Abstract

This research examines the tension between the application of international humanitarian law and the legal needs of the military in maintaining state sovereignty during armed conflict. Using normative juridical methods, the study analyses the legal framework governing military action and the protection of civilians in conflict situations. The research focuses on three issues: the effectiveness of applying humanitarian law without compromising military strategies to safeguard sovereignty; obstacles in ensuring civilian protection and solutions from humanitarian law; and synergies between military law and humanitarian law without compromising operational effectiveness. The results show that the dilemma between military and humanitarian interests can be harmonised through proper interpretation of the principles of proportionality, distinction, and precaution, as well as the development of military doctrine that  integrates humanitarian values. The research concludes that strengthening compliance mechanisms, humanitarian law training for military personnel, and improving rules of engagement are crucial steps to balance military imperatives with humanitarian protection in contemporary armed conflicts.

Abstract

Globalization has cut the boundaries between national law and international law which are increasingly expanding in their role that increasingly influences the national legal systems of each country, including Indonesia as a country with a mixed legal system. This article examines the position of international law against countries with national legal systems in their integrity to maintain state sovereignty with obligations in the context of international law. In this study, the normative juridical method is used, namely the type of legal research that looks at primary and secondary legal materials such as laws, court decisions, international agreements, and doctrines and opinions of experts, where international agreements in their mechanisms must be ratified before they apply to the national legal system. Although Article 11 of the 1945 Constitution is the constitutional basis, there is no definite mechanism that regulates this integration, thus creating legal uncertainty. Strengthening regulations and harmonization are needed so that international law can be applied effectively without ignoring the sovereignty and values of Pancasila

Abstract

Perdagangan manusia merupakan pelanggaran serius terhadap hak asasi manusia yang masih menjadi tantangan global, termasuk di Indonesia. Studi ini bertujuan untuk menganalisis sejauh mana peran hukum internasional berkontribusi dalam upaya pencegahan perdagangan manusia di Indonesia. Pendekatan normatif digunakan dengan mengkaji berbagai instrumen hukum internasional seperti Protokol Palermo, Konvensi PBB tentang Kejahatan Terorganisir Transnasional, serta peran organisasi internasional seperti UNODC dan IOM. Penelitian ini menemukan bahwa Indonesia telah mengadopsi sejumlah instrumen internasional ke dalam peraturan nasional, seperti Undang-Undang No. 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Meskipun demikian, implementasi di tingkat lokal masih menghadapi tantangan seperti lemahnya penegakan hukum, keterbatasan sumber daya, serta kurangnya koordinasi antar lembaga. Hasil kajian ini menegaskan pentingnya sinergi antara instrumen hukum internasional dan mekanisme nasional, serta perlunya peningkatan kapasitas institusi untuk memperkuat upaya pencegahan perdagangan manusia secara berkelanjutan di Indonesia.

Abstract

Military law is an important part of the national legal system that serves to ensure the professionalism of the Indonesian National Army through discipline, ethics, and distinctive internal law enforcement. The military legal system is regulated by Law No. 31/1997 on Military Justice to meet the different needs of military organizations and civil society, especially with regard to discipline enforcement, hierarchy, and preparedness. However, in its implementation, there are various challenges such as overlapping jurisdictions with the general courts, lack of transparency, and a military culture that opposes democratic principles. There is a need to formulate solutions to the existing structural and normative barriers. Military law reform is needed so that the system can be aligned with human rights and the rule of law, and so that Indonesian National Army remains neutral and integrity as a professional national defense tool

Abstract

The conflict involving the Rohingya ethnic group in Myanmar is a longstanding and complex issue, rooted in discrimination against their citizenship status and prolonged interethnic tensions. The enforcement of Myanmar’s 1982 Citizenship Law has led to the Rohingya losing official recognition as citizens, along with their fundamental rights. The Myanmar government regards them as illegal immigrants from Bangladesh, despite historical evidence indicating that the Rohingya have resided in the Arakan (now Rakhine) region long before the country's independence. This discrimination has been further exacerbated by the Burmanization policy implemented by the military regime, which restricts the Rohingya's rights in various aspects of life, such as education, employment, freedom of movement, land ownership, and family planning. The escalation of conflict in 2012 triggered a mass exodus to several countries, including Indonesia. Although Indonesia is not a party to the 1951 Refugee Convention, the country has shown humanitarian concern by providing temporary shelter for Rohingya refugees. Nevertheless, this reception has not always proceeded smoothly due to resistance from local communities, particularly in Aceh, influenced by past experiences and the spread of misinformation. This issue underscores the importance of international cooperation and a deeper understanding of refugee protection principles in order to uphold humanitarian values and maintain regional stability.

Abstract

In recent years, satellite launch activities by the private sector have increased significantly, especially by global companies such as SpaceX, OneWeb, and Amazon. This phenomenon marks a shift in the dominance of space exploration from states to private entities. However, this development raises complex legal issues, especially related to the principle of international responsibility as stipulated in the Outer Space Treaty 1967 and the Liability Convention 1972. This study aims to examine the legal implications arising from losses due to satellite launches by the private sector against states and third parties, and to analyze the effectiveness of the launching state's supervision in the context of international and national law. The Normative-Qualitative Approach to Satellite Launch Law is an analytical method used to understand and analyze the legal aspects of satellite launches. Through, this study found that although the launching state still bears absolute and fault-based responsibility for the activities of non-state entities, the oversight and law enforcement mechanisms are still weak and not yet adaptive to the development of the commercial space industry. The absence of strict sanctions, regulatory gaps, and limited international jurisdiction make the principle of international responsibility difficult to apply optimally. Therefore, it is necessary to update the legal framework, increase national capacity, and international cooperation to create fair, responsible, and sustainable space governance.

