Abstract

This study aims to examine the role of Article 28C Paragraph (1) of the 1945 Constitution in guaranteeing access to education and cultural development in Indonesia. This article stipulates the right of every person to develop themselves through the fulfilment of their basic needs, including education and culture, as part of their human rights that must be protected by the state. The research method used is qualitative through the analysis of legal documents, education and cultural policies. The results show that Article 28C Paragraph (1) is an important constitutional basis that guides government policy in providing equitable and inclusive access to education and supporting the preservation and development of culture. However, in its implementation, there are still various challenges, such as inequality in access to education and a lack of attention to cultural diversity. This study recommends strengthening the synergy between the government and the community in order to optimise the role of this article in realising quality human resource development and sustainable cultural preservation in Indonesia.

Abstract

The COVID-19 pandemic has been a real test of the effectiveness of state administrative law in disaster management. This study examines how the legal and regulatory framework in Indonesia responds to emergency situations during the pandemic, and identifies key lessons for future improvement. The main findings show that policy flexibility, inter-agency collaboration, and transparency in decision-making are crucial factors for effective disaster management. In addition, the integration of technology and innovation within a legal framework is essential for rapid and data-driven response adaptation. The study recommends reforms in state administrative law to face future challenges in a more agile and coordinated manner.

Abstract

Illegal drug abuse in Indonesia is a complex national problem because it involves legal, health, social, and moral dimensions of society. This study aims to analyse the role of the judicial system and health policies in handling drug abuse cases through law enforcement, rehabilitation, and mental and physical health recovery approaches. The research method used was library research, reviewing legislation, government policies, previous research results, and relevant literature discussing the integration of law and health in the context of drug abuse treatment. The results of the study show that the judicial system in Indonesia still tends to apply a retributive approach, even though Law No. 35 of 2009 has opened up opportunities for a rehabilitative approach through the principle of restorative justice. Meanwhile, health policies have offered solutions based on medical and social rehabilitation, but their implementation is still constrained by limited resources, infrastructure, and social stigma against addicts. Stronger integration between law enforcement agencies and the health system is needed to achieve fair, humane, and sustainable drug treatment, with a focus on comprehensive recovery for drug abusers.

Abstract

This study examines the effectiveness of Corporate Social Responsibility (CSR) in improving economic inclusiveness and reducing social inequality, using a literature review method. The results indicate that well-designed and implemented CSR programmes can contribute to community economic empowerment and the reduction of social inequality. Key factors influencing the success of CSR programmes include programme sustainability, active community involvement, alignment with local needs, and multi-stakeholder collaboration. However, this study also identifies several challenges and limitations in the use of CSR as a tool to address complex socio-economic issues. This study concludes that CSR can be an effective instrument in promoting economic inclusiveness and reducing social inequality, but it must be integrated with broader efforts involving government policies and civil society initiatives to achieve optimal and sustainable impact.

Abstract

This study aims to reconceptualise the law governing Indonesia's national economic activities in order to realise distributive justice through an in-depth literature review of the principle of equitable distribution of economic benefits from two main perspectives, namely constitutionally based on Articles 33 and 34 of the 1945 Constitution and ideologically through the Pancasila Economic framework, whereby a legal-normative analysis reveals that the current liberal economic paradigm has failed to implement the constitutional mandate regarding state control over strategic production sectors and natural resources for the prosperity of the people, thus requiring legal reforms that integrate the principles of equitable efficiency, mutual cooperation, and humanity. The results of the study show that the constitutional perspective affirms the state's obligation to distribute economic results through redistributive instruments such as progressive natural resource royalties, state-owned enterprise social dividends, and people's empowerment programmes, while Pancasila Economics enriches this reconceptualisation with a family-based mixed economy model that rejects the capitalism-socialism dichotomy, resulting in a new legal paradigm that makes proportional distribution of income a benchmark for the success of national economic regulation amid the challenges of globalisation and energy transition.

