Abstract

This research discusses the relationship between citizenship in international law, with a focus on two implications, namely extradition treaties and diplomatic immunity. Citizenship has an important role in the extradition process and the application of diplomatic immunity because often an individual's citizenship status influences legal and diplomatic decisions. Through literature analysis, recent case studies, and international comparisons, this research identifies that legal and political decisions on extradition and the application of diplomatic immunity are influenced by citizenship. Modern cases, such as the involvement of Julian Assange and Chelsea Manning, forgivemin prove the lack of balancing between international obligations and individual rights. Variations in legal practices between countries, including differences between European countries, the United States, and Asian countries, highlight the need for more consistent international standards. This research recommends increased multilateral dialogue, transparency of legal processes, and long-term case studies to improve understanding and practice regarding citizenship in international law.

Abstract

The regulation of protection during armed conflicts is greatly aided by the distinction between the rights and protections granted to combatants and non-combatants under International Humanitarian Law (IHL). Nonetheless, there hasn't been much discussion in the literature about how nationality affects how these legal safeguards are applied. This study attempts to investigate how fighters' and non-combatants' rights and safeguards under IHL are impacted by nationality. The results show that nationality can have a substantial impact on the legal status and level of protection that individuals receive, regardless of whether they are combatants or not. This research examines obstacles to the application of legal safeguards and illustrates how nationality influences their implementation using case studies of the crises in Syria and Ukraine. The study suggests that within IHL, precise standards on nationality be developed.

Abstract

This research explores the role of the Constitutional Court (MK) in protecting citizenship rights in Indonesia. As a constitutional judicial body, the MK holds a crucial responsibility to review laws against the 1945 Constitution (UUD 1945), ensuring that fundamental rights of citizens, such as freedom of expression, the right to education, and the right to privacy, are not violated by existing legal policies. Through the mechanism of judicial review, the MK acts as a primary guardian capable of annulling laws that are in conflict with the constitution. This study examines various significant cases where the MK has played a critical role in safeguarding citizenship rights. We also identify various challenges faced by the MK, including issues in implementing rulings and potential political pressures that may affect the independence of this institution. From a global perspective, this research compares the role of the MK with constitutional bodies in other countries to provide a broader understanding of how the MK functions in an international context. The research employs doctrinal legal research, which is a process of discovering rules, principles, and doctrines to address the issues at hand. The research is prescriptive in nature. The methodology used is normative/doctrinal/library research. The findings indicate that although the MK has successfully protected citizens' rights through significant rulings, there remains an urgent need to improve the implementation of decisions and to safeguard the institution’s independence. Recommendations for enhancing the MK’s role include expanding legal education to the public, strengthening public access to judicial review mechanisms, and fostering closer collaboration with legal academics and practitioners. With these measures, the MK is expected to continue functioning effectively as a guardian of constitutional rights in Indonesia.

Abstract

This study compares national and Islamic law on citizenship and legal protection for minority groups. Citizenship determines the basic rights of individuals, while minority groups often face discrimination in national and Islamic legal systems. This research explores the protection of minorities in international human rights-based national law and Islamic law through the concept of ahl al-dhimma. Case studies from India, France, Saudi Arabia and Tunisia show a variety of approaches, such as the controversial CAA in India, the laïcité principle in France, and conservative and progressive interpretations of Islamic law in Saudi Arabia and Tunisia. The results highlight the challenges of implementing equal protection in both legal systems due to political and social dynamics. In conclusion, inclusive policies based on interfaith and cross-cultural dialogue are needed to strengthen minority rights globally.

Abstract

This research focuses on the social integration of foreign nationals in Indonesia from the perspective of citizenship. Indonesia has become a favored destination for many foreigners who come to work, study, or seek refuge due to the increasing global mobility. However, the social integration process of foreign nationals in Indonesia faces several challenges, including restrictive citizenship policies and significant cultural and social differences. The aim of this study is to examine the factors that influence the social integration of foreign nationals in Indonesia and to provide policy recommendations that could facilitate a better integration process. This study employs a qualitative case study approach. Policy analysis, in-depth interviews with foreign nationals and local communities, as well as literature reviews from various sources, are all part of the process. The research findings indicate that Indonesia's strict citizenship policies, along with a lack of understanding and interaction between foreign nationals and local communities, are often major barriers to the integration process. The extent to which foreign nationals can integrate into society is influenced by access to education and employment, as well as community support. Additionally, the study compares the social integration processes of foreign nationals in Indonesia with those in countries such as the United States, Germany, and Australia; it was found that more inclusive policies and better-organized integration programs play a significant role in the success of foreign nationals' integration in these countries.

