Abstract

This study aims to assess the effectiveness of appellate remedies in divorce cases as a legal mechanism that protects individuals who disagree with or are dissatisfied by decisions made by the court of first instance. Within the framework of Indonesia’s civil procedural law, appeals function as a corrective measure to address potential judicial errors in the application of law or the evaluation of facts. The research focuses on the normative legal basis of the appellate process as regulated in the Herziene Indonesisch Reglement (HIR), Rechtsreglement voor de Buitengewesten (RBg), Law Number 48 of 2009 on Judicial Power, and the amended Law Number 7 of 1989 concerning Religious Courts. Additionally, the study examines the implementation of Supreme Court Regulation (PERMA) Number 1 of 2019, which introduces the use of electronic systems for filing appeals. Appeals in divorce cases are commonly initiated due to disputes over divorce rulings, child custody, division of marital property, or alimony determinations considered disproportionate. This research employs a normative juridical approach with qualitative analysis, relying on secondary data sources including primary legal materials such as statutes and court decisions, as well as secondary sources like legal literature and academic journals. The findings indicate that the appellate mechanism plays a vital role in ensuring tiered justice and provides an important avenue for parties who feel aggrieved to seek a review of decisions perceived as legally or substantively flawed.

Abstract

Legal Evidence is an important part that determines the process of proving civil cases. Among the various means of proof recognized in civil procedural law, written documents are often used as primary evidence because of their real nature and can be verified through records or archives. This study focuses on the analysis of evidentiary data from letters as evidence, covering authentic deeds and private deeds, and their use in court practice. The method used is normative juridical, with an approach to relevant laws and regulations, legal doctrine, and court decisions. The research findings indicate that written documents, especially authentic deeds, have strong evidentiary value because they fulfill the elements of formality and legal substance, so they can be a strong basis for judges in making decisions. Meanwhile, deeds that are not made before authorized officials have weaker evidentiary power and usually require strengthening through recognition or additional evidence. Overall, the level of success in the process of proving civil cases is highly dependent on the validity and legal force of the written documents submitted..

Abstract

Katsuobushi adalah masakan tradisional Jepang yaitu sejenis ikan kayu yang telah lama dikenal memiliki mutu dan flavour yang baik. Flavour dari katsuobushi terbentuk melalui tahapan proses yang cukup unik yaitu, perebusan, pengasapan, pengeringan dan fermentasi. Penelitian ini bertujuan untuk mengetahui proses pengolahan ikan kayu (Katsuobushi) tongkol (Euthynus affinis) dengan menggunakan perbandingan metode pengeringan matahari, oven dan pengasapan, dan untuk mengetahui parameter mikrobiologi serta untuk mengetahui Aktivitas air (aw) yang terjadi pada ikan kayu. Hasil penelitian nilai aw pada ikan kayu menunjukkan perbedaan nilai. Nilai aw pada pengeringan oven adalah A1 = 0,61, A2 = 0,59, A3 = 0,63 sedangkan pengeringan dengan pengasapan adalah B1= 0,67, B2 = 0,66, B3 = 0,65 dan nilai aw pada pengeringan matahari menunjukkan nilai sebesar C1 = 0,63, C2 = 0,63 C3 = 0,62. Hasil pengujian (ALT) ikan kayu dengan metode perbandingan pengeringan dengan oven 6 x 102 sedangkan nilai ALT ikan kayu yang menggunakan metode pengeringan pengasapan yaitu, 9 x 102 dan nilai ALT ikan kayu dengan metode pengeringan matahari yaitu, 8 x 102, sedagkan total kapang pada ikan kayu dengan perlakuan perbandingan pengeringan yaitu oven 3 x 101 sedangkan pengeringan menggunakan pengasapan yaitu, 9 x 101 dan pengerinagan menggunakan matahari yaitu 6 x 101

Abstract

Introduction: Law enforcement and protection for cyber cases is focused on consumers as victims of digital crimes where consumers are generally harmed when conducting business transactions digitally.  Where the focus of this paper discusses the legal protection of victims of cybercrime victims when transacting business.Purposes of the Research: The purpose of this study is to explain the concept of cybercrime in financial transactions.Methods of the Research: The research method used is normative legal research with a statute legal approach and a conceptual approach.Results of the Research: Cyber crime is currently very growing in Indonesia, especially in the current era of digitalization. Where the law can protect from new crimes that live in the current kekininia period so that victims of cyber crime legally in Indonesia can be implemented in accordance with its purpose, which is to protect all Indonesian people from crime cases.

Abstract

The background of this study is based on the fact that mediation as a non-litigation dispute resolution mechanism is increasingly relevant and needed in the modern legal system. Mediation offers a more participatory, flexible, and deliberation-oriented approach and restorative justice. Debt default cases are common examples that often arise in society, where emotional and social relationships between parties are often disrupted due to legal disputes. This study uses a qualitative method with an empirical legal approach and case studies. Data were obtained through interviews, observations, and reviews of legal documents and academic literature. The analysis was carried out using the Miles and Huberman interactive model to understand the dynamics of communication and negotiation in the mediation process. This study aims to analyze the effectiveness of mediation in resolving default disputes on debt agreements, and to identify factors that influence the success or failure of the process. The problem raised is the high dependence of society on litigation which often results in a long process, high costs, and rifts in social relations between the disputing parties. The results of the study indicate that mediation is effective in reducing conflict escalation and producing a legally binding peace agreement through a peace deed. Key success factors include the competence of the mediator, the openness of the parties, and an empathetic communicative approach. Despite obstacles such as ego, the presence of rigid legal counsel, and technical obstacles, mediation remains a viable peaceful solution and is in line with responsive legal reform.

