Abstract

Tulisan ini membahas tentang fenomena merebaknya paham radiklasime dikalangan remaja. Radikalisme merupakan bagian dari tindakan kekerasan yang dilakukan oleh sebagain orang untuk mencapai tujuan-tujuan yang dikehendaki, motif politik dan kekuasaan biasanya yang mendominasi . Penyebaran radikalisme dikalangan remaja sungguh sangat berbahaya karena dampaknya akan merusak masa depan remaja sebagai masa depan orang tua sekaligus masa depan bangsa dan negara. Radikalisme tidak terjadi dalam ruang hampah , dimana ada masyarakat pasti akan muncul fenomena kekerasan atau tindakan radikal. Secara psykologis masa remaja merupakan suatu fase kritis dalam daur hidup manusia, dimana rentan untuk dipengaruhi berbagai paham sesat seperti radikalisme. Faktor penyebab radikalisme dikalangan remaja begitu kompleks, disamping kondisi psykologis yang labil , faktor lain seperti situasi kondisi, ekonomi, politik, sosial budaya seperti tafsir agama yang keliru, ketidakadilan dalam penegakan hukum, distribusi ekonomi yang tidak merata, minimnya literasi digital dan ketiadaan figur pemimpin yang jadi panutan adalah sebagain sebab munculnya radikalisme pada remaja. Upaya pencegahan dapat dilakukan dengan perbaikan sistem ekonomi, politik, sosial budaya seperti memperkuat pendidikan multikulturisme, optimalisasi deradikalisasi secara komperehensif, pengutan literasi digital dan membangun kepercayaan publik dari pemerintah serta perlu kehadiran kepemimpian nasional yang dapat menjadi panutan bagi remaja.

Abstract

Children in Conflict with the Law (ABH) are part of the community who are powerless both physically, mentally and socially, so they need special attention in handling them. Children who are well protected create a quality generation, which is needed for the future of the nation. For reasons of physical, mental and social immaturity, children need special attention and guidance, including legal protection both before and after birth. Children have the right to special protection and opportunities guaranteed by law and other means to grow and develop physically, mentally and socially. Protection of children is carried out in all aspects of life, special protection and obtaining opportunities guaranteed by law and other means, to grow and develop physically, mentally and socially. Protection of children is carried out in all aspects of life, including in this case in juvenile criminal justice. This research is a normative legal research that is strengthened by primary data to sharpen the analysis. The results show that the application of diversion in handling children in order to realize the concept of restorative justice or balanced justice between perpetrators and victims is a breakthrough in the juvenile criminal justice system. The results of the study show that the application of diversion in juvenile justice in order to realize restorative justice is the right step to prevent children from criminal justice which has the potential to rob children of independence. the application of punishment to children is the last option and is carried out in the shortest possible time

Abstract

With the rapid development of technology, it is now easier for people to communicate and find information, one of which is through social media. Social media has various types, advantages and disadvantages. The use of social media is not limited to a person's status, such as age, gender, religion or profession. Currently, many judges use social media to communicate, seek information and interact with the public. However, the use of social media by judges can affect public trust in the judiciary. In several countries, there are already rules and ways for judges to use social media properly and correctly. However, in Indonesia, the Code of Ethics and Code of Conduct for Judges (KEPPH) which has been in effect since 2009 does not regulate the use of social media by judges. Therefore, this research aims to assist the Supreme Court and the Judicial Commission in creating regulations or guidelines regarding the use of social media by judges, as well as assisting judges in using social media without violating the judge's professional code of ethics.

Abstract

Judges who act as executors and spearheads of justice and interact with the public are expected to have high professionalism in considering and making legal decisions in a case. In carrying out their duties, a judge is required to comply with the applicable code of ethics. When a judge violates the professional code of ethics, he will be given sanctions according to the violation he has committed. The case of violating the code of ethics that recently occurred was the case regarding Anwar Usman as Chairman of the Constitutional Court who was proven to have violated the professional code of ethics for judges in relation to Decision Number 90/PUU-XXI/2023. The aim of this research is to find out the accountability of a judge who has violated the professional code of ethics and to know the role of the Honorary Council of the Constitutional Court in handling cases of violations of the code of ethics committed by constitutional judges. This research uses a normative juridical method by referring to legal norms contained in statutory regulations as well as legal norms that exist in society. An approach that refers to applicable laws and regulations including principles, principles and doctrine. Judges who violate the code of ethics can impose three types of sanctions taking into account the background, level of seriousness and consequences of the violation. The Honorary Council of the Constitutional Court is an instrument formed by the Constitutional Court with the aim of maintaining and upholding honor, nobility and dignity. The authority possessed by the Honorary Council of the Constitutional Court includes maintaining the dignity and honor of the Constitutional Court, examining and deciding on allegations of violations of the code of ethics and behavior of constitutional judges. The trial led by Jimly Asshiddiqie as Chair of the Honorary Council of the Constitutional Court (MKMK) through the Decision of the Honorary Council of the Constitutional Court Number 02/MKMK/L/11/2923 stated that Anwar Usman in this case had been proven to have violated the code of professional ethics and behavior of judges. For this reason, Anwar Usman was dismissed from his position as Chairman of the Constitutional Court.

