Abstract

The Islamic religious organization Persatuan Islam was founded on September 12, 1923 in Bandung. Now the Islamic Association has approximately 230 boarding schools throughout Indonesia. The number is not small with a management system that has been tested, it is proven that the longer the Islamic Unity boarding school is growing rapidly with santri alumni spread throughout Indonesia. However, there is something interesting about this Islamic Unity Islamic Boarding School, namely the implementation of the santri promise which is read every day of the week in the santri ceremony. This promise aims to shape the morals of students and most importantly to prevent behavior that deviates from Islamic law. This study aims to analyze the material of the Islamic Unity boarding school's santri pledge so that it can ward off radical behavior in religion and form the character of santri and embody the values of Pancasila. The research was conducted at Islamic Unity boarding schools in Bangil, East Java, West Java, and those in Central Java. The method used is descriptive analytical with a sociological and philosophical approach. Data were collected by observation, interview, and documentation. The data obtained were classified and analyzed using the content analysis method. The concept of de-radicalization of religious behavior and character building of santri through the santri promise system in Islamic Unity boarding schools in Indonesia refers to the vision of PERSIS pesantren education, namely realizing santri and pesantren alumni who have a deep understanding of Islamic teachings, have good character, and become role models for the people. Deradicalization will automatically be implemented because the santri uphold their promises. The embodiment of Pancasila values through the santri pledge system in Islamic Unity boarding schools in Indonesia is carried out through Muslim character education that is faithful, pious, instills a spirit of togetherness, tolerance, rational, emotional and spiritual intelligence. The realization is in the form of skills training, curriculum, and cultivating various obligations and sunnat-sunnat in Islamic teachings.

Abstract

This research aims to examine the legal process carried out by the Bengkulu Religious High Court in ensuring the living expenses of children after their parents' divorce. This study is qualitative research with a normative legal approach. Primary data comes from laws, court decisions related to children's rights post-divorce, and children's civil rights, while secondary data is obtained from books, online media, and journals with the same relevance. In exercising its authority, the Bengkulu Religious High Court prioritizes the principle of justice by maintaining the interests of the child, as well as the principles of balance and proportionality. However, there are several challenges such as the lack of public understanding of children's rights and obstacles in the implementation of Religious High Court decisions regarding the enforcement of children's civil rights. More intensive efforts are needed to provide the public with an understanding of children's rights and to improve the quality of enforcement of Religious High Court decisions to ensure optimal protection of the child's interests following their parents' divorce.

Abstract

This study examines Constitutional Court Decision Number 62/PUU-XXII/2024, which annulled the presidential candidacy threshold in Article 222 of Law No. 7/2017 for violating principles of morality, rationality, and justice. Using a normative juridical approach and the siyasah qadaiyyah (Islamic judicial political theory) perspective—alongside Rousseau’s concept of popular sovereignty—this research analyzes the decision’s legal reasoning and its impacts on Indonesia’s constitutional system, governance, and institutional balance. The findings show that removing the threshold enhances democratic participation but may also lead to political instability and institutional imbalances. The study recommends strengthening deliberation, oversight, and justice in political processes, guided by the siyasah qadaiyyah approach, to achieve a just and stable constitutional order. Contribution: This research not only enriches academic understanding but also provides guidance for policymakers working to ensure that Indonesia’s constitutional evolution upholds both justice and stability.

Abstract

Hukum Islam memiliki pengaruh yang signifikan dalam kehidupan sosial masyarakat Indonesia, menciptakan hubungan yang kompleks antara norma hukum dan realitas sosial. Selain berfungsi sebagai pedoman agama, hukum Islam juga menjadi bagian integral dari budaya dan tradisi yang hidup dalam masyarakat, terutama di kalangan umat Muslim. Penerapan hukum Islam tercermin dalam berbagai aspek kehidupan, seperti pernikahan, warisan, dan ekonomi, yang sering disesuaikan dengan konteks lokal dan adat setempat. Interaksi antara hukum Islam dan masyarakat Indonesia menunjukkan saling mempengaruhi, hukum Islam memandu perilaku sosial dan etika masyarakat, sementara perubahan sosial akibat modernisasi dan globalisasi juga mempengaruhi praktik hukum Islam, seperti munculnya lembaga keuangan syariah. Dalam masyarakat Indonesia yang plural, penerapan hukum Islam cenderung terbatas pada bidang-bidang tertentu, seperti hukum perdata, untuk menjaga harmoni antar agama dan menghindari konflik sosial, sementara hukum pidana jarang diterapkan. Dengan pendekatan sosiologi hukum, kita dapat melihat bagaimana hukum Islam membentuk identitas kolektif masyarakat Muslim Indonesia dan mempengaruhi struktur sosial serta dinamika interaksi antarindividu dalam masyarakat.

Abstract

Era digital membawa perubahan signifikan dalam cara hukum ditegakkan, terutama dengan kemunculan teknologi yang memengaruhi struktur sosial dan interaksi manusia. Dalam konteks ini, sosiologi hukum berperan penting untuk memahami dinamika hubungan antara hukum, teknologi, dan keadilan sosial. Artikel ini mengkaji tantangan yang muncul dalam penegakan hukum di era digital, seperti ketimpangan akses teknologi, bias algoritma, dan pergeseran norma sosial. Dengan pendekatan sosiologis, penelitian ini menyoroti bagaimana hukum dapat beradaptasi dengan perubahan sosial yang cepat sekaligus memastikan prinsip keadilan tetap terjaga. Solusi berbasis inklusi sosial dan pemahaman mendalam tentang dampak teknologi diusulkan sebagai langkah strategis untuk menjawab tantangan ini.

