Abstract

Ketenagakerjaan merupakan salah satu sektor yang sangat penting dalam perekonomian suatu negara. Dalam sistem ekonomi modern, pekerja menjadi elemen utama yang mendukung keberlangsungan suatu perusahaan atau organisasi. Metode yang digunakan oleh penulis dalam penulisan artikel ini adalah metode penelitian hukum normatif. Hal ini dikarenakan artikel ini banyak mengacu pada aturan-aturan hukum, prinsip-prinsip hukum, dan doktrin-doktrin hukum yang diperlukan untuk membahas topik hukum yang diangkat. Secara yuridis, Pasal 5 Undang-Undang Ketenagakerjaan memberikan penjelasan bahwa hukum Indonesia telah menjamin perlindungan bagi setiap tenaga kerja untuk mendapatkan hak yang sama dan kesempatan yang setara untuk memperoleh pekerjaan dan penghidupan yang layak, tanpa memandang jenis kelamin, suku, ras, agama, atau pandangan politik, termasuk perlakuan yang setara terhadap penyandang disabilitas. Pasal 6 mengatur kewajiban pengusaha untuk memberikan hak-hak pekerja tanpa diskriminasi.

Abstract

Kemajuan teknologi telah menggeser banyak aktivitas tradisional, termasuk perdagangan, ke platform digital. Meskipun transisi ini membawa manfaat seperti kemudahan transaksi dan efisiensi waktu, hal ini juga memperkenalkan risiko, terutama pada sistem binary options. Binary options telah dinyatakan sebagai investasi ilegal dan perjudian online oleh Bappebti, yang menyebabkan kerugian finansial yang signifikan. Afiliasi yang mempromosikan platform ini, seperti Indra Kenz, terkait dengan aktivitas kriminal, termasuk penipuan dan pencucian uang. Dengan menggunakan taktik seperti placement, layering, dan integration, mereka menyembunyikan hasil ilegal agar tampak sah. Penelitian ini bertujuan untuk mengkaji legalitas binary options pada platform perdagangan serta hubungannya dengan tindak pidana pencucian uang. Melalui pendekatan yuridis normatif dengan metode perundang-undangan, data primer, sekunder, dan tersier dianalisis secara kualitatif untuk mengidentifikasi tindak pidana asal. Hasil penelitian menunjukkan bahwa afiliasi binary options dapat dijerat dengan pasal-pasal penipuan dan perjudian, termasuk Pasal 378 KUHP, Pasal 303 Ayat (1) KUHP, dan Pasal 28 Ayat (1) Undang-Undang Nomor 19 Tahun 2016 tentang ITE. Studi ini menyoroti perlunya regulasi yang lebih ketat dan pendekatan yang lebih rinci untuk mengatasi modus operandi afiliasi binary options, guna memastikan penegakan hukum yang lebih baik dan pencegahan kejahatan semacam ini.

Abstract

Sexual violence against children is an urgent issue that has become a global concern, including in Indonesia. Although the Indonesian government has issued various policies and regulations to address this issue, implementing the policies and regulations still faces significant obstacles. These include the establishment of a Regional Technical Service Unit for the Protection of Women and Children (UPTD PPA), training programs for relevant institutions, and educational campaigns for the prevention of sexual violence against children. However, the prevalence of sexual violence against children remains alarmingly high, with over 11,000 cases reported in 2022. The main factors contributing to the high rate of child sexual abuse are weak law enforcement, lack of coordination between institutions, and cultural barriers that hinder understanding and education about child protection. Additionally, resistance to implementing the Child Protection Law highlights the gap between policy formulation and practical law enforcement. In order to minimize the incidence of sexual violence against children, this study emphasizes the necessity of greater collaboration among the society, non-governmental organizations (NGOs), the private sector, and the government. The research further highlights the need to raise awareness of the significance of children's rights and sexual violence prevention. Key recommendations include strengthening the implementation of the policies and regulations, improving law enforcement, and enhancing the capacity of law enforcement institutions in order for child protection policies to be implemented more effectively and efficiently.

