Abstract

This study examines the criminal responsibility of a child perpetrator of sexual intercourse offenses under Indonesia’s juvenile justice system, focusing on the analysis of the District Court of Pangkalpinang Decision Number 4/Pid.Sus-Anak/2025/PN Pgp. The child was sentenced to three months in a Special Child Development Institution and required to participate in a three-month vocational training program. The sentence was conditional, emphasizing rehabilitative and educational approaches. This research aims to assess the alignment of the judicial verdict with the principles of Law Number 11 of 2012 on the Juvenile Criminal Justice System, particularly the application of restorative justice and non-penal approaches for juvenile offenders. Employing normative juridical methods and a case study approach, this paper reveals that the conditional sentence and vocational training illustrate a concrete application of juvenile criminal punishment prioritizing the child’s best interests and legal protection. Furthermore, the involvement of legal counsel, social advisors, and the child’s parents signifies the practical implementation of restorative justice principles within juvenile court proceedings.

Abstract

This study aims to examine the influence of school climate on junior high school students attitudes toward bullying in the South Pontianak District, the influence of peer conformity on these attitudes, and the combined effect of both variables. The research employed a quantitative approach using an ex post facto design conducted in public junior high schools throughout the district. The sample comprised 368 students selected through proportional random sampling. Data were collected using a validated and reliable questionnaire. The analysis techniques included descriptive statistics, normality testing, hypothesis testing, and the coefficient of determination. The findings reveal that school climate has a positive and significant influence on students anti-bullying attitudes, with a significance value of 0.001 0.05. Peer conformity also has a positive and significant influence, with the same significance level. When analyzed simultaneously, school climate and peer conformity significantly influence students attitudes, contributing 27.3% to the variance in bullying attitudes as indicated by the adjusted R square value. The remaining 72.7% is attributed to other factors beyond the scope of this study.AbstrakPenelitian ini bertujuan untuk mengkaji pengaruh iklim sekolah terhadap sikap remaja SMP di Kecamatan Pontianak Selatan terkait perundungan, pengaruh konformitas teman sebaya terhadap sikap remaja terhadap perundungan, serta pengaruh simultan antara iklim sekolah dan konformitas teman sebaya terhadap sikap tersebut. Pendekatan yang digunakan dalam penelitian ini adalah kuantitatif dengan jenis penelitian ex post facto, yang dilaksanakan di SMP Negeri se-Kecamatan Pontianak Selatan. Sampel berjumlah 368 siswa yang dipilih melalui teknik proportional random sampling. Pengumpulan data dilakukan melalui angket yang telah diuji validitas dan reliabilitasnya. Teknik analisis data meliputi analisis deskriptif, uji normalitas, uji hipotesis, dan uji koefisien determinasi. Hasil penelitian menunjukkan bahwa iklim sekolah berpengaruh positif dan signifikan terhadap sikap remaja dalam menolak perundungan, dengan nilai signifikansi 0,001 0,05. Konformitas teman sebaya juga memiliki pengaruh positif dan signifikan terhadap sikap remaja terhadap perundungan, dengan nilai signifikansi yang sama. Secara simultan, iklim sekolah dan konformitas teman sebaya memberikan pengaruh signifikan terhadap sikap remaja, dengan nilai adjusted R square sebesar 0,273. Artinya, kedua variabel tersebut berkontribusi sebesar 27,3% terhadap sikap remaja, sementara sisanya dipengaruhi oleh variabel lain di luar penelitian ini.

Abstract

This study investigates the role of Rambu Solo funeral rituals and Tongkonan ancestral houses in fostering interfaith harmony and social cohesion in Rembon, Tana Toraja, Indonesia. The research aims to explain how these traditions, beyond their symbolic functions, operate as practical mechanisms for conflict resolution and community solidarity in a highly plural society. This focus is crucial given Indonesia’s recurring challenges in managing religious diversity, where pluralism, if not effectively governed, can lead to social tension and communal conflict. A qualitative case study design was employed, drawing on in-depth interviews with traditional leaders, religious figures, and community members, complemented by participant observation and document analysis. Data were analyzed using thematic analysis to uncover the mechanisms, values, and processes embedded in Rambu Solo and Tongkonan. The findings reveal that Rambu Solo serves as a site of interfaith cooperation through collective participation in rituals, while Tongkonan provides a deliberative forum for consensus-building on social and religious issues. The implications suggest that Toraja traditions can serve as models for multicultural policy and practice, particularly in promoting local wisdom as instruments of peacebuilding. Adaptive strategies, including simplifying ritual obligations, integrating cultural values into education, and fostering interfaith dialogue between adat and religious leaders, are recommended to sustain harmony. The originality of this research lies in its demonstration that interfaith harmony emerges not only from doctrinal ideals or abstract principles but from living cultural institutions that embed pluralism into daily practices. By bridging Durkheim’s concept of collective consciousness and Weber’s theory of communal solidarity with empirical evidence from Toraja, this study contributes a distinctive model of sustainable pluralism rooted in indigenous traditions.