Abstract

This study analyses the role of legal norms as the main constitutional instrument in regulating Indonesia's national economic activities towards a fair distribution of wealth through a normative-juridical literature review of the implementation of the principles of social justice (the fifth principle of Pancasila) and economic sovereignty of the people (Article 33 of the 1945 Constitution), where findings show that although derivative regulations such as the State-Owned Enterprises Law, the Job Creation Law, and redistributive policies (KUR, Village Funds, agrarian reform) have attempted to implement the principles of familial economic democracy, a significant gap still exists due to the dominance of neoliberalism, weak institutional enforcement, and structural inequality with a Gini ratio of 0.375. An analysis of two main discussions reveals that legal norms are effective as national economic governance through state control of strategic production sectors and synergy between state-owned enterprises and micro, small and medium enterprises (MSMEs). but the implementation of the principle of social justice is hampered by poor inter-agency coordination and systemic corruption, where Rawls' perspective on the difference principle reinforces the recommendation for progressive regulatory reform to ensure that economic benefits flow to the most disadvantaged groups. Thus, the conclusion emphasises the need to harmonise ius constitutum and ius operatum through the strengthening of the Constitutional Court's judicial review, revising the inclusive Job Creation Law, and developing social welfare-oriented SOE holdings to realise a distributively just Indonesia Emas 2045, with theoretical implications for the development of the Pancasila economic law doctrine and practical implications for policymakers in reducing urban-rural disparities.

Abstract

The development of digital financial services brings new challenges related to data security and user identity protection. Biometric technologies, such as fingerprint and facial recognition, offer more secure and practical authentication solutions than conventional methods such as PINs or passwords. This study aims to examine the effectiveness of biometric implementation in enhancing the security and accessibility of digital financial services through a literature review of various scientific sources and recent industry reports. The results of the study indicate that biometrics significantly reduces the risk of identity theft and illegal access, as well as speeds up the user verification process. In addition, this technology also supports financial inclusion by facilitating access for previously underserved communities. However, challenges related to data privacy, implementation costs, and infrastructure readiness remain major concerns. Therefore, collaboration between financial institutions, regulators, and technology providers is essential to ensure the safe, efficient, and inclusive implementation of biometrics in the digital financial ecosystem.

Abstract

This study aims to compare the factors that influence the adoption of e-wallets in developed and developing countries and analyse their implications for financial inclusion. The results show that in developing countries, e-wallets play an important role in expanding access to formal finance, especially for the unbanked and micro-entrepreneurs, through ease of access, pro-digital regulations, and mobile technology penetration. Conversely, in developed countries, e-wallet adoption is more focused on improving transaction efficiency and convenience within an already established financial ecosystem, so that its impact on financial inclusion is relatively limited. This study confirms that e-wallet development strategies must be tailored to the social, economic, and regulatory context of each country in order to promote optimal and sustainable financial inclusion.

Abstract

This study aims to analyse the implementation of the principle of social justice in economic law as an effort to protect the poor, abandoned children, and vulnerable groups in Indonesia. This study uses a desk research method with a qualitative and normative approach, examining various laws and regulations, government policies, and relevant scientific literature. The results show that the state has developed a number of legal instruments and social protection programmes, such as the Family Hope Programme (PKH), Non-Cash Food Assistance (BPNT), and National Health Insurance (JKN), which are based on the constitutional mandate, particularly Article 34 of the 1945 Constitution. However, the effective implementation of these policies still faces challenges such as weak law enforcement, complicated bureaucracy, budget constraints, and lack of coordination between institutions. Therefore, there is a need to strengthen the synergy between the government, private sector, NGOs and civil society, as well as bureaucratic reform and stricter supervision to ensure the protection of vulnerable groups is optimal. This research is expected to contribute to the development of a more inclusive and socially just economic legal policy in Indonesia.

Abstract

This study aims to examine the role of economic law and health law in the implementation of diversion and restorative justice for petty theft offenders through a literature review approach. The results of the study show that the integration of economic law in the diversion process provides a concrete solution in the form of a compensation scheme that considers the economic capacity of the offender as well as an economic empowerment programme to prevent recidivism. Meanwhile, health law plays an important role in supporting the physical and psychosocial rehabilitation of offenders, especially those with mental health problems, so that recovery does not only focus on legal aspects, but also on improving the overall quality of life of offenders. The integration of these two areas of law in diversion and restorative justice mechanisms can create a more humane, fair and sustainable case resolution system, while strengthening the protection of human rights and supporting the social reintegration of offenders into society.
