Abstract

Tujuan penelitian ini mengkaji terhadap pelanggaran kode etik yang mana dilakukan seorang advokat. Adapun rumusan masalah yang diangkat pada penelitian kali ini mengenai pelanggaran kode etik disertakan dengan kasus Frederich Yunadi. Kode etik yang dilanggar termasuk pelanggaran pada kewajiban yang dilakukan oleh advokat pada saat menjalankan tugasnya, baik itu diluar ataupun didalam pengadilan. Kode etik ini ada karena bertujuan untuk memastikan bahwa advokat bisa menjalankan profesinya secara baik, kemudian bertanggung jawab, serta dapat menjaga dan meningkatkan profesionalitas dari profesinya. Penelitian terkait isu ini menggunakan metode yuridis normatif, dengan sumber data yang meliputi data primer dan sekunder, seperti buku, dokumen, jurnal dan literatur lainnya. Teknik pengumpulan data yang dilakukan melalui studi pustaka, yakni mengkaji berbagai informasi tertulis mengenai etika profesi dan hukum dari sumber-sumber yang relevan dan dipublikasikan secara luas, sesuai kebutuhan penelitian hukum normatif. Pelanggaran terhadap kode etik advokat, seperti pada kasus Frederich Yunadi, menunjukkan bahwa advokat memiliki kewajiban untuk menjaga hak dan kepentingan klien. Kasus Fredrich Yunadi menunjukkan pelanggaran serius terhadap kode etik advokat di Indonesia. Hal ini mencerminkan kurangnya integritas dan profesionalisme dalam praktik hukum. The purpose of this study is to examine the violation of the code of ethics commited by an advocate. The formulation of the problem raised in this study regarding violations of the code of ethics is included in the case 0f Frederich Yunadi. The code of ethics that was violated included violations of the obligations carried out by advocates when carrying out their duties, both outside and inside the court. This code of ethics exists because it aims to ensure that advocates can carry out their profession properly, then be responsible, and can maintain and improve the professionalism of their profession. Research related to this issue uses a normative legal method, with data sources including primary and secondary data, such as books, documents, journals and other literature. The data collection technique used was a literature study, namely reviewing various written information regarding professional ethics and law from relevant sources and widely published, according to the needs of normative legal research. Violations of the advocate’s code of ethics, such as in the case of Frederich Yunadi, show that advocates have an obligation to protect the rights and interests of clients. The case of Frederich Yunadi sjows a serious violation of the advocate’s code of ethics in Indonesia. This reflects a lack of integrity and professionalism in legal practice

Abstract

Abstrak Kehadiran advokat sangat penting untuk melindungi hak dan kepentingan klien, terutama karena sebagian besar masyarakat Indonesia memiliki keterbatasan dalam memahami hukum. Pada kenyataannya advokat sebagai penegak hukum dalam membela hak dan memperjuangkan keadilan menghadapi berbagai tantangan dan hambatan yang dapat mempersulit advokat. Penelitian ini menggunakan pendekatan yuridis normatif. Penelitian ini bertujuan untuk menganalisis dan menyoroti pentingnya peran dan fungsi advokat dalam mengawal hak dan keadilan serta tantangan yang dihadapi advokat dalam menjalankan kewajibannya. Peran advokat dalam penegakan hukum tidak hanya berfokus pada memenangkan perkara, tetapi juga pada memperjuangkan kebenaran dan keadilan bagi klien. Hasil penelitian menunjukkan bahwa peran dan fungsi advokat sebagai penegak hukum untuk tercapainya keadilan dan perlindungan hak sangatlah penting bagi masyarakat Indonesia yang memerlukan bantuan hukum. Tantangan dan hambatan yang harus dihadapi advokat ialah seperti ketidaktahuan masyarakat terkait pentingnya pendampingan hukum, penyidik yang menganggap advokat dapat memperumit masalah hukum, adanya praktik makelar kasus. Namun terhadap tantangan tersebut advokat memiliki perlindungan hukum yang dapat membantu advokat bekerja tanpa hambatan seperti hak imunitas advokat yang terdapat dalam Pasal 16 Undang-Undang Nomor 18 Tahun 2003 tentang Advokat, berdasarkan Undang-Undang Nomor 18 Tahun 2003 tentang Advokat, advokat merupakan penegak hukum dengan posisi yang sejajar dengan penegak hukum lainnya dalam usaha menegakkan hukum dan keadilan. Kata Kunci: : Advokat, Keadilan, Penegakan Hukum, Perlindungan Hak   Abstrak The presence of advocates is crucial in protecting the rights and interests of clients, especially since the majority of Indonesians face limitations in understanding the law. In reality, advocates, as legal enforcers defending rights and advocating for justice, encounter various challenges and obstacles that can complicate their work. This study employs a normative juridical approach. It aims to analyze and highlight the importance of the role and function of advocates in safeguarding rights and justice, as well as the challenges they face in carrying out their obligation. The role of advocates in law enforcement extends beyond winning cases; it also involves fighting for truth and justice for their clients. The findings of this study reveal that the role and function of advocates as legal enforcers are essential for achieving justice and protecting rights, particularly for Indonesians in need of legal assistance. The challenges and obstacles faced by advocates include public ignorance of the importance of legal representation, law enforcement officers perceiving advocates as complicating legal processes, and the presence of case-brokering practices. However, in addressing these challenges, advocates are supported by legal protections that enable them to work without hindrance, such as the immunity rights stipulated in Article 16 of Law No. 18 of 2003 on Advocates. According to this law, advocates are legal enforcers with an equal position to other law enforcement officials in the pursuit of justice and the rule of law. Abstract