Abstract

This study aims to evaluate the effectiveness of the AIR (Auditory, Intellectually Repetition) learning model in enhancing students' cognitive, psychomotor, and affective learning outcomes. The research employs an experimental approach using a pre-test and post-test design on selected student groups. Test results analyzed through the SPSS application indicate a significant improvement in learning outcomes before and after implementing the AIR model, with a significance value below 0.05. These findings suggest that the AIR model effectively enhances student learning. Additionally, an improvement in the psychomotor aspect was observed, as students demonstrated greater engagement when using the AIR model compared to traditional methods. Similarly, the affective aspect showed progress, as students exhibited responsibility in group settings by actively responding to teachers' questions. This reinforces the effectiveness of the AIR model in improving learning outcomes across cognitive, psychomotor, and affective domains. However, students with a kinesthetic learning style may not fully benefit from this approach, necessitating adjustments to accommodate their needs. This research is expected to contribute to the development of learning strategies that align with educational objectives across different levels

Abstract

Penelitian ini bertujuan untuk menguraikan bagaimana politik hukum perburuhan di Indonesia: sebuah gerak perubahan karakter produk hukum dari 1945-2021, dimana masalah penegakan hukum bidang perburuhan di Indonesia saat ini adalah pembuatan peraturan-peraturan hukum yang tidak memiliki karakter responsif seperti halnya Undang-Undang Nomor 11 Tahun 2020 tentang Omnibus Law. Metode penelitian yang digunakan adalah metode penelitian normatif dan secara proporsional juga menggunakan metode penelitian sosiolegal dengan pendekatan kasus. Originalitas dari penelitian ini adalah menganalisis langkah-langkah perkembangan konfigurasi politik hukum DPR dan Presiden yang dapat mempengaruhi karakter produk hukum bidang pemburuhan seperti yang dihasilkan melalui Undang-Undang Nomor 11 Tahun 2020 tentang Omnibus Law tersebut. Hasil penelitian menunjukan bahwa saat ini konfigurasi politik hukum otoriter dan dapat menghasilkan karakter produk hukum bidang perburuhan refresif. Hal terpenting dari mempelajari teori-teori dan tipe-tipe perkembangan hukum tersebut adalah untuk menyesuaikan ke arah mana kebijakan pembangunan hukum nasional dapat diarahkan, khususnya hukum perburuhan.

Abstract

Pada saat ini sering terjadi kasus kebocoran data pribadi, salah satunya ialah kebocoran data pribadi pasien. Banyak klinik atau fasilitas pelayanan kesehatan yang mempublikasikan hasil perawatan pasien tanpa persetujuan yang bersangkutan. Salah satu klinik gigi di pangkalpinang yaitu klinik FRAYA Dental  juga mempublikasikan hasil perawatan gigi pasien di halaman sosial media yang klinik miliki. Tujuan dari penelitian ini untuk mengetahui bagaimana tanggung jawab klinik Fraya Dental dalam mengelola dan menjaga keraasiaan data pasien berdasarkan peraturan yang berlaku. Metode penelitian yang digunakan adalah normatif empiris dimana peneliti mengkaji kaidah hukum yang berlaku mengenai peraturan data pribadi pasien. Hasil penelitian ini menyatakan bahwa klinik Fraya Dental telah melakukan prosedur yang tepat dalam menjaga kerahasiaan data pasien. Namun belum sepenuhnya terpenuhi karena klinik masih mempublikasikan hasil perawatan gigi pasien dilaman sosial media klinik. Oleh karean itu sebaiknya klinik tetap menjalakan prosedur yang tepat dalam mengelola kerahasiaan data pasien agar keamaan dan kesejahteraan pasien terjamin.

