Abstract

Purpose: This study investigates the legal legitimacy and democratic consequences of the “empty box” (kotak kosong) mechanism in Indonesia’s local elections, particularly in uncontested single-candidate regional head races. The increasing frequency of such elections raises concerns regarding diminished political competition, legitimacy, and voter choice within Indonesia’s democratic processes. Methodology/approach: This study adopts a normative juridical approach by analyzing statutory laws, especially Law No. 10 of 2016, and key Constitutional Court rulings, such as Decision No. 100/PUU-XIII/2015. Additionally, this study incorporates secondary data from relevant local election cases and academic literature published between 2016 and 2024. Results/findings: The findings reveal that the empty box mechanism is legally acknowledged and constitutionally permitted as a tool for democratic resistance. However, its increasing usage reflects systemic problems: weak internal democracy among political parties, the dominance of political elites, and the absence of viable alternatives. These factors contribute to declining electoral competitiveness and limit the meaningful participation of voters. Conclusions: While the empty box offers a symbolic form of dissent, it does not resolve deeper structural constraints undermining local democratic processes. This mechanism highlights dissatisfaction but fails to generate substantive democratic alternatives. Limitations: This study is limited to doctrinal legal analysis and case study reviews without empirical field research, which may restrict the generalizability of its findings to other countries. Contribution: This study contributes to the ongoing discourse on electoral reform in transitional democracies by assessing the empty box as an instrument of political expression and identifying the need for structural democratic improvements.

Abstract

Regional languages are an important part of cultural identity and objects of constitutional protection as regulated in Article 32 paragraph (2) of the 1945 Constitution. This study aims to analyze the challenges faced by the Lampung provincial government in efforts to preserve and strengthen the Lampung language in the digital era. The problem is studied how the government deals with social and technological dynamics in maintaining the existence of the Lampung language, especially through regional policies in the field of education. This study uses an empirical method. This study also uses the theory of Legal Politics and Regional Autonomy Theory. This theory is used to analyze the direction of the Lampung provincial government's legal policy and regional authority in strengthening the Lampung language as part of cultural affairs in the digital era. The results of the study show that the implementation of the Lampung language preservation policy still faces challenges, including limited digital learning media, minimal teaching staff, and minimal interest from the younger generation.

Abstract

Local government assets are important resources that must be protected in order to support sustainable development and public services. The Local Government Police Unit (Satpol PP) plays a strategic role in securing local government assets, both through preventive and repressive measures. This study aims to conduct a normative analysis of the legal basis and scope of authority of the Satpol PP in securing local government assets, as well as its contribution in preventing the misuse and illegal occupation of such assets. The method used is a normative legal approach with a literature review of relevant laws and regulations, such as Law No. 23 of 2014 on Regional Government, Government Regulation No. 6 of 2010, as well as relevant regional regulations and governor regulations. The research findings indicate that the Satpol PP has clear and structured authority in securing local government assets, including supervision, enforcement, and administrative actions. Additionally, the Satpol PP's role in preventing asset misuse is carried out through routine patrols, public awareness campaigns, and cross-sectoral coordination. However, the effectiveness of implementing such authority still faces challenges such as limited resources and coordination among local government agencies

Abstract

The National Health Insurance Program (JKN) by BPJS Kesehatan provides broad access to health services to the public, but also presents its own challenges for doctors in carrying out their professional duties. The high workload, limited facilities, and patient expectations can pose a risk of criminalization for medical actions, even though they are in accordance with professional standards. This study aims to examine the forms and limits of criminal liability of doctors in BPJS services based on positive law in Indonesia, as well as examine how the principles of medical ethics become the basis of legal protection for doctors. The method used is a normative juridical approach with a literature study of relevant laws and regulations, such as Law Number 17 of 2023 concerning Health, Criminal Code, Presidential Regulation Number 59 of 2024 as an amendment to Presidential Regulation Number 82 of 2018 concerning Health Insurance, and other professional regulations. The results showed that doctors in the JKN system by BPJS have limited criminal liability, as long as medical actions are carried out according to professional standards and operational procedures. Medical ethical principles such as beneficence, non-maleficence, autonomy, and justice provide an important basis for legal protection, especially when doctors face a dilemma between professional obligations and system restrictions. Integration between law, ethics, and policy is needed to ensure fair legal protection for doctors in the practice of national health services

