Abstract

Landasan Nasional Pancasila dan HUT RI merupakan bagian yang tidak terpisahkan dari Bhinneka Tunggal Ika dan tidak dapat dipisahkan satu sama lain. Hal ini sejalan dengan unsur-unsur yang terkandung dalam lambang negara Indonesia. Garuda dengan kepala menoleh ke kanan, perisai berbentuk hati yang tergantung di leher garuda dan semboyan yang tertulis di pita yang dipegang garuda adalah tiga komponen yang membentuk lambang negara, sebagaimana tercantum dalam Pasal 1 Tahun 1951 Peraturan Pemerintah Nomor 66 Tahun 2009. Ungkapan "BHINNEKA TUNGGAL IKA" dicetak dalam bahasa Jawa Kuno pada pita dengan huruf latin. Ini adalah moto Kebangsaan Indonesia.

Abstract

In 1858, Emile Durkheim presented a sociological theory of the concept of solidarity. According to Durkheim, solidarity is a bond between individuals and/or groups based on moral values and beliefs, which are developed from shared emotional experiences. Solidarity stresses the state of interaction between individuals and organizations and serves as the basis for a common bond in life that is supported by the moral standards and beliefs of society. The real realization of a partnership will evoke emotional experiences that will strengthen the partnership. Simple civilization has grown into a modern society. Primitive society's social solidarity is different from modern society's solidarity.

Abstract

Pemerintahan Republik Indonesia saat ini menganut Undang-Undang Dasar yang tercermin dalam Undang-Undang Dasar 1945. Pada tanggal 18 Agustus 1945, PPKI mengesahkan UUD 1945 sebagai konstitusi negara. Di Indonesia, UUD RIS berlaku sejak 27 Desember 1949, dan UUDS 1950 berlaku di Indonesia sejak 17 Agustus 1950. Pemulihan UUD 1945 disahkan dengan Keputusan Presiden tanggal 5 Juli 1959. Hal itu kemudian diakui DPR pada 22 Juli 1959. Ketika negara Indonesia pertama terbentuk, salah satu tujuan utamanya adalah mewujudkan keadilan sosial yang lebih besar bagi seluruh rakyat Indonesia. Dalam rumusan ini, fokusnya bukan pada kepentingan individu, tetapi pada kepentingan seluruh rakyat Indonesia.

Abstract

The Universal Declaration of Human Rights (UDHR) is the foundational human rights declaration. The United Nations adopted it on December 10, 1948. The Universal Declaration of Human Rights is a global reference that establishes universal principles for achieving human rights. Although the Universal Declaration of Human Rights lacks official legal power, its fundamental concepts have become universal standards and are regarded as international law by many nations. Human rights have been codified in numerous international, national, provincial, and local/municipal legal texts. In this piece, the author employs a qualitative descriptive research methodology. It is said to be 'universal' because this right is stated to be a part of every human being's humanity, regardless of skin color, gender, culture, or religion; and it is said to be 'attached' because anyone possesses this right by virtue of his birth as a human being and not because of the grant of any authority institution. This privilege cannot be revoked by anyone because it is "attached." On the basis of the articles of all applicable Indonesian constitutions, it is possible to assert that the conceptualization of human rights in Indonesia has undergone a rigorous and protracted dialectical process. Incorporating human rights into the constitution demonstrates a commitment to upholding the law and human rights. In addition, different human rights provisions in the Indonesian constitution have been crafted to satisfy the needs and requirements for human rights protection in the personal, family, community, and national contexts.

Abstract

The right to justice, and human rights more generally, requires the filing of a judicial review (PK) in Indonesia. A judicial review (PK) can be requested by an individual who believes that his rights have been infringed or that the court's judgment is incorrect. The cassation decision can be challenged in court by either the convicted person or the prosecution if they believe it violates basic principles of fairness and legal certainty. However, the Constitutional Court can in its decision revoke the prosecutor's authority to submit a judicial review (PK) because it is considered contrary to human rights, especially in terms of recognition, guarantees, protection and fair legal certainty and equal treatment before the law. This study used a qualitative research method with a statutory and literature approach. The results of the study stated that it was very important for the prosecutor to have the right to submit a judicial review (PK) on the cassation decision of the Supreme Court which was deemed not to have fulfilled legal certainty and justice for the victim and the state. If this is omitted, it will cripple law enforcement. The reason for submission, guarantee, protection and legal certainty for the convict cannot be fully recognized, because there are still rights to guarantee, protection and legal certainty for the victim and the people of Indonesia which must also be maintained and respected.

