Abstract

This study examines the disparity in court rulings concerning the status of confiscated assets in online trading crime cases. The Banten High Court Decision No. 117/Pid.Sus/2022/PT BTN ordered the return of assets to victims, whereas the Bandung High Court Decision No. 1/Pid.Sus/2023/PT BDG ruled that such assets be confiscated for the state. This divergence generates legal uncertainty and raises fundamental questions of justice. The research aims to critically assess the extent to which these rulings are consistent with the objectives of maqāṣid al-sharīʿah, particularly the principle of ḥifẓ al-māl (protection of property). A normative legal approach is employed, drawing on statutory analysis, judicial decisions, and comparative perspectives. The findings indicate that the Banten ruling more closely reflects ḥifẓ al-māl by safeguarding victims’ property rights, while the Bandung ruling risks undermining justice, as the state did not directly incur losses. Beyond highlighting this jurisprudential inconsistency, the study underscores the urgency of harmonizing regulatory frameworks so that the principle of ḥifẓ al-māl can be systematically integrated into Indonesian criminal justice practice, thereby advancing substantive justice and strengthening public trust in the law.

Abstract

This study aims to analyze the influence of the monitoring system on the smoothness of People's Business Credit (KUR) payments at BSI KCP Setia Budi. Using a quantitative approach with regression analysis using SPSS version 26, the results show a positive relationship and significant influence between the monitoring system and smoothness of KUR payments, with a regression coefficient of 0.518. This finding indicates that an improved monitoring system contributes to smooth debtor payments. A structured monitoring system, supported by digital technology and employee training, allows for regular monitoring of debtor performance, reminders of due dates, and mitigation of the risk of late payments. This study recommends strengthening digitalization and regular evaluation of the monitoring system, as well as further research to explore specific indicators such as evaluation frequency and digital application usage.

Abstract

This study examines how Mosques in Medan manage waqf funds to support productive, empowering economic programs for the ummah. Using a qualitative case study approach, data were collected through in-depth interviews with mosque administrators, waqf practitioners, and related stakeholders, and analyzed using NVivo 12 to identify patterns, themes, and Mosque typologies in cash waqf management. The findings reveal that while many mosques in Medan have initiated cash waqf collection, few have successfully channeled these funds into sustainable economic empowerment initiatives. Key determinants of effective management include institutional structure, congregational engagement, collaboration with Islamic financial institutions, and digital support. Theoretically, this study contributes to the development of an integrative framework that positions mosques as socio-economic institutions within the broader discourse of Islamic economics. This study contributes to Islamic social finance literature by formalizing mosque typology as an institutional variable, thereby strengthening the conceptual link between mosque governance and economic empowerment. Practically, it proposes a typology-based Mosque replication model to enhance the sustainability and scalability of cash waqf-driven economic empowerment. This integrative approach offers a pathway for transforming mosques into centers of community-based economic justice and prosperity.

Abstract

This research aims to analyze the productivity of zakat, infak, and ?adaqah (ZIS) in empowering the Muslim community’s economy; assess the effectiveness of its productive management; and examine it through the lens of al-Ma?la?ah al-Mursalah. This study employs a qualitative method with a descriptive–interpretative case study approach conducted at four mosques in Medan City, namely Asy-Syafi‘iyah Mosque, Al-Hidayah Mosque, Haji Maraset Mosque, and Nurul Islam Mosque. The findings reveal that productively managed ZIS can transform from a consumptive-charitable pattern into a sustainable socio-economic investment through the development of community-based enterprises, Islamic cooperatives, and mosque business units. From the perspective of al-Ma?la?ah al-Mursalah, this management model reflects a concrete form of public benefit in terms of ?if? al-m?l (protection of wealth), as it delivers socio-economic utility without contradicting the principles of Sharia. This study offers a theoretical contribution by integrating the concept of al-Ma?la?ah al-Mursalah into mosque-based Islamic philanthropy practices, as well as practical implications for advancing professional and empowerment-oriented governance of communal religious funds.

Abstract

This research aims to analyze conflict management strategies implemented at PTPN IV Terantam Plantation in handling organizational conflicts, specifically those involving oil palm harvesters. Using a qualitative approach with a case study design, this research identifies types of conflicts, their causes, and their impact on productivity and working relationships.  The subjects of this research consist of three main groups: management, supervisors, and harvesters. Data collection methods include direct observation, in-depth interviews, and documentation. Data analysis in this research is conducted through three main stages: data reduction, data presentation, and verification or conclusion drawing. The research results show that conflicts most often occur due to miscommunication between management and workers, workers' unawareness of their rights, and interpersonal tension among workers. The conflict management strategies used include an integrative conflict management approach through improved two-way communication, ongoing education, and a participatory clarification forum. This strategy has proven effective in building trust, increasing work motivation, and creating a conducive work environment.