Abstract

The effort of providing protection for all Indonesian migrant workers abroad is focused on two categories. Firstly, the phase of pre-departure of Indonesian migrant workers in which an approach of cross sectors is carried out by both the Indonesian government and the private agencies in order to prepare them with all the things needed when they arrive at countries of their destination. Secondly is the phase of arrival and post-arrival of Indonesian migrant workers abroad. As in Malaysia, the policy on the arragenment of labor affairs either for Malaysian workers or for foreign workers is officially and legally protected in Labor Act of 1955, Industrial Relation Act of 1967, Trade Union Act of 1959, and in Compensation Act of 1952. The process of labor trials is settled through The Labor Court. This Labor Court no more handles the process of trial of illegally foreign workers. There are needs of establishing Labor Cooperation Agreement (LCA) on the ministerail level, Implementaion Agreement serving as the general policy on the executors level as well as Standardized Labor Contract which has been amended. The establishments of Labor Cooperation Agreement, Implementing Agreement and Standardized Labor Contract should occur before all workers leave Indonesia and are aimed at providing legal protection for every single Indonesian migrant worker. In order that there is no collision between the Malaysian laws and Indonesian laws, the government officials of related issues of both countries must do observations and conduct discussions without neglecting the prevail laws of each country. Any issue of labor affairs should always be referred to the laws of both countries.

Abstract

Curriculum of corporate law must be prepared to enter into the world of the industry with a very characteristic and distinctive, and the corporate law is not separated from the external business culture conditions develop. This means, the conditions of the external culture assumed already embedded in advance within the students, before they work in a company and then drift in the culture of the company. Because of its implication, build a new paradigm of curriculum into an absolute obligation to be met by faculty of law at this time. Construct curriculum based corporate law building the entrepreneurial spirit in faculty of law is the solution. The results showed that the revitalization of the new paradigm in developing corporate law should be immediately done. Where in the era of free market today many businessmen doing business without an understanding of corporate law and a strong corporate culture. The implications of this, the theories of corporate law, in the curriculum of lectures, also great for hindsight

Abstract

This study discusses the phenomenon of Babel Pilgub 2017 in understanding the extent of the character of early voters in determining their constitutional rights in the Pilgub. The novice viewers' views are now evolving and have undergone many changes. The approach model used by the beginner Bangka Beliutng voters in determining and dropping their choice. The advance level of the beginner's education of Bangka Belitung became the main reason for the occurrence of electoral disorientation. So far, the most dominant and decisive primordial factor of primal voters has shifted toward the achievement factor of the candidates. This can be seen from 27,988 novice voters or 3.08% of the total number of existing voters list, the distribution of candidate achievement relationships with the choice of the novice to the spouse is very strong. The results of this study indicate that there is a tendency to change the character of the beginner voters before they decide and choose their choice to cover five aspects such as the novice voters to choose candidate pairs of governors / representatives who are faithful, honest, rich, fair and able to separate between the people's property and private property, knowing what the advantages and disadvantages of the candidates are, they do not choose candidate pairs who use money politics or any unlawful means to get people to vote for them, and they choose candidate pairs that use the wealth of the people for the importance of education and welfare.

Abstract

This research aims to investigate the improvement of learning outcomes of Social Studies in class VIII-D of SMP Negeri 1 Dusun Selatan by the method Quantum Learning. Pre-cycle data shows that the majority of students (61%) are below the Minimum Completion Criteria (KKM) due to passive and unmotivated learning processes. The research uses the Classroom Action Research (CAR) method, which is implemented in two cycles with 31 students. The research stages include gradual interventions, where Cycle I showed initial but not optimal improvements. Based on reflection, corrective actions in Cycle II were refined by optimizing the learning environment through spatial arrangement and music, and strengthening individual accountability through independent worksheets (LKPD) before group discussions. The main findings show a very significant increase in learning outcomes: the number of students in the "High" and "Very High" categories jumped drastically from only 22.5% in the pre-cycle to 84% at the end of Cycle II. It was concluded that the implementation of the adaptive and holistic Quantum Teaching model has proven to be very effective in transforming the learning process and fundamentally improving student learning outcomes.