Abstract

Sosiologi hukum adalah cabang ilmu yang mengkaji hubungan antara hukum dan masyarakat untuk memahami bagaimana hukum berfungsi sebagai alat pengendalian sosial dan refleksi dari nilai-nilai sosial. Dalam masyarakat, hukum tidak hanya bertindak sebagai aturan formal, tetapi juga sebagai mekanisme yang dinamis dalam menciptakan ketertiban sosial. Karya tulis ilmiah ini membahas peran hukum dalam menjaga harmoni sosial melalui peningkatan kesadaran hukum masyarakat dan analisis terhadap efektivitas regulasi yang ada. Dengan menggunakan metode kualitatif berbasis studi literatur, penelitian ini menunjukkan bahwa keberhasilan hukum sangat bergantung pada kemampuan hukum untuk mencerminkan norma dan nilai-nilai masyarakat, serta adaptabilitasnya terhadap perubahan sosial. Temuan ini menegaskan pentingnya peran sosiologi hukum dalam menciptakan sistem hukum yang inklusif, responsif, dan berorientasi pada keadilan.

Abstract

Artikel ini mengeksplorasi peran sosiologi hukum Islam dalam mewujudkan keadilan sosial di masyarakat modern yang ditandai oleh perubahan sosial, pluralisme, dan perkembangan teknologi. Dengan pendekatan studi literatur dan analisis konseptual, penelitian ini menyoroti tantangan yang dihadapi hukum Islam dalam menyesuaikan diri dengan nilai-nilai modern, seperti individualisme dan sekularisasi, tanpa kehilangan identitas spiritualnya. Temuan penelitian menunjukkan bahwa hukum Islam dapat menjadi instrumen transformasi sosial yang efektif melalui penerapan kebijakan berbasis syariah, penyelesaian konflik sosial, dan pemberdayaan masyarakat marginal. Artikel ini menegaskan bahwa sosiologi hukum Islam, sebagai cabang ilmu yang memadukan pendekatan normatif dan sosiologis, mampu memberikan solusi inovatif terhadap permasalahan modern, sehingga menciptakan masyarakat yang adil, harmonis, dan berkelanjutan.

Abstract

Constitutional Court Decision Number 60/PUU-XXII/2024 provides a new interpretation of the provisions on the threshold for nominating regional heads in Article 40 paragraph (3) of Law Number 10 of 2016, which previously limited non-parliamentary political parties from nominating regional head candidates even though they obtained valid votes. This study aims to analyze the normative correction from a legal perspective. This study uses a juridical-normative and qualitative-contextual approach with a library research method through an analysis of the Constitutional Court's decision, the principles of legal principles, and constitutional law literature. The results of the study show that the Constitutional Court's decision eliminates forms of electoral discrimination by restoring the rights of political parties that obtain 25% of valid votes to continue to nominate regional head candidate pairs, even without DPRD seats. In a legal perspective, this constitutional interpretation is in line with the principles of justice (al-adl), political equality (al-musawah), and public welfare (al-maslahah al-'ammah). This decision is considered as a form of ijtihad siyasiy by state institutions to free political access from the domination of local oligarchy. Thus, the constitution and Islamic principles can synergize in encouraging substantive democracy at the local level.

Abstract

The Unity of Islam cleric's thinking is distinctive in determining legal provisions, especially in formal rituals. However, a different approach is used when discussing the shift in the role of housewives, which does not yet have a firm view from Islamic Unity scholars. This research uses descriptive analysis method by collecting data through observation, interviews, and documentation, as well as the main data source from the opinions of Islamic Unity scholars. The aim is to analyze the thoughts of Islamic Unity scholars on the changing social and economic roles of women as housewives. The results of the study were analyzed using an empirical juridical approach, gender equality theory, and the concept of family law reform from Tahir Mahmood. In conclusion, the Islamic Union scholars consider the role of women in family law as part of muamalah that can be developed progressively, while still paying attention to the principles of Islamic law. This thinking is socialized positively through various activities to the community, with the al-maslahah al-mursalah approach to maintain the principle of women's dual role as housewives, without equating all activities between men and women.

Abstract

Nepotism in Indonesia is a complex phenomenon and rooted in the culture of kinship and the patronage system. One of the most common patterns of nepotism in Indonesia is the appointment of officials and staff based on family or relative relationships, not on the basis of qualifications or competencies. Various strategic positions in the government are filled by family members or close relatives of political officials. Effective and strong law enforcement can dispel the practice of nepotism. Strengthening the capacity of law enforcement agencies and internal oversight mechanisms in each institution will ensure that every case of nepotism is handled seriously and transparently. Cultural change and institutional governance are important aspects in efforts to overcome nepotism. It is also important to conduct ethics education and training for all employees and public officials that includes an understanding of the negative impact of nepotism and the importance of integrity in decision-making. It is also necessary that continuous ethics training can build awareness and commitment to fair practices. Through ethics education, organizations can build a culture of integrity that rejects all forms of nepotism.Increasing transparency in the decision-making process is an important step to reduce nepotism by providing open access to information about the recruitment, promotion, and procurement process. Transparency in the administrative process can reduce the likelihood of nepotism and increase public trust.Organizations must adopt policies that encourage information disclosure and ensure that every decision taken can be held accountable. An effective complaint channel can improve the detection and handling of nepotism cases. Effective monitoring and evaluation mechanisms are needed to overcome nepotism. The use of technology will increase scrutiny of nepotism practices, as technology can increase efficiency and transparency in human resource management, reduce subjective intervention in decision-making processes and ensure that every decision is based on objective data so that at a consistent and sustainable level of implementation it will help build a fairer system and increase public trust in institutions.
