Abstract

The dualism between military courts and general courts in Indonesia presents a serious issue within the legal system, especially regarding the administration of justice for military personnel who commit general criminal offenses. Military courts still hold the authority to try soldiers for crimes committed outside of official duties, creating a potential space for impunity and human rights violations. This research aims to examine the problems caused by this jurisdictional dualism and explore the urgency of reforming the military justice system in Indonesia. This study uses normative legal research methods with a statutory approach, conceptual approach, and case study approach. The findings indicate that the authority of military courts to handle general crimes contradicts the principle of equality before the law and the spirit of legal reform. The Constitutional Court Decision No. 106/PUU-X/2012 serves as a critical foundation in pushing for military justice reform. Therefore, revising Law Number 31 of 1997 is urgently needed to ensure justice, transparency, and accountability within Indonesia’s judicial system

Abstract

Military courts play a strategic role in maintaining discipline, stability, and legal enforcement within the Indonesian National Armed Forces (TNI). Any violation committed by TNI personnel can seriously impact the institution's reputation, troop morale, and public trust in the rule of law. This study examines how military courts function as a legal instrument in handling disciplinary violations and military crimes, as well as evaluates their effectiveness in upholding justice and preserving military hierarchy. The analysis is conducted using a normative juridical approach by reviewing legal instruments such as Law No. 31 of 1997 on Military Justice and Law No. 25 of 2014 on Military Discipline Law. The findings indicate that although the military justice system has a clear and structured legal mechanism, it still faces challenges in terms of transparency, accountability, and the independence of military judges.

Abstract

The criminal act of desertion is a serious offense that can significantly impact and undermine the discipline and operational readiness of the military institution if committed by members of the Indonesian National Armed Forces (TNI). This article examines the factors contributing to desertion and the role of regulations in addressing this issue under military law. The study employs a normative juridical method by analyzing various regulatory sources, such as the Military Criminal Code (KUHPM) and the internal policies of the TNI. The findings indicate that psychological pressure, along with internal and external stressors, are key triggers of desertion. Although law enforcement against desertion cases under military law has been implemented, strategic measures are still needed to enhance the welfare of military personnel and strengthen the overall system to prevent such offenses.

Abstract

Myanmar is one of the countries that is part of Southeast Asia, whose government has been led by the Military since 1962. The Military, which has long held high power in Myanmar, certainly will not let go of its power just like that, they do everything they can to continue to hold the highest power. If the highest power has been seized from the Myanmar Military, they can do everything they can to prevent it from happening, including by overthrowing the power that has been taken over. This study uses normative and qualitative legal research methods. This study uses a normative legal research method (normative juridical), namely research that focuses on the study of applicable legal norms, both those written in laws and regulations and those that live and develop in legal practice. The method used is qualitative, supported by reference sources from journals related to international law and also news sources about the Myanmar Coup case. The military coup that took place in Myanmar on February 1, 2021 was not just a regime change, but a turning point that destroyed the foundations of democracy and triggered widespread suffering for its people. By arresting Aung San Suu Kyi, Win Myint, and other elected figures, the junta buried the legitimate election process and upheld power as a tool of power. As a result, hundreds to thousands of citizens died in protests, tens of thousands were detained without trial, and millions fell into poverty when the national economy collapsed and food supplies were disrupted. The results of the study show that international legal intervention can be carried out on humanitarian grounds.

Abstract

This study examines the role of international law in conflict resolution and the establishment of global peace, highlighting the effectiveness of legal mechanisms and the challenges of their implementation in prolonged conflict areas. Using a normative juridical approach, the research analyzes international legal instruments such as the UN Charter, the Geneva Conventions, and the Rome Statute, while also exploring their application in contemporary cases like the Russia–Ukraine conflict and the Israel–Palestine crisis. The findings indicate that international law holds a strategic position in providing a normative foundation for peaceful dispute settlement and accountability for human rights violations. However, its effectiveness is often hindered by the political interests of major powers, weak enforcement mechanisms, and the involvement of non-state actors in armed conflicts. Therefore, a strong global commitment, institutional reform, and enhanced legal frameworks are required to optimize the role of international law in achieving sustainable peace.