Abstract

Seeing from the historical side, violence is one of the oldest social problems, which may be as old as human civilization, this is understandable because basically humans are homo homini lupus creatures, referring to the thoughts of the famous philosopher Aristotle, that humans can become wolves for others, can become "cannibals" in the sense that in certain situations humans can commit acts of violence against others both in physical and psychological forms. One form of violence that has been a serious problem for a long time is gender-based violence, especially against vulnerable groups, namely women. The phenomenon of violence against women is a global issue that continues to be discussed in various forums on a domestic, regional and international scale. Gender-based violence does not only target women, but can also occur in several other groups such as men, transgender or LGBT people. However, statistically, it does happen more to women. Gender-based violence targeting women is an act of terror against women that occurs quite a lot in various parts of the world Online Gender-Based Violence (GBV) has become a global phenomenon that is happening along with the progress and increased access to internet-based communication technologies. This research is a normative legal research that is reinforced with primary data to sharpen analysis. The results show that the forms of gender-based violence against women are cyber grooming, cyber harassment, hacking, illegal content, infringement of privacy, threat of personal photo/video distribution (malicious distribution), online defamation, and online recruitment. Legal protection for women victims of online gender-based violence refers to the regulations stipulated in the PKDRT Law, ITE Law, Child Protection Law, Pornography Law and TPKS Bill.

Abstract

Military Judges may face situations that can limit their freedom and independence, whether from internal or external factors. Institutionally, the legal relationship between judges and superiors can be direct, indirect, involve authority, or be within the organizational structure. Apart from that, in terms of legal substance, there are still several regulations which are considered by some members of the public to be limiting and have the potential to interfere with the independence of Military Judges. In an effort to maintain the independence of judges, judges need to adhere to legal principles, investigate legal facts at trial, and consider factors in a systematic way. The judge's decision, as a result of the Procedural Law, is expected to provide certainty, justice and benefits for all groups.

Abstract

Professional ethics are indispensable in law enforcement, especially for police institutions like Indonesia. Police officers who abuse their authority such as being involved in acts of extortion will get legal consequences and also ethical sanctions along with administrative sanctions. Several factors also cause the police to commit extortion.  The handling of sanctions against police who commit extortion is regulated in the Criminal Code and in addition to getting ethical sanctions, members of the National Police who violate the Police Professional Code of Ethics will also be subject to administrative sanctions as stipulated in the Regulation of the National Police of the Republic of Indonesia Number 7 of 2022 concerning the Professional Code of Ethics and the Code of Ethics Commission of the National Police of the Republic of Indonesia. This research uses the normative juridical method with a statute approach and conceptual approach. Therefore, it is necessary to increase public awareness, training, and clear law enforcement to reduce police officers who commit extortion and to maintain the professionalism of the police force.

Abstract

The Corruption Eradication Commission (KPK) Code of Ethics is a code of conduct that contains an explanation of the basic principles and values of personal behavior that must be implemented by all KPK employees. This code of ethics aims to ensure that KPK employees carry out their duties with integrity, professionalism and independence, as well as building public trust in the Corruption Eradication Committee as a law enforcement agency that is free from influence from any party. There are so many cases of violations of the professional code of ethics committed by KPK individuals in this era, so it is necessary to have fair and binding legal enforcement and sanctions so that violations of the code of ethics, especially the Corruption Eradication Commission (KPK) which has many pillars as a pillar of legal supremacy in Indonesia, do not lose public trust. The research method that the author uses is normative juridical legal writing in writing this article by carrying out a process to identify legal regulations and principles that contribute to solutions to the problems that will be discussed and faced by the author. Law enforcement in violation of the KPK's professional code of ethics which the KPK As a law enforcement agency in Indonesia, It is important to note that the KPK, as a corruption eradication agency, is expected to have high standards of ethics and integrity.

Abstract

Ethics is a value that must be understood and owned by everyone, with ethics, life together can be arranged as we expect. However, in practice, law enforcement in Indonesia still finds problems that distance the law from its main goal of providing justice, certainty, and benefits for the community. This study raises issues related to the relationship between judicial independence and integrity with the enforcement of legal professional ethics, as well as factors that can affect the independence and integrity of the judiciary in court processes. The methods used in this study are normative juridical and literature research, both of which are secondary data collection methods. Then, it can be concluded that judges who uphold the independence and integrity of their judiciary, can show the meaning of legal professional ethics. The relationship between the independence and integrity of the judiciary and the ethics of the legal profession is very close, because independence and integrity are the main conditions for the realization of the rule of law, and are guarantees for the upholding of law and justice.

Abstract

In applying these principles, the participation and function of law enforcement is essential as a defence of justice especially in the awareness of the fundamental rights of the people in the legal context. In practice, however, the law enforcement agencies that are supposed to enforce such legal norms are often unable to avoid unethical practices. The CPC specifically investigates the elite of power involved in corruption crimes carrying out a noble mission to adapt to the realities of public life. Therefore, this study aims to further evaluate the extent to which the authority recipient can play their role by applying the principles in the Code of Ethics of the CPC profession to the legal objectives and code of ethics of a profession that is justice. The method used is qualitative research method of library research or known as library study. This research found that, from the moral code of ethics perspective, some failures in the implementation of professional standards were also seen in cases that occurred in the CPC.
