Abstract

The discourse on investment is important to discuss. This relates to the Islamic investment model in Indonesia being below conventional investment, both in terms of quality and amount of capital and market share. Therefore, if conventional investments are regarded as haram according to Islamic law, this could have a negative impact on the image of the conventional investment market in the future. The purpose of this study is to re-clarify the understanding of investment law in Islam, particularly in the context of conventional investments. In the preparation of the paper, the author uses a descriptive-analytical approach to re-evaluate the law of investment in Islam. The results of this study conclude that although investments that promise huge profits with minimal effort are considered a reasonable practice and can be done because they have become common in society, from the perspective of financial goodness, this can disrupt financial stability, both for investors and in terms of currency value stability (volatility). Although these investment ventures initially originate from real and halal activities, if they are then sold using the derivatives market sales method, they will contain elements of usury, speculation, and uncertainty which are prohibited in some sharia laws because they do not produce good in the context of investing in accordance with Islamic teachings.

Abstract

Abstract

This study aims to analyze the implementation of professional waqf at Pondok Modern Darussalam Gontor for Girl from the perspective of Maqasid al-Syariah. Professional waqf is understood as a form of empowerment of individual skills potential that are donated for the benefit of education, da'wah, and community development. This study seeks to explore how the principles of Islamic law and the objectives of sharia (maqasid), especially hifz al-'aql, hifz al-nafs, and hifz al-māl are actualized in the practice of managing and implementing professional waqf in the Islamic boarding school environment. This study uses a qualitative approach with a descriptive-analytical research type. Data were collected through in-depth interviews with caretakers, waqf managers, and teachers as actors in professional waqf, as well as a documentary study of the internal regulations of the Islamic boarding school and literature related to waqf law. Data analysis was carried out through the stages of reduction, presentation, and drawing conclusions with verification of Islamic legal theory and the concept of maqasid al-Sharia as an analytical framework. The research results show that the implementation of professional waqf at Pondok Modern Darussalam Gontor for Girls reflects the principles of maqasid al-sharia through professional service oriented towards the welfare of the community, educational sustainability, and institutional independence. Abstract

Maqāṣid al-sharī‘ah has not only been understood as a normative concept within ushul al-fiqh, but has also undergone a paradigmatic evolution into a methodological approach for addressing contemporary legal and social issues. This article aims to examine the evolution of the maqāṣid al-sharī‘ah paradigm from both historical and systematic perspectives, beginning with its conceptual roots in the classical tradition of ushul al-fiqh, its emergence as an independent scholarly discipline, and its subsequent transformation into a methodological framework in the development of modern Islamic law. This study employed a qualitative method using a library research approach, drawing upon primary and secondary sources from both classical and contemporary literature. Data analysis was conducted through descriptive-analytical, historical, and conceptual methods. The findings indicate that maqāṣid al-sharī‘ah has developed gradually, reaching its peak of systematic formulation in the thought of Imam al-Shatibi, and later expanding significantly in the modern era through the contributions of contemporary scholars. The paradigmatic evolution of maqāṣid al-sharī‘ah has proceeded through four principal stages: its implicit presence in scriptural texts (nusūs) and in the understanding of the early Muslim generations (al-salaf); its integration into the studies of fiqh and ushul al-fiqh; its establishment as an independent scholarly discipline; and its application as an approach to addressing various contemporary issues. The conclusion of this article affirms that the transformation of maqāṣid al-sharī‘ah from a concept within ushul al-fiqh into a methodological approach strengthens its relevance as an instrument for the renewal of Islamic law, making it responsive to contemporary challenges.

Abstract

As a Muslim entrepreneur, it is obligatory to avoid anything that may cause harm or lead to misconduct in human life. Propertys Yogyakarta, as a provider of rental services for lighting and sound systems, sometimes assists and accepts in the organization of events that may lead to misconduct or damage when the events are held. The purpose of this research is to examine how the principles of Maqashid Shariah relate to the events served by Propertys, whether they comply with Maqashid Shariah or not. This study employs a descriptive qualitative research method, using both primary and secondary data sources. It involves field research with observation, interviews, and documentation as data collection techniques. The findings reveal that Propertys Yogyakarta utilizes the ijarah contract in accepting and servicing various types of events while rejecting events or productions that pose a risk of material loss and endanger the safety of the Propertys Yogyakarta team. However, in its service, Propertys does not provide specific provisions regarding the preservation and maintenance of Islamic values in events. The conclusion of this research indicates that there are still some events or activities accepted and served by Propertys Yogyakarta that may cause harmful consequences (mafsadat) which should be rejected in order to preserve and maintain the Maqashid Shariah in terms of preserving religion and wealth.

Abstract

This study discusses the Background of the Problem In fulfilling their needs, humans are governed by laws that have been determined by Allah SWT. Law in Islam is a rule relating to the relationship between individuals and other individuals, as well as individuals and their creator. Therefore, Allah SWT reminds us that in fulfilling their needs, humans do not harm each other, in this case exchanging needs between members of society is a fair way. The rules of Allah that are unified and codified in the fiqh of mu'amalah cover several aspects of economic activities, one of which is buying and selling (al-ba'i). Buying and selling or referred to as Bai' is the exchange of property for property on the basis of mutual consent, or transferring property with a justified exchange. According to Sulaiman al-Asyqar, buying and selling is the exchange of property for property, or benefits for benefits in the form of transferring ownership and ownership. The term down payment is also known as DP (Down of Payment), advance payment, or down payment. In Indonesia this is regulated in Article 1464 of the Civil Code. The payment of a down payment or down payment in a buying and selling transaction is known by fiqh scholars as ba'i 'urbun. Ba'i 'urbun is a down payment paid by the buyer which shows that he is serious about his order. If the buyer then agrees on the ordered goods, a sale and purchase transaction is formed and the down payment is part of the agreed price of the ordered goods (assets). If the buyer later refuses to purchase the order, then the down payment is forfeited and becomes the property of the seller. Abstract

Dropshipping is a growing digital business model in e-commerce. However, from an Islamic economic perspective, this system creates legal dilemmas related to product ownership and contract transparency. This study aims to analyze the relevance of Yusuf Al-Qaradawi's maqashid sharia to the dropshipping concept to determine whether this business model complies with Islamic economic principles. The research method used is a qualitative approach based on literature review, with deductive and comparative analysis of maqashid sharia. The results show that dropshipping can be implemented in Islamic economics, provided there is clarity in the contract, transparency of information, and protection of consumer rights to avoid gharar. Therefore, clearer sharia regulations are needed for dropshipping practices to ensure compliance with maqashid sharia.
