Abstract

Business competition is competition between competition in carrying out production and marketing activities of goods and services. Competition is a strategy to advance the company by producing good quality products through new discoveries and ways to run a better company. This kind of competition is fair competition, where competition is justified by law and brings profits without harming competition. In addition to fair business competition there is unfair business competition, which is business competition that is carried out not in competition, against the law, and against competition.This type of research can be classified in the type of sociological (empirical) legal research, because in this study the authors directly conduct research at the location or place of study in order to provide a complete and clear picture of the problem under study. This research was conducted at the CA Building Store, while the population and sample were CA Store Owners, Building Stores that sell the same items and Consumers. Data sources used are primary data and secondary data. Data collection techniques in this study were interviews, questionnaires, and literature review.The conclusions that can be obtained from the results of the study are First, the Practice of the Prohibited Agreement in Unfair Business Competition Against the Difference in Price of Stairs in Pekanbaru Building Stores has often happened one of them as did the CA shop. Prohibited agreements are included in the Pricing category, whereby the business actors agree to jointly determine the price of goods / services on the market for the benefit of the business actor. Article 5 Paragraph (1). Abstract

The concept of the rule of law provides rights and obligations to citizens by the state, one of which is guaranteed by the state is the availability of employment for citizens. This can be seen in Article 28 D Paragraph 2 of the 1945 Constitution which states that everyone has the right to work and to receive fair and appropriate compensation and treatment in an employment relationship. Judging from this article, it states that the state must contribute to guarantee citizens for decent work. To support government policies and programs, the government issues government policies and programs in the placement of Indonesian migrant workers abroad.However, in its implementation a lot of legal violations occurred concerning Indonesian Migrant Workers working abroad, such as violating the law in a work agreement or (default). There are many incidents where Indonesian Migrant Workers who flee while doing work cause many service providers to become victims of losses for mistakes made by Indonesian Migrant Workers.The purpose of writing this thesis, namely; First, knowing the responsibility of PT.Herotama Indonusa for migrant workers who have violated the employment contract with the Panasonic refinery, Second; know the nature of the legal consequences of Indonesian Migrant Workers who violate employment contracts.From the results of the study based on two problem formulations can be concluded, First, In the responsibilities carried out by the company PT. Herotama Indonusa to the Panasonic Refinery, PT. Herotama Indonusa must compensate for actions committed by migrant workers. PT. Herotama also had consequences on the blacklist from the refinery so that this was very detrimental to PT. Herotama Indonusa. Second, the implementation of the legal consequences given to the Migrant Workers should be to impose sanctions in accordance with the contents of the employment contract agreement between the Migrant Worker and PT.Herotama Indonusa Company, but in reality the Migrant Worker does not fulfill the contents of the agreement. And also supposedly in Law number 18 of 2017 concerning the Protection of Migrant Workers regulates the obligations of Migrant Workers when committing violations or mistakes related to work contracts.Keywords: Liability-violation-employment contract

Abstract

Economic development requires substantial funds and to meet the needs of the fund established financing institutions that can help such large funding requirements. one of the financial institutions is that channeling funds through the pawn shops pawn system and then to help the government program to help small and medium enterprises, the pawnshops accept collateral with fidusia and based one of which is a Limited Liability Company Pawn (Persero).Fiduciary guarantee the transfer of ownership of an object on the basis of trust with the provision that transferred ownership rights object is retained by the owner, and the fiduciary must register with the registration office fiduciary and Mortgage Company Limited (Persero) branch of Pekanbaru City always register but enactment law also regulates the deletion fiduciary after customers paid off debt and Pawn party never do that. the purpose of this thesis was to determine (1) The write-off (Roya) fiduciary between Mortgage Company Limited (Persero) and customers in the city of Pekanbaru (2) the efforts made Pawn Company Limited (Persero) in addressing the problem of deletion (Roya).This study uses a kind of sociological research the correlation between law and society. This study also uses primary data, secondary data and data tertiary. From the research we concluded that in the application of the write-off (Roya) fiduciary in the financing agreement between the Company Limited Pawn (Persero) and customers in the city of Pekanbaru is not in accordance with the legislation in force despite all fiduciary registered but after debt clients paid off never do deletion (roya). In an effort to overcome the problem of the party Roya Pawn Company Limited (Persero) did not make any effort caused during this time they have never had a problem with not doing it and remain that they can re-enroll the same object even if the certificate has not been done previously deletion (Roya).Keywords: Application - Fiduciary - Roya

