bank Nagar Syariah Solok is effective in collecting and distributing funds and has great potential in consistently improving the community's economy. . with sharia principles, but the biggest challenge is a lack of understanding. to the public about sharia products that require additional education from the bank.

Abstract

This study aims to identify the risks that will arise due to fraudulent practices and breach of contract will be carried out by clients during musyarakah financing. This text also aims to explore how the implementation of risk management can reduce the risks that will occur in the PT. BPRS Haji Miskin Pandai Sikek is a microfinance institution that aims to provide services to the underprivileged population in the Sikek area. In this study, the qualitative method was chosen by the author as the approach that will be used to carry out their research. In this paper, the author uses two types of primary data. Initially, primary information will be obtained directly from primary sources, such as written records and direct observations at the research site. Furthermore, primary information will be obtained through library studies or by referring to relevant books on Islamic banking and related subjects. In this study, the analytical method was used by the researchers. Based on the study, it was reported that fraud and default by customers in musyarakah financing present two types of risks, namely financing risk and operational risk. The implementation of risk management in musyarakah financing will be carried out by a specific PT company. In order to implement the precautionary principle, BPRS Haji Miskin Pandai Sikek utilizes the standard operating procedure (SOP) instructions that have been decided. The risk management process includes four stages, namely risk detection, risk assessment, risk management, and risk monitoring. The principle of the five Cs (character, capacity, capital, collateral and condition of economy) is used in this process.

Abstract

This article is entitled Analysis of the Implementation of Customer Relationship Management in Increasing Customer Loyalty at the LKMS-A Gapoktan Panampuang Prima Cooperative. Matters relating to behavior towards customers, how to serve customers, and all matters relating to customer behavior are part of Customer Relationship Management. In this study, the research used is field research which is descriptive qualitative in nature by collecting data through observation, interviews and documentation. Qualitative research is carried out to build knowledge through understanding and discovery. The results of this research, the implementation of Customer Relationship Management at LKMS-A Gapoktan Panampuang Prima is CRM designed to utilize information technology by developing a continuous relationship with customers by maximizing four dimensions, namely planning, People, Process. , Technology. Which can be seen in the LKMS-A Gapoktan Panampuang Prima which has maximized these four dimensions. Meanwhile, the obstacle faced by the LKMS-A cooperative is the difficulty in increasing the number of customers due to the large number of competing institutions nearby. However, these obstacles can be overcome by improving service quality, increasing trust, increasing satisfaction, and building a better company image.

Abstract

Knowledge is very closely related to behavior, the practice of documenting nursing care must be sustainable which pays attention to patient safety. Workload and motivation also play an important role in improving behavior, high motivation and low workload have a positive effect on the behavior of a nurse in a hospital in the application of patient fall prevention. The purpose of this study was to determine the effect of nurses' knowledge on patient safety, workload and work motivation on nurse compliance. Quantitative type with a cross sectional approach with a sample of 117 people which is the total population with a statistical test t-test. The results showed that the characteristics of nurses aged < 20-30 years (61.5%), female (95.7%), D3 Nursing education (70.9%), working years > 3 years (62.4%) and serving on the 3rd floor (47.0%). Nurses have high knowledge of 99.7, high workload with a score of 101.22, high motivation, a score of 95.70 and compliance with a score of 100.1. The bivariate test has a relationship between knowledge and compliance (p-value: 0.021), workload (p-value: 0.000) and there is no relationship between motivation and compliance (p-value: 0.961). And there is a relationship between knowledge and workload on motivation (p-value: 0.000). Multivarite test found that knowledge and workload with a significance of <0.05, but knowledge has the smallest significant (p-value = 0.000). It is recommended to the hospital to increase the knowledge of nurses about patient safety, namely by providing education and training regularly both internally and externally to all nurses who work in the inpatient room.

Abstract

Penelitian ini adalah penelitian dan pengembangan atau Research and development (R&D) 4-D yang bertujuan untuk menghasilkan modul pembelajaran biologi berbasis Al-Qur’an pada materi sirkulasi darah yang valid, praktis dan efektif digunakan dalam pembelajaran. Teknik analisis data yang digunakan adalah analisis data kevalidan, analisis data kepraktisan dan analisis data keefektifan. Hasil penelitian yang diperoleh menunjukkan bahwa modul pembelajaran biologi berbasis Al-Qur’an pada materi sirkulasi darah yang dikembangkan secara keseluruhan memiliki kualitas yang baik dalam kegiatan belajar mengajar. Tingkat kevalidan modul dapat dilihat dari hasil persentase validator ahli materi sebesar 80% dengan kriteria valid, dari ahli media sebesar 87% dengan kriteria sangat valid, dan ahli Agama sebesar 78% dengan kriteria valid. Tingkat kepraktisan modul dilihat dari respon guru sebesar 92% dengan kriteria sangat menarik dan dilihat dari respon siswa sebesar 83% dengan kriteria sangat menarik. Efektivitas modul dilihat dari hasil belajar siswa dengan nilai rata-rata siswa sebesar 82% dengan kategori sangat efektif. Sehingga dapat disimpulkan bahwa modul pembelajaran biologi berbasis Al-Qur’an pada materi sirkulasi darah yang dikembangkan dengan model 4-D valid, praktis, dan efektif sehingga layak untuk digunakan sebagai bahan ajar bagi siswa kelas XI MA/SMA.

