Abstract

Abstract:Today there are so many couples who have long been married, but have not been blessed with a child in married life. In Indonesia, so many believe that one of the efforts to get a child is by inducement, which is presenting a foster child to give a provocation to a couple who do not have children to be immediately given offspring. Most of them raised their own family, others lifted children from other people who are not family, and even raised children from orphanages whose origins are unclear. From this the legal protection of the adopted child is needed in order to obtain guarantees and a decent life. This study will discuss how legal protection, the criteria for terminating custody of adopted children, and inheritance rights will be obtained. This research uses descriptive qualitative method with a normative approach.Keywords: foster children, child protection, civil lawAbstrak:Zaman sekarang begitu banyaknya pasangan yang sudah lama menikah, namun belum dikaruniai seorang anak dalam kehidupan berumah tangga. Di Indonesia begitu banyak yang percaya bahwa salah satu upaya untuk mendapatkan seorang anak adalah dengan pancingan, yaitu menghadirkan seorang anak asuh untuk memberikan pancingan kepada pasangan yang belum memiliki anak agar segera diberikan keturunan. Sebagian besar ada yang mengangkat dari pihak keluarga sendiri, ada juga yang mengangkat anak dari orang lain yang bukan keluarga, bahkan mengangkat  anak dari panti asuhan yang tidak jelas asal usulnya. Dari hal tersebut diperlukan perlindungan hukum terhadap anak yang diangkat tersebut agar mendapat jaminan dan kehidupan yang layak. Dalam penelitian ini akan dibahas bagaimana perlindungan hukum, kriteria pemutusan hak asuh anak angkat, dan hak waris yang akan didapatkan. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan normatif.Kata kunci : anak asuh, perlindungan anak, hukum perdata

Abstract

AbstractPresidential Election in 2019 has become the most interesting executive election throughout Indonesia's political history. People likely separated, either Jokowi’s or Prabowo’s stronghold. Then it can be assumed, when someone, not a Jokowi’s stronghold he or she certainly within Prabowo’s stronghold. The issue that was brought up in the presidential election campaign, sensitively related to religion, communist ideology, China’s employer, and any other issues. On the other side, politics identity also enlivened the presidential election’s campaign in 2019. Normative Yuridis method used in this research, which was supported by primary and secondary data sourced from either literature and social phenomenon sources as well. The research analysis concluded that political identity has become a part of the political campaign in Indonesia as well as in other countries. The differences came as the inevitability that should not be avoided but should be faced wisely. Finally, it must be distinguished between political identity with the politicization of identity clearly.Keywords. Identity Politics, 2019 Presidential Election

Abstract

Di Indonesia, era reformasi bergulir sejak 1998 yang menumbangkan era rezim Orde Baru. Analisis Huntington dan Nelson mengenai model populis tidak cocok dengan era pasca orde baru dalam melihat dampak dari peningkatan partisipasi politik rakyat. Konflik-konflik kecil memang terjadi dalam bentuk intrik-intrik politik, dan hal ini juga biasa terjadi dalam model-model lain termasuk model liberal. Pada era pasca orde baru tren yang berkembang justru pertumbuhan ekonomi yang labil dan pemerataan ekonomi yang belum berdampak luas yang mengakibatkan semacam kejenuhan rakyat dengan persoalan politik. Angka partisipasi politik dalam pemilu di atas sedikit banyaknya menunjukkan tren tersebut. Ditambah lagi dengan kecilnya angka partisipasi dalam berbagai pemilihan kepala daerah (pilkada) yang digelar di tiap provinsi dan kabupaten/kota di seluruh Indonesia.

Abstract

A trade union is a group of workers who band together to promote, protect, and improve their members' social, economic, and political interests through collective action. A trade union is a workers' organization formed to defend the destinies of workers. In the world of work, there are two parties, namely workers and employers. Workers/labourers as citizens have equal position in the law, the right to get a decent job and livelihood, express opinions, gather in one organization, and establish and become members of a trade/labour union. The right to freedom of association has also been recognized by the international community. Settlement of disputes between business actors cannot be separated from the application of business ethics which is an inseparable part of the business law environment and business practices itself. This writing uses a qualitative methodology, which in its translation will make it easier for the writer to analyze and convey the intent and purpose of writing that has been adjusted to the author's background and goals.

Abstract

Good governance berperan sebagai ideology yang akan membuka jalan rintisan bagi terbentangnya jalan yang lebih luas bagi masuknya neo-liberalisme ke dalam ruang kesadaran warga Negara-bangsa di seluruh dunia. konspe good governance merupakan suatu unit elit yang akan meruntuhkan basis paling inti dari pertahanan kesadaran anti-liberalisme dan anti-neoliberalisme, yaitu konsep mengenai apa yang baik (good) dalam pengelolaan Negara-bangsa. Dalam hal ini, konsep good governance sungguh menerapkan secara bagus kekuatan tersembunyi dari bahasa.