Abstract

This study discusses about consumer protection in drinking water services of PDAM Tirta Indragiri Hilir in Indragiri Hilir Regency, consumer protection is all efforts that ensure legal certainty to provide protection to consumers. As an institution that provides public services and also at the same time aims to obtain profits, the Regional Drinking Water Company is required to be able to provide the best service for its customers, by providing customer rights as regulated in Law Number 8 of 1999 concerning Consumer Protection. The PDAM must always improve its services by taking steps both internally and externally to provide legal protection for its customers. The purpose of writing this skipsi is, first, to find out the implementation of the responsibility for the service of PDAM Tirta Indragiri Hilir to the community in Indragiri Hilir Regency, secondly to know the PDAM responsibility towards customers who are disadvantaged by water services by PDAM Tirta Indragiri Hilir. The type of legal research used by the author is a type of sociological legal research that is research that wants to see the correlation between law and society, so as to reveal the effectiveness of the validity of law in society. This research was conducted at the Regional Water Company of Tirta Indragiri Hilir, Indragiri Hilir Regency. Sociological legal research uses primary data and secondary data, while the population and samples are parties related to the problem under study, namely the PDAM Tirta Indragiri Hilir and the community as consumers of PDAM Tirta Indragiri Hilir. The technique of collecting data in this study was library research, interviews and questionnaires. From the results of this study the author concludes that the responsibility of the businessman of PDAM Tirta Indragiri Hilir in providing clean water needs in Indragiri Hilir Regency has not been carried out optimally, the availability and needs of water in Indragiri Hilir Regency are still difficult to do, the form of responsibility carried out by the Actor The business of PDAM Tirta Indragiri Hilir which has caused losses to the community is by installing Pam Plow Meter and Browsing, installing the Water Meter (WM) for the parent and will replace Nseveral subscription Water Meter connections, will cooperate with PT. Setia Mandala Surabaya for water treatment and with PT. Nafarij Jakarta and PT. POS Indonesia (Persero) Tembilhan Post Office to improve the quality of technology- based performance. Abstract

Low awareness and knowledge society as consumers, make the consumer as the object of business activity for businesses to obtain maximize profits in various ways that are not selling well, including the manipulation of prices, selling a defective product as well as reducing measures and weights. The number of consumers who are victims of the reduction measures and weights by traders require governments to provide monitoring and protection. One of the government agencies that play an active role in overseeing businesses and provide consumer protection is the Department of Trade and Industry, through the agency of Legal Metrology Unit oversees a range of activities including business operators regarding the implementation of measures and weights traditional market traders. Consumer protection and supervision to prevent fraud by businesses to the public as consumers.The problems discussed in this thesis is how the protection of consumers conducted Department of Industry and Trade of Pekanbaru to the adoption by the market sellers UTTP Limapuluh and whether the constraints and how the efforts of the Department of Industry and Trade of the City of Pekanbaru to optimize consumer protection for the future.The method used in this research is a kind of sociological research. The nature of this research is descriptive and research done on Limapuluh Market and the Office of Industry and Trade of the City of Pekanbaru. Samples taken in this study as many as 46 people by using purposive sampling method. Source data in this study was obtained through primary and secondary data. Data collection techniques used is through questionnaires, interviews, and literature studies. While data analysis technique using qualitative descriptive analysis.The results showed that the efforts of the Department of Trade and Industry in providing consumer protection related to the implementation of tera UTTP is re-scheduled each year and provide counseling how to do good and honest trade related to the implementation of measures and weights to the market traders Limapuluh Pekanbaru. Constraints experienced by the Department of Industry and Trade is a lack of initiative merchants to make re tera and various characters trader adds to the difficulty to provide an appeal related to fairness in trade transactions. Abstract

Banking transactions can be done without having to come to the bank office, that is with theexistence of technology-based banking services such as telephone, sms, banking, ATM, and thelatest with brokers bank agents branchless banking service which is a service without office by notthrough office network but use information technology in its operations and requires cooperationfrom other parties that is the agent as an arm of the bank to provide banking services to people whodo not know, use and or obtain banking services and other financial services.The research is to know the legal protection for customers against the users of BRI LINKAgent service under the Regulation of the Financial Services Authority Number. 19 / POJK.03 /2014. And know the efforts made by the bank if the customer suffered losses on transactions in theAgent BRI LINK. This type of research is sociological juridical. This research was conducted atseveral BRI LINK Agencies in Pekanbaru City Area, while the population and sample were allparties related to the problem studied in this research, data source used, primary data, secondarydata and tertiary data, data collection technique in research this is by observation, interview andliterature study.Conclusion, First, the Bank must provide protection to its customers, both preventive andrepressive. This preventive protection on Branchless Banking Services, which is obliged to provideinformation in terms of delivery of products services Agent BRI LINK, the imposition ofadministrative costs and even obliged to educate the public and business actors with the aim tounderstand in the use of services Agent BRI LINK While the protection customer in a repressivemanner, the Bank must provide a customer complaint scheme. Secondly, while legal protection forBRI LINK Agent agent can only be realized with the participation of various parties. Abstract

