Abstract

This study aims to analyze the legal basis for the cancellation of a notarial deed and explain the legal consequences that arise on the status of the deed, the notary's responsibility, and the rights of the parties, as well as to examine legal protection for third parties in good faith. Cancellation of a notarial deed in a civil dispute is an important issue because the deed functions as authentic evidence with perfect evidentiary power. However, the deed can be canceled if there is a violation of the formal and material requirements according to the provisions of the Civil Code and Law Number 2 of 2014 concerning the Position of Notary. The research method used is normative juridical with an approach to statutory regulations, legal doctrine, and court decision studies. The results of the study show that the cancellation of the deed eliminates its authentic power and gives rise to civil, criminal, administrative, and ethical responsibilities for the notary, as well as having an impact on derivative agreements and the rights of third parties. Therefore, caution is needed in notarial practices as well as strengthening supervision and legal updates that are responsive to developments in the digital era. Abstract

 Peran penting dimiliki advokat untuk mendukung penegakkan hukum di Indonesia, termasuk menjalankan fungsi advokasi dan juga memberikan kontribusi bagi sistem hukum. Penelitian ini membahas tentang permasalahan peran advokat yang minim dipahami  masyarakat. Penelitian hukum normatif merupakan metode yang digunakan dalam penelitian ini, dengan analisis yang difokuskan pada regulasi dan kode etik profesi. Hasil penelitian menunjukkan bahwa advokat berfungsi sebagai agen perubahan yang berperan dalam meningkatkan kesadaran masyarakat terhadap hak hukum, memperjuangkan keadilan sosial, serta menegaskan pentingnya organisasi advokat dalam menjaga standar profesionalisme dan etika. Pemahaman tersebut diharapkan dapat mendukung peningkatan kualitas sistem hukum sekaligus memperkuat kepercayaan masyarakat terhadap profesi hukum.Kata Kunci : Advokat, Peran, Organisasi

Abstract

AbstrakArtikel ini membahas hak dan kewajiban advokat terhadap klien dan sistem peradilan berdasarkan tinjauan Undang-Undang No. 18 Tahun 2003 tentang Advokat. Dalam konteks hukum Indonesia, advokat memiliki peran strategis dalam menjamin keadilan bagi klien sekaligus menjaga integritas sistem peradilan. Penelitian ini mengeksplorasi hubungan profesional antara advokat dan klien, meliputi kewajiban advokat untuk menjaga kerahasiaan, memberikan layanan hukum yang berkualitas, serta hak untuk menjalankan profesinya tanpa intervensi yang melanggar hukum. Selain itu, artikel ini mengkaji tanggung jawab advokat dalam mendukung sistem peradilan yang adil dan transparan. Dengan menggunakan pendekatan yuridis normatif, artikel ini menawarkan analisis mendalam mengenai ketentuan hukum yang relevan dan implikasinya dalam praktik advokat di Indonesia.Kata Kunci: hak, kewajiban, Advokat, keadilan, UU No. 18 Tahun 2003.

Abstract

Penelitian ini bertujuan mengkaji tentang teknis pembuatan Surat gugatan yang efektif dan sah secara yuridis. Surat Gugatan dalam hukum perdata menjadi bagian integral dalam sistem hukum perdata, dengan mempertimbangkan aspek, struktur dan konteks hukum. Penelitian ini menggunakan metode penelitian Normatif dengan pendekatan perundang-undangan (Statute Approach) dan pendekatan konsep (Conteptual Approach) Penelitian ini bertujuan mendeskripsikan teknik pembuatan Surat gugatan yang sesuai dengan ketentuan Perundang-undangan. Adapun yang menjadi tujuan penelitian ini adalah memberikan panduan praktis bagi praktisi hukum dan diharapkan dapat meningkatkan kesadaran akan petingnya surat gugatan yang baik dalam memperkuat sistem hukum secara keseluruhan.

Abstract

The issue of child custody (Hadhanah) following divorce in Indonesia remains a critical legal concern, particularly in ensuring children's welfare. Indonesian regulations, including Law No. 1 of 1974 and the Compilation of Islamic Law (KHI), govern custody based on the child’s age and impose an obligation on parents to provide financial support. However, these regulations lack sanctions for parents who neglect their responsibilities, leading to concerns over inadequate care, education, and financial support for children. This study aims to analyze the legal reconstruction of Hadhanah rights from the Maqashid Syari’ah perspective to ensure better child protection. The research employs a library research methodology, examining various legal sources, scholarly works, and judicial decisions to assess the existing legal framework and its implementation in judicial practice. The findings reveal that Indonesian courts typically grant custody to the mother for children who have not yet reached the age of discernment (mumayyiz), following normative legal provisions. However, some judges decide contra legem, prioritizing the child’s best interests based on Maqashid Syari’ah. For example, the Padang High Religious Court granted custody to the father, considering the child's welfare. Enforcement of custody decisions involves forcibly placing the child with the designated guardian, while financial support enforcement is executed through asset seizure from non-compliant parents. To enhance child protection, legal reconstruction is necessary through regulatory reforms and judicial discretion. Revisions should include the introduction of sanctions for negligent parents and the establishment of specialized institutions for child welfare. Judicial reform should provide equal custody opportunities for both parents while prioritizing the child's best interests in alignment with Maqashid Syari’ah principles.

Abstract

This research aims to analyse the role of advocates in providing legal services in various judicial environments in Indonesia, including religious, state, state administration, and military. The background of this research is based on the importance of advocates as an integral part of the legal system that bridges society with judicial institutions, as well as being an enforcer of the rule of law, justice, and human rights. The issue raised is the extent to which advocates are able to carry out their role effectively in various courts. The method used is normative juridical with a statutory approach (statute approach) and literature analysis to explore the relevant legal framework. Research results show that advocates have a great responsibility not only in defending the client, but also in ensuring the fulfilment of the community's constitutional rights, including through free legal assistance (pro bono). However, the main challenge lies in the limited scope of advocates in the military judiciary. In conclusion, advocates play an important role as a balancer of power in the legal system. Strengthening the legal framework is needed so that advocates can contribute more widely, ensuring a fair, transparent, and just judicial process.

