Abstract

Purpose: This study aims to analyze the interaction between civil law settlements and criminal law settlements in the Indonesian military justice system, focusing on the implications of Military Court Decision I-05 Pontianak Number 46K/PM. I-05/AD/IX/2021. This study explores the complexity of overlapping jurisdictions and their effects on the rights and obligations of the parties involved. Research Methodology: The research method used is a conceptual approach with a normative analysis of laws and regulations, relevant legal practices, and library research. The conceptual approach is intended to analyze legal materials so that the meaning contained in legal terms can be understood. Results: The findings show that criminal proceedings significantly influence civil dispute resolution, particularly in determining liability and shaping civil court decisions. Conversely, the outcomes of civil cases may also affect criminal proceedings when overlapping elements exist. This case study demonstrates how fraud rooted in debt relations blurs the boundaries between civil and criminal domains, creating legal uncertainty. Conclusions: There is a strong need for harmonization and coordination between civil and criminal legal systems to prevent overlapping jurisdictions and ensure fairness. Integrating compensation claims into criminal trials can provide more efficient and comprehensive justice. Limitations: This study is limited to a single military court decision, which may restrict generalization to other jurisdictions and legal contexts. Contribution: This research contributes to legal scholarship by clarifying the interaction between civil and criminal dispute resolution and offers practical recommendations for policymakers, military judges, and practitioners to strengthen legal certainty and justice in Indonesia’s dual legal system.

Ragam bahasa ilmiah yang di gunakan dalam karya tulis ilmiah harus mengikuti kaidah tata bahasa Indonesia dan pedoman ejaan bahasa Indonesia yang di sempurnakan. Tujuan ini adalah mendeskripsikan ciri-ciri bahasa ilmiah dalam karya tulis ilmiah, khususnya artikel ilmiah, serta melihat implementasi penggunaan tata bahasa Indonesia dalam artikel ilmiah. Sebagai alat bantu untuk yang ditetapkan oleh pusat Bahasa Indonesia, yaitu Tata Bahasa Hasil pengamatan menunjukan bahwa dalam artikel ilmiah masih ditemui penggunaan bahasa yang tidak sesuai dengan standar aturan berbahasa Indonesia

Abstract

Di pesisir-pesisir kepulauan Indonesia, kesejahteraan nelayan perikanan skala kecil praktis tidak banyak berubah dari waktu ke waktu, padahal porsi produksi perikanan skala kecil adalah cukup signifikan. Dalam Policy Brief ini disampaikan potret nelayan perikanan skala kecil, harga ikan yang adil dan akses pasar dan teknologi, upaya peningkatan kesejahteraan mereka selama ini, dan beberapa implikasi dan rekomendasi terobosan kebijakan yang dapat memperbaiki situasi yang sudah berlangsung sejak lama agar kesejahteraan nelayan perikanan skala kecil dapat meningkat.

Abstract

Sektor kemaritiman telah berkontribusi dalam pembangunan nasional melalui berbagai komoditas, antara lain perikanan, minyak dan gas, serta dalam bentuk penyediaan jasa lingkungan laut seperti transportasi laut dan wisata bahari. Namun, proporsi kontribusinya dalam pembangunan nasional masih relatif kecil. Dalam Policy Brief ini diuraikan mengapa literasi maritim perlu mendapat perhatian, urgensi dan nilai strategisnya, serta didiskusikan mengapa literasi maritim adalah landasan bagi pembangunan Negara Kepulauan seperti Indonesia. Selanjutnya, disampaikan implikasi dan rekomendasi kebijakan peningkatan literasi maritim.

