Abstract

This study discusses the dynamics of drafting and revising legislation in Indonesia, emphasising the importance of regulations that are responsive to social, economic, and technological changes. Through a literature review, this study shows that non-adaptive regulations often lag behind the realities of society, creating a gap between legal norms and public needs. On the other hand, accelerated legislation without in-depth review can lead to controversy and public resistance, as seen in various cases of important law formation in Indonesia over the past two decades. This study emphasises that responsive regulations do not only depend on temporal aspects, namely the speed of responding to change, but also substantive aspects, namely the compatibility between the content of the law and public interests, principles of justice, and global developments. A participatory approach provides space for the public to be involved in every stage of legislation, while constitutional principles ensure that legislation is in line with the basic values of the 1945 Constitution, upholding the protection of human rights, legal certainty, and social justice. The results of the study confirm that the success of legislation in Indonesia is determined by the ability to integrate regulatory responsiveness with substantive public participation and respect for constitutionalism. With a legislative model that is increasingly open, inclusive, and adaptive, it is hoped that Indonesia will be able to build a legal system that is relevant, legitimate, and capable of facing the challenges of globalisation and technological transformation without sacrificing democratic stability.

Abstract

This study discusses the role of jurisprudence as a fundamental pillar in building an adaptive, transparent, and effective legal system in Indonesia. Using a normative legal research method based on literature review, this study examines how judicial discovery functions as a mechanism for legal adaptation to social dynamics and substantive justice needs that are not always fulfilled by written regulations. In addition, this study explores the role of court decision digitisation in improving openness and access to information, which triggers accountability and public trust in judicial institutions. Consistency between cases is also analysed as an important element in upholding legal certainty and the effectiveness of the judicial system. The findings show that the synergy between judicial discovery, the digitisation of decisions, and consistency between cases can strengthen the existence of jurisprudence as a key pillar of Indonesia's modern legal system, which is responsive and reliable. The contribution of this research lies in strengthening the theoretical and practical foundations for the development of a more adaptive, open, and effective national legal system.

Abstract

This study aims to comprehensively examine the concept, function, and role of written law in the Indonesian legal system, particularly in ensuring legal certainty. Using a literature review method and a qualitative-descriptive approach, this study explores various sources of literature, ranging from legal doctrine, legislation, to previous research results. The results of the study show that written law has regulatory, instrumental, and legitimising functions, as well as a strategic role as a main pillar in a state based on the rule of law that guarantees legal certainty for all citizens. However, challenges such as overlapping regulations, unclear formulation of norms, and weak harmonisation of regulations remain obstacles to optimising the role of written law. Therefore, efforts to improve the drafting, harmonisation, dissemination, and enforcement of written law are crucial to strengthening the guarantee of legal certainty in Indonesia.

Abstract

This study aims to examine the governance and supervision of extended land rights in the context of sustainable land use and the protection of the rights of surrounding communities. Through a literature review, this study analyses the regulations, administrative mechanisms, and supervisory practices applied in Indonesia regarding the extension of land rights, particularly Building Use Rights (HGB) and Cultivation Use Rights (HGU). This study highlights challenges such as legal uncertainty, administrative barriers, and lack of community participation, which have the potential to trigger conflicts and hinder sustainable land use. Furthermore, this study integrates environmental and social sustainability principles into the management of land rights extension, with a focus on protecting the rights of surrounding communities, particularly indigenous peoples and local communities with traditional tenure rights. Effective monitoring, involving technology and active community participation, is key to achieving fair, productive, and sustainable land use. This study provides policy recommendations based on the principles of good governance to promote transparent, accountable, and inclusive governance. The results of this study are expected to serve as a basis for stakeholders in formulating policies and practices for land tenure extension that not only guarantee legal certainty but also support sustainable development and social protection. Thus, this study contributes to strengthening a land tenure system that is responsive to current and future needs.

Abstract

This study analyses the social and economic impacts of local oil palm plantation laws on the welfare of disadvantaged communities through a literature review approach that integrates agrarian, political economy, and inclusive development perspectives. The main focus is on two dimensions: (1) land access and natural resource utilisation, where regional regulations such as spatial planning regulations and land use rights (HGU) tend to prioritise corporations, causing agrarian conflicts, marginalisation of customary land, and degradation of water and non-timber forests; and (2) economic opportunities and social welfare, including plasma-inti partnerships, CSR, and profit-sharing funds whose distribution is uneven due to local elite corruption and weak oversight. A synthesis of literature from journals, regulations, and NGO reports reveals patterns of structural inequality, in which disadvantaged communities are trapped as vulnerable labourers without long-term autonomy, even though the palm oil sector contributes significantly to the regional GDP. The conclusion emphasises the urgency of local legal reform based on participation, transparency, and distributive justice to transform palm oil into a driver of sustainable welfare.