Abstract

Damage will hit the people of a country when corruption has become a culture. However, religion as a way of life for the people is able to contribute to dampening this culture of corruption, so that it can save people from the destruction of their culture of life. The method used in this study is a qualitative method with a literate approach. The results of the study stated that religion greatly contributed to reducing the culture of corruption. However, there are still challenges for religion to be able to contribute to reducing the culture of corruption, including the limited involvement of religious leaders in political issues, religious differences, lack of coordination between religious institutions and the government, cultural and social environmental factors, lack of supervision and strict law enforcement. In addition, there are limitations of religious leaders in their mastery of general science and technology.Keywords: Corruption Culture; Religion; Contribution

Abstract

Eradicating the culture of Corruption in people's lives cannot only be done by enforcing the Law, but also by having strong laws and also the courage and willingness of the authorities to apply these laws fairly and firmly. This study also aims to evaluate the effectiveness of criminal Law in dealing with criminal acts of Corruption and provide recommendations to improve weaknesses in the Indonesian criminal law system related to handling criminal acts of Corruption. The method used is a qualitative research method with a literature approach and a statutory approach. The results of the study state that there are weaknesses and challenges in enforcing the Law on Corruption in Indonesia. Therefore there must be government efforts to handle and prevent this criminal act of Corruption. Apart from building anti-corruption awareness so that Corruption does not become a culture in society.Keywords: Corruption Culture; Legal Substance; Legislation Abstrak:Pemberantasan budaya korupsi di dalam kehidupan masyarakat tidak hanya dapat dilakukan dengan penegakan hukum saja, namun juga harus memiliki undang-undang yang kuat dan juga keberanian serta kemauan dari pihak-pihak yang berwenang untuk menerapkan hukum tersebut secara adil dan tegas. Penelitian ini juga bertujuan untuk mengevaluasi efektivitas hukum pidana dalam menangani tindak pidana korupsi dan memberikan rekomendasi untuk memperbaiki kelemahan yang ada dalam sistem hukum pidana Indonesia terkait penanganan tindak pidana korupsi. Metode yang digunakan adalah metode penelitian kualitatif dengan pendekatan literatur dan pendekatan peraturan perundang-undangan. Hasil penelitian menyatakan bahwa ada kelemahan dan tantangan dalam penegakan hukum tindak pidana korupsi di Indonesia. Oleh karena itu harus ada upaya dari pemerintah dalam melakukan penanganan dan pencegahan tindak pidana korupsi tersebut. Selain harus membangun kesadaran anti-korupsi agar korupsi tidak menjadi budaya di masyarakat.Kata Kunci: Budaya Korupsi; Substansi Hukum; Peraturan Perundang-undangan

Abstract

The MUI fatwa has moral weight and can pressure the government to eradicate Corruption and uphold human rights because it comes from a religious institution. The MUI fatwa against bribery and Corruption can serve as a moral compass for Indonesian people, encouraging them to avoid acts of Corruption in their daily lives. In addition to understanding how MUI fatwas can contribute to efforts to eradicate the culture of Corruption in Indonesia, it aims to research the role that MUI fatwas can play. The research method used is qualitative, with a literature approach and a statutory approach. The study results stated that the MUI Fatwa was essential in eradicating Corruption in Indonesia. The MUI fatwa on prohibiting Corruption and prohibiting bribery advises people not to engage in Corruption and encourages them to live an honest and moral life. Applying the MUI fatwa in public and political life is essential to creating a clean and open culture.Keywords: Contribution; MUI fatwas; Corruption Culture Abstrak:Fatwa MUI memiliki bobot moral dan dapat menekan pemerintah untuk memberantas korupsi dan menegakkan HAM karena berasal dari lembaga agama. Fatwa MUI melawan suap dan korupsi dapat menjadi kompas moral bagi masyarakat Indonesia, mendorong mereka untuk menghindari tindakan korupsi dalam kehidupan sehari-hari. Selain untuk memahami bagaimana fatwa MUI dapat berkontribusi dalam upaya pemberantasan budaya korupsi di Indonesia menjadi tujuan penelitian tentang peran yang dapat dimainkan oleh fatwa MUI. Metode penelitian yang digunakan adalah metode penelitian kualitatif dengan pendekatan literatur dan pendekatan peraturan perundang-undangan. Hasil penelitian menyatakan bahwa Fatwa MUI berperan penting dalam pemberantasan korupsi di Indonesia. Fatwa MUI tentang pelarangan korupsi dan pelarangan praktek suap menasihati orang-orang untuk tidak melakukan korupsi dan mendorong mereka untuk menjalani kehidupan yang jujur dan bermoral. Penerapan fatwa MUI dalam kehidupan publik dan politik juga penting untuk menciptakan budaya bersih dan terbuka.Kata Kunci: Kontribusi; Fatwa MUI; Budaya Korupsi

