Abstract

The digital era has triggered a significant evolution in Indonesian contract law, shifting the paradigm of the Civil Code from conventional obligations based on physical documents towards dynamic electronic contracts through the recognition of the Information and Electronic Transactions Act No. 11 of 2008, as amended by Act No. 1 of 2024, where this transformation faces challenges regarding the authentication of digital signatures, the proof of transaction data integrity, and the role of e-commerce platforms as subjects of multilateral contractual liability within a platform economy valued at Rp 500 trillion by 2025. This normative-legal study analyses the dynamics of virtual breach of contract in the form of non-delivery of goods, algorithmic system errors, and the manipulation of fake reviews—which are subject to Articles 1234–1246 of the Civil Code but require digital forensics to establish causality—as well as the evaluation of the effectiveness of consumer protection under the Consumer Protection Act No. 8 of 1999 and the Personal Data Protection Act No. 27 of 2022 against information asymmetry and misleading practices on marketplaces such as Shopee and Tokopedia. The analysis reveals a regulatory gap between the static norms of the Civil Code and the dynamics of blockchain smart contracts and the gig economy, where adaptive solutions include integrated Online Dispute Resolution (ODR), automatic escrow payments, and joint and several liability of platforms and sellers to mitigate virtual breach of contract, whilst reform recommendations include a dedicated digital contracts law, strengthening the BPSK for e-commerce mediation, and consumer legal literacy to realise a fair transaction ecosystem in line with the ASEAN Digital Economy 2030 vision.

Abstract

This study analyses the effectiveness and challenges of enforcing sanctions for medical malpractice in Indonesia through a literature review of regulations and their implementation from criminal, civil, and administrative law perspectives. The study findings indicate that although the legal framework has established criminal, civil, and administrative sanctions for medical malpractice perpetrators, its implementation still faces various obstacles, such as difficulties in proving liability, a heavy burden of proof on patients, unclear definitions of medical malpractice in regulations, and weak coordination and oversight among relevant agencies. Harmonisation of regulations, strengthening the capacity of law enforcement agencies, and developing supporting systems such as electronic medical records are needed to enhance the effectiveness of sanction enforcement and legal protection for both patients and medical personnel.

Abstract

This study discusses the forms of legal liability of medical personnel in cases of malpractice based on Law Number 29 of 2004 concerning Medical Practice and Law Number 36 of 2009 concerning Health using a normative-legal literature review method. The analysis reveals that the legal liability of medical personnel is multidimensional, encompassing civil, criminal, and administrative domains. In practice, the resolution of medical malpractice cases in Indonesia still faces various challenges, such as overlapping regulations, a heavy burden of proof on patients, and disparities in access to evidence and legal assistance. The resolution mechanism through the Indonesian Medical Disciplinary Council (MKDKI) has not been fully effective because its decisions are not legally binding. Therefore, regulatory harmonisation, strengthening the role of disciplinary bodies, and improving access to justice for patients are necessary to create a fair and just legal accountability system for all parties.

Abstract

This study examines the criminal liability of medical personnel for malpractice from the perspective of the Criminal Code (KUHP) and Law No. 17 of 2023 on Health. The main issue raised is the difference in approach between the general nature of the KUHP and the more specific provisions of Law No. 17 of 2023 in regulating medical negligence. This study employs a normative legal method with a comparative legal approach and case studies of court decisions. The findings reveal that the KUHP holds medical personnel liable based on general negligence without considering professional standards, whereas Law No. 17/2023 emphasizes that criminal liability must be based on violations of professional standards, service standards, operational procedures, and professional ethical codes. Additionally, Law No. 17 of 2023 prioritises mechanisms such as professional disciplinary board recommendations and mediation before criminal proceedings can proceed. As a result, Law No. 17 of 2023 is considered more effective in providing legal protection for medical personnel who act in accordance with standards and ensuring justice for patients. Harmonisation and socialisation of the two regulations remain necessary to prevent overlapping in the enforcement of medical malpractice cases in Indonesia.

Abstract

This study discusses the forms and legal basis of civil and administrative liability of medical personnel in cases of malpractice in Indonesia using a literature review method. The findings reveal that civil liability is based on the principle of unlawful acts as stipulated in the Civil Code and the Health Law, which require medical personnel or hospitals to compensate patients if negligence causing harm is proven. Meanwhile, administrative liability arises when medical personnel violate administrative regulations or professional discipline, with sanctions ranging from warnings to revocation of practice licences, imposed through an examination mechanism by the Indonesian Medical Disciplinary Council (MKDKI). This study underscores the importance of harmonising regulations and enhancing transparency in dispute resolution mechanisms to ensure optimal legal protection for both patients and medical personnel.