Abstract

An ethics-based information security system based on Immanuel Kant's transcendental legal paradigm can give a strong foundation for tackling moral quandaries in AI, hacking, and information systems. Lavanya Singh highlights the necessity of instinctive ethics based on philosophical literature and presents a Kantian ethics application that adheres to the philosophical tradition. Meanwhile, Sanchita Saha et al. address ethical hacking as a method of disclosing vulnerabilities in information systems for the benefit of society, emphasizing ethical concerns in cybersecurity operations. Furthermore, Flávia Maria Santoro and Rosa Maria Esteves Moreira da Costa underline the significance of examining information systems via an ethical lens in order to negotiate conceptual conflicts and make informed judgments in delicate situations, which is consistent with Kant's moral philosophy. Using doctrinal research methodologies with legal material sources derived from literature studies and qualitative descriptive analysis. This study discovered that by incorporating Kant's concepts into information security systems, the transcendental legal paradigm may guide ethical decision making and promote responsible technological advancement. The Ethics-Based Information Security Systems Act, modeled after Immanuel Kant's Transcendental Paradigm, would prioritize universal ethical principles, respect for human autonomy, duty-bound behaviors, transparency, accountability, and a structured regulatory framework. The law will guarantee that information security is maintained not just through technological means, but also via a solid ethical foundation that respects the dignity and rights of all those concerned.

Abstract

ABSTRACT Purpose of the Study: This paper aims to analyze the judicial consideration of judges in Decision No. 273/Pdt.g/2021/PA.Bkt from the perspective of benefit and justice for all parties in the murabahah and its legal consequences.  Methodology: This research used the literature review method. It used the descriptive qualitative analysis, which was conducted by profoundly reading the decision, analyzing the case, examining the appropriateness of the legal basis, and how to define them. Results: The legal considerations of judges in Decision No. 273/Pdt.g/2021/PA.Bkt are: (1) the resolution of disputes on sharia economy is the absolute authority of the Religious Court; (2) the judge assembly must maintain the legal interests and rights of the plaintiff from the actions of the defendant to undergo an auction, as well as avoiding the losses and harm that may befall the plaintiff; (3) there was an emphasis on good intentions, benefit, and justice for all parties but the judges punished the defendant to undergo rescheduling, restructuring, and reconditioning. Applications of this study: It can inspire judges to create legal reasoning that supports the aspect of legal certainty. It can inspire banks and customers to emphasize the aspects of good intention, benefit, and justice in implementing contracts. Novelty/ Originality of this study: It explained the legal consideration of judges that emphasized the aspect of mediation through contract renegotiation based on the positive law and relevant sharia principles. Keywords: Judicial consideration, murabahah contracts, banks, good intention, benefit, justice.  ABSTRAK  Tujuan: Tulisan ini bertujuan untuk menganalisis pertimbangan yuridis hakim dalam Putusan No. 273/Pdt.g/2021/PA.Bkt dari perspektif kemanfaatan dan keadilan bagi semua pihak dalam murabahah dan akibat hukumnya.  Metodologi: Penelitian ini menggunakan metode literature review. Analisis yang digunakan adalah deskriptif kualitatif, yang dilakukan dengan membaca putusan secara mendalam, menganalisis kasus, memeriksa kesesuaian dasar hukum, dan bagaimana mendefinisikannya.  Hasil: Pertimbangan hukum hakim dalam Putusan Nomor 273/Pdt.g/2021/PA.Bkt adalah: (1) penyelesaian sengketa ekonomi syariah merupakan kewenangan mutlak Peradilan Agama; (2) majelis hakim harus menjaga kepentingan hukum dan hak penggugat dari tindakan tergugat untuk menjalani lelang, serta menghindari kerugian dan kerugian yang mungkin menimpa penggugat; (3) ada penekanan pada itikad baik, kemanfaatan, dan keadilan bagi semua pihak tetapi hakim menghukum terdakwa dengan penjadwalan ulang, penataan ulang, dan rekondisi.   Aplikasi penelitian ini: Dapat menginspirasi hakim untuk menciptakan penalaran hukum yang mendukung aspek kepastian hukum. Hal tersebut dapat menggugah bank dan nasabah untuk mengedepankan aspek itikad baik, manfaat, dan keadilan dalam pelaksanaan kontrak.  Kebaruan/Orisinalitas: Dijelaskan pertimbangan hukum hakim yang menekankan aspek mediasi melalui renegosiasi kontrak berdasarkan hukum positif dan prinsip syariah yang relevan.  Kata kunci: akad murabahah, bank, itikad baik, kemanfaatan, keadilan

