Abstract

Pancasila education can have a significant impact on reducing corruption in Indonesia, especially among university students. This is because Pancasila, Indonesia's state ideology, promotes the development of an honest and transparent government. The purpose of the study of how much Pancasila education can help reduce the culture of corruption in Indonesia is to find out how much Pancasila education can help reduce the culture of corruption in Indonesia. The research method used is a qualitative research method with a literature approach and a statutory approach. Research data shows that Pancasila Education is a big reason why the culture of corruption in Indonesia is getting better. Students can get to know and understand the values of Pancasila which encourage anti-corruption attitudes and actions, by studying Pancasila educational resources. In order to continue to fight for the importance of Pancasila education and eliminate the culture of corruption in Indonesia, strong support from the government, educational institutions, society and society is needed.

Abstract

Basically, human rights in Islam are centered on five main things which are summarized in al-dloruriyat al-khomsah or also called al-huquq al-insaniyah fi al-islam (human rights in Islam). This concept contains five main things that must be guarded by every individual, namely hifdzu al-din (respect for religious freedom), hifdzu al-mal (respect for property), hifdzu al-nafs wa al-'ird (respect for the soul, rights to life and individual honor) hifdzu al-'aql (respect for freedom of thought) and hifdzu al-nasl (the obligation to protect offspring). Every human being has basic (fundamental) rights that cannot be revoked and relinquished simply because of differences in race, skin color, religion, gender, language, politics, nationality, and other statuses. Islam as a universal religion has taught the importance of human rights in general regardless of religion, race, ethnicity, and language. In writing this writing using qualitative research methods with a literature approach. The results of the research in this article provide an explanation regarding human rights in the Koran along with the interpretation and protection of human rights law according to the interpretation of the Koran which is in accordance with Islamic teachings.

Abstract

Indonesia and Malaysia are predominantly Muslim and belong to the Shafii school of thought. Both have similarities concerning the rights of the wife in divorce. This study examines the fulfilment of post-divorce rights for women based on the decisions of the Religious Courts in Indonesia and Malaysia. The period for this research object is limited to 2014-2016. The research used a qualitative method with comparative and case approaches. This study finds that, legally, a wife can receive post-divorce rights, including ‘iddah, mut‘ah and ḥaḍānah. However, the Indonesian and Malaysian courts’ decisions regarding women’s post-divorce rights differ depending on whether the women request the fulfilment of their rights in their petitions. In Indonesia, judges can use their ex-officio rights to grant women their rights even without their requests. In Malaysia, on the other hand, the wives must state their demands in their petitions.  Abstrak: Indonesia dan Malaysia adalah negara mayoritas berpenduduk muslim dan bermazhab Syafi’i. Keduanya memiliki persamaan berkaitan dengan hak- hak isteri dalam perceraian. Penelitian ini bertujuan untuk mengetahui hak-hak isteri dalam perceraian berdasarkan putusan-putusan Pengadilan Agama di Indonesia, dalam hal ini Pengadilan Agama Jakarta Selatan dan Mahkamah Syariah di Malaysia. Kurun waktu objek penelitian ini dibatasi tahun 2014- 2016. Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan komparatif dan pendekatan perundang-undangan. Hasil penelitian menyatakan bahwa hak-hak yang dapat diterima isteri dalam perceraian yaitu hak nafkah ‘iddah, mut‘ah dan ḥaḍānah. Namun dalam kenyataan, putusan pengadilan tentang hak-hak isteri dalam perceraian di Indonesia dan Malaysia terjadi perbedaan. Perbedaan putusan tersebut terjadi dalam hal isteri pada proses persidangan tidak memohon atau menuntut hak-haknya kepada majelis hakim. Di Indonesia, hakim memiliki hak ex officio. Hakim memberi hak- hak isteri, meskipun isteri tidak menuntut hak-haknya selama temohon selalu hadir dalam persidangan. Di Malaysia, hak-hak isteri harus diminta kepada majelis hakim oleh isteri, karena perceraian merupakan permohonan dan kesepakatan antara para pihak.