Abstract

Sasando is a traditional musical instrument originating from East Nusa Tenggara that holds significant cultural and historical value, serving as a symbol of Indonesia’s national identity. In 2021, reports emerged that Sri Lanka attempted to register Sasando as part of its cultural heritage with the World Intellectual Property Organization (WIPO), raising concerns over transnational cultural claims. This case highlights the urgency of protecting cultural heritage through international legal instruments, particularly within the framework of Intellectual Property Rights (IPR). This study aims to examine how international law can safeguard traditional cultural expressions such as Sasando and to what extent international IPR mechanisms can prevent unilateral claims by other countries. Using a normative juridical approach supported by case studies and analysis of international conventions—particularly the 2003 UNESCO Convention and WIPO’s role—the findings reveal that while legal frameworks exist, cultural heritage protection remains suboptimal without active registration, documentation, and diplomatic efforts by the country of origin. Therefore, countries like Indonesia must proactively engage in international mechanisms to protect and uphold their cultural heritage against illegitimate claims at the global level.

Abstract

The digital era has increased global dependence on cyber infrastructure, yet it has also created vulnerabilities to transnational cyberattacks. This phenomenon becomes legally complex when attacks are carried out by non-state actors, raising fundamental questions about the accountability of the state from which such attacks originate. This research aims to analyze the application of the principle of state responsibility in international law, particularly concerning how the actions of non-state actors can be attributed to a state. Furthermore, this study identifies the fundamental juridical challenges in the process of evidence-gathering and law enforcement against states suspected of involvement or negligence. Using a normative legal research method with a statute approach and a case study approach, this article examines primary and secondary legal sources such as the Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA), the UN Charter, and relevant doctrines including the Tallinn Manual 2.0. The findings indicate that the attribution standard based on 'effective control' is difficult to meet in the context of anonymous and decentralized cyberattacks. Consequently, the focus of responsibility shifts to the breach of the due diligence obligation, where a state can be held accountable if proven negligent in preventing or responding to malicious cyber activities from its territory. Nevertheless, significant challenges remain in terms of technical evidence and the limitations of effective, non-escalatory international enforcement mechanisms

Abstract

The misuse of firearms by members of the Indonesian National Armed Forces (TNI) constitutes a serious violation that not only breaches military discipline but also poses a threat to civilian security and public trust. This study aims to analyze the legal considerations in military court decisions involving soldiers who have misused firearms, as well as to assess the effectiveness of verdict implementation, the forms of legal accountability imposed, and the impact of public pressure on judicial proceedings. Using a normative juridical approach and case studies of several military court rulings, the findings indicate inconsistencies in sentencing, the influence of the defendants’ relationships with superiors, and a lack of transparency and internal oversight. Moreover, public pressure plays a significant role in shaping judicial outcomes—both as a driver of justice and as a potential threat to judicial independence. Reform of the military justice system is needed through strengthened oversight mechanisms, improved disciplinary training, and safeguarding judicial independence in order to achieve substantive justice and uphold public confidence

Abstract

Tulisan ini membahas tanggung jawab negara atas pelanggaran hak asasi manusia (HAM) dari perspektif hukum internasional. Dalam hukum internasional, negara bukan hanya wajib menghormati HAM, tetapi juga bertanggung jawab apabila melanggar atau gagal mencegah pelanggaran tersebut. Artikel ini mengulas aspek normatif dan institusional dari tanggung jawab negara, mulai dari sumber hukum, yurisdiksi, hinggamekanisme reparasi. Pembahasan mencakup peran lembaga internasional, pengaruh aktor non-negara, dan dinamika implementasi di negara-negara berkembang. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif-analitis, dan merekomendasikan penguatan sistem internasional untuk penegakan tanggung jawab negara atas pelanggaran HAM

Abstract

Human trafficking poses a serious challenge in the modern world and requires serious attention from the international community. This journal discusses the role of international law in efforts to combat human trafficking through a review of literature studies. By analyzing various prior studies and related reports, this article investigates on how international legal developments seek to address this issue of human trafficking. Through a literature study, this article identifies the various international legal approaches that have been taken to address human trafficking as well as evaluates the effectiveness of measures as well as the challenges faced by the international community in combating human trafficking. The results of this literature review provide an understanding of the international legal landscape related to human trafficking, as well as identify areas where further efforts are needed. This article concludes the importance of interstate cooperation and effective implementation of laws in efforts to combat human trafficking effectively worldwide.