Abstract

This study analyses the effectiveness of the Guidelines for Significant Corporate Activities of State-Owned Enterprises in integrating the management of Additional State Capital (PMN), organisational restructuring, and business development strategies to ensure the sustainability and growth of State-Owned Enterprises. Using a qualitative literature review approach with content analysis of the latest regulations (Minister of State-Owned Enterprises Regulations PER-01/MBU/07/2024, PER-02/MBU/03/2023, PER-03/MBU/12/2023) and over 90 national and international academic references, the study found that the synergy of these three elements successfully increased the average ROE by 12-15%, EBITDA margin by 15%, and ESG scoring to 70/100 in strategic holdings such as MIND ID, Bio Farma, and Telkom Group. The main challenges include the independence of PMN evaluation, cultural resistance to restructuring, and regulatory uncertainty that hinders business agility. Strategic recommendations include PMN clawback clauses, blockchain monitoring digital dashboards, and a 10% PMN State Venture Fund for deep tech/green investment to achieve 20 SOEs in the global top 500 by 2030, in line with Indonesia's Golden Vision 2045.

Abstract

This study analyses the role of SOE governance guidelines in optimising significant corporate activities, namely restructuring, state capital injections (PMN), and business development, as key pillars of sustainability and competitiveness in the global economy. Through a descriptive-comparative literature review approach, the study explores two main discussions: the optimisation of governance in restructuring and PMN for structural efficiency and fiscal accountability, and ESG-based business development for innovation and global expansion. The results show that holistic governance guidelines—integrating transparency, accountability, and continuous evaluation—can overcome the challenges of political intervention and capability gaps, thereby improving the financial performance of SOEs and their contribution to national development. Recommendations include reforming digital governance regulations and strengthening the independence of the board of commissioners to realise the vision of Indonesia Emas 2045.

Abstract

Health facility and infrastructure management in Indonesia, with a focus on managing infrastructure (backup power systems, HVAC, clean water, hazardous waste) and medical equipment (ventilators, ultrasound machines, defibrillators) to achieve operational efficiency of up to 25% and the sustainability of modern services, using the PRISMA approach on the Garuda, Sinta, Neliti, and Scopus databases for the period 2019-2025, based on PMK Regulation No. 43/2019 IPSRS and MFK Regulation No. 26/2022, which identified gaps such as 20-30% downtime, a biomedical human resource deficit of 1:500, and vulnerability to the COVID-19 pandemic; The findings emphasise the preventive lifecycle, e-Sarpras digitalisation, and IoT predictive maintenance for 85% utilisation and a 3-year ROI, with PPP ESG recommendations and certification training to achieve net zero emissions in the 2025-2029 RPJMN.

Abstract

This study analyses the operational arrangements, management, and legal obligations of hospitals in Indonesia based on Law No. 44 of 2009 to ensure legal certainty and patient protection, using a normative juridical approach with a descriptive-analytical review of Articles 4-28 on operations (classification, licensing, facilities, human resources) and Articles 29-46 on management (organisational structure, informed consent, vicarious liability, sanctions), which reveals the strength of regulations in creating comprehensive standards despite implementation gaps such as regional disparities and a lack of digital adaptation. The findings indicate that the law is effective as a foundation for good hospital governance, in line with the National Health Insurance (JKN) and constitutional health rights, but requires strengthened supervision, mandatory malpractice insurance, and harmonisation with the latest Health Law to optimise patient protection in the post-pandemic era. Recommendations include the digitisation of licensing, director certification, and pre-litigation mediation to reduce legal disputes.

Abstract

Hospital law in Indonesia comprehensively regulates the operational, managerial, and legal responsibilities of institutions in healthcare services, as stipulated in Law-Law Number 44 of 2009 concerning Hospitals, which emphasises the obligations of good hospital governance, quality control, risk management, and joint liability for systemic negligence such as medical record failures, emergency response, and nosocomial infection control. This study uses a normative juridical approach to analyse the primary responsibility of hospitals based on Article 1365 of the Civil Code and Supreme Court decisions, which indicate that institutions are responsible for managerial defects even when medical personnel are involved, thus requiring the integration of strict SOPs and risk committees to balance accountability with operational efficiency. In parallel, the legal protection of medical personnel is guaranteed through Law-Law Number 29 of 2004 concerning Medical Practice and the principle of error in judicio, with the role of hospitals in supporting vicarious liability, informed consent, and Good Samaritan immunity, despite challenges such as criminal litigation based on Article 351 of the Criminal Code and SLAPP suits demanding reforms such as a national risk guarantee fund to maintain professionalism without sacrificing patient rights. The study concludes that harmonisation between institutional responsibility and individual protection is essential for a sustainable health system, with recommendations for strengthening preventive regulations, specialised medical courts, and cross-professional legal training to achieve fair legal certainty.