Abstract

Penelitian ini bertujuan untuk mengeksplorasi upaya yang dilakukan oleh lingkungan keluarga dan sekolah dalam mendukung perkembangan kemampuan anak berkebutuhan khusus. Menggunakan pendekatan kualitatif dengan metode wawancara mendalam dan focus interview, penelitian ini melibatkan siswa, guru, dan tenaga pendukung yang berinteraksi langsung dengan anak berkebutuhan khusus di SD Negeri Pisangan Timur 11. Hasil penelitian menunjukkan bahwa dukungan emosional dan psikologis dari keluarga sangat berpengaruh terhadap kepercayaan diri dan adaptasi sosial anak. Selain itu, sekolah yang inklusif dan menyediakan program pendidikan yang adaptif serta guru yang terlatih mampu memberikan dampak positif yang signifikan terhadap kemampuan akademik dan sosial anak berkebutuhan khusus. Namun, penelitian ini juga mengidentifikasi beberapa tantangan utama, termasuk kurangnya sumber daya, pelatihan yang kurang memadai untuk guru, dan stigma sosial. Penelitian ini menyimpulkan bahwa sinergi antara lingkungan keluarga dan sekolah sangat penting untuk mendukung perkembangan anak berkebutuhan khusus. Upaya bersama dari kedua lingkungan ini dapat membantu anak-anak tersebut mencapai potensi penuh mereka, baik dalam bidang akademik maupun sosial, meskipun dengan berbagai keterbatasan yang mereka miliki.

Abstract

Covid-19 is a virus that attacks the lungs so that a person will experience breathing problems. The effect caused by the virus is the thickening of the fluid in the lungs, causing the sufferer to experience difficulty in breathing. This service aim is to socialize and educate the role of ventilators as a medical support tool for COVID-19 patients the general public, students, and Medical staff through webinars. The method used is to provide material online through the Zoom meeting application which is attended by 100 participants using the Zoom application. The results obtained were an increased understanding of the COVID-19 virus and understanding of the functions and benefits of ventilators used for patients as measured based on the pre-test at the start of the webinar with an average value of 63.58 and the post-test held at the end of the webinar with an average value -an average of 91.18 with an increase in understanding of 30.27%. The community is very interested in the material presented and hopes that there will be a continuation of the webinar with other topics.

Abstract

This research aimed to assess the educational abilities of teachers in terms of planning learning activities, implementing the teaching process, and making efforts to increase student motivation in learning. The research employed a qualitative approach to gather data through interviews, observations, and document collection. The data analysis process encompassed information reduction, data presentation, and conclusion. The subjects who became informants were the principal, his deputy, and educators. The results indicate that educators’ pedagogical expertise in compiling learning activities is evident in their preparation of the lesson plan. However, several teachers often do not bring it, so the learning objectives are not achieved optimally. When learning, teachers demonstrate an understanding of the material by studying the textbook’s contents. However, problems still exist in class management, and there is a lack of discipline regarding time usage. To increase students' enthusiasm for learning, teachers create opportunities for active participation by utilizing information and communication technology, establishing effective communication with them, and conducting reflection to enhance the quality of learning.

Abstract

The rapid advancement of technology in the contemporary era has inspired individuals to contemplate more efficient and appropriate technologies, that potentially offer substantial benefits for many applications. Among these progressive technologies are the Internet of Things (IoT) and Cyber-Physical Systems (CPS). This research aims to develop a cyber-physical system for the supervision and regulation of refrigeration systems for fishing vessels via smartphones. This approach is seamlessly integrated into the fishing industry to enhance operational efficiency and optimize the preservation of fishery products. We have successfully applied IoT and CPS technologies for effective monitoring and control of the refrigeration system. In evaluating the accuracy of this application, two sensors were employed for analysis, specifically the primary temperature sensor and the reference temperature sensor. The principal yardstick for assessing measurement accuracy in this research is the standard deviation in sensor readings. The research findings reveal that the measured data from the primary temperature sensor and reference temperature sensor demonstrates a minimal standard deviation, signifying a high level of measurement precision. The expected outcome of implementing this system is the capability to regulate and monitor the refrigeration system, thus enabling fishermen to minimize losses in the fishery production process and elevate the quality of fishery products.