Abstract

Marriage is a sacred matter, the pillars and conditions must be fulfilled. In the Indonesian context, marriage must be registered and in an orderly administration. There are other matters that are very important for the Malay community in Batu Bara Regency, when a marriage (akad nikah) takes place, while the walimatul `urs has not been carried out, the bride and groom cannot live together, the rights and obligations of each cannot be carried out until walimatul `urs urs is held, this marriage is known as the "Kawin Gantung". This study wants to analyze the kawin gantungtradition, and a juridical review of the hanging marriage custom practiced in Dahari Indah Village, Talawi District, Batu Bara Regency. This type of research is qualitative, with a juridical-empirical approach, the primary sources consist of observations and interview results as well as laws and regulations in Indonesia regarding marriage. Data collection techniques were carried out by means of observation and interviews. The results of the study found that hanging marriage practiced by the community is a tradition that has long existed, and is part of local wisdom. It is known that the custom of kawin gantung does not conflict with the laws and regulations in Indonesia, and also in the Syafi`i school of law. Kawin gantung have a noble purpose, so that young couples do not fall into adultery, so that the marriage contract is permitted beforehand, even though they are not allowed to live in the same house, and have not been burdened with household duties and obligations. The implementation of a hanging marriage must have the agreement of both partners and both parties from the partner's family, if the couple is forced and not happy, then the kawin gantung is not carried out.

Abstract

Di era globalisasi ini, perusahaan dituntut dapat mengatasi masalah-masalah yang sering timbul khususnya pada bidang pengendalian hartanya agar tidak terjadi penyelewengan yang mengakibatkan kerugian pada perusahaan tersebut. Penelitian ini berupaya mengungkap kesesuaian antara praktik yang diterapkan oleh perusahaan dengan teori kepustakaan dan berdasarkan konsep maqashid syariah. Jenis penelitian ini menggunakan metode pendekatan deskriptif kualitatif yang termasuk dalam penelitian lapangan dengan teknik pengumpulan data adalah wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa pada PT. Sejati Inter-Trans Logistic Medan masih ditemukan beberapa hal yang belum sesuai dengan teori kepustakaan, seperti masih adanya perangkapan tugas yang terjadi antara Bagian Kasir dengan Bagian Akuntansi, belum diterapkannya pemeriksaan mendadak terhadap pekerjaan karyawan dan juga belum adanya perputaran jabatan pada perusahaan. Berdasarkan konsep Maqashid syariah, PT. Sejati Inter-Trans Logistic Medan sudah menerapkan aturan-aturan bekerja yang telah dijelaskan dalam Al Qur’an dan hadist. Sehingga kemaslahatan dapat tercapai. Terlepas dari beberapa hal tersebut, PT. Sejati Inter-Trans Logistic Medan sudah memiliki sistem pengendalian intern penerimaan dan pengeluaran kas yang baik.

Abstract

This article criticizes MUI Fatwa Number 24 of 2017 concerning guidelines for naming through social media, wherein the decision of its legal provisions the fatwa has given many restrictions that can be understood as an effort to close the space for freedom of expression and opinion on social media, the impact of which social media users feel afraid and restrained to views. The existence of this fatwa is fundamental because it provides clues regarding the rights of free speech for social media users from an Islamic perspective. This paper uses Jasser Auda's maqasheed sharia approach, namely system theory, as a normative analysis in criticizing fatwas against the interpretation of ghibah behavior, the concept of tabayyun, the public domain in the torso of the general provisions of fatwas. This article argues that the performance of the behavior of the ghibah, the concept of tabayyun, the public domain, in the general conditions of the fatwa body is very influential in the understanding of Islamic law itself towards a direction that is contrary to the purpose of maqasheed sharia, namely the law for the benefit of the people. This is because the interpretation of the fatwa is not ideal for realizing the goal of protecting the human right to opinion for social media users in a country that applies the concept of democracy. This argument is based on the researchers' reading of the MUI Fatwa using a system theory that says the purpose of the law is to achieve the universal benefit, which is inseparable from all points of view of Islamic law. In the end, this article concludes that there is a need to reconstruct the interpretation of the ghibah concept of tabayun, the public domain in the Majelis Ulama’s fatwa.

Abstract

Pernikahan adalah institusi suci dalam agama Islam yang memiliki dampak mendalam pada kehidupan individu. Surah At-Talaq membahas aspek perceraian dalam Al-Qur'an. "Barang siapa bertakwa kepada Allah, niscaya Dia akan mengadakan baginya jalan keluar. Dan memberinya rezeki dari arah yang tidak disangka-sangkanya". Surah ini menekankan pentingnya perlakuan adil terhadap istri, terutama selama masa iddah. Suami diingatkan untuk tidak menyalahgunakan talak sebagai alat untuk menyakiti atau menzalimi istri. "Hendaklah orang yang mempunyai kelapangan memberikan nafkah menurut lapang rezekinya dan orang yang rezekinya sempit, hendaklah memberikan nafkah dari harta yang diberikan Allah kepadanya". Metode Penelitian menggunakan kualitatif deskriptif. Dan menggunakan analisis data keabsahan data, reduksi data dan triangulasi. Hasil penelitian misteri ekonomi dalam pernikahan sering kali berkaitan dengan bagaimana pasangan dapat mengelola perbedaan, komunikasi terbuka, dan kemampuan untuk bekerja sama dalam mencapai tujuan keuangan bersama. Komunikasi yang baik, keadilan, dan perencanaan yang matang dapat membantu menjawab sejumlah misteri dan mengatasi tantangan yang mungkin muncul dalam konteks ekonomi pernikahan.