This research analyzes cases of business competition violations in the sale of packaged cooking oil in Indonesia, related to unfair pricing. The Decision of the Business Competition Supervisory Commission (KPPU) Number 15/KPPU-I/2022 is the focus of the research, concerning Article 19 letter c of Law Number 5 of 1999. This research aims to produce KPPU results from the Maqashid Sharia perspective, especially in safeguarding assets and treasure (Hifz Al-Mal). In addition, this research examines the impact of violations on the availability and price of cooking oil in the Indonesian market. The research method used is normative juridical which is used to analyze statutory regulations, especially Law Number 5 of 1999, as well as related KPPU decisions which involve data analysis from books, journals, and literature relevant to cases of violations and Maqashid Sharia principles. The research results showed that seven companies were proven to have violated Article 19 letter c of Law Number 5 of 1999, by practicing limiting supply and creating artificial shortages that were detrimental to consumers. This violates the principles of Hifz Al-Mal, and is detrimental to the economy and social welfare. Implementation of a program that includes business competition which is expected to prevent similar violations and promote healthy business competition following Maqashid Sharia. However, the effectiveness of this program needs to be increased through massive outreach by KPPU. This research provides policy recommendations to create a fairer and more prosperous market in Indonesia.

Abstract

Artikel ini membahas hak dan kewajiban profesi advokat dalam konteks sistem hukum di Indonesia. Advokat memainkan peran krusial sebagai perwakilan hukum yang bertanggung jawab untuk membela hak-hak klien serta menjaga keadilan dalam proses peradilan. Hak advokat mencakup akses terhadap informasi yang relevan, perlindungan dari tekanan eksternal, serta hak untuk berkomunikasi secara bebas dengan klien. Di sisi lain, kewajiban advokat meliputi menjaga kerahasiaan informasi klien, memberikan nasihat hukum yang akurat, dan bertindak dengan itikad baik. Penelitian ini juga mengidentifikasi tantangan yang dihadapi advokat dalam menjalankan hak dan kewajiban mereka, termasuk konflik kepentingan dan praktik hukum yang tidak etis. Dengan pemahaman yang mendalam mengenai hak dan kewajiban ini, diharapkan advokat dapat lebih efektif dalam menjalankan profesi mereka dan berkontribusi pada sistem peradilan yang lebih adil. Artikel ini menggunakan pendekatan kualitatif dengan analisis dokumen dan wawancara terhadap praktisi hukum untuk mendapatkan wawasan yang lebih mendalam mengenai dinamika profesi advokat di Indonesia.

Abstract

Kode etik profesi advokat merupakan landasan hukum moral dan hukum yang mengatur perilaku dan tindakan advokat dalam menjalankan tugasnya. Penelitian ini bertujuan untuk menganalisis pentingnya kode etik bagi profesi advokat dalam menjaga integritas dan kepercayaan publik. Dalam prakteknya masih banyak dari para advokat ini yang melanggar kode etik profesi advokat itu sendiri, baik berupa pelanggaran etik ringan maupun pelanggaran berat. Penelitian ini menggunakan metode kajian literatur dan dengan pendekatan deskriptif kualitatif. Hasil dari penelitian ini menyimpulkan bahwa kode etik profesi terkhususnya advokat itu sangat penting dan juga krusial dalam menjaga integritas profesi, membangun kepercayaan publik, serta memastikan terselenggaranya peradilan yang adil.