Consumer protection is any effort that ensures the legal certainty to provide protection to the consumer. One of the ideals of the struggle of the Indonesian nation is the realization of a just and prosperous society based on Pancasila and the 1945 Constitution in line with national development objectives is to realize the welfare of the birth and the inner for all the people of Indonesia in a fair and equitable. One of the basic elements of people's welfare is the fulfillment of housing needs, which is a basic necessity for every Indonesian citizen and his family, in accordance with his dignity and human dignity. To meet the needs of good and livable housing, people buy homes through developers (developers) housing. Various offers are made by the developer to promote and market their products. In general, residential marketing is done by means of advertising means or brochures as a means of communicating products created and / or marketed by the developer to introduce or disseminate information from the product that the developer has created. The advertisement through the brochure, as well as to attract consumers to buy products in the trade, in this case is housing.namun still many developers are cheating in offering products through brochures not in accordance with the truth, this is clearly violate the Consumer Protection Act namely Law No. 8 of 1999 on Consumer Protection and violated Article 134 of Law No. 1 of 2011 on Housing and Settlement Area. The purpose of this thesis writing so that Consumers are more careful and thorough in buying housing that will in hini, as well as warning for housing developers who have violated the rights of consumers. Abstract

Law Number 22 Year 2009 on Traffic and Road Transport (LLAJ), is the legal basis that it is not allowed to withdraw levies of overload. So there needs to be the responsibility of business actors to the excess weight of transport on cement transport Padang PT. Business World Dumai City, which became one of the problems that have a major impact on the smooth flow of traffic. Therefore, the purpose of writing this thesis, namely: First, how the implementation of the responsibility of business actors on the transport of goods that are overloaded hauling, Secondly, What is the legal consequences for the transporting business that transports more than the weight of transport, Third, how the efforts of the government in to curb business actors who exceed the weight of freight.This type of research can be classified in the type of sociological legal research that is the study of the effectiveness of the current law. In this case the authors do research on the implementation in the transportation of goods by land. This research was conducted in Dumai City. Populations and samples are Business actors who use cargo trucks as a means of land transportation, Trucking entrepreneurs use cargo trucks in Dumai City as freight services, and drivers as truckers carrying truckloads that exceed the capacity of cargo.The conclusion that can be obtained from the results of the research is Firstly, the implementation of the responsibility of the business actors on the transportation of goods that are overweight of transport has not been suitable as a whole. Secondly, the legal consequences for the transporting business that transports more than the weight of the transporter should be imposed administrative sanctions and sanctions but the legal consequences have not been implemented properly. Abstract

The process of resolving disputes through mediation is emphasized in the deliberations oragreements of the parties, so that there is no element of coercion between the parties and mediators, theparties request voluntarily to the mediator to help resolve the conflict. Therefore, a mediator domiciledhelps the parties to reach an agreement that can only be decided by the parties to the dispute. The mediatoris an employee of a government agency responsible for the field of labor who fulfills the requirements as amediator determined by the Minister to carry out mediation and has the obligation to provide written adviceto the disputing parties to resolve rights disputes, interest disputes, termination of disputes, and disputesbetween trade unions / labor unions in only one company.From the results of the research that the authors did, it can be concluded that the stages ofmediation at the Office of Social Services, Manpower and Transmigration in Rokan Hulu Regency were inthe stage of recording disputes, determining mediators to handle cases and research case files inaccordance with procedures stipulated by Law Number 2 of 2004 regarding Industrial Relations Disputes,but in the next stage, the calling of the parties is not in accordance with the provisions of the Law, namelymediators calling parties only through telephone calls which should be regulated by the parties sent aninvitation letter to attend the mediation session. Second, efforts that can be made to resolve industrialrelations disputes in the Social Service, Manpower and Transmigration Office of Rokan Hulu Regency canbe efficient and effective by increasing the trust of the parties to the mediator, increasing the number ofmediators and increasing the mediator's abilities and expertise, and making space a special session formediation that is clean and adequate.Keywords: Mediation - Disputes - Termination of Employment.

Abstract

3 Kilograms of LPG gas is an essential requirement for supporting the life of every community. The distribution of 3 Kilogram LPG gas is carried out by the private sector, which is the agent of the arm of the first party, the principal. The agent and sub-agent cooperate on the basis of the agreement made. 3 Kilograms of gas that were distributed to the base were aimed at people in need. In Article 1313 of the Civil Code, an agreement is an act whereby one or more people bind themselves to one or more people. The agreement made between the base and the agent is a standard cooperation agreement. The agreement that has been agreed must be carried out as well as possible. If the parties do not run it well, there will be losses for those who carry out their achievements. The problems and objectives that will be discussed in this thesis are to determine the implementation of the 3 Kilogram LPG distribution agreement between PT. Valery Family Sejahtera and Pangkalan UD. Maju Jaya in Pekanbaru City.This type of research is sociological, because in this study the author directly conducts research at the location or place under study in order to provide a complete and clear picture of the problem under study. This research was conducted at Pangakalan UD. Maju Jaya and PT. Valery Family Sejahtera in Pekanbaru City, while the population and sample are all parties related to the problems studied in this study, the data sources used, primary data and secondary data, data collection techniques in this study with interviews, questionnaires and literature study.The results of the study concluded that the implementation of the agreement between PT. Valery Family Sejahtera based on UD. Maju Jaya in the distribution of 3 Kilogram LPG gas has not been carried out properly.
