Kejahatan siber merupakan tantangan serius bagi penegak hukum di era digital. Penelitian ini mengkaji tantangan dalam pembuktian kasus kejahatan siber di Indonesia. Metode kualitatif digunakan dengan menganalisis literatur, peraturan perundang-undangan, dan studi kasus. Hasil penelitian menunjukkan bahwa tantangan utama meliputi sifat transnasional kejahatan siber, anonimitas pelaku, volatilitas bukti digital, dan keterbatasan sumber daya serta keahlian penyidik. Faktor-faktor ini menyulitkan proses pengumpulan dan analisis bukti digital yang valid dan dapat diterima di pengadilan. Diperlukan peningkatan kapasitas penegak hukum, kerjasama internasional, dan pembaruan regulasi untuk mengatasi tantangan ini. Penelitian ini memberikan rekomendasi untuk meningkatkan efektivitas pembuktian dalam kasus kejahatan siber di Indonesia.

Penelitian ini mengkaji peran sentral pembuktian dalam sistem peradilan perdata di Indonesia, dengan fokus pada tantangan praktis dan filosofis yang dihadapi dalam era globalisasi. Pendahuluan membahas pentingnya pembuktian sebagai elemen kunci dalam proses penegakan hukum, serta kerumitan yang terkait dengan interpretasi dan aplikasi prinsip-prinsip pembuktian di konteks hukum perdata. Tujuan penelitian adalah untuk mengeksplorasi teori-teori dasar dan perkembangan terkini dalam hukum pembuktian, dengan menggunakan metode Studi Literatur untuk menganalisis kerangka hukum yang relevan dan penelitian sebelumnya. Hasil penelitian mengidentifikasi bahwa pembuktian bukan hanya sebagai alat teknis, tetapi juga sebagai proses intelektual yang memerlukan pertimbangan mendalam terhadap bukti-bukti yang dipersembahkan dalam sengketa perdata.

Penelitian ini bertujuan tentang analisis strategi hukum guna mempercepat eksekusi putusan hakim perdata. Analisis dilakukan dengan mengkaji permasalahan yang ada dalam penelitian ini yaitu apa saja faktor-faktor yang menghambat pelaksanaan eksekusi putusan hakim perdata dan bagaimana strategi hukum yang efektif untuk mempercepat pelaksanaan eksekusi putusan hakim perdata. Penelitian ini menerapkan metode penelitian hukum normatif melalui pendekatan yuridis. Eksekusi putusan hakim merupakan tindakan hukum yang dilakukan untuk mewajibkan pihak yang kalah dalam perkara agar mematuhi isi putusan hakim. Namun dalam praktiknya, pelaksanaan eksekusi putusan hakim seringkali terhambat oleh berbagai faktor. Hal ini mengakibatkan lambatnya penyelesaian sengketa dan hilangnya kepercayaan masyarakat terhadap sistem peradilan. Hasil penelitian menunjukkan bahwa faktor-faktor yang menghambat pelaksanaan eksekusi putusan hakim perdata dikategorikan menjadi tiga yaitu faktor yuridis, faktor teknis, dan faktor non-yuridis. Untuk mengatasi faktor hambatan tersebut maka diperlukan strategi hukum dalam mempercepat eksekusi putusan hakim perdata yang dikategorikan menjadi dua kelompok yaitu strategi preventif dan strategi represif. Jurnal hasil penelitian ini menyimpulkan bahwa pemilihan strategi hukum yang tepat harus disesuaikan dengan kondisi dan fakta hukum yang ada dalam setiap kasus. Dengan menerapkan strategi hukum yang tepat dan efektif, diharapkan dapat meningkatkan efektivitas eksekusi putusan hakim perdata.

This paper discusses the forms of legal advocacy and efforts that can be made to strengthen legal advocacy carried out by LPAI. The author found that LPAI has actively carried out legal advocacy in the form of lobbying in the form of counseling and education to the community about children's rights and how to identify and report cases of violence or exploitation of children. Through these programs, they try to raise awareness of the need to protect children from all forms of threats they may face. This study analyzes the efforts of child protection institutions in Indonesia in protecting victims of sexual abuse. Using qualitative analysis methods on related data, the main conclusion of this study is that child protection institutions face a number of obstacles that limit their effectiveness in providing adequate protection for victims of sexual abuse. These obstacles include limited resources, lack of coordination between institutions, low public awareness, limited access to protection services, and inconsistent implementation of the law