Abstract

Children who commit criminal offenses require a justice approach that prioritizes their rights and welfare. This study examines the legal basis and judicial considerations in imposing sanctions on children convicted of committing criminal acts of threats of violence forcing other children to commit obscene acts, based on Decision Number: 8/Pid.Sus-Anak/2024/PN.Gdt in the Pesawaran District Court. The objective is to analyze how judges apply legal, philosophical, and sociological considerations in sentencing child offenders while aligning with the principles of child protection law in Indonesia. This research uses a normative juridical approach with conceptual, statutory, and case study methods. Data were collected through literature review and analyzed using legal interpretation techniques, including grammatical, teleological, and restrictive interpretations. The findings indicate that judges apply sanctions in the form of rehabilitation measures rather than imprisonment, considering the child's young age (13 years) and the best interest of the child. Judicial considerations include ensuring the protection of children's rights under Law Number 11 of 2012 on the Juvenile Criminal Justice System and Law Number 17 of 2016 concerning Child Protection. The sanction imposed a one-year placement in a Child Special Guidance Institution (LPKS) reflects a restorative justice approach, aiming for rehabilitation and reintegration of the child into society while balancing the interests of victims and maintaining public legal order.

Abstract

The increasing number of children involved as perpetrators in sexual crimes against fellow minors raises serious concerns in criminal law and child protection. This research examines the criminal sentencing imposed on a child who committed forced indecent acts against a child victim, as reflected in Decision No. 7/Pid.Sus-Anak/2024/PN.Gdt. The study aims to analyze (1) how the sentencing is carried out and (2) whether the sentencing aligns with the purposes of punishment. This research applies a normative juridical and empirical juridical approach, with data collected through literature review and field interviews with judges, prosecutors, and legal scholars. The results show that the child offender was sentenced to 7 years in the Class II Child Development Institution (LPKA) in Bandar Lampung and 6 months of job training at LPKS Insan Berguna. The judge’s decision was based on legal (juridical), philosophical, and sociological considerations. It was also grounded in the integrative theory of punishment, which combines retributive and rehabilitative aims. The punishment not only served as a deterrent and accountability for the committed crime but also aimed to reform and reintegrate the child into society. The study concludes that the imposed sentence was proportionate, aligned with statutory requirements, and reflected the best interests of the child without neglecting public justice and protection.

Abstract

This study stems from the growing need to uphold ethical standards within the Indonesian judicial system, particularly concerning prosecutors, who play a pivotal role in law enforcement and justice. The lack of a specific and binding code of ethics for prosecutors has raised concerns about accountability, professionalism, and integrity in the exercise of their duties. This research aims to analyze the urgency of establishing a code of ethics for prosecutors and examine the standards of ethical behavior in accordance with the 1945 Constitution of the Republic of Indonesia. This is a normative legal study employing a legislative and conceptual approach. Data were collected through an extensive literature review and analyzed using qualitative methods. The findings indicate that a dedicated code of ethics is essential for guiding prosecutors in carrying out their duties, functions, and authorities with integrity, professionalism, and wisdom. Ethical integrity emphasizes loyalty to Pancasila and the 1945 Constitution, while professionalism demands adherence to legal and institutional regulations. Wisdom reflects the prosecutor’s responsibility as a public servant who respects prevailing religious, moral, and societal norms. Ethical standards are an extension of the rule of law principle as enshrined in Article 1 paragraph (3) of the 1945 Constitution.

Abstract

Child exploitation through forced begging in Bandar Lampung City constitutes a severe violation of fundamental rights, substantially undermining both physical and psychological development. Criminal networks systematically manipulate vulnerable minors for economic gain, representing a grave breach of child labor protection statutes. This research examines law enforcement mechanisms targeting exploitation perpetrators, identifies systemic barriers, and proposes enhanced legal protection frameworks. The investigation employs a sociological-juridical methodology, utilizing documentary analysis, ethnographic observations, and structured interviews with law enforcement personnel, social service practitioners, and child advocacy specialists. Analysis draws upon child protection theory and progressive jurisprudence principles. Findings reveal enforcement mechanisms remain fragmented, reactive, and institutionally unsupported. Primary impediments encompass inter-agency coordination deficits, inadequate street children documentation, and insufficient rehabilitation funding. The research advocates for policy restructuring and systematic strengthening of child protection mechanisms through interdisciplinary collaboration. The study's significance lies in advancing more integrated and effective legal safeguards for exploited children across municipal and national jurisdictions.

