Abstract

The making of a Fiduciary Guarantee Deed by a Notary must be made in accordancewith the existing laws and regulations. In practice, notaries often make mistakes bymaking a fiduciary guarantee deed that exceeds the amount that is limited to making thedeed as it should be and then the notary also often makes a fiduciary guarantee deedoutside the notary's jurisdiction, whereas if the notary acts outside his jurisdiction, thedeed can be filed for cancellation. by parties who have an interest in the general courtand there has been a general court decision that has permanent legal force or thenotarial deed has a proving position as a private deed or a notarial deed is null and void.

Abstract

Rape is one of the many violations of human rights that often occur so that there is no reason that can justify it if it is contrary to the applicable rules, both from an ethical and religious perspective as well as law. Especially from a legal perspective, considering that Indonesia is a country based on law. Rape is a deprivation of human rights or deprivation of rights, such as the right to virginity, the right to be free from suffering, the right to be free from fear and inhumane behavior and with rape the victim has felt the consequences of human rights abuse.

Abstract

The problem of euthanasia is part of the actions of a doctor who is treating his patient or asking for his help so that a person's illness can be cured. In terms of legislation, there is no new and complete regulation on euthanasia, but because the issue of euthanasia involves the issue of the safety of the human soul, a legal basis must be sought. The purpose of this research is to find out Euthanasia which is regulated in the Indonesian Criminal Law and Health Law. Therefore, the only legal basis used is Article 344 of the Criminal Code because it is considered close. The method used is a normative juridical method with a statutory approach. The results show that in principle not everyone agrees with the act of euthanasia as well as doctors. Some community groups start on a religious basis, so that everything is the will of God. The arguments put forward by the doctors are in accordance with the Indonesian medical code of ethics which also reflects the attitudes or views of doctors in Indonesia regarding euthanasia.

Abstract

The urgency of this research is the application of local value-based RJ in the community as an integrative mechanism in efforts to resolve disputes or conflicts in the community. This study aims to answer two legal problems, namely: the urgency of implementing RJ by adopting living law in society and the formulation of RJ implementation as an integrative mechanism that adopts living law in society as an effort to settle criminal law. This research is normative legal research by optimizing conceptual and statutory approaches. The results of the study confirm that the urgency of implementing RJ by adopting living law in society is expected so that the criminal justice system in Indonesia can run and be enforced effectively because it is based on living law which originates from people's personalities. The formulation of the application of RJ as an integrative mechanism in the criminal law settlement process is to reform the criminal procedural law through the revision of the Criminal Procedure Code by including the RJ substance which facilitates living law in society. However, because the process of revising the Criminal Procedure Code takes a long time, a transitional legal product can be formed in the form of a SKB RJ which substantially contains the principles, basis and practice of implementing RJ by facilitating living law in society in the criminal justice system.

Abstract

The purpose of this study is to analyze the application of restorative justice in cyber crime, especially for victims of cyber crime. This research is a normative legal research with a concept and statutory approach. The results of the study confirm that the manifestation of protecting the rights of victims of restorative justice-based cyber crime can actually be carried out by providing assistance, facilitation, and compensation which are considered more relevant and essential to fulfilling victims' rights. This is considered more relevant when compared to the orientation to catch perpetrators of cyber crimes which tend to be more difficult and on the one hand are also not able to fulfill the rights of victims who are reduced as a result of a cyber crime. Therefore, restorative justice efforts that emphasize recovery and compensation for victims are relevant to efforts to ensure the protection of the rights of victims of cyber crime. The implementation of the protection of the rights of victims of restorative justice-based cyber crimes can be carried out by revising the ITE Law and its amendments by adding a restorative justice orientation as the first step to provide protection for the rights of victims of cyber crimes. Apart from that, revisions also need to be made to the PDP Law, especially in the absence of provisions for a time limit for the establishment of implementing regulations for compensation mechanisms. In addition to revising the PDP Law to provide a time limit for the formation of implementing regulations, the President can also immediately pass Government Regulations related to technical compensation for cyber crimes. Tujuan penelitian ini yaitu menganalisis penerapan keadilan restoratif dalam tindak pidana cyber khususnya bagi korban tindak pidana cyber. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan konsep dan perundang-undangan. Analisis dilakukan secara kualitatif-preskriptif yang hasil akhirnya berupa solusi hukum atas isu hukum yang dikemukakan dalam penelitian ini. Hasil penelitian menegaskan bahwa manifestasi perlindungan hak korban tindak pidana cyber berbasis keadilan restoratif sejatinya dapat dilakukan dengan memberikan pendampingan, fasilitasi, serta ganti rugi dianggap lebih relevan dan esensial untuk memenuhi hak-hak korban. Hal ini dianggap lebih relevan jika dibandingkan dengan orientasi untuk menangkap pelaku tindak pidana cyber yang cenderung lebih sulit serta di satu sisi juga tidak secara substantif dapat memenuhi hak-hak korban yang tereduksi akibat suatu tindak pidana cyber. Oleh karena itu, upaya keadilan restoratif yang menekankan pemulihan dang anti rugi bagi korban relevan dengan upaya untuk menjamin perlindungan hak korban tindak pidana cyber. Implementasi perlindungan hak korban tindak pidana cyber berbasis keadilan restoratif dapat dilakukan dengan melakukan revisi atas UU ITE beserta perubahannya dengan menambahkan orientasi keadilan restoratif sebagai langkah awal untuk memberikan perlindungan hak korban tindak pidana cyber. Selain itu, revisi juga perlu dilakukan pada UU PDP, khususnya dengan tidak terdapatnya ketentuan limitasi waktu dibentuknya peraturan pelaksana mekanisme ganti rugi. Selain merevisi UU PDP untuk memberikan limitasi waktu dibentuknya peraturan pelaksana, Presiden juga dapat secepatnya mengesahkan Peraturan Pemerintah yang berkaitan dengan teknis pemberian ganti rugi atas tindak pidana cyber.