Abstract

This article aims at discussing Vladimir Putin's use of constitutional amendments as a political communication tool. The 2020 amendments to the Russian Constitution have significant implications for Putin's political powers and communication strategies. This research explores Putin's role in the constitutional amendments using a qualitative methodology, a literature-based approach, and an analysis of laws and regulations. The study results indicate that Putin uses constitutional amendments to increase his authority and extend the President's term. One of the communication strategies employed is effectively utilizing media and communication channels to create a narrative supporting the amendment. Putin also uses nationalist rhetoric and Russian identity to legitimize his decisions. In addition, Putin controls state media and prioritizes messages that influence public opinion. Putin's political communication strategy includes manipulating propaganda and information to enhance his position, maintain public opinion, and obtain support.

Abstract

This article seeks to investigate Indonesian government policymakers' role in enhancing education quality. This study employed a qualitative approach focusing on the literature and the Law. Data is gathered from various sources, including scientific journals, government publications, and educational policy documents. The findings of this study indicate that government policymakers play a crucial role in the development and enhancement of the education system in Indonesia. The Government creates a high-quality, inclusive, and competitive educational environment through various programs, policies, and budget allocations. The formulation of the appropriate procedure is crucial to attaining the objective of improving the quality of education. Education policies that are comprehensive and in line with the community's requirements are the foundation for sustainable education development. In addition, rigorous monitoring and evaluation by government stakeholders contribute to implementing effective policies and following national education standards. Improving the caliber of the teaching staff is also a key objective, necessitating ongoing training and professional development. Improving education quality also depends on the Government's dedication to allocating the education budget. By allocating sufficient funds, the Government can construct and maintain an appropriate educational infrastructure, offer tuition assistance, and promote increased access to education for all segments of society.Keywords: Contribution; Government Policy Holders; Education quality; Education system; Indonesia Abstrak:Artikel ini berusaha menyelidiki peran pembuat kebijakan pemerintah Indonesia dalam meningkatkan kualitas pendidikan. Penelitian ini menggunakan pendekatan penelitian kualitatif dengan fokus pada literatur dan hukum. Data dikumpulkan dari berbagai sumber, termasuk jurnal ilmiah, publikasi pemerintah, dan dokumen kebijakan yang berkaitan dengan pendidikan. Temuan penelitian ini menunjukkan bahwa pembuat kebijakan pemerintah memainkan peran penting dalam pengembangan dan peningkatan sistem pendidikan di Indonesia. Pemerintah berkontribusi dalam menciptakan lingkungan pendidikan yang berkualitas, inklusif, dan berdaya saing melalui berbagai program, kebijakan, dan alokasi anggaran. Perumusan kebijakan yang tepat sangat penting untuk mencapai tujuan peningkatan mutu pendidikan. Kebijakan pendidikan yang komprehensif dan sesuai dengan kebutuhan masyarakat merupakan landasan pembangunan pendidikan yang berkelanjutan. Selain itu, pemantauan dan evaluasi yang ketat oleh pemangku kepentingan pemerintah berkontribusi pada implementasi kebijakan yang efektif dan sesuai dengan standar nasional pendidikan. Meningkatkan kualitas staf pengajar juga merupakan tujuan utama, yang memerlukan pelatihan berkelanjutan dan pengembangan profesional. Peningkatan mutu pendidikan juga tergantung pada kesungguhan pemerintah dalam mengalokasikan anggaran pendidikan. Dengan mengalokasikan dana yang cukup, pemerintah dapat membangun dan memelihara infrastruktur pendidikan yang memadai, menawarkan bantuan biaya pendidikan, dan mendorong peningkatan akses pendidikan bagi semua lapisan masyarakat.Kata kunci: Kontribusi; Pemangku Kebijakan Pemerintahan; Kualitas Pendidikan; Sistem Pendidikan; Indonesia

Abstract

This article examines the role of zakat social solidarity in reducing the Indonesian culture of corruption. Corruption is pervasive and detrimental to development and the welfare of the people in Indonesia's numerous sectors. In Islam, social solidarity is a fundamental value that encourages Muslims to share their prosperity with those in need through the tithe. This article explains that the practice of tithing social solidarity can play a significant role in preventing and reducing corruption culture. Through qualitative research methods with a literature approach, this article explores an understanding of social solidarity and its impact on reducing the culture of corruption. Various related literature and research are used as references to support the arguments presented. The results of the study state that by practicing zakat, people are empowered economically, educationally and healthfully, thereby reducing social inequality and increasing welfare. In addition to fostering strong social awareness and concern, the practice of zakat reduces harmful behaviors such as corruption and extortion. Social solidarity through zakat also promotes the adoption of ethical and moral values in business, increases public participation in monitoring corruption, and fosters cooperation among economic actors to promote transparency and accountability.