Abstract

This study explores the implications of citizenship on land ownership rights within Indonesian agrarian law. It examines how citizenship status affects the rights to land ownership, focusing on the legal framework established by Indonesian laws, including the Basic Agrarian Law (UUPA) and other relevant regulations. The study employs a qualitative approach, utilizing literature review and case analysis to identify key issues and challenges in the implementation of land ownership laws. Findings reveal that full land ownership rights are exclusively granted to Indonesian citizens, while foreign nationals face significant restrictions. The research highlights several challenges in legal implementation, including bureaucratic inefficiencies and inconsistencies between laws and practical applications. The paper concludes with recommendations for regulatory reforms, improved administrative processes, and enhanced transparency to better support both domestic and foreign stakeholders in land ownership. These recommendations aim to address existing problems and facilitate a more equitable and efficient land management system in Indonesia.

Abstract

The foundation of the Indonesian nation is Pancasila. In Indonesia, the 1945 Constitution serves as the foundation. As an example of a country that has adopted Pancasila as its national anthem, Indonesia is one such country. As an ideology, personal code of ethics, and economic foundation of the Indonesian nation, Pancasila has been assimilated into the guiding principles of the Indonesian nation. The Republic of Indonesia, which was founded on August 17, 1945, is officially known as Pancasila, a name taken from the Arabic letter 0 (Slaat). The Indonesian government designed Pancasila and the Preparatory Party for Indonesian Independence approved it. At the 1945 Session of the People's Representative Council of the Republic of Indonesia, Pancasila was ratified. As the foundation of the state and the foundation of the life of the Indonesian people, the practice of the values of Pancasila is an obligation for all Indonesian people. As a value that can be applied by society in Pancasila. On the other hand, the 1945 Constitution establishes a clear basis for legislative action. Both Pancasila as a national principle and the 1945 Constitution, especially the prohibition clause, as a legal principle, have a very close or inseparable relationship. If Pancasila is hereditary, then the 1945 Constitution is also hereditary. In other words, everything in the government's power structure - including laws, decisions, the executive branch, the democratic system, and so on - must be in accordance with the values outlined in Pancasila. Therefore, the relationship between Pancasila and the 1945 Constitution is a formal relationship. In other words, Pancasila is a positive standard and guiding principle for national development. Pancasila is a strong and unchangeable concept. On the other hand, the creation of the 1945 Constitution is considered the highest decision. In addition, there is a material relationship between Pancasila and the 1945 Proclamation Constitution. Thus, the 1945 Constitution is the basic document of Indonesian law, with all its provisions and clauses derived from Pancasila.

Abstract

The conflict between citizenship and religious identity has become one of the significant social and political challenges in the modern era, especially amidst increasing religious pluralism and globalization. This research aims to analyze these problems within the framework of Islamic law, as well as offering relevant solutions to resolve this conflict. Using a descriptive qualitative approach, this research explores the concepts of citizenship, religious identity, and the interaction between the two in various country contexts, both Muslim and non-Muslim majority. This study also examines concepts in Islamic law such as muwatana (citizenship), ummah (community), and maslahah (public interest) as solutions offered by Islamic law to harmonize citizenship and religious identity. The findings of this research show that Islamic law has the flexibility to be applied in the context of a modern state, by emphasizing justice, equality and respect for human rights. Through these principles, conflicts between citizenship and religious identity can be reduced, both in Muslim-majority countries and in countries with secular policies.

Abstract

The life of the Indonesian nation and state is guided by Pancasila as an ethical system. Pancasila as the basis of the state functions as a value system that directs people's behavior towards a just, harmonious and dignified life. In the ethical context of national life, Pancasila teaches important values such as tolerance, justice, humanity and unity. These values help build national unity amidst cultural, religious and ethnic diversity. In the current era of globalization, the urgency of Pancasila as an ethical system is increasingly important because the nation's noble values can be damaged by modern issues such as individualism, materialism and social conflict. Indonesian society can use Pancasila as an ethical guideline to develop ways of thinking and acting that are in accordance with the spirit of mutual cooperation, respect for human rights, and a balance between rights and obligations. Pancasila helps society unite and helps people make decisions, both institutionally and personally. Therefore, internalizing Pancasila values as an ethical system is a strategic effort to maintain the nation's immortality in facing the evolution of the times and realizing national ideals for a just, prosperous and prosperous life.