Abstract

This study discusses the practice of engine modification on motorcycles in the Medan Tembung District, specifically at the MRT Garage workshop. The modifications are carried out at the request of customers to increase engine capacity. However, this practice is often considered illegal because it does not comply with safety standards and existing regulations in Indonesia. This study analyzes the phenomenon from the perspective of Sadd Adz-Dzari’ah in Islamic law, which prohibits actions that have the potential to lead to harm, even if initially permitted. The study also examines Indonesian legal regulations such as Government Regulation No. 55 of 2012 and Law No. 22 of 2009, which regulate the technical aspects of motor vehicle modifications. The findings show that such modification practices violate both Islamic law and government regulations, as they cause harm such as vehicle instability and an increased risk of accidents. This study contributes to the understanding of motor vehicle modification regulations from both Islamic and Indonesian positive law perspectives.

Abstract

This study aims to examine the limitations of judges' authority in issuing civil case decisions based on the principle of ultra petitum partium. The main problem in this study is that there are still judges' decisions that exceed the petitum, thus raising questions about the limits of judicial authority and the consistency of the application of the principles of procedural law. The principle of ultra petitum partium is one of the fundamental principles in civil procedural law which emphasizes that judges may not issue decisions beyond the demands of the disputing parties. This principle functions to maintain objectivity, neutrality, and balance in the role of judges in resolving cases. This study uses a normative legal method with a statutory approach and analysis of a number of court decisions directly related to the application of this principle. The results of the study show that the application of this principle is important to prevent abuse of authority by judges. However, in certain conditions such as cases concerning the public interest, public order, or protection of vulnerable parties, judges are allowed to issue decisions exceeding the petitum. Therefore, the application of this principle must be carried out proportionally and contextually in order to create a fair and just trial.

Abstract

Penelitian ini bertujuan untuk mendalami peran advokat dalam penegakan keadilan, dengan fokus khusus pada hubungan antara etika dan profesionalisme dalam praktik hukum. Dalam konteks sistem hukum yang kompleks, advokat memainkan peran krusial sebagai pembela hak-hak klien sekaligus sebagai penjaga integritas sistem peradilan. Masalah utama yang diangkat dalam penelitian ini adalah tantangan yang dihadapi advokat ketika mereka berusaha menjalankan fungsi mereka secara optimal di tengah tekanan sosial, politik, dan ekonomi yang dapat memengaruhi independensi dan objektivitas mereka. Penelitian ini berakar dari pengakuan bahwa advokat tidak hanya berfungsi sebagai perwakilan hukum, tetapi juga memiliki tanggung jawab moral untuk menegakkan keadilan. Dalam banyak kasus, advokat harus menghadapi dilema etika, seperti konflik kepentingan dan tantangan dalam mempertahankan integritas ketika membela klien yang mungkin bersalah. Oleh karena itu, pemahaman mendalam tentang bagaimana advokat dapat menavigasi situasi-situasi sulit ini sangat penting untuk memastikan bahwa mereka dapat beroperasi secara efektif dalam sistem hukum yang adil. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan analisis deskriptif. Penelitian ini melibatkan studi literatur sejumlah advokat berpengalaman untuk menggali pandangan dan pengalaman mereka dalam praktik hukum. Data yang dikumpulkan kemudian dianalisis untuk mengidentifikasi pola dan tema yang relevan mengenai tantangan etika dan profesionalisme yang dihadapi oleh advokat.

Abstract

The purpose of this paper is to evaluate the direct implications for women, especially wives, if their rights in divorce are not fulfilled. This evaluation is based on the principle that women have equal rights under the law, as regulated in SEMA No. 2 of 2019 concerning the protection of women in the legal system. This research will explain in detail the implications for women if they do not obtain their rights after divorce, such as iddah maintenance and madhiyah maintenance in cases of contested divorce. The study employs a qualitative method with an empirical juridical approach. Primary data sources include interviews with legal experts and affected individuals, while secondary data sources encompass relevant legal documents and literature. The conclusion of this research is that women have the right to obtain their rights after divorce, including iddah and madhiyah maintenance, even in cases of contested divorce, in accordance with the relevant SEMA. Failure to obtain these rights results in various legal and negative implications for women, both long and short term.

Abstract

The phenomenon of illegal marriages among Indonesian Migrant Workers (TKI) in Selangor, Malaysia, especially in the Gombak area, has raised serious legal and social issues, especially concerning the protection of children's rights. Marriages that are not officially registered (nikah siri) cause children from these relationships to face difficulties in obtaining identity documents, citizenship status, access to education, and other basic services. This situation reflects the gap between the legal protection guaranteed by Law No. 35 of 2014 concerning Child Protection and its implementation in the context of cross-jurisdictional countries. This study aims to analyze how the Child Protection Law is applied to children from illegal marriages of TKI abroad, with a focus on access to education and legal status. The method used is a juridical-empirical approach through descriptive qualitative research, with data collection through interviews, field observations, and document studies in the TKI community of SB Sungai Mulia, Gombak, Malaysia. The results of the study indicate that although Law No. 35 of 2014 provides a strong legal basis, its implementation abroad faces major obstacles, including the limitations of Indonesian legal jurisdiction, strict Malaysian regulations, and minimal administrative awareness of Indonesian migrant workers. Data from 2024 recorded that more than 5,400 children of Indonesian migrant workers in Selangor were born from unregistered marriages, with the majority not yet having citizenship status. The Indonesian government has sought solutions through the overseas marriage validation program, the issuance of Birth Registration Certificates (SPL), and the establishment of non-formal learning centers. However, structural obstacles and suboptimal bilateral policies still hinder the fulfillment of children's rights in full.