Abstract

Having a mediator in this case is very important, apart from making peace, a mediator is also responsible for helping both parties to make peace and reach an agreement on what both parties want. A mediator’s ability to mediate is really needed, especially in certain cases, to be a mediator you must have expertise or be competent. However, the mediation process is not always successful in helping the dispute resolution process. In reality, the divorce rate in Indonesia is increasing, as is what is happening in the Medan Religious Courts. This research aims to examine the strategies applied by mediators in resolving early divorce cases at the Medan Religious Courts, as well as to assess the level of success of mediators in mediating early divorce cases based on data for 2023. This research uses a qualitative approach with a focus on the quality of the objects studied and applies descriptive methods to related subjects. The approach used is juridical-sociological, by observing social phenomena from a legal perspective. Data sources were obtained through literature study and interviews with mediators at the Medan Religious Court. The results of the research show that mediator at the Medan Religious Court applies seven main strategies in mediating early divorce cases: the mediator must know the situation of the case very well, find out what the desires of both parties are, come up with a solution that is acceptable to both parties, and apply a religious, psychological, beautiful past and family approach. It can be said that the effectiveness achieved by mediators in resolving early divorce cases at the Medan Religious Court has not been effective and efficient. However, several factors that influence the success of mediation, both internal and external, have also been identified. Internal factors can come from the litigants.

Abstract

Tujuan dari penelitian ini sebagai penjelas peran advokat yang tidak hanya sebagai penasihat hukum akan tetapi juga dapat menjadi seorang mediator. Masalah kepastian profesi advokat yang diperbolehkan memegang profesi lain masih terdapat kekosongan hukum antara peraturan dan kenyataan di lapangan. Peran advokat sebagai mediator diperbolehkan dengan syarat memiliki izin sebagai mediator dan tidak sedang memegang perkara dari salah satu pihak yang berperkara dengan tujuan untuk memenuhi syarat sebagai moderator yang bersifat netral. Pendekatan dalam penelitian ini menggunakan pendekatan yuridis normatif, kesimpulan yang didapatkan ialah seorang advokat yang berperan sebagai mediator juga harus tetap memenuhi syarat-syarat sebagai mediator dan tetap mematuhi kode etik sebagai advokat.

Abstract

The implementation of e-Litigation regulated in Perma Number 1 of 2019 is a form of reform of the judicial system to improve efficiency, transparency, and accessibility of law in the digital era. Within this framework, the author determines the formulation of the problem to solve how compliance and obstacles and solutions in the implementation of e-Litigation in Divorce Cases at the Medan Religious Court Based on PERMA Number 1 of 2019, the purpose of this study is to Analyze advocate compliance with the implementation of e-Litigation according to PERMA Number 1 of 2019, Identify the challenges and obstacles of advocates in divorce cases through e-Litigation, Propose solutions to overcome obstacles in the implementation of e-Litigation at the Medan Religious Court. In this study, the author uses the empirical normative juridical research method. In this study, legal documents, field data, and various secondary data such as laws and regulations, court decisions, and legal theories are used. Advocates play a key role as legal assistants who are responsible for mastering electronic procedures, implementing professional ethics, and protecting client data. However, the implementation of this system faces several challenges, especially in divorce cases, such as gaps in technological infrastructure, parties’ unfamiliarity with the e-Litigation mechanism, and concerns regarding data security. This article highlights the strategic role of advocates in ensuring a fair and inclusive judicial process through e-Litigation. In addition, it is proposed to improve training, strengthen technological infrastructure, and develop supporting regulations to overcome existing obstacles. In conclusion, the success of e-Litigation is highly dependent on the synergy between technical readiness and the role of advocates in supporting technology-based access to justice

Abstract

This study aims (1) to find out how the perception of users of the Madrasah Aliyah Negeri 1 Medan Library related to facilities and infrastructure, (2) to find out the obstacles faced by libraries in providing facilities and infrastructure (3) to find out the efforts made by libraries in provide facilities and infrastructure. The method used in this study uses a qualitative descriptive approach. Data collection techniques in this study through observation, interviews and documentation. The results of the research are user perceptions regarding the area of the room, reading tables and chairs, storage of goods, spatial planning, room decoration, collections, wifi and library computers still do not make users feel comfortable and have not been used optimally by library users. In addition, the obstacles faced by the library according to user perceptions can be seen from the facilities and infrastructure that are still inadequate to what is expected by library users. Efforts that have been made by the library in overcoming these obstacles are by submitting a proposal to the principal so that the facilities and infrastructure in the library are adequate and meet the needs of library users. In addition, the efforts made by the library are also through donations of books from students of MAN 1 Medan.