Abstract

This study aims to determine the effect of using the Student facilitator and explaining learning model on student learning outcomes on the theme 8 of our best friend's environment in class V of SD Negeri 173442 Batunagodang in the 2023/2024 learning year. In this study using quantitative methods, sampling using purposive samples and the sample used was class V which amounted to 30 students. The results of this study indicate that student learning outcomes using the Student facilitator and explaining model are included in the very good category with an average of 80.16 with a correlation test result of 0.815 which means rcount (0.815) ≥ rtabel (0.361) then Ha is accepted. So there is a strong influence between the use of the Student facilitator and explaining learning model on student learning outcomes on the theme of our best friend's environment in class V of SD Negeri 173442 Batunagodang. It can be seen from the results of the T-test research where tcount ≥ ttable, namely 7.432 ≥ 2.048 so it can be stated that Ha is accepted. This shows that there is a significant positive effect of using the Student facilitator and explaining learning model on student learning outcomes on the theme of our best friend's environment in class V of SD Negeri 173442 Batunagodang in the 2023/2024 learning year.

Abstract

This research will use the writings of two contemporary Islamic legal experts, Nasr Hamid Abu Zayd and Muhammad Syahrur, to delve into the idea of gender equity in Islamic inheritance and wills. This research uses a philosophical and analytical approach to clarify how the two thinkers reach a more egalitarian and gender-neutral understanding of religious texts concerning inheritance law. The analytical descriptive approaches are used to describe and investigate Islamic legal ideas and positive law enforcement mechanisms relevant to gender issues and inheritance. The research shows that both experts believe that ijtihad and adapting Islamic law to contemporary society are crucial to achieving gender equality and justice. There is mounting evidence, including this research, that Islamic inheritance law may need a reevaluation in view of advances in gender equality and other notions of inclusive social justice

Abstract

In the context of litigation, a simple lawsuit is one that has no legal recourse. It is an objection that is heard by judges who are senior in the field. This type of lawsuit is convenient for the community at large, encompassing companies, People's banks, and other banks whose proof is simple. The data collection methods employed in this research are observation, interview, and documentation. The subject of this research is the application of a straightforward lawsuit in the Jakarta District Court, specifically, the types of cases that may be resolved by such a suit. This is a qualitative study employing an empirical juridical approach, employing a descriptive methodology. This research provides a conclusion that a simple lawsuit based on Supreme Court Regulation Number 4 of 2019 represents a significant advancement over Supreme Court Regulation Number 2 of 2015. However, it was subsequently amended by Supreme Court Regulation Number 4 of 2019. The value of the lawsuit is set at IDR 500,000,000.00, with a case subscription period of 25 days. The categories of this simple lawsuit are default (breach of promise) and tort, with the exception of those concerning land issues. The application of this simple lawsuit at the Pekanbaru District Court is commendable, although a few obstacles remain. However, these do not impede the resolution of existing cases. With regard to the obstacles for judges in this simple lawsuit, namely the District Court, it is necessary to implement a more extensive socialization program to educate the public about this simple lawsuit. This will help to prevent any errors when filing a case resolved through a simple lawsuit.

Abstract

The Indonesian Land Acquisition Law serves as a crucial legal instrument in facilitating national development. However, the implementation of this law often gives rise to criticism, particularly with regard to the welfare of landowners whose property is acquired for the public good. This article seeks to provide a critical analysis of the implementation of the Land Acquisition Law in Indonesia and its impact on the welfare of landowners. The methodology employed is a literature review that examines previous research, related legislation, and cases of land acquisition implementation. The findings indicate that, despite the law's objective of enhancing welfare through fair compensation, there are still shortcomings in its implementation that result in injustice to landowners.
