Abstract

Corporate Social Responsibility (CSR) is the Company's commitment to participate in sustainable economic development to improve the quality of life and the environment that is beneficial, both for the Company itself, the local community, and society in general. One sector that is an essential component in implementing CSR is education. This study aims to describe CSR policies as a legal strategy to protect children's education rights. This research uses normative juridical research with a statutory approach. The results obtained in this study are that the Indonesian government guarantees the protection of children's education rights by implementing a CSR policy. CSR implementation in Indonesia is regulated in Indonesian Law number 40 of 2007 concerning Limited Liability Companies. Article 74 paragraph (1) states that companies whose businesses are in the field and/or related to natural resources are obliged to carry out CSR. Therefore, the progress of the world of education cannot run alone, so there is a need for cooperation between companies, communities, and governments through CSR programs.

Abstract

Insurance in the electronic trading business has been regulated by law in Indonesia, but there are technical obstacles related to electronic trade insurance in the Indonesian legal system in its application. When insurance is used in business through e-commerce, there is legal protection for the insurer regarding the obligation to notify the policyholder about the subject of insurance, and legal protection for the policyholder regarding the purpose of the policy, namely the transfer of risk to compensation for the damage caused by the event, as well as the risk against risks that threaten insurance coverage. Therefore, this study aims to disseminate knowledge about how insurance arrangements for e-commerce businesses are from a legal point of view in Indonesia and what are the reasons for e-commerce insurance to be specifically regulated by Indonesian law. This study uses a normative legal research method through library research tracing guidelines such as laws, articles, or journals related to the themes and titles to be studied which will be used as the basis or foundation for the preparation of this article. The results of this study indicate that insurance agreements can be used to mitigate risks that may arise from the intrusion of third parties into the e-commerce protection system, as long as the agreement does not violate the insurance principles as regulated in Indonesian legislation.

Abstract

Indonesia's potential has made Indonesia a strategic investment destination, both domestic investment and foreign investment. The enormous number of human resources, abundant natural wealth, and various forms of culture that stretch from Sabang to Merauke, have encouraged many potential investors to continue to monitor the development of the Indonesian economy. All of this potential can even continue to increase, if it is put to good use by the creative economy and the industries within it. The global economic recession caused by the COVID-19 pandemic has increased the urgency for the development of the creative economy sector as a sector that has proven its resilience. Using normative legal research methods, this study analyzes Indonesia's ability to facilitate the interests and development of the creative economy in the context of investment. This research outlines the problems contained in the laws and regulations governing investment in Indonesia, as well as their impact on the creative economy in Indonesia. This research also proves that there is an urgency to renew the regulations contained in the laws and regulations governing investment, in order to attract more investors to invest, especially in creative industries.

Abstract

Technological developments and digital transformation have had a significant impact on the banking industry sector, triggering the rapid growth of digital banking. This research aims to examine the regulation of digital banking in the era of digital banking transformation by focusing on the comparison between Indonesia and Singapore. This research uses normative juridical research with a statute approach and comparative approach. The results of this research provide in-depth insight into the differences and similarities in regulatory approaches to the level of security, innovation and digital banking penetration between Indonesia and Singapore. The results of this research bring a comprehensive understanding of how the two countries respond to the challenges and opportunities in the era of digital banking transformation which is expected to contribute to the development of digital banking in Indonesia today.

Abstract

This research aims to analyze the regulatory framework for the implementation of operational principles in banking as an effort to protect consumer data in Indonesia. The research method employed is normative legal research with a legislative approach to analyze banking regulations. This study involves the analysis of secondary data. The results indicate that the regulation of the implementation of operational principles in Indonesian banking has provided legal certainty in the protection of consumer data. Banks in Indonesia are mandated to maintain the confidentiality of consumer data, enhance trust, and manage risks with caution. The research also identifies several challenges and shortcomings that need further consideration to strengthen consumer data protection. The implementation of operational principles in banking, such as the Principles of Trust, Confidentiality, Prudence, and Know Your Customer (KYC) Principles, constitutes critical steps in safeguarding consumer banking data in the digital era.