Abstract

In the era of digital transformation in the banking sector, there has been an increasing practice of sharing customer data with third parties, such as service providers or vendors. This practice poses legal challenges, particularly concerning the fulfillment of the principles of necessity and proportionality in the protection of personal data. This study aims to analyze the implementation of these two principles in the collaborative practices between banks and vendors regarding the protection of customers’ personal data. This normative juridical research employs a conceptual and statutory approach, using legal materials obtained from national and international regulations, academic journals, and best practices in the banking sector. The findings indicate the need for clear and comprehensive internal bank policies on personal data protection in third-party data processing, serving as a guideline to ensure compliance with personal data protection principles.

Abstract

This research is very important because there are many similar cases in Indonesia. An International Arbitration award is basically final and binding, so the award should be enforceable. But sometimes it is often canceled by the rules of a country which in this case is Indonesia. That is why we need to look back at how the rules regarding this matter. Because as we know that everyone has rights, and those rights need to be protected by the state, even though in this case it is a foreign party, but based on the decision issued by the SIAC court, the person has rights that must be fulfilled based on the SIAC decision. This is because companies in Indonesia often deliberately set traps when making a contract, so that when a dispute arises, and then loses. They can file a lawsuit in the Indonesian court, or if the winning party in the arbitration court wants to execute in Indonesia, they can file a nullification of the execution due to the contract violating Indonesian laws. It will have a huge influence on the image of Indonesia towards international business, so that Indonesia will be more willing to enter into a business cooperation with foreign parties if it is often done by companies in Indonesia

Abstract

Forests have significant function related biological diversity, habitat protection of flora fauna such as orangutan, tiger, elephant; climate-related functions such as carbon sequestration, air pollution; human settlements, human health, school activities, habitat for people, rural livelihoods; state defense as natural resources such as commercial industrial wood, non-wood forest products, international and national trade; ecotourism, and recreation. However the problem in Indonesia is forest fires. In order to maintain its functions, all the famers, forestry-concession owners, government, local government and private enterprise should prevent and suppress the forest fires through the existing law and regulations such as Constitution Law of 1945, Act Number 5 Year 1990, Act Number 22 Year 1999, Act Number 41 Year 1999, Act Number 1 Year 2009, Act Number 6 Year 1994 and Act Number 17 Year 2004 and aircraft operation conducted by foreign aircraft such as Australia, Canada, Malaysia, Russia and Singapore to assist Indonesian’s forest fires.

Abstract

The provisions and implementation of BJR in Indonesia and the United States need to be studied because the latest Company Laws of both countries have codified the principles of BJR generated by court practice so far where BJR elements are regulated imitatively in the Company Law and accompanied by an explanation of the concept of the core elements of BJR. The formulation of the problems in writing this journal are 1) How are the regulations governing the application of the business judgment rule in Indonesia and the United States? 2) how is the application of the business judgment rule principle as a legal protection effort against directors in Indonesia and the United States? The research method used in this journal is normative juridical research with qualitative data analysis. The results showed that 1) regulations governing the application of the business judgment rule in Indonesia are regulated in Law Number 40 of 2007 concerning limited liability companies and OJK Regulation Number 33 / PJOK.04 / 2014 related to BJR which provides protection for directors and commissioners in carrying out their duties are sufficient. Meanwhile, regulations governing the application of the business judgment rule in the United States are regulated in the MBCA 2016. 2) The application of the business judgment rule principle as an effort to protect the law against directors in Indonesia can be applied to protect directors from legal liability as long as there are no elements of fraud, conflict of interest, unlawful acts and intentional misconduct as in the case of Decision Number 121 K/Pid.Sus/2020. Meanwhile, the application of the business judgment rule principle as an effort to protect the law against directors in the United States in accordance with the scope of the directors' responsibilities as in the Disney dispute case, Delaware Supreme Court.

