Abstract

Customary law reform in Indonesia in the context of globalization raises significant challenges and opportunities. The values of Pancasila, as the ideological foundation of the nation, play an important role in ensuring that customary law reform remains relevant, fair and rooted in local culture. Globalization encourages the modernization and homogenization of the legal system, which often contradicts the principles of customary law based on local wisdom. This article examines how Pancasila values, such as humanity, social justice, unity, and deliberation, can be integrated in the process of customary law reform to remain relevant amid global dynamics. This research uses a qualitative approach with the methods of literature study, interviews, and document analysis. Literature study was conducted to understand the theoretical context of customary law reform and Pancasila values, while interviews were conducted with legal experts, academics, and traditional leaders to obtain empirical perspectives on challenges and opportunities in customary law reform. Document analysis was conducted on policies and regulations relating to customary law and the implementation of Pancasila values in Indonesia. The results show that customary law reform based on Pancasila has great potential to deliver a legal system that is more inclusive and responsive to the needs of local communities. Key challenges identified include difficulties in harmonizing customary law with national and international law and homogenizing pressures from global standards. However, opportunities are also found in the ability of updated customary law to provide more culturally and locally relevant dispute resolution alternatives. The integration of Pancasila values is believed to strengthen the position of customary law within national and global legal frameworks.ract

Abstract

This research evaluates the effectiveness of citizenship legislation in Indonesia, focusing on Law No. 12 of 2006. The background of this study is based on the importance of protecting citizenship rights within the context of evolving social and political dynamics. The aim of the research is to identify discrepancies between regulations and practices, as well as to analyze the impact of policies on social integration and the protection of individual rights. The methodology employed is normative legal analysis, which includes legislative, conceptual, and comparative approaches, along with data collection through literature review and interviews with legal experts. The findings indicate that although Law No. 12 of 2006 has brought positive changes, the implementation of policies still faces challenges such as inconsistency and administrative obstacles. The implications of this research highlight the need for reforms in citizenship policy that are fairer and more responsive, which can enhance the protection of individual rights and create a more inclusive system for all citizens.

Abstract

Pancasila, as the foundation of Indonesia, has a historical source that includes the historical background and thoughts of the founding fathers. This can be seen from the ratification of the Pancasila on August 18, 1945 and Soekarno's speech on June 1, 1945 formulating the basic values of the state. historical source Pancasila reflects Indonesia's socio-cultural diversity, including values such as gotong royong, tolerance, and deliberation, which form the basis of unity amid ethnic differences. Both complement each other in shaping the nation's identity and ideology.

Abstract

This study examines citizenship as a constitutional right in Indonesia, focusing on the foundational principles of citizenship, the roles of state institutions, challenges in the enforcement of rights, and relevant case studies. The research employs a doctrinal legal methodology with a normative approach, incorporating legislative, case law, conceptual, historical, and comparative perspectives. Data is collected from primary, secondary, and tertiary legal sources through a literature review. The analysis reveals that the foundational principles of citizenship are enshrined in the 1945 Constitution of Indonesia (UUD 1945), which includes the right to participate in government, the right to decent work, and other social rights. State institutions such as the President, the People's Consultative Assembly (DPR), and the judiciary play crucial roles in the enforcement of constitutional rights. However, several challenges persist, including human rights violations, injustices within the legal system, and barriers to political participation. Case studies related to administrative issues in the 2024 elections, human rights violations in Papua, and the controversy surrounding the Omnibus Law on Job Creation illustrate practical issues in the implementation of constitutional rights.