Abstract

Military comes from the word miles, meaning people who are ready or assigned to go to war. The military is a tool of the state that is assigned to go to war and defend the country. Legal politics in the current era or after the reform era states that those who commit general crimes must be subject to general justice. Therefore, in Indonesia itself, regulations are regulated regarding the formation of military justice in Indonesia. Referring to the country of Indonesia which is an agricultural country with a geographical area flanked by two continents and two oceans, Indonesia's position is very strategic because its territory is very potential. Although Indonesia has a potential area, Indonesia is very disadvantaged because it has a territory located in the ring of fire area. Thus, Indonesia becomes an area prone to natural disasters due to this. Therefore, the military also has a role to help overcome natural disasters because the military has the capacity in the form of the ability to carry out tasks which are in fact in emergency conditions with its command network down to the regional level. This is based on the fact that natural disaster management is not only the task of BNPB and BPBD according to the military, but this proves that the military can also help with problems related to natural disaster management

Abstract

Perkembangan teknologi informasi dan komunikasi telah membawa dampak besar terhadap transformasi global, termasuk dalam aspek keamanan siber. Negara berkembang seperti Indonesia menghadapi tantangan serius dalam membangun kapasitas pertahanan siber yang andal, akibat keterbatasan sumber daya, infrastruktur, serta regulasi yang belum harmonis. Dalam konteks ini, peran organisasi internasional menjadi sangat penting untuk membantu negara-negara berkembang dalam meningkatkan kesiapan dan ketahanan terhadap ancaman siber. Artikel ini membahas kontribusi organisasi internasional, khususnya International Telecommunication Union (ITU), dalam membangun kapasitas siber negara berkembang melalui kerja sama teknis, pelatihan sumber daya manusia, dan advokasi kebijakan keamanan siber. Melalui metode yuridis normatif dan studi pustaka, artikel ini menelusuri bagaimana ITU menjalankan perannya melalui berbagai inisiatif, seperti pengembangan broadband, pelatihan mitigasi kejahatan siber, serta kolaborasi dengan organisasi lain seperti IMPACT dan INTERPOL. Di sisi lain, Indonesia juga telah membentuk Badan Siber dan Sandi Negara (BSSN) sebagai langkah strategis untuk mengoordinasikan keamanan siber nasional. BSSN menerapkan strategi berdasarkan lima pilar Global Cybersecurity Index (GCI), yakni aspek hukum, teknis, organisasi, pengembangan kapasitas, dan kerja sama. Penelitian ini menyimpulkan bahwa kolaborasi internasional menjadi kunci dalam menciptakan ekosistem keamanan siber yang tangguh dan adaptif. Oleh karena itu, diperlukan sinergi berkelanjutan antara pemerintah, organisasi internasional, sektor swasta, akademisi, dan masyarakat guna meningkatkan daya saing digital negara berkembang di tengah tantangan dunia maya yang semakin kompleks.

Abstract

The incident of the shooting of five Indonesian migrant workers (PMI) by the Malaysian Maritime Enforcement Agency (APMM) in the waters of Tanjung Rhu, Selangor, on January 24, 2025, which resulted in two deaths and three injuries, highlights violations of human rights (HAM) and international legal norms.This research examines the actions of the Malaysian Maritime Enforcement Agency (APMM) that allegedly used excessive force and committed extrajudicial killings, violating Article 3 of the UDHR, Article 6 of the ICCPR, and Article 104 of Law No. 39/1999.The driving factors of illegal migration, such as the lack of job opportunities in Indonesia and the allure of high wages in Malaysia, are exacerbated by labor trafficking syndicates.The Indonesian government has sent diplomatic notes and provided legal assistance, but the weakness of bilateral agreements poses a challenge.This normative legal research recommends a systematic approach to law enforcement, eradication of labor trafficking, and protection of Indonesian Migrant Workers (PMI) to prevent the recurrence of tragedy.

Abstract

The financial sources of political parties as stated in Article 34 paragraph (1) of Law Number 2 of 2011 concerning Political Parties are, membership fees, legally valid donations and financial assistance from the state. Financial assistance from the state through the State Budget/Regional Budget. Assistance from the state based on Article 34 paragraph (3) is given only to political parties that get seats in the legislative institution. This study aims to analyze financial assistance from the state to political parties in accordance with the principles of ideal democracy. With a normative legal approach, this study found that although regulations have regulated financial assistance to political parties, this assistance is only given to political parties that get seats in the legislative institution. Therefore, in order to realize an ideal democracy, financial assistance from the state should also be given to political parties that do not get seats in the legislative institution but participate in the general election contest, because all political parties have the same rights, obligations and functions without exception, as mandated in the laws and regulations. With this step, it is hoped that a democratic system will be realized for each political party.