Abstract

Luxembourg lebih kaya tiga ratus lima puluh kali lipat dibanding Burundi. Menurut data World Bank, Pendapatan rata-rata penduduk negara kecil yang berada di dataran Eropa tersebut pada 2017 sebesar 104,1 ribu dolar AS. Sedangkan pada tahun yang sama, pendapatan rata-rata penduduk Burundi hanya mendekati 300 dolar AS. Ilustrasi di atas boleh jadi bagi sebagian orang hanya perkara sepele. Sebagian lainnya mungkin menganggap itu takdir. Namun, Daron Acemoglu dan James A. Robinson bukan tipe orang semacam itu. Di hadapan dua ekonom tersebut, ilustrasi di atas ialah rangkaian misteri yang mesti disibak. Walhasil, mereka menyelidikinya dan menuliskannya dalam sebuah buku berjudul Why Nations Fail: The Origins of Power, Prosperity, and Poverty (2012). Di Indonesia, buku tersebut terbit pada 2017 dengan judul Mengapa Negara Gagal: Awal Mula Kekuasaan, Kemakmuran, dan Kemiskinan.

Abstract

Porsi buku ini banyak mengulas soal fenomena yang terjadi di Amerika Serikat. Yakni ketika Donald Trump, yang diusung oleh Partai Republik, menang pada Pilpres Amerika Serikat tahun 2016. Trump unggul atas kandidat Partai Demokrat, Hillary Clinton. Padahal banyak lembaga survei lokal yang memprediksi kekalahan Trump. Trump diduga kuat menang karena berhasil memainkan isu rasisme kulit hitam dan menebarkan ketakutan melalui hoax. Begitu terpilih, Trump langsung mengeluarkan pernyataan kontroversial membuatnya terkesan seperti diktator. Beberapa di antaranya pernyataan perang yang diumumkan lewat akun Twitter pribadinya, rencana membangun tembok perbatasan Meksiko-Amerika Serikat; kebijakan luar negeri Korea Utara dan Afghanistan yang memicu perang; reformasi pajak; sikapnya arogan kepada media yang mengkritiknya; ketidakpercayaannya pada fenomena perubahan iklim; hingga yang paling kontroversial soal pengakuan Trump atas Yerusalem sebagai ibu kota Israel.

Abstract

In Who Rules the World?, Chomsky’s target audience and methods differ somewhat from traditional academic treatments of US foreign policy. His analyses are concise but brief vignettes on a relatively broad range of issues relating to American power, including the Israel-Palestine conflict, the threat of nuclear war and relations with Iran. Nonetheless, a handful of common themes thread the essays together, providing answers to the question posed by the title of the book.Perhaps the most provocative theme is Chomsky’s view on the motives behind the exertion of state power at home and abroad. It is often argued that the behaviour of democratic state actors is strongly informed—if not determined—by security considerations; in other words, states’ first priority is to guarantee the protection of the nation and its citizens from external or domestic threats. This, it is assumed, gives state behaviour an aspect of democratic accountability, since citizens have the ability to withdraw their consent for being ruled by a government that cannot make those guarantees. But Chomsky notes that this is unlikely to be the primary motive behind state behaviour, not least because in the American context as well as elsewhere it has been so unsuccessful. For example, since the beginning of the global “war on terror” there has been a sharp increase in the number of terrorist attacks in both the West and the Middle East, thereby making the world a less safe and secure place than it was before. If the United States’ priority was to eradicate terrorism, Chomsky’s argues, there are considerably more effective and rational ways of doing so than the strategies adopted in the wake of 9/11.

Abstract

Conflicts between nations that adhere to distinct worldviews will continue to shape the course of world politics in the foreseeable future. Culture, not politics or economics, will drive future wars on a global scale; these two factors are becoming increasingly irrelevant. This battle, in turn, will be the most significant symptom that replaces the polarization of world ideology into communist and capitalism, together with the collapse of the governmental system in the vast majority of Eastern European countries. The following are some of the factors that, according to Huntington, would cause conflicts between different civilizations in the future of world politics: 1). Differences in culture, tradition, and ethnicity, as well as differences in people's perspectives on how humans should relate to God, are all part of what distinguishes one civilization from another. These philosophical differences are at the root of the fact that people of different civilizations have different perspectives on how humans should relate to God. 2). In the sense that the interaction between various peoples and civilizations is continuing to rise, we might say that the world is continuing to become a smaller place. When people connect with one another on a deeper level, their knowledge of their own civilization grows, and they become more attuned to the distinctions that exist between their culture and those of other civilizations. 3). People all across the world have been uprooted from their deep-seated roots of local identity as a consequence of the process of economic modernization and social development. This has occurred as a result of globalization. 4). The Western world has played a dual role, which has contributed to the development of civilization consciousness. This may be understood as a stronger sense of love for a belief in the identity of civilization that has been going on for a long time.