Abstract

The establishment of the Tulungagung Regional Regulation Number 1 of 2018 concerning the Arrangement and Development of People's Markets, Shopping Centers, and Supermarkets to maintain the economic stability of the surrounding community with regulations to relocate networked shops. After the enactment of Law No. 11 of 2020 concerning Job Creation, namely through the implementing regulations of Government Regulation Number 5 of 2021 which regulates the licensing system through Online Single Submission (OSS). This study will discuss the effectiveness of Article 6 paragraph (2) Tulungagung Regional Regulation No. 1 of 2018 After the enactment of the Job Creation Act to run by existing developments in Tulungagung Regency. The problems that will be studied in this paper are 1) the Effectiveness of Article 6 Paragraph (2) Tulungagung Regional Regulation No. 1 of 2018 after the Employment Creation Law; 2) Obstacles in the implementation of Article 6 Paragraph (2) Tulungagung Regional Regulation No. 1 of 2018 After the Job Creation Act. The research method in this paper uses the type of empirical juridical. This study resulted in the first conclusion, the existence of Article 6 paragraph (2) Tulungagung Regional Regulation Number 1 of 2018 is no longer effective after the enactment of Law Number 11 of 2020 concerning Job Creation through its implementing regulation Government Regulation Number 5 of 2021. Second, regarding the authority to issue permits, the authority to supervise and grant business permits, especially SMEs, is currently in the hands of the central government after the enactment of Government Regulation Number 5 of 2021. There are recommendations, namely: Making changes to existing Regional Regulations and improving the quality of Regency Governments based on supervision in issuing permits by looking at the provisions stipulated in Regional Regulations. Keywords: Effectiveness; Authority; Supervision; Permission.   Abstrak Dibentuknya Peraturan Daerah Tulungagung Nomor 1 Tahun 2018 tentang Penataan dan Pembinaan Market Rakyat, Pusat Perbelanjaan dan Toko Swalayan untuk menjaga stabilitas perekonomian masyarakat sekitar dengan adanya aturan untuk melakukan relokasi terhadap toko berjejaring, pasca lahirnya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja, yakni melalui peraturan pelaksananya Peraturan Pemerintah Nomor 5 Tahun 2021 yang mengatur mengenai sistem perizinan melalui Online Single Submission (OSS). Sehingga dalam penelitian ini membahas terkait efektivitas pasal 6 ayat (2) Peraturan Daerah Tulungagung No. 1 Tahun 2018 Pasca lahirnya Undang-Undang Cipta Kerja agar berjalan sesuai dengan perkembangan yang ada di Kabupaten Tulungagung. Permasalahan yang akan dikaji dalam tulisan ini adalah 1) Efektivitas Pasal 6 Ayat (2) Peraturan Daerah Tulungagung No. 1 Tahun 2018 Pasca UU Cipta Kerja; 2) Kendala dalam pelaksanaan Pasal 6 Ayat (2) Peraturan Daerah Tulungagung No. 1 Tahun 2018 Pasca UU Cipta Kerja. Adapun metode penelitian dalam tulisan ini adalah menggunakan tipe penelitian hukum empiris. Dalam penelitian ini menghasilkan kesimpulan pertama, keberadaan Pasal 6 ayat (2) Perda Tulungagung No. 1 Tahun 2018 sudah tidak berlaku efektif pasca lahirnya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja melalui peraturan pelaksananya PP No. 5 Tahun 2021. Kedua, berkaitan dengan kewenangan dalam mengeluarkan izin, kewenangan dalam melakukan pengawasan dan pemberian izin berusaha khususnya UMKM saat ini berada di tangan pemerintah pusat pasca lahirnya PP No. 5 Tahun 2021. Dari penelitian ini peneliti merekomendasikan: Melakukan perubahan terhadap Peraturan Daerah juga meningkatkan kualitas pemerintahan. Keywords: Efektivitas; Kewenangan; Pengawasan; Izin.

Abstract

Pancasila education can have a significant impact on reducing corruption in Indonesia, especially among university students. This is because Pancasila, Indonesia's state ideology, promotes the development of an honest and transparent government. The purpose of the study of how much Pancasila education can help reduce the culture of corruption in Indonesia is to find out how much Pancasila education can help reduce the culture of corruption in Indonesia. The research method used is a qualitative research method with a literature approach and a statutory approach. Research data shows that Pancasila Education is a big reason why the culture of corruption in Indonesia is getting better. Students can get to know and understand the values of Pancasila which encourage anti-corruption attitudes and actions, by studying Pancasila educational resources. In order to continue to fight for the importance of Pancasila education and eliminate the culture of corruption in Indonesia, strong support from the government, educational institutions, society and society is needed.
