Abstract

Universities in Indonesia have been known to act as educational and teaching institutions, as well as research and community service institutions. The function of Higher Education itself is to increase the added value of students, to produce trained and educated human resources in the fields of science, technology and art so that they can produce Intellectual Property through various research and innovation activities carried out. Universities are obliged to increase the participation of the academic community in supporting institutional performance and making a significant contribution to the community's economy as well as participating in IPR which is a form of real commitment in contributing and being an important part of the development of the National Innovation System (SINAS) in Indonesia. This type of research is normative legal research, with a statutory approach. Types and sources of primary research materials and sources of secondary research materials. The technique of collecting legal materials is through document studies (library studies), and data processing techniques using descriptive techniques. Finally, this study uses data analysis techniques with deductive logic, or processing legal materials by deductive means. This study concludes that efforts to increase awareness of respect for other people's copyrighted works are indeed not an easy job, must be supported by facilities and infrastructure that require very large costs. Support for academics, students, law enforcement officials, the government and the general public regarding copyright is very much needed, because the challenges that arise are not only in terms of the laws and regulations which always open up space to be interpreted differently, but also weak law enforcement, the lack of government contribution to fulfillment of educational data and lack of awareness of respecting copyright of ordinary people or those who are in the world of education, especially higher education..

Abstract

Indonesia's fintech industry has grown rapidly, with transactions reaching more than IDR 15 trillion by 2023, but this growth has also brought significant challenges such as fraud and data leaks that highlight weaknesses in consumer protection. Regulations such as OJK Regulation No. 77/POJK.01/2016 and Government Regulation No. 71 of 2019 have been implemented to balance innovation and consumer protection, but still require further evaluation for their adequacy. The study aims to assess the effectiveness of these regulations in identifying, preventing, and addressing fraud and privacy violations, as well as supporting the continued growth of the fintech industry. Using juridical-normative methodology with statutory, comparative, and conceptual approaches, this study seeks to map weaknesses in the existing legal framework and propose possible improvements. The results of this study are expected to provide practical recommendations to strengthen fintech regulation in Indonesia, support the growth of the digital economy while protecting consumer rights

Abstract

The quality and efficiency of healthcare services have changed significantly due to advances in digital technology and artificial intelligence (AI) in the medical field. However, these advances also present various legal, ethical, and social obstacles that require serious consideration. This study investigates the application of AI in the medical field from a progressive and responsive legal perspective. Using normative juridical methods and qualitatively analyzed secondary data. This study aims to establish adaptive regulations that can adapt to the changing nature of technology while protecting the integrity of medical services and patient rights. This study also shows the importance of integrating human and spiritual values ??into the application of medical technology to ensure that healthcare services are holistic and focused on patient welfare. The study findings suggest that the establishment of a safe, equitable, and sustainable digital health ecosystem depends on the collaboration of policymakers, medical personnel, technology experts, and the public. Therefore, to optimize the advantages of technology and reduce risks in the future healthcare sector, it is important to establish responsive and inclusive regulations based on lex specialist.

Abstract

Civil law is a dynamic field that is constantly evolving in tandem with the evolution of human civilization, which is also impacted by technological advancements and global climate change. Civil law is fundamentally interconnected with the reinforcement of the internal supervisory function, which replaces the external supervisory function. This research aims to ascertain the current state of civil law and the obstacles it faces. The data was analyzed qualitatively, and the method employed normative juridical with secondary data. The findings indicate that the development of modern civil law is a direct result of its fundamental relationship with the relationship between government and society, which enhances the role and participation of society in various domains. Some of the modernizations of civil law that have emerged and are being used to strengthen internal functions related to external control are contract law, consumer protection law, and employment law.

Abstract

A party's liability for unlawful acts committed by another person under its responsibility is established by the principle of vicarious liability in civil law. This principle is crucial in determining the hospital's liability for malpractice committed by medical personnel under its supervision in the context of health services. This investigation employed a normative legal method that considered pertinent legal literature, doctrines, laws, and regulations. The results reveal that Article 1367 of the Civil Code normatively establishes a general basis for liability for the actions of others in a dependent relationship, whereas Article 46 of Law Number 44 of 2009 concerning Hospitals explicitly mandates that hospitals are accountable for the negligence of health workers employed in their institutions. Conversely, the practical implementation of this principle continues to encounter numerous impediments, including the absence of sufficient technical regulations, the challenge of substantiating formal employment relationships, and the absence of consistent jurisprudence. It is anticipated that the principle of vicarious liability will be enforced more effectively, which will enhance legal protection for patients, promote institutional accountability, and establish a health service system that is more transparent, fair, and prioritizes patient safety.
