Abstract

One of the obstacles in the Musyarakah Mutanaqisah contract is that two contracts must be carried out, namely cooperation (Syirkah) and rent (Ijarah). In implementing musyarakah mutanaqishah, two types of transactions are involved in one agreement. Therefore, capital goods are not only the object of transactions in musyarakah mutanaqishah but also function as objects in ijarah transactions for business development and as objects in buying and selling transactions to protect ownership of capital goods. This research aims to determine how the implementation of the musyarakah mutanaqisah contract at Bank BNU'26 Syariah Magelang is implemented. Mutanaqisah musyarakah contract is an agreement or arrangement between two or more people that is derivative and in the form of an agreement. This study uses qualitative methods with two approaches, namely interviews and observations. The results of this study confirm that BNU'26 Syariah, implementing the mutanaqisah musyarakah contract to customers, is there is cooperation between the bank and the customer in an effort based on mutual agreement. The contract can be agreed upon if the customer agrees to the requirements that Bank BNU'26 Syariah Magelang has determined.

Abstract

There were at least four schools before the Mullā Ṣadrā era: peripatetic, illumination, ‘irfa>n, and kala>m. These four schools reached common ground in a school of thought known as al-H}ikmah al-Muta'a>liyyah, pioneered and developed by Mullā Ṣadrā. This paper aims to reveal how the epistemology of Mullā Sadrā in al-H}ikmah al-Muta'a>liyyah. The writing method uses the library method. The findings of this study are that Mullā Ṣadrā succeeded in reconciling the peripatetic, illumination, 'irfān, and kala>m methods and then harmonized them with Islamic law. Mullā Ṣadrā believes that the most successful method for attaining true knowledge is kasyaf, which is supported by revelation and does not conflict with burha>n. This can be seen when Mullā Ṣadrā interprets surah al-Wāqi'ah. At first, he was busy studying discursive books, so he felt he already had extensive knowledge. However, when his spiritual vision began to open, he realized that he was empty of true knowledge and convincing essence, and that could be achieved through żauq. Mullā Ṣadrā metaphysical thought is based on three main teachings, namely as}a>lah al-wuju>d (existence excellence), tasyki>k al-wuju>d (gradation of form), harakah al-jauariyah (substantial movement) and al-asfār al-aqliyah al-arba'ah.

Abstract

The “Jo Kawin Bocah” (Javanese term for “No Child Marriage”) movement implemented by the Central Java Government over the past two years has significantly reduced the number of child marriages in Central Java province. This research aims to analyze the concept of “Jo Kawin Bocah” as a government-sponsored movement, identify the critical success factors, and explore the concept in terms maqāṣid al-sharī'ah (Sharia objectives). This field research uses a qualitative approach and deductive thinking, with data collected from interviews and documentation. The findings show that the social movement is feasible because stakeholders are aware of the negative impacts of early marriage. Another critical success factor is the involvement of community members and district/city leaders and collaboration between civil society organizations, the government, educational institutions, and other cross-sector organizations. Viewed from the maqāṣid al-sharī'ah side, the social movement “Jo Kawin Bocah” can realize the protection of the soul (ḥifẓ al-nafs), protection of the mind (ḥifẓ al-‘aql), protection of assets (ḥifẓ al-māl), and protection of offspring (ḥifẓ al-nasl). This research implies that increasing awareness about the negative consequences of early marriage is the key to the success of social movements.

Abstract

This research investigates how the Indonesian Muslim diaspora in the Netherlands strategically reduces or even prevents Islamophobia. The study employs a qualitative research methodology to collect primary data through in-depth interviews and direct observation, complemented by secondary data from both published and unpublished literature, including journals and books. The data was examined through descriptive analysis, which reveals that the adaptation strategies implemented by the Indonesian Muslim diaspora through existing religious organizations effectively mitigate the negative stigma associating Islam with violence and terrorism. The significance of this study lies in its examination of how these strategies influence broader perceptions of Islam in the Netherlands. Although the primary focus is on religious organizations, their involvement is crucial in addressing and countering social stigma. The research identifies several multi-path dimensions used to address and reduce stigma. This includes Track Two Diplomacy, involving non-state actors, and collaboration with the Indonesian Embassy, the Ministry of Religious Affairs of Indonesia, universities, the European Council for Fatwa & Research, and various Dutch communities. These efforts involve biannual conferences, seminars, and interfaith dialogues aimed at tackling Islamophobia and offering solutions. Furthermore, the diaspora participates in Track Seven Diplomacy by engaging religious communities to promote a peaceful vision of Islam Nusantara in partnership with the European Council for Fatwa & Research. The study concludes with recommendations for policymakers, which may influence parliamentary discussions.