Abstract

This study discusses the application of contra legem in the custody (?adhanah) decision following a divorce involving a child who has not yet reached the age of discernment (non-mumayyiz), with a focus on Decision No. 361/Pdt.G/2018/PA.Dps. The research concentrates on three main aspects: the custody rights of non-mumayyiz children, the impact of divorce on caregiving responsibilities, and the legal conflict in the application of custody laws. The method used is normative juridical research, emphasizing the analysis of statutory regulations, legal literature, and relevant legal concepts. The data sources include primary, secondary, and tertiary legal materials. The analysis is conducted qualitatively using juridical, sociological, and shar’i approaches. The findings indicate that Decision No. 361/Pdt.G/2018/PA.Dps is contra legem, deviating from the default legal provisions that assign ?adhanah to either the father or the mother. However, within the framework of Maq??id al-Shar??ah, custody was granted to the maternal grandmother based on legitimate shar’i grounds. Although the mother was deemed nasyuz (disobedient), and the father had a history of domestic violence, the court prioritized the child’s emotional welfare and stability. Therefore, placing the child with the maternal grandmother was considered the most appropriate choice to protect the child’s ma?la?ah (best interest) and fulfill the objectives of Islamic law (maq??id al-shar??ah). The decision aimed to safeguard the child’s life and intellect (?if? al-nafs and ?if? al-?aql). The ?illah qawiyyah (strong legal reasoning) in this case lies in the fact that both parents were deemed unfit, leading the judge to assign custody to the nearest capable relative — the maternal grandmother.

Abstract

Legal uncertainty regarding jurisdiction in cases of corruption involving civilian and military actors, as well as its impact on the effectiveness of the Corruption Eradication Commission (KPK RI), has caused the KPK RI to hesitate in investigating cases of corruption, which could potentially hinder the optimal handling of cases and harm the constitutional rights of citizens to receive the benefits of development. This study aims to unravel how the military hierarchy structure, military court jurisdiction, and analyze the Constitutional Court (MK) Decision Number 87/PUU-XXI/2023 are carried out through the perspective of Maslahah Mursalah, an Islamic legal philosophy that focuses on public welfare and benefit. These research uses a qualitative method with a legal-normative approach. The research is conducted by reviewing and analyzing relevant literature related to the research topic being studied. The results of the study indicate that the military environment is classified as a social stratification when viewed from a legal sociology perspective, with one of its characteristics being the existence of differences in rank and position within the military hierarchy. Furthermore, progressive law advocates the need to revise the Military Court Act so that military personnel who commit general criminal offenses can be fully tried in civilian courts, which undoubtedly represents a significant step forward toward a more humane and just legal system. Furthermore, an analysis of the Maslahah Mursalah principle regarding the Constitutional Court's Decision No. 87/PUU-XXI/2023, using the criteria outlined by Asy-Syatibi, shows that the Court, in its decision, considered the principle of legal certainty as explained in its legal reasoning, as well as Islamic law governing the principle of legal certainty, thereby ensuring that this decision does not contradict Islamic law.

Abstract

This study aims to determine the formation of Advocate Organizations in Indonesia as mandated in Law Number 18 of 2003 concerning Advocates, in fact it has caused a polemic regarding which Advocate Organizations are recognized by the law. As it is known that the 1945 Constitution has provided fundamental protection for freedom of association and assembly, the provisions of that article provide a constitutional basis that every Advocate actually has the right to establish more than one Advocate Organization, so from this it was found a misunderstanding in the Advocate Law, which confuses the notion of an organization and its formation with what is the true meaning of the purpose of establishing a single forum in the Advocate profession. This paper is intended so that the formation of this single forum does not lead to conflicts of struggle between Advocates without prejudice to the freedom and independence of Advocates which is in line with the goals of a modern democratic rule of law which requires the role of the government in the formation of this single forum. Abstract

After the enactment of Qanun No. 6 Year 2014 on (Qanun Jinayat), several problems arose, both internal and external. After the enactment of Qanun No. 6 of 2014 on (Qanun Jinayat), several problems arose, both internal and external problems. Internal problems arise with a variety of problems, facilities and infrastructure are not yet complete, the emergence of polemics about the place of execution of flogging, socialization is still considered insufficient, uneven resolution of Qanun Jinayah enforcement problems in each district / city, the emergence of differences in interpretation in Jinayat cases resolved by Jinayat law and Qanun fostering customary law, between one gampong and another gampong differ in the type of customary sanctions on khalwat, varied in the type of sanctions and law enforcement. More specifically, the internal problems faced in the implementation of Qanun Jinayat in Aceh are from the law enforcement apparatus itself (Wilayatul Hisbah, Police, Attorney General's Office, and Syar`iyah Court) and traditional leaders who have different perceptions of Qanun Jinayat. This not only leads to variations in application, but also often obscures the legal certainty desired by a regulation. The author conducts this research using empirical juridical research method which is a legal research method that uses empirical facts taken directly from the object of research in this case including the Community, University, and Islamic Shari'at Office of Aceh Province either by conducting interviews or direct observation. and with conceptual and statutory approaches using normative juridical methods. The data source used is data obtained indirectly through literature study. The legal materials obtained are then analyzed using descriptive-qualitative analysis to obtain conclusions that can be scientifically accounted for. Keywords: Law, Enforcement, Aceh.