Abstract

The most important goal in health services is to produce patient health outcomes that benefit patients and continue to prioritize the quality of health services. The results of the interviews conducted found that referrals from insurance agents also decreased due to problems related to the variety of services that have an impact on increasing service costs. The purpose of this study was to determine the impact of implementing a clinical pathway as a tool for quality and cost control on length of stay, hospital costs, patient health outcomes in groups that implement and do not implement clinical pathways. This study took place at the EMC Pekayon Hospital with a population of all medical record files of patients who had a diagnosis of appendicitis with laparoscopic appendectomy surgery in the period 2021 to November 2022 who met the inclusion criteria, namely 69 patients. Clinical pathway is the independent variable and length of stay, hospital cost, patient health outcome is the dependent variable. The research design used is analysis with qualitative in-depth interviews and documentation studies. The results showed that the implementation of the clinical pathway had an impact on the length of stay, hospital costs and patient health outcomes. The implications of this research in theory will prove the impact of the implementation of research variables and managerially will further improve the service evaluation system in hospitals to improve service quality and cost efficiency.

Abstract

Bank adalah lembaga keuangan yang kegiatan usahanya menghimpun uang dari masyarakat dan menyalurkan uang kepada masyarakat serta memberikan pelayanan jasa-jasa keuangan. Penelitian ini bertujuan untuk menjelaskan penyelesaian kredit macet terhadap debitur pada bank perkreditan rakyat. Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis. Penyelesaian kredit macet terhadap debitur pada Bank Perkreditan Rakyat tidak dilaksanakan berdasarkan perjanjian kredit antara Bank Perkreditan Rakyat dan nasabah debitur. Hambatan-hambatan dalam penyelesaian kredit macet terhadap debitur pada Bank Perkreditan Rakyat adalah kurangnya kehati-hatian pihak bank dalam melakukan analisa kredit terhadap karakter nasabah, kondisi keuangan nasabah, pekerjaan nasabah, usaha nasabah, dan jaminan kredit nasabah serta pandemi Virus Corona COVID-19 yang melanda berdampak terhadap perekonomian nasabah debitur. Upaya yang dilakukan untuk mengatasi hambatan-hambatan dalam penyelesaian kredit macet terhadap debitur pada Bank Perkreditan Rakyat adalah menyelesaikan kredit macet secara persuasif atau kekeluargaan terlebih dahulu sesuai dengan perjanjian kredit antara Bank Perkreditan Rakyat dan nasabah debitur serta mengajukan gugatan ke Pengadilan Negeri terhadap nasabah debitur yang tidak memiliki itikad baik untuk melunasi utangnya.

Abstract

Dasar hukum yang mengatur mengenai hubungan kerja di Indonesia adalah Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Penelitian ini bertujuan untuk menjelaskan pelaksanaan hak-hak tenaga kerja akibat Pemutusan Hubungan Kerja berdasarkan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis. 13 Pelaksanaan hak-hak tenaga kerja akibat Pemutusan Hubungan Kerja pada PT Asia Forestama Raya berdasarkan Undang-Undang Ketenagakerjaan belum terlaksana. Hambatan pertama adalah kurangnya pemahaman pekerja mengenai Undang-Undang Ketenagakerjaan. Hambatan kedua adalah kondisi keuangan PT Asia Forestama Raya saat ini sedang dalam keadaan rugi sehingga pihak perusahaan tidak mampu untuk membayar hak-hak tenaga kerja yang mengalami Pemutusan Hubungan Kerja. Hambatan lainnya adalah kurangnya pembinaan dan pengawasan yang dilakukan oleh Dinas Tenaga Kerja Kota Pekanbaru. Pada tahun 2019, Serikat Buruh Cahaya Indonesia mengajukan gugatan Perselisihan Hubungan Industrial terhadap PT Asia Forestama Raya. Selain itu, para pekerja PT Asia Forestama Raya yang mengalami Pemutusan Hubungan Kerja tanpa adanya penetapan dari Pengadilan Hubungan Industrial dapat melapor ke Dinas Tenaga Kerja Kota Pekanbaru.

Abstract

The background of this journal is to see the strategy for channeling one thousand a day alms funds (S.3) in Bukittinggi, whether it is in accordance with the Islamic religion in the way of distribution. The strategy for distributing funds for S.3 is to channel funds to underprivileged people or those who need assistance from S.3. The first source of funds for S.3 is one thousand alms a day by people who want to help people in need, through social media , such as Facebook, WhatsApp, Instagram and the surrounding community. These donors are people who admire and support this S.3 program. The management of the S.3 funds was entrusted to Siti Rahmayanti, who is usually called Ummi Cinto. Funds disbursed from the S.3 Program must be distributed to people in need. The purpose of this research is to find out the strategy for channeling funds to the One Thousand A Day Alms Institution (S.3) in the City of Bukittinggi.
