Abstract

Privacy and security are two crucial issues in the era of digital communication. The rapid development of technology has created various challenges in protecting personal information and maintaining security in cyberspace. The main challenges faced in digital communication include identity theft, data breaches, cyber attacks, and misuse of personal information. Solutions include the use of encryption, security software, education and awareness raising, regulation and enforcement, and individual responsibility. Therefore, it is important to emphasise the collective efforts and constant vigilance of various parties, including individuals, companies, and governments, to create a safer and more trusted digital environment. With a comprehensive and adaptive approach to technological developments, it is expected to protect privacy rights, reduce the risk of cyber threats, and promote sustainable growth of the digital economy.

Abstract

The rapid spread of hoaxes in the digital era poses a significant threat to social, political, and economic stability worldwide. Artificial Intelligence (AI) has emerged as a promising solution for detecting and mitigating hoaxes through advanced techniques such as natural language processing, machine learning, and deep learning. This study employs a literature review method to examine the role of AI in identifying, verifying, and limiting the dissemination of false information across digital platforms. Data were synthesized from relevant academic articles, reports, and previous studies to provide a comprehensive understanding of current approaches and challenges. The findings reveal that AI technologies enhance the efficiency and accuracy of automatic hoax detection, enabling real-time analysis of large-scale digital content. However, challenges persist, particularly related to data scarcity, algorithmic bias, and the complexity of understanding cross-linguistic and cross-cultural contexts. To address these limitations, collaborative efforts involving governments, technology developers, academic researchers, and society are required. Strengthened regulatory frameworks, cross-sector partnerships, and improved digital literacy are essential to ensure the sustainable and ethical application of AI in combating hoaxes. This study contributes to the growing body of knowledge by highlighting the dual role of AI as both a technical and socio-ethical tool in countering misinformation. It provides practical insights for policymakers, educators, and technology practitioners on integrating AI-based detection systems with broader strategies for digital literacy and regulatory governance. By presenting a comprehensive framework, the study underscores how AI can be leveraged responsibly to safeguard information integrity in the digital age.

Abstract

The COVID-19 pandemic has not only brought challenges in the health sector, but also given rise to the phenomenon of disinformation that has had a significant impact on public health. This study aims to identify patterns of dissemination and the impact of COVID-19-related disinformation, as well as to formulate effective mitigation strategies through a literature review of various scientific literature and research reports. The results of the analysis indicate that misinformation spreads massively through social media, instant messaging apps, and mass media, with patterns that exploit public emotional sentiment and uncertainty. The impact of misinformation includes a decline in compliance with health protocols, scepticism about vaccination, and a decline in public trust in health institutions and the government. The recommended mitigation strategies include improving digital and health literacy, strengthening regulations, promoting cross-sector collaboration, and optimising data-driven public communication and transparency. These findings underscore the importance of synergies among various parties in building public information resilience to face similar crises in the future

Abstract

This study examines the criminal liability of healthcare professionals in cases of medical malpractice, using a literature review of Indonesian case law. The focus of the study is on the concept of criminal liability, its legal basis, and the patterns of judicial reasoning in ruling on medical malpractice cases. The method employed is normative legal research through a review of primary, secondary and tertiary legal sources, including legislation, health law literature and relevant court rulings. The findings indicate that criminal liability for healthcare professionals can only be imposed if the following elements are proven: fault, a deviation from professional standards, a causal link, and a result that causes harm to the patient. Indonesian case law shows that judges tend to exercise caution in distinguishing between medical risk, medical negligence and malpractice; consequently, criminal penalties are only imposed where there is a serious breach for which legal liability can be established. This study emphasises the importance of striking a balance between patient protection and legal certainty for healthcare professionals in order to achieve a fair and accountable healthcare system.

Abstract

This study examines the legal framework for occupational health in the informal sector in Indonesia through a comparative analysis with several ASEAN countries. The informal sector is characterised by flexible and dispersed working arrangements and often falls outside the scope of formal labour inspection, leaving workers in this sector vulnerable to workplace accidents and work-related illnesses. In Indonesia, occupational health protection for informal workers is already enshrined in law through the constitution, health legislation, and technical policies such as the Occupational Health Service Posts (Pos UKK). However, its implementation still faces challenges in the form of limited oversight, poor access to services, and weak cross-sectoral integration. Through a comparison with other ASEAN countries, this study demonstrates that protection for informal workers is more effective when supported by an approach that is simple, participatory, community-based and integrated into national policy. The findings of this study emphasise that strengthening the legal framework must be accompanied by context-specific implementation strategies to ensure that occupational health protection for informal workers can be delivered more effectively and sustainably.

Abstract

Herbal-based pharmaceutical products and health supplements are increasingly in demand amongst the public as they are considered more natural and safer. However, the rise in the consumption of herbal products is also accompanied by various risks, such as the circulation of illegal products, exaggerated claims of benefits, incorrect labelling, and the potential presence of pharmaceutical chemicals. This article aims to review the regulation of herbal-based pharmaceutical products and health supplements in Indonesia, focusing on the role of the Indonesian Food and Drug Authority (BPOM) and consumer protection. The method employed was a literature review, examining scientific literature, legislation, and official sources relating to the supervision of herbal products. The results of the review indicate that the BPOM plays a central role in pre-market and post-market supervision, including registration, labelling, distribution oversight, and enforcement against products that breach regulations. On the other hand, consumer protection requires legal certainty, accurate information and guarantees of product safety for the public. Consequently, strengthening regulation, supervision and consumer education are crucial steps towards ensuring the safe, high-quality and responsible use of herbal products.

