Abstract

This article analyzes the role of Bhabinkamtibmas in making problem solving efforts by prioritizing mediation. The purpose of writing this article is the problem solving techniques of the Habibinkamtibmas in mediating married couples who experience domestic conflicts. In addition, to reveal the obstacles faced when mediating, because when making efforts to assist there are challenges from the parties that are difficult to make peace. This type of research is fielresearch, which is a type of field research, conducted in Mulyosari Village, West Metro Subdistrict, Metro City. The fielresearch was analyzed qualitatively. This research approach was analyzed using a case study approach. The result of the research is the problem solving of the Habibinkamtibmas in mediating domestic problems taken by Aibda Ali Iqbal by taking several steps, namely dissecting the siting of the case that occurred then making observations and then implementing the best solution for the parties, the result of mediation is that both parties take the peaceful path. Meanwhile, the obstacle in conducting mediation is the unanimous determination of the married couple to divorce. In addition, the litigants feel reluctant to reconcile, due to the trauma factor of the events that occurred in their household. If peaceful efforts reach a dead end, then Bhabinkamtibmas' efforts are to take repressive measures both criminally and civilly.Keywords: Problem Solving, Bhabinkamtibmas, Media, Household Problems

Abstract

This article discusses the application of kejawen science in marriage. The purpose of writing this article is why some Javanese people still believe and practice kejawen science, especially in marriage, whether kejawen science has an impact on household harmony. Type of qualitative article, object of research in Kotabaru Village, Central Lampung, phenomenological study approach method, primary data sources are parents of married couples, religious leaders and community leaders. Data collection techniques through observation, interviews and documentation. The results showed that the Javanese community still believes and applies kejawen science in marriage. The reason is that it is believed that married couples have different wetons, have conflicting characters and traits, so the implication is that marriage is full of conflict and ends in divorce. Believing in Islamic divination is contradictory and forbidden for the reason of polytheism.Keywords: Kejawen Science, Marriage, Household Harmony.

Abstract

This research discusses community empowerment in the use of cassava leaves to make processed food in the form of beef jerky. This community empowerment was carried out together with the Women's Farming Community in Jatidatar Village, Mataram. This mentoring program aims to enable people to gain skills and theoretical understanding in processing cassava leaves into beef jerky and how to package them into products that have selling value and can market the products that have been produced through social media. Apart from that, by using cassava leaves, the community will get a solution in utilizing the abundant cassava plants and in improving the community's economy. The focus of this article's study is How does empowering cassava leaf jerky increase MSMEs in Jatidatar village, Mataram and product marketing through digital marketing? The service research method or strategy used in this program is the Asset-Based Community Development (ABCD) method. The ABCD method is a community service approach that is oriented towards providing the community with the power to recognize and utilize all the advantages and assets it has for the benefit of the community. The results of this research are that the assisted communities can independently make beef jerky from processed cassava leaves which is nutritious and has sales value. The assisted community can market the products produced through social media and the products from this assistance can be marketed widely so that they can increase MSMEs in Jatidatar Village.

Abstract

Abstract: Indonesia has provided the institution in charge of marriage registration. However, the registration process does not always run effectively for a particular community. This article sheds light on the existence and obstacle of marriage registration faced by the followers of Sapta Darma belief in East Lampung. Data were collected through observation, documentation, and interview. Using a socio-legal lens, this article identifies consecutive facts impeding followers of the Sapta Darma belief in East Lampung from obtaining the legality of their marriages through state institutions. The organization of Sapta Darma believers has no internal institution which especially in charge of registering their marriage. They seem trapped and face a disproportionately negative stigma. Many of them do not have identity cards (KTP) as the basic term for the registration process. However, they continue to believe that their marriages are valid according to their faith and do not violate state law.Abstract: Indonesia telah menyediakan lembaga yang bertanggung jawab atas pendaftaran pernikahan. Namun demikian, proses pendaftaran pernikahan tidak selalu berjalan efektif untuk komunitas tertentu. Artikel ini bertujuan untuk menjelaskan keberadaan dan hambatan pendaftaran pernikahan yang dihadapi oleh para pengikut Sapta Darma di Lampung Timur. Data dikumpulkan melalui pengamatan, dokumentasi, dan wawancara. Menggunakan lensa sosio-hukum, artikel ini mengidentifikasi fakta berturut-turut yang menghambat pengikut kepercayaan Sapta Darma di Lampung Timur untuk mendapatkan legalitas pernikahan mereka melalui lembaga negara. Organisasi Sapta Darma tidak memiliki institusi internal yang terutama bertugas mendaftarkan pernikahan mereka. Mereka tampak terjebak dan menghadapi stigma negatif yang tidak proporsional. Banyak dari mereka tidak memiliki kartu tanda penduduk (KTP) sebagai persyaratan dasar untuk pendaftaran pernikahan mereka. Namun demikian, mereka tetap percaya bahwa pernikahan mereka sah menurut keyakinan mereka dan tidak melanggar hukum negara.