Abstract

This study examines the mechanisms of proof and resolution of medical malpractice disputes by the Indonesian Medical Disciplinary Honour Council (MKDKI) through a literature review method. The results of the study indicate that the proof mechanisms in the MKDKI include stages of complaint, administrative verification, medical document examination, expert testimony, and disciplinary hearings that emphasise medical professional standards. MKDKI decisions hold a strategic position as initial evidence in subsequent legal proceedings, although their implementation still faces various challenges such as time constraints, incomplete medical documentation, and inadequate integration with law enforcement agencies. This study recommends strengthening regulations, enhancing human resource capacity, and digitising medical records to improve the effectiveness of the MKDKI's dispute resolution mechanism. As a result, the MKDKI is expected to provide fair and accountable legal protection for both patients and medical personnel in Indonesia.

Abstract

Medical malpractice is one of the critical issues in Indonesia's healthcare system, significantly impacting patient safety and the security of the medical profession. This study aims to analyse the factors causing medical malpractice, its legal implications, and the effectiveness of legal protection measures for patients and medical personnel. The causes of medical malpractice include negligence, lack of competence, communication failure, inadequate facilities and infrastructure, and weak institutional oversight. The legal implications of medical malpractice encompass civil, criminal, and administrative liability, which often create legal uncertainty for both patients and healthcare professionals. Legal protection measures have been regulated in various regulations, but their implementation still faces challenges, such as the difficulty of proving negligence, low legal literacy among the public, and the ambiguity of the definition of medical malpractice. This study recommends strengthening the supervision system, harmonising regulations, and providing balanced legal education to ensure justice and legal certainty in the handling of medical malpractice cases in Indonesia.

Abstract

This study examines the role of land title certification in supporting financial inclusion and improving social welfare through access to capital in formal financial institutions. Using a literature review approach, this study examines literature and empirical studies that link legal certainty of land ownership with ease of access to capital for the community, especially vulnerable groups. The results of the study show that land certification provides legal certainty that encourages financial institutions to distribute credit more widely and safely, thereby expanding access to formal finance. This access to capital plays an important role in strengthening the economic capacity of the community, increasing business productivity, and promoting sustainable social welfare. However, to optimise the role of land certification, policy synergy, inclusive financial product innovation, and public education are needed to ensure that capital utilisation is effective and has a broad impact.

Abstract

This study examines the role of regulatory harmonisation in the development of national economic law as a strategic effort to create legal certainty and promote inclusive economic growth in Indonesia. Through a literature review, the study examines how regulatory harmonisation can overcome the disharmony and overlap of regulations that have been obstacles to the implementation of economic law. Harmonisation based on the values of Pancasila and the provisions of the 1945 Constitution is expected to create a consistent and fair legal system, which in turn supports equitable development and people's welfare. The findings of the study show that regulatory harmonisation is not only important to ensure legal certainty for economic actors and investors, but also an effective means of realising an inclusive and socially just economy in accordance with the fundamental values of the Indonesian nation. Policy recommendations are formulated based on a comprehensive analysis of the philosophical, constitutional and practical aspects of regulatory harmonisation in the context of national economic law.

Abstract

This study examines the predictability of economic dispute resolution in Indonesia through the perspective of legal reform that focuses on harmonisation and synchronisation of regulations as instruments to support the national investment climate. Legal uncertainty has arisen from overlapping regulations, inconsistencies in implementation, and weak consistency in court and arbitration decisions. These conditions reduce investor confidence and lower the competitiveness of Indonesia's economic law in the global arena. Using a normative legal research approach and literature study, this research analyses the relationship between regulatory harmonisation, legal certainty, and the investment climate in accordance with the mandate of the constitution. The results of the study show that the ability of the Indonesian legal system to provide predictability is highly dependent on the consistency of norms, the professionalism of dispute resolution institutions, and the application of technology as an instrument of legal modernisation. Legal reforms that emphasise the synchronisation and harmonisation of regulations will not only increase legal certainty but also strengthen the legitimacy of investment in Indonesia within the framework of fair and sustainable economic development in accordance with constitutional principles.