Abstract

This article discusses the legal aspects of mental health within the criminal justice system, focusing on the rights of suspects and convicted persons with mental disorders. This study is motivated by the importance of legal protection for individuals with mental disorders who are involved in criminal proceedings, whether at the investigation stage, during trial, or whilst serving a prison sentence. This research employs a literature review method, examining various scientific sources, legislation and relevant policy documents. The findings indicate that suspects with mental disorders are entitled to a mental health assessment, legal aid, humane treatment, and legal proceedings that take their psychological capacity into account. Meanwhile, convicted persons with mental disorders are entitled to mental health services, appropriate care, suitable rehabilitation, and protection from discrimination within correctional institutions. However, the implementation of these protections still faces various obstacles, such as a lack of facilities, specialist staff, and inter-agency coordination. Therefore, a more humane and human rights-based legal approach is required so that the criminal justice system can provide fair protection for this vulnerable group.

Abstract

Sexual violence represents a fundamental infraction of human rights, generating profound physiological, psychological, and social ramifications for the victims. This study aims to critically evaluate the efficacy of current legal protections designated for victims of sexual harassment in Indonesia, while simultaneously mapping the institutional impediments within the prosecution of perpetrators. Employing a doctrinal legal methodology (normative juridical), this research relies exclusively on secondary legal sources, specifically conducting a comparative analysis between the legacy Penal Code (KUHP Lama) and the newly enacted National Penal Code (KUHP Nasional). The analytical framework is constructed through a statutory and conceptual approach. The empirical findings elucidate that despite substantial legislative updates, the practical adjudication of sexual offenses consistently encounters multi-dimensional bottlenecks spanning substantive law limitations, deep-rooted cultural biases, and lack of gender-sensitive law enforcement. Although the newly codified Penal Code introduces expanded definitions and enhanced victim safeguards, its ultimate success remains heavily contingent upon systemic implementation at the operational level.

Abstract

. Surrogacy practices in Indonesia have created a conflict of legal norms between the doctrine of mater semper certa est, as stipulated in Article 250 paragraph (3) of the Indonesian Civil Code, and the new provisions introduced under Health Law No. 17 of 2023. This normative legal research aims to compare the regulation of surrogacy in Indonesia, the Netherlands, and the United Kingdom in order to identify an appropriate legal solution to the existing normative conflict. The analysis demonstrates a fundamental similarity among the three jurisdictions in permitting altruistic surrogacy, particularly arrangements that do not involve commercial compensation. However, a significant difference is found in the legal mechanisms used to determine and transfer maternal status. In the Netherlands and the United Kingdom, the transfer of legal motherhood requires a court ruling issued after the child is born. In contrast, Indonesia adopts a conceptual and administrative transfer mechanism established from the beginning of the surrogacy agreement based on the principle of lex specialis. Although these new regulations provide a clearer legal basis for recognizing the intended mother, future challenges will involve synchronizing civil registration systems and harmonizing implementing regulations to ensure legal certainty and effective application in practice.

Abstract

Era milenium digital mendisrupsi lanskap industri musik secara masif, mengubah model distribusi fisik menjadi berbasis digital streaming dan memunculkan new users (pengguna baru) seperti platform konten berbasis kecerdasan buatan (AI) dan media sosial User-Generated Content (UGC). Namun, transformasi ini menyisakan celah hukum yang merugikan musisi akibat ketimpangan posisi tawar (bargaining power) dalam kontrak musik (360-degree deal dan standard form contract), ketidaktransparan formula persentase pembagian royalti (streaming pro-rata model), serta lemahnya penegakan hukum hak cipta oleh Lembaga Manajemen Kolektif (LMK/LMKN) terhadap pengguna baru. Penelitian ini bertujuan untuk menganalisis problematika hukum dalam kontrak musik di era digital serta efektivitas regulasi hak cipta Indonesia dalam mengakomodasi skema persentase royalti dan model distribusi baru. Dengan metode penelitian yuridis normatif, penelitian ini mengkaji data sekunder berupa peraturan perundang-undangan, literatur hukum, dan putusan terkait. Hasil penelitian menunjukkan bahwa kontrak musik digital saat ini cenderung mengabaikan asas proporsionalitas dan keadilan berkonstrak (Pasal 1320 dan 1338 KUHPerdata), sementara UU No. 28 Tahun 2014 tentang Hak Cipta belum secara eksplisit meregulasi micro-licensing untuk new users serta mekanisme audit algoritma platform digital. Diperlukan rekonstruksi regulasi melalui revisi undang-undang dan standardisasi kontrak berbasis keadilan distributif guna melindungi hak ekonomi musisi di era milenium digital.