Abstract

ABSTRAKKabupaten Pringsewu yang baru terbentuk dan wilayah yang terus berkembang membutuhkan sebuah infrasruktur yang memadai. Terdapat 5 Kecamatan yang masih belum terjangkau sarana air bersih perpipaan. Sehingga, diperlukan peningkatan infrastruktur wilayah dalam hal ini jaringan perpipaan air bersih. Berdasarkan hal tersebut, pemerintah daerah merencanakan perluasan jaringan distribusi air bersih untuk memenuhi kebutuhan air bersih perpipaan yang bersumber dari air sungai Way Sepagasan. Tujuan dari penelitian ini adalah mengetahui jumlah kebutuhan air bersih di 5 Kecamatan dari tahun 2019 hingga tahun 2030, merencanakan detail desain intake, dan merencanakan jaringan pipa transmisi. Proses pengumpulan data dilakukan dengan melakukan survey lapangan. Terdapat 2 jenis data yang dikumpulkan yaitu data primer dan data sekunder. Data primer meliputi data pengukuran debit air, data topografi (elevasi), data jalur tracking jaringan transmisi serta dokumentasi. Sedangkan, data sekunder meliputi data jumlah penduduk, data peta topografi sekitar lokasi, data kualitas air, dan data curah hujan. Data-data yang diperoleh selanjutnya akan dianalisa dengan metode analisa destruktif. Berdasarkan analisa data yang dilakukan, terdapat 5 Kecamatan yang akan dilayani yaitu Kecamatan Pagelaran Utara, Kecamatan Pagelaran, Kecamatan Banyumas, Kecamatan Sukoharjo dan Kecamatan Adiluwih dengan total kebutuhan air dari tahun 2019 hingga tahun 2030 sebesar 90,79 liter per detik. Bangunan intake memiliki volume bak sebesar 120 m3, dengan dimensi panjang bak 12 meter, lebar bak 8 meter, dan kedalaman bak 1,25 meter. Jaringan pipa transmisi dapat di simulasikan dengan program Epanet 2.0 dengan tekanan di ujung pipa transmisi sebesar 16,22 meter dan memiliki kecapatan aliran sebesar 0,8 meter per detik.Kata kunci:  transmisi, epanet 2.0, way sepagasan ABSTRACTPlanning Of Transmission Pipes In Pringsewu District With Raw Water Sources From The Way Sepagasan River. The newly established Pringsewu Regency and the region which continues to develop need an adequate infrastructure. There are 5 Districts that are still not reached by water distribution system. Thus, it is necessary to improve regional infrastructure, in this case the water distribution system. Based on this, the local government plans to expand the clean water distribution system to meet the need for piped clean water sourced from the Way Sepagasan river water. The purpose of this study is to determine the amount of clean water demand in 5 Districts from 2019 to 2030, to plan detailed intake designs, and to plan transmission pipelines. The data collection process was carried out by conducting field surveys. There are 2 types of data collected, namely primary data and secondary data. Primary data includes water flow measurement data, topographic data (elevation), transmission line tracking data and documentation. Meanwhile, secondary data includes population data, topographic map data around the location, water quality data, and rainfall data. The data obtained will then be analyzed by destructive analysis methods. Based on the data analysis carried out, there are 5 Districts to be served, namely North Pagelaran District, Pagelaran District, Banyumas District, Sukoharjo District and Adiluwih District with total water needs from 2019 to 2030 of 90.79 liters per second. The intake building has a body volume of 120 m3, with dimensions of 12 meters long, 8 meters wide, and 1.25 meters deep. The transmission pipeline network can be simulated with the Epanet 2.0 program with a pressure at the end of the transmission pipe of 16.22 meters and a flow rate of 0.8 meters per second.Keywords: transmission, epanet 2.0, way sepagasan

Abstract

This study explores the role of women in strengthening participatory monitoring in the 2024 Regional Head Election (Pilkada) in Metro City. Using a juridical-empirical approach, the research reveals that women play a strategic role in safeguarding electoral integrity, promoting inclusive political participation, and ensuring a transparent democratic process. Findings indicate that women's involvement remains limited, from village-level election monitors to Bawaslu commissioners. Therefore, affirmative support, political education, and equal participatory space are essential to enhance women's roles in sustainable election monitoring.
