Abstract

Industrial revolution 4.0 causes everyone to compete to produce work. One of the things that play an important role in this industry is a brand. The term brand is familiar in society, every day we use many products with various brands. This is where the presence of a brand is needed to differentiate the products that have been produced. Brands also make it easy for consumers to identify the products they want. With the increasing number of products on the market today, it is necessary to regulate the brand. Everyone is indeed free to work, but that freedom is also often violated. Therefore, as a part of intellectual property, the brand must get protection. So, this research aims to compare the protection of brands between Japan and Indonesia. This study uses a normative legal research method with a statutory approach and a comparative law approach. Indonesia already has a legal instrument that regulates trademark protection, namely Law no. 20 of 2016. The same is done by Japan. They have also provided protection to their citizens about trademark rights. This is stipulated in the Japan Trademark Act.

Abstract

Copyright is a part of Intellectual Property Rights whose existence must receive legal protection. The same is the case with other creations, especially those produced through digital media which are copyright works that must be protected. However, in reality there are still many people who do not understand about this protection, and many people are not responsible for using a copyrighted work without the author's permission. This of course is very detrimental to the creator as the original owner of the work by violating the exclusive rights of the creator. Some of the main issues that will be discussed in this research are copyright protection of digital works, namely digital painting as one of the works that should be protected as well as several legal remedies that can be taken against infringement of the exclusive rights of the author. This type of research is normative legal research with analytical descriptive research type and the problem approach used is a normative approach with a normative juridical approach. The results of the research and discussion conclude that legal protection for digital painting is implicitly regulated in Law Number 28 of 2014 concerning Copyright. Starting from the protection of the creator's exclusive rights to legal remedies that the creator can take.AbstrakHak cipta merupakan salah satu bagian dari Hak Kekayaan Intelektual yang keberadaannya harus mendapat perlindungan hukum. Sama hal nya dengan ciptaan-ciptaan lainnya khususnya terhadap ciptaan yang dihasilkan melalui media digital yang merupakan salah satu karya cipta yang harus dilindungi. Akan tetapi, pada kenyataannya masih banyak masyarakat yang belum paham mengenai perlindungan ini, serta banyak orang yang tidak bertanggung jawab memanfaatkan suatu karya cipta tanpa seizin pencipta. Hal tersebut tentu saja sangat merugikan pencipta sebagai pemilik asli dari ciptaan tersebut dengan dilanggarnya hak eksklusif dari si pencipta. Beberapa pokok permasalahan yang akan dibahas di dalam penelitian ini adalah tentang perlindungan hak cipta terhadap karya digital yaitu digital painting sebagai salah satu ciptaan yang seharusnya dilindungi serta beberapa upaya hukum yang dapat dilakukan terhadap pelanggaran atas hak eksklusif pencipta. Jenis penelitian ini yaitu penelitian hukum normatif dengan tipe penelitian deskriptif analitis dan pendekatan masalah yang digunakan yaitu pendekatan normatif dengan tipe pendekatan yuridis normatif. Hasil dari penelitian dan pembahasan menyimpulkan bahwa perlindungan hukum terhadap digital painting ini secara tersirat telah diatur di dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Mulai dari perlindungan terhadap hak eksklusif pencipta hingga upaya hukum yang dapat dilakukan oleh pencipta.

Abstract

MSMEs are businesses that can be run by all people who want to start a business with small capital. Q, MSMEs have strategic role in building Indonesian economy. However, the growth  of MSMEs is experiencing a slump due to COVID-19. On March 11, 2020, WHO as a legal world health organization declared the COVID-19 as a pandemic. MSMEs have become solution to increase the welfare of Indonesian citizen, since the issue of welfare itself is not an easy to realize. To support MSMEs in increasing the welfare, it is necessary for the government to take action in pushing MSME actors to registrate their trademarks as part of intellectual property which is very important in the economic recovery. Based on these problems, this study uses non-doctrinal research methods to examine trademark regulation in Indonesia, the awareness of MSME actors on the importance of trademark protection, and the relation of trademark registration as an effort to recover the MSME economy after the pandemic. The result of this study indicates that the regulation regarding trademark protection is contained in Indonesian Trademark & Geographical Indication Law.  Additionally,  the study reveals that there are several MSME actors who aware that a brand must be protected because it is an intellectual property, but there are also MSME actors who do not aware about this issue. In fact, the urgency of trademark registration is considered to be the part of efforts in recovering the economy of MSMEs after the COVID-19 pandemic, this is because after registering the trademark, it automatically has economic value.

Abstract

Non-Fungible Tokens (NFTs) are one of the technological innovations that provide convenience for every human being, especially in the context of business and economic opportunities. Features such as anonymity, decentralization, and its online scope are undeniably a double-edged knife phenomenon. On the one hand, it makes things easier, but on the other hand, it has the potential to become a platform for criminal acts such as money laundering, personal data violations, and copyright plagiarism. So that the urgency of special regulations should be considered, but with a progressive nature and paradigm so that NFT innovation does not die just because the law does not adjust to the times. Progressive law is a solution and answer to the phenomena that occur, where the legal paradigm and its enforcement must be in accordance with the moral system, the times, and the values that live in society to achieve substantive justice. Practical breakthroughs such as utilizing the latest technology can be developed to assist the law enforcement process in cyberspace.

Abstract

This article examines the manifestation of trademarks as collateral to enhance the capacity of Micro, Small, and Medium-sized Enterprises (MSMEs) in Indonesia. The study employs a normative research approach, drawing upon legal sources derived from legislation, relevant legal theories, and concepts. Data is analyzed using a qualitative juridical method and deductive reasoning. The research findings suggest that trademarks should be eligible as collateral since they meet the criteria of intangible movable property that can contribute to the growth and development of SMEs in Indonesia. However, the practical application of trademarks as collateral is hindered by existing regulations and the absence of a specialized intellectual property asset appraisal institution. Such measures are crucial in fostering MSMEs and, ultimately, improving the welfare of the Indonesian society.