Abstract

This study aims to explore the social perception of the Lampung Pepadun indigenous community regarding the ownership of sesan following divorce due to infidelity. Sesan refers to household goods provided by the bride’s family in traditional marriages, serving symbolic, social, and cultural functions. Employing a qualitative approach and case study method in Nabang Baru Village, Marga Tiga District, this research investigates family deliberation dynamics, gender relations, and value shifts in post-divorce sesan distribution. The findings reveal that in infidelity cases, the wife’s family assumes authority over the sesan without formal involvement of customary leaders. Family deliberation becomes the primary mechanism to uphold social justice, with the sesan redirected to the child as a moral responsibility. Pepadun custom in this context shows flexibility it is not rigid, but remains alive through social negotiation. Women emerge as active agents defending rights and family dignity. The study concludes that the indigenous social system is not static but adaptive to the realities of domestic conflict, emphasizing moral legitimacy and community-based justice through deliberative practices. Abstract

In Indonesia, women still suffer discrimination and injustice. This is supported by the persistence of gender-biased laws not giving the protection of the rights of women, such as Law No. 1 of 1974 about Marriage. Women's issues that was settled in the line of traditional Islamic law (classical) tending to be conservative and literal in understanding religious messages and doctrines, such as the patriarchal culture which puts women as beings lower position than men. Patriarchal culture which is done with legism legalized legislation in its application to the gender bias that is highly detrimental for women. The marginalization of women then occurs and is caused by the differences and gender inequalities that cause woman discomfort and not free. Therefore, all forms of injustice is a violation to Human Rights (HAM), a crime against human dignity and a form of discrimination that must be abolished.[Di Indonesia, perempuan masih mengalami diskriminasi dan ketidakadilan. Hal ini didukung oleh masih adanya undang-undang bias gender yang belum memberikan perlindungan terhadap hak-hak perempuan, seperti UU No.1 Tahun 1974 tentang Perkawinan. Isu-isu perempuan yang dimapankan di dalam UU tersebut sejalan Islam tradisional (klasik) yang cenderung konservatif dan literal dalam memahami pesan-pesan keagamaan dan doktrin-doktrin yang ada, seperti budaya patriarkhis, yang menempatkan perempuan sebagai makhluk yang lebih rendah kedudukannya dari pada laki-laki. Budaya patriarkhis yang dilakukan dengan kecenderungan legisme itu telah melegalisir peraturan perundang-undangan bias gender ke dalam penerapannya yang sangat merugikan perempuan. Marginalisasi perempuan kemudian terjadi dan disebabkan oleh perbedaan  dan ketidakadilan gender yang menyebabkan ketidaknyamanan serta terbelenggunya kebebasan perempuan. Karena itu, segala bentuk ketidakadilan merupakan pelanggaran Hak Asasi Manusia (HAM), kajahatan terhadap martabat kemanusiaan dan bentuk diskriminasi yang wajib dihapuskan.]

Abstract

As part of reformation outcomes, the substitute heir in Islamic inheritance law has been long heeded by Indonesian jurists. However, amidst the facet of the traditional scheme, Indonesian Religious Court judges (judex factie) have not shared the same implementation of this succession. This article endeavors to examine the practice of substitute heir in the field. Relies on the Religious Court decisions as the primary source, this article argues that the norm of substitute heir (Article 185 of The Compilation of Islamic Law) has been implemented restrictedly according to The Compilation and the Supreme Court consensus. Restricted interpretation means the descendants of the pre-deceased side-relative was not accounted as substitute heir. It implies that the state reformation attempt in Islamic inheritance law has not come into play in the way the state desires.[Sebagai bagian dari hasil reformasi, substitute heir dalam hukum waris Islam telah lama diperhatikan oleh para ahli hukum Indonesia. Namun, di tengah sisi skema tradisional, hakim Pengadilan Agama Indonesia (judex factie) belum memiliki kesamaan pelaksanaan suksesi ini. Artikel ini mencoba mengkaji praktek penerapan substitute heir di lapangan. Berpijak pada putusan Pengadilan Agama sebagai sumber data utama, artikel ini berargumen bahwa norma ahli waris pengganti (Pasal 185 Kompilasi Hukum Islam) telah dilaksanakan secara terbatas menurut Kompilasi dan konsensus Mahkamah Agung. Penafsiran terbatas berarti keturunan dari kerabat menyamping yang telah meninggal dunia terlebih dahulu tidak diperhitungkan sebagai ahli waris pengganti. Abstract

Background This article departs from concern about the high violation of children's rights in Indonesia, particularly children in conflict with the law (child in conflict with the law), either as witnesses, victims or perpetrators of crime. In this article, focusing on the study of the question of the juvenile criminal justice system, namely Law. No. 11 of 2012 on the Criminal Justice System Child (Law SPPA), which still left many problems so that justice and the rights of children difficult to materialize. However, it should be realized that the product legislation is the result of a political compromise so much criticism even guguatan shown in SPPA law shortly after enactment. Although, on the other hand the Act SPPA lot of progress compared to the previous juvenile justice law. Therefore, in this article that will be studied is what are the issues in the Act SPPA and how efforts to optimize the Act SPPA in justice and human rights protection for children in Indonesia against the law.