The principle of the rule of law demands a guarantee of equality for everyone before the law (equality before the law). The Constitution also stipulates that everyone has the right to recognition, guarantee, protection and legal certainty in community and state life, the role and function of advocates as a free, independent and responsible profession is important, in addition to judicial institutions and law enforcement agencies. The role of advocates here is how advocates can carry out their profession in accordance with their duties and functions and in accordance with the code of ethics and oath taken by advocates is to accompany, become legal counsel, provide legal services to clients, both socially and on the basis of receiving honorariums. The purpose of this study is to find out how advocates carry out their duties and professions for the sake of upholding justice based on law for people seeking justice before the law. The research method used is normative with an empirical legal approach using theories and concepts to examine legislation. Advocates in carrying out their duties and functions accompany suspects/defendants in criminal cases and plaintiffs/defendants in civil cases in carrying out their defense when facing a case

The history of the development of the advocate profession in Indonesia reflects the long journey in realizing an independent and just justice system. During the colonial period, the profession of advocate was limited by discriminatory regulations, only allowing advocates of European nationality or those with approval from the colonial government. After independence, the regulation of advocates underwent reform through several laws aimed at establishing an advocate profession that was independent and had integrity. The peak was the birth of Law Number 18 of 2003 concerning Advocates, which established advocacy as a profession that is free, independent and not bound by government power. Through this law, the role of advocates as law enforcers on a par with prosecutors, judges and police is increasingly strengthened. This article aims to provide a chronological overview of the development of the advocate profession in Indonesia, the challenges faced, and its implementation in the modern justice system. With a historical and analytical approach, this research shows that the development of the advocate profession not only reflects the dynamics of law in Indonesia, but also efforts to ensure access to justice for all levels of society

Advokat is a profession that provides legal services both in court and outside of cort that meets the requirements based on the provisions of the Advokat Law. And Advocates have a professional code of ethics, one of which is providing free legal assistance to poor people. However, we often see information on social media that poor people rarely get justice which is caused by various things and one of them is because they cannot hire/hire an Advocate. Because of this, the author wonders how an Advocate is responsible for the code and standars of his profession. This research aims to comprehensicely examine the responsibilities of Advocates regarding their professional code of ethics in providing legal service to poor communities. This research uses the method, systematic literature review (SLR) with the aim of drawing conclusions from pouchtian’s findings which investigate the professional ethics of Advocates in providing legal services free of charge to poor people. The objective of this study is to analyze the juridical aspects of third-party objections to default judgments within the civil justice system in Indonesia. This research aims to understand how judges consider third-party objections and how such objections may affect the enforcement of default judgments. This study adopts a juridical-normative approach, aiming to deeply analyze the prevailing legal norms related to third-party opposition (derden verzet) against default judgments. This approach emphasizes an examination of legal materials, including legislation, doctrines, and court decisions. The methods used in this study are library research and document analysis, where the researcher gathers and examines relevant literature and analyzes legal documents to comprehensively understand the issues studied. The research reveals several important findings regarding third-party objections to default judgments in the context of Indonesia's civil justice system. First and foremost, to submit an objection, the third party must have a right or interest that is harmed by the default judgment. This indicates that third-party opposition cannot be made arbitrarily; it must be based on actual harm suffered by the third party as a result of the judgment. Furthermore, third parties intending to file an objection must not have been involved in the prior proceedings and must not be represented by any of the litigants in the case.

The existence of electronic documents as a system of evidence that is increasingly prevalent is a challenge for the Indonesian legal system. However, proof of electronic documents still refers to the provisions on proof of conventional documents. This research aims to juridically analyse the new system in proving electronic documents in civil cases. The method used in this research is normative juridical (legal research) and uses a statute approach and conceptual approach. The results of this study indicate that electronic document evidence along with the times is included in the realm of law and justice. This new system allows proof of electronic documents online, digital signatures and metadata can be used to determine the authenticity of documents. The development of a new system in electronic documents has actually been regulated quite a lot in Indonesian legislation, but in the realm of civil procedural law there are no provisions governing electronic documents as evidence. This issue is also a problem in civil law, because until now electronic documents have become part of national and international commerce. This is also an expansion of electronic documents as evidence in civil procedure law.

This research aims to understand social action through the lens of Structuration and Agency Theory, with a special focus on the thought of Anthony Giddens and Malcolm Walters. Giddens' Structuration Theory emphasizes the dialectical relationship between agency (individual action) and structure (social rules and resources), where structure not only constrains but also enables action. The concept of duality of structure shows that structure is both the medium and the result of social action. Walters expands this concept by highlighting how individuals, through reflexive capacities, can reproduce or change social structures. This research uses library research methods. The research results show that a deeper understanding of the interaction between agency and structure can enrich sociological analyzes of social change and the sustainability of social structures.