Abstract

This research discusses the validity of rental agreements for joint property objects after divorce, with a case study of the divorce between Yosephin Evylia Dewi (YED) and Paulus Trijanto Adi Wibowo (PTAW) in Jakarta in 2021. This case illustrates the complexities that arise when joint property , which in this case is a house, is rented by one party without the consent of the other party. Based on Marriage Law Number 1 of 1974, every legal action related to joint property requires approval from both parties. Rental agreements entered into without this approval give rise to several legal consequences, including the potential for the agreement to be null and void and losses for the tenant. This study emphasizes the importance of mutual agreement in managing joint assets to avoid legal disputes and provide legal certainty for all parties involved.

Abstract

Bank diarahkan untuk berperan sebagai agen pembangunan (agent of development), yaitu sebagai lembaga yang bertujuan mendukung pembangunan nasional dengan meningkatkan pemerataan pembangunan, pertumbuhan ekonomi dan stabilitas nasional. Salah satu cara peran bank sebagai agent of development adalah menyalurkan kredit kepada masyrakat tentunya dalam menyalurkan kredit bank tidak secara cuma-cuma, tetapi harus berdasarkan prinsip berhati-hati (prudence). Sehingga dalam menyalurkan kredit, bank menerapkan syarat 5C dalam pemberian kreditnya yakni: (a) character (karakter); (b) capacity (kemampuan); (c) capital (modal); (d) collateral (jaminan); dan (e) condition (keadaan). Collateral atau jaminan dianggap salah satu hal penting karena berjaga-jaga apabila debitur tidak dapat mengembalikan kredit, ada berbagai macam jaminan dalam pemberian kredit yang salah satunya adalah jaminan perorangan (borgtocht) dimana pihak ketiga bersedia pribadinya dijadikan jaminan dalam perjanjian kredit debitur. Namun jaminan perorangan (borgtocht) kurang diminati oleh bank, karena bersifat accecoir sehingga tidak memberikan status privilege kepada bank selaku penerima jaminan dan pelaksanaan eksekusinya yang cukup memakan waktu. Oleh karenanya Peneliti ingin membahas pelaksanaan eksekusi jaminan perorangan (borgtocht), berdasarkan secara normatif dengan pendekatan undang-undang dan kasus, serta teknik analisa data kualitatif.

Abstract

Perlindungan hukum terhadap merek terkenal (well-known mark) dari tindakan passing off menjadi isu krusial dalam era globalisasi dan persaingan bisnis yang semakin ketat. Tindakan passing off merujuk pada praktik menipu konsumen dengan cara menyamarkan produk atau layanan agar terlihat seolah-olah berasal dari merek terkenal, sehingga dapat merugikan pemilik merek dan mengganggu reputasi yang telah dibangun. Penelitian ini bertujuan untuk menganalisis upaya perlindungan hukum yang dapat diambil oleh pemilik merek terkenal dalam menghadapi tindakan passing off. Dengan menggunakan pendekatan yuridis normatif, studi ini mengeksplorasi berbagai instrumen hukum, baik dalam perundang-undangan hak atas kekayaan intelektual (HAKI) maupun hukum dagang, yang dapat digunakan untuk melindungi merek terkenal. Selain itu, penelitian ini juga membahas pentingnya kesadaran hukum bagi pelaku bisnis dalam menjaga reputasi dan hak mereka. Hasil penelitian menunjukkan bahwa perlindungan yang efektif terhadap merek terkenal memerlukan kolaborasi antara pemilik merek, pemerintah, dan masyarakat untuk menciptakan lingkungan bisnis yang adil dan berkelanjutan. Dengan demikian, langkah-langkah proaktif dalam mengatasi tindakan passing off tidak hanya melindungi hak pemilik merek, tetapi juga berkontribusi pada kesehatan pasar dan perlindungan konsumen.
