Abstract

Istinbath of law which is able to abstract the thoughts of previous scholars and place them according to portions and proposals. On the other hand, various fatwa institutions have also emerged, but the results are very irrelevant and not adaptive to the environment, the ilhaq al-masail bi nadhairiha method was born as one of the methods of legal istinbath carried out by LBM MUDI Mesjid Raya Samalanga. The ilhaq al-masail bi nadhairiha method is not just the result of the thoughts of the LBM board and expert council, but this method is reconstructed from a solid foundation. The basic argumentation of applying istinbath with the ilhaq al-masail bi nadhairiha method is also caused by the opening of the door to interrupt some of the arguments and evidence which are used as a legal basis in the past. The opening of the door can be seen from the existence of several rules which have very universal meanings and are able to adapt according to the development of the times.

Abstract

The objective of this study is to investigate communication strategies implemented by Forum Kerukunan Umat Beragama (Indonesian: Religious Harmony Forum) in maintaining religious harmony in Medan. The research used a qualitative descriptive analysis and a method of data collection which consisted of indepth interviews with research informants, interviews using observation techniques with direct field observation, and document study to explore data. Communication strategies implemented by Forum Kerukunan Umat Beragama (FKUB) in maintaining religious harmony in Medan include determining communicators based on the communicants’ religion and ethnicity; grouping the target audience by adjusting the program’s theme to the communicants’ age, gender, education, work and religion; gathering informative, persuasive and educational messages; and utilizing printed, electronic and outdoor media.

Abstract

Getting a life partner is a human partner in accordance with their nature. Living together must be carried out in an official way, namely through marriage. Marriage must be carried out with the provisions that have been set in Islam. In addition, the state also requires registration of marriages. This research is entitled Marriage Registration in Islamic Law. This study discusses how the views of Islamic law on marriage registration at the Office of Religious Affairs (KUA) and the consequences of marriages that are not registered at the Office of Religious Affairs (KUA). This research is library research. This type of research is a type of qualitative research with a normative approach that is descriptive-analytical. This research concludes thatIslamic law does not view marriage registration as a pillar or condition for a valid marriage. Marriage is still valid as long as the pillars and conditions are met. Marriages that are not registered with the Office of Religious Affairs (KUA) are considered a mistake in the view of Islamic law, because they do not obey Allah's orders in terms of obeying government regulations. Marriage registration is a must in juridical studies. The state does not declare illegitimate marriages that are not registered at the Office of Religious Affairs (KUA). However, the marriage is not under the legal umbrella, so the state is not responsible for the impacts that occur from the marriage in the future.

Abstract

Indonesia is a constitutional state which was contain in Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia and based on the prevailing laws and regulations. The current laws and regulations are considered to have a lot of influence on legal positivism teachings, the law is considered rigid and causes the number of regulations that Indonesia has. The number of regulations is considered quite a cause for concern, and can lead to a decline in the quality of regulations in Indonesia. So, the Government tries a new method, namely the omnibus law method in simplifying regulations in Indonesia. The government's efforts to reduce regulatory obesity through the omnibus law method are considered formal flaws because they are not in accordance with the rules for the formation of laws and regulations stipulated in Law no. 12 of 2011. The progressive legal view of the omnibus law is necessary then to see the real and living substantial aspects of society and the consideration of social perspectives needs to be adjusted and the Government needs to continue to explore the real aspects in society.