Abstract

Elections are an important aspect of democracy, and their success depends largely on the integrity and transparency of the process. In the Indonesian context, the Election Supervisory Body (Bawaslu) plays a major role in supervising and resolving election disputes. This article explores Bawaslu's key role in resolving election disputes and its contribution to democratic stability in Indonesia. This research aims to identify the positive impact of dispute resolution by Bawaslu on the general election process and public trust. This research uses qualitative research methods with a literature approach and a statutory regulations approach. Data was obtained from various sources, including related literature, laws and regulations related to elections, and official Bawaslu documents. This research concludes that Bawaslu has a very important role in resolving election disputes in Indonesia. By using transparent and fair research methods, Bawaslu helps maintain the integrity of general elections, overcome disagreements, and increase public confidence in election results. Bawaslu's contribution is not only in resolving disputes but also in strengthening the democratic system in Indonesia. This means that Bawaslu also produces valuable learning experiences for stakeholders, including political parties, election organizers and civil society, to improve the general election process in the future.Keywords: Bawaslu; Dispute resolution; Election AbstrakPemilihan umum merupakan aspek penting dalam demokrasi, dan keberhasilannya sangat bergantung pada integritas dan transparansi prosesnya. Dalam konteks Indonesia, Badan Pengawas Pemilu (Bawaslu) memegang peran utama dalam mengawasi dan menyelesaikan sengketa pemilu. Artikel ini mengeksplorasi peran kunci Bawaslu dalam mengatasi sengketa pemilu dan kontribusinya terhadap stabilitas demokrasi di Indonesia. Penelitian ini bertujuan untuk mengidentifikasi dampak positif penyelesaian sengketa oleh Bawaslu terhadap proses pemilihan umum dan kepercayaan publik. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan literatur dan pendekatan peraturan perundang-undangan. Data diperoleh dari berbagai sumber, termasuk literatur terkait, peraturan perundang-undangan terkait pemilu, dan dokumen resmi Bawaslu. Penelitian ini menyimpulkan bahwa Bawaslu memiliki peran yang sangat penting dalam penyelesaian sengketa pemilu di Indonesia. Dengan menggunakan metode penelitian yang transparan dan adil, Bawaslu membantu menjaga integritas pemilihan umum, mengatasi ketidaksetujuan, dan meningkatkan kepercayaan publik terhadap hasil pemilu. Kontribusi Bawaslu bukan hanya dalam menyelesaikan sengketa tetapi juga dalam memperkuat sistem demokratis di Indonesia. Artinya, Bawaslu juga menghasilkan pengalaman pembelajaran yang berharga bagi pemangku kepentingan, termasuk partai politik, penyelenggara pemilu, dan masyarakat sipil, untuk meningkatkan proses pemilihan umum di masa depan.Kata Kunci: Bawaslu; Penyelesaian Sengketa; Pemilu