Abstract

Kewarganegaraan adalah segala jenis hubungan dengan suatu negara yang menimbulkan kewajiban bagi negara tersebut untuk melindungi orang tersebut. Aspek penting dalam hubungan tersebut adalah penerapan hukum, termasuk hukum perdata, yang mengatur hubungan antar individu dalam konteks hukum perdata. Dalam konteks negara-negara dengan system hukum yang beragam, seperti negara-negara yang menerapkan hukum Islam, pengaruh kewarganegaraan terhadap penerapan hukum perdata menjadi sebuah isu yang kompleks dan banyak aspek. Kewarganegaraan dapat mempengaruhi bagaimana hukum perdata Islam diterapkan dan diintegrasikan ke dalam hukum negara saat ini, sehingga menyebabkan perbedaan dalam penegakan hukum di berbagai belahan dunia. Pengaruh kewarganegaraan terhadap penerapan hukum perdata Islam terlihat jelas di negara-negara dengan sistem hukum campuran atau pluralistik. Di negara-negara seperti Indonesia dan Malaysia, sistem hukum nasional menerapkan hukum perdata Islam bagi warga negara Muslim, sedangkan hukum non-Islam berlaku bagi non- Muslim. Pembedaan ini menggambarkan bagaimana kewarganegaraan dapat menentukan penerapan hukum dalam konteks hukum perdata Islam. Tujuan dari penelitian ini adalah untuk menyelidiki pengaruh kewarganegaraan terhadap penerapan hukum perdata Islam, dengan fokus pada berfungsinya sistem hukum campuran dan pluralistik di negara-negara dengan komunitas muslim. Tinjauan terhadap kasus hukum dan peraturan yang ada saat ini memberikan wawasan yang lebih dalam mengenai keterkaitan antara kewarganegaraan, hukum. Kewarganegaraan tidak hanya menentukan penerapan hukum tetapi juga menciptakan kerangka hak dan tanggung jawab individu dalam sistem hukum yang berbeda. Pada akhirnya, negara-negara berbasis hukum Islam harus mencapai keseimbangan antara mempertahankan prinsip-prinsip dasar Syariah dan beradaptasi dengan perkembangan hukum internasional dan hak asasi manusia, terutama dalam konteks masyarakat yang semakin plural dan mengglobal Metode penelitian yang digunakan. adalah penelitian hukum normatif dengan pendekatan perundang-undangan, kasus, konseptual, historis, dan perbandingan. Studi ini menyimpulkan bahwa status kewarganegaraan juga mempengaruhi hak dan kewajiban dalam penerapan hukum perdata Islam, khususnya yang berkaitan dengan perkawinan, warisan, kontrak, dan masalah hubungan. Bagi warga negara yang beragama Islam, hukum Islam secara tegas mengatur permasalahan tersebut dengan mengacu pada Al-Qur'an dan Hadits, sedangkan bagi warga negara non-Muslim, peraturan tersebut terbatas pada, misalnya hukum perdata atau peraturan adat yang diberlakukan secara nasional dapat berbeda- beda. Pengaruh kewarganegaraan terhadap penerapan hukum perdata dapat memberikan perbedaan yang signifikan terhadap hak dan kewajiban individu dan juga dapat mempengaruhi keputusan pengadilan dalam kasus-kasus yang melibatkan hukum Islam. Kajian ini memberikan kontribusi penting untuk memahami dinamika hukum perdata Islam dalam konteks global dan menyoroti perlunya reformasi dan harmonisasi hukum untuk mencapai keadilan yang lebih adil. Citizenship is any kind of relationship with a country that gives rise to an obligation for that country to protect that person. An important aspect in this relationship is the application of law, including civil law, which regulates relationships between individuals in the context of civil law. In the context of countries with diverse legal systems, such as countries that apply Islamic law, the influence of citizenship on the application of civil law becomes a complex issue and has many aspects. Citizenship can influence how Islamic civil law is applied and integrated into current state law, resulting in differences in law enforcement in different parts of the world. The influence of citizenship on the application of Islamic civil law is clearly visible in countries with mixed or pluralistic legal systems. In countries such as Indonesia and Malaysia, the national legal system applies Islamic civil law to Muslim citizens, while non-Islamic law applies to non-Muslims. This distinction illustrates how citizenship can determine the application of law in the context of Islamic civil law. The aim of this research is to investigate the influence of citizenship on the application of Islamic civil law, with a focus on the functioning of mixed and pluralistic legal systems in countries with Muslim communities. A review of current case law and regulations provides deeper insight into the relationship between citizenship and law. Citizenship not only determines the application of law but also creates a frame work of individual rights and responsibilities in different legal systems. Ultimately, countries based on Islamic law must strike a balance between maintaining the basic principles of Sharia and adapting to developments in international law and human rights, especially in the context of an increasingly plural and globalized society. The research method used is normative legal research with statutory, case, conceptual, historical and comparative approaches. This study concludes that citizenship status also influences the rights and obligations in the application of Islamic civil law, especially those relating to marriage, inheritance, contracts and relationship issues. For Muslim citizens, Islamic law strictly regulates these issues by referring to the Al-Qur'an and Hadith, while for non-Muslim citizens, these regulations are limited to, for example, civil law or customary regulations that are applied nationally which may be different. different. The influence of citizenship on the application of civil law can make a significant difference to individual rights and obligations and can also influence court decisions in cases involving Islamic law. This study makes an important contribution to understanding the dynamics of Islamic civil law in a global context and highlights the need for legal reform and harmonization to achieve fairer justice.

Abstract

This study looks at the legal ramifications of changing the Republic of Indonesia's 1945 Constitution's articles pertaining to citizenship (UUD 1945). The complexity of citizenship issues has increased with globalization, especially when it comes to dual citizenship and the rights of Indonesians residing outside. This study is classified as doctrinal research since it examines legal sources to determine legal principles. The study finds that amendments to the UUD 1945 are necessary to better align Indonesia's citizenship policies with global developments. However, these changes must be carefully considered to protect human rights and maintain national loyalty and identity. Reforming Indonesia's citizenship laws should be done thoughtfully, with input from various stakeholders, to ensure the resulting policies are inclusive and adaptable to the current global context. This research aims to contribute significantly to the development of Indonesia's citizenship policies and to offer a foundation for policymakers in crafting regulations that are more responsive to global challenges.

Abstract

This article examines the testimony of mute individuals from the perspectives of Indonesian positive law and the comparative fiqh of the four major Islamic schools of thought (Hanafi, Maliki, Shafi’i, and Hanbali). The study aims to understand the challenges and opportunities in recognizing the testimony of mute individuals in court and its implications for justice. The research employs a normative approach with doctrinal analysis. The findings indicate that Indonesian positive law provides room for the testimony of mute individuals, but there are still obstacles in its implementation, such as the lack of adequate accommodations and qualified interpreters. On the other hand, Islamic fiqh presents varied views on mute testimony, with the Maliki school being more inclusive than others. The article also discusses opportunities for legal reform to create a more inclusive and just judicial system for persons with disabilities. In conclusion, the testimony of mute individuals requires special attention within the legal system to ensure that the principles of justice and equality are upheld.

Abstract

This study explores the social perceptions of dual citizenship in Indonesia from the perspectives of both Indonesian citizens and non-citizens, and compares these views with practices in other countries. Employing a descriptive qualitative approach, the research utilizes in-depth interviews, focus group discussions (FGDs), and surveys to gather data from diverse stakeholders. The findings reveal that in Indonesia, dual citizenship is often perceived as a threat to national identity and unity, primarily due to concerns about divided loyalties. Conversely, non-citizens view dual citizenship as advantageous for accessing various services and opportunities. Comparative analysis with countries such as Germany and Canada shows that dual citizenship policies can be accepted and even considered beneficial for social integration and international relations. Based on these findings, policy recommendations include reforming citizenship laws, adjusting legal and regulatory frameworks, enhancing public awareness, providing support for individuals with dual citizenship, and conducting further research to explore the long-term impacts of dual citizenship.

Abstract

Handling terrorism cases in Indonesia requires a careful approach considering the diversity of applicable legal sources, especially Islamic Law and Pancasila. This article explores harmonization efforts between the two legal systems in the context of countering terrorism. Islamic law, with its principles that emphasize justice, security and protection of society, offers an approach based on restoration and enforcement of social norms. On the other hand, Pancasila as the basis of the state and national ideology provides a normative framework that emphasizes unity, social justice and human rights. This study analyzes how the principles of Islamic law can be integrated with the Pancasila legal framework to create an effective legal system in dealing with terrorism. The research focus includes a review of existing laws and regulations, policies for handling terrorism, as well as the implementation and implementation of the law in practice. This article also identifies challenges that may arise in the harmonization process, including potential conflict of norms and differences in interpretation between Islamic Law and Pancasila. This study aims to provide strategic recommendations for policy makers and law enforcement officials to create a more holistic and harmonious approach in dealing with terrorism. It is hoped that the integration of the values of Islamic law with the principles of Pancasila can strengthen efforts to prevent and overcome terrorism, as well as maintain the diversity and unity of the nation. Thus, this research contributes to the development of legal policies that are more inclusive and fair, in accordance with the Indonesian social and cultural context.

Abstract

Citizenship is a legal status that gives a person rights and responsibilities as a citizen. Many laws in Indonesia regulate political rights, including the right to vote. One of them is Law Number 7 of 2017 concerning General Elections. Within Indonesia's democratic framework, the right to vote is an important expression of popular sovereignty, allowing voters to actively elect their leaders at both the legislative and executive levels. Fulfilling the right to vote cannot be separated from various technological, political and social difficulties that may have an impact on democracy in Indonesia. Over the last five years, several dynamics have emerged in the enforcement of voting rights regulations, including changes to regulations, election implementation, and the application of digital technology to increase election transparency and accountability. Despite the implementation of legal and technological reforms, there are still challenges in verifying permanent voter lists, especially for vulnerable groups such as people with disabilities and those living in remote locations or abroad, which continues to hinder efforts to tackle disinformation and hoaxes on social media. This research examines the political rights of Indonesian individuals, especially regarding their right to vote in general elections as regulated by law. The right to vote is one manifestation of political participation that is recognized internationally and guaranteed in various national legal instruments.