Abstract

This article's goal is to explain how the National Sharia Council Institution - Indonesian Ulema Council (DSN-MUI) works to avoid sharia conflicts. The purpose of this research is to provide a holistic view of the DSN-MUI's role in settling potential disputes involving sharia-related components of different spheres of life. This article uses a qualitative research method with a literature approach, meaning that it takes information from previously published works at the DSN-MUI Institute and the role it plays. The information collected is then critically examined to reveal how the DSN-MUI can be used to avoid and resolve sharia-based legal problems. The findings of the study indicate that the DSN-MUI Institute plays a significant part in the avoidance of sharia disagreements by issuing fatwas and guidance. Because the DSN-MUI acts as a respected authority in interpreting Islamic law and offering guidance on its application, it is able to avoid or resolve a variety of possible issues that may develop as a result of differences in the interpretations of Islamic law. In addition, the DSN-MUI serves as a community-recognized organization for the resolution of disputes, thereby assisting in the prevention of conflicts and the discovery of solutions that are in conformity with the tenets of sharia law.Keywords: DSN-MUI; Sharia Disputes; The Role of Prevention Abstrak:Artikel ini bertujuan untuk menjelaskan bagaimana Lembaga Dewan Syariah Nasional - Majelis Ulama Indonesia (DSN-MUI) bekerja untuk menghindari konflik syariah. Tujuan dari penelitian ini adalah untuk memberikan pandangan holistik tentang peran DSN-MUI dalam penyelesaian potensi sengketa yang melibatkan komponen-komponen yang terkait dengan syariah dari berbagai bidang kehidupan. Artikel ini menggunakan metode penelitian kualitatif dengan pendekatan literatur, artinya mengambil informasi dari karya-karya yang diterbitkan sebelumnya di Institut DSN-MUI dan peran yang dimainkannya. Informasi yang terkumpul kemudian dikaji secara kritis untuk mengungkap bagaimana DSN-MUI dapat digunakan untuk menghindari dan menyelesaikan permasalahan hukum berbasis syariah. Temuan penelitian menunjukkan bahwa DSN-MUI Institute berperan penting dalam menghindari perselisihan syariah dengan mengeluarkan fatwa dan tuntunan. Karena DSN-MUI bertindak sebagai otoritas yang dihormati dalam menafsirkan hukum Islam dan menawarkan pedoman penerapannya, ia mampu menghindari atau menyelesaikan berbagai kemungkinan masalah yang mungkin berkembang sebagai akibat dari perbedaan interpretasi hukum Islam. Selain itu, DSN-MUI berfungsi sebagai organisasi penyelesaian sengketa yang diakui masyarakat, sehingga membantu pencegahan konflik dan penemuan solusi yang sesuai dengan prinsip hukum syariah.Kata Kunci: DSN-MUI; Sengketa Syariah; Peran Pencegahan

Abstract

The rise of social media has facilitated communication between people, but it has also made it simpler to spread false information, which can lead to hate speech. At the height of the COVID-19 pandemic, all public gatherings were canceled, and people stayed home. Due to the ease with which information may be shared and disseminated and the difficulty in determining the authenticity of user claims, online hate speech is commonplace. The author incorporates legal research methods from qualitative and normative perspectives into this paper. As the results show, social media use has skyrocketed during the COVID-19 pandemic due to government restrictions on activities that can be carried out outside the home. Thus, many people like spending time on social media, and some even deliberately post remarks that amount to hate speech.Keywords: Crime; Hate Speech; Social media Abstrak Maraknya media sosial telah memfasilitasi komunikasi antar manusia, tetapi juga mempermudah penyebaran informasi palsu, yang dapat mengarah pada ujaran kebencian. Pada puncak pandemi COVID-19, semua pertemuan publik dibatalkan, dan orang-orang tetap tinggal di rumah. Karena mudahnya informasi dibagikan dan disebarluaskan serta sulitnya menentukan keaslian klaim yang dibuat oleh pengguna, ujaran kebencian online menjadi hal yang lumrah. Penulis memasukkan metode penelitian hukum baik dari perspektif kualitatif maupun normatif ke dalam makalah ini. Hasilnya, penggunaan media sosial meroket di masa pandemi COVID-19 sebagai akibat dari pembatasan pemerintah terhadap aktivitas yang boleh dilakukan di luar rumah. Sehingga, banyak orang yang suka menghabiskan waktu di media sosial, bahkan ada yang sengaja memposting ucapan yang berbau ujaran kebencian.Kata Kunci: Tindak Pidana; Ujaran Kebencian; Media Sosial

Abstract

This article discusses the politics of marriage law in the Russian Muslim diaspora. The Muslim community in Russia faces challenges in carrying out their marriage according to the principles of the Islamic religion amidst the legal regulations in force. This article analyzes the political development of marriage law in the Russian Muslim diaspora, including the recognition of Islamic marriage law, the settlement of legal conflicts between Islamic marriage and state law, and the role of Islamic organizations in safeguarding Muslim marriage rights. This article also presents case studies, examples of legal marriage practices in the Russian Muslim diaspora, and obstacles and solutions encountered in dealing with different legal regulations. This study uses normative research methods. Conceptual, literary and sociological approaches are used in normative or doctrinal research. Data analysis in this study used qualitative analysis methods. The results of the study state that there are political implications of the marriage law of the Russian Muslim diaspora, in addition to the challenges and opportunities in fulfilling the elements of the rights of the Muslim community in Russia. Therefore, it is expected to contribute to broadening the understanding of the politics of marriage law in the Russian Muslim diaspora and exploring issues related to Muslim marriage rights in the context of that country.
