Abstract

This article discusses the application of Islamic Law principles in criminal law reform in Indonesia, focusing on efforts to integrate Islamic norms into the pluralistic national legal system. Using the literature research method, it explores the principles of justice ('adl), balance (tawazun), public good (maslahah), and crime prevention (saddu al- dhara'i) as the foundation for criminal law reform. The results show that despite the challenges in harmonising Islamic law with secular national law, the application of these principles can enrich the Indonesian criminal law system with strong moral and ethical values. In addition, wise and comprehensive integration can optimise the effectiveness of law enforcement and improve the sense of justice in society. This study recommends the need for continuous dialogue between stakeholders to reach consensus and ensure that the resulting laws are inclusive and adaptive to the diversity of Indonesian society. In the long run, criminal law reform that considers the principles of Islamic Law has the potential to strengthen the foundation of national law and improve social welfare.

Abstract

The integration of Sharia criminal law into the national legal system presents significant challenges. Firstly, there are fundamental differences between the principles and values espoused by Sharia criminal law and national criminal law, which may hinder their alignment. Secondly, the juridical and institutional challenges require the revision of laws and regulations, as well as the development of new mechanisms to implement the law, which requires inter-agency coordination and a significant amount of time. Thirdly, the socio-cultural aspect is also a major obstacle, given that the application of Sharia criminal law must be adapted to a society that is diverse in terms of religion, culture and social values. Thus, a thoughtful and inclusive approach, as well as effective communication and education strategies are needed to achieve harmonious integration.

Abstract

This article discusses the conflict and convergence between criminal law and religious law from a criminological perspective. This conflict often occurs due to differences in principles and norms between the two legal systems, which can include differences in sentencing, views on justice, and the protection of human rights. On the other hand, however, convergence can be found when the ethical and moral principles espoused in religious law support the objectives of secular criminal law, such as in crime prevention and the protection of society. Through criminological analysis, this article explores how these conflicts and convergences affect the implementation of the law, public perceptions of justice, and the formulation of more inclusive and effective criminal policies. The article concludes that by carefully considering the differences and similarities between the two legal systems, areas in need of reform or adjustment can be identified to improve the effectiveness of the justice system and promote social justice.

Abstract

This article conducts a comparative analysis between the concept of restorative justice in modern criminal law and Islamic law. Restorative justice is an approach in the legal system that prioritises the restoration of the relationship between the victim and the offender as well as reparation for the harm suffered by the victim. In modern criminal law, this approach focuses on mediation and dialogue that aims to reduce recidivism and restore balance in society. On the other hand, Islamic law also has similar mechanisms through the concepts of sulh (peace) and diyya (compensation) which emphasise the importance of forgiveness and reconciliation. Despite differences in cultural and normative contexts, both legal systems demonstrate that restorative justice principles can be an effective and humane alternative in the handling of legal offences. As such, the integration of these principles is expected to contribute to the establishment of a more just and harmonious justice system.

Abstract

This research examines the role of religious values in the process of criminal law formation in Indonesia. Referring to Pancasila as the foundation of the state, the value of Belief in One God emphasises the importance of religious aspects in national legislation. The moral values of the various religions practised by Indonesians, particularly Islam, Christianity and Hinduism, have influenced a number of provisions in the Kitab Undang-Undang Hukum Pidana (KUHP). Examples of these provisions include prohibitions against adultery and alcohol consumption, which resonate with the moral teachings of the dominant religions. However, the application of religious values in criminal law also faces challenges related to religious pluralism. Therefore, the legislative process should take into account inclusive dialogue and consultation with various religious groups to ensure that the resulting laws are not discriminatory and still respect the diversity of beliefs, in order to maintain social harmony in Indonesia.

Abstract

This study examines the optimal role of downstreaming, food security, and fiscal reform as key pillars in Indonesia's economic transformation towards the Indonesia Emas 2045 vision. Downstreaming is identified as an important strategy to increase the added value of domestic products and promote sustainable industrialisation. Food security is the foundation of national social and economic stability through the provision of sufficient, high-quality, and sustainable food. Meanwhile, fiscal reform ensures the availability of effective policies and financing capacity to support the two pillars through a more efficient and fair taxation system and budget management. This literature review examines various related literature to describe the current conditions, challenges, and opportunities for implementing the three pillars in the context of national economic development. The results of the study emphasise the need for synergy and an integrative approach to the three pillars so that Indonesia can achieve a self-reliant, inclusive, and globally competitive economic transformation by 2045.

Abstract

This study discusses the Daya Anagata Nusantara Investment Management Agency (BPI Danantara) as a new legal entity in the management of state-owned enterprises (BUMN) investments in the era of Law No. 1 of 2025. BPI Danantara was established to integrate the management of SOE assets and investments in a professional, transparent, and accountable manner to support sustainable national economic development. This study uses a literature review method by analysing regulations, academic literature, and official documents to explore the concept, position, and impact and challenges of implementing BPI Danantara. The research findings indicate that BPI Danantara plays a strategic role as a national investment management centre that combines the principles of good corporate governance with effective mobilisation of state assets. However, the success of this institution depends on its ability to manage risks, enhance managerial capacity, and ensure independence and transparency in decision-making. This study provides recommendations for strengthening regulations and institutional capacity so that BPI Danantara can contribute maximally to accelerating economic transformation and the management of state-owned enterprise investments.

Abstract

This study discusses the dilemma of legal protection for indigenous peoples in Indonesia that has arisen due to the limited effectiveness of regional legal products in guaranteeing their rights. Although a number of regional legal products have been issued as an effort to recognise and protect them, their implementation has often failed to provide substantial and sustainable protection. The main obstacles identified include overlapping authority between the central and regional governments, complex bureaucracy, political and economic pressures, and a lack of regulatory harmonisation. These conditions result in legal uncertainty that is detrimental to indigenous peoples, particularly in relation to the recognition of customary territories, land rights, and cultural preservation. Through a literature review, this study outlines the national legal framework and local legal products, and examines the limiting factors and real implications for the rights of indigenous peoples. The results of the study emphasise the importance of policy harmonisation, synergy between governments, and strengthening the national legal framework to improve the effectiveness of legal protection and ensure social justice for indigenous peoples.

Abstract

This study discusses the implementation of Pancasila values and digital transformation as a strategy to strengthen Indonesia's economic sovereignty. Pancasila values such as social justice, mutual cooperation, unity, and independence are the philosophical foundation for building an inclusive, just, and sovereign economic system. Digital transformation offers significant opportunities to accelerate economic inclusion, expand market access, and enhance national competitiveness while upholding the nation's noble values. Through a literature review, this study reveals how the integration of Pancasila values in the utilisation of digital transformation contributes to creating an independent and sustainable Indonesian economy, while rejecting foreign economic dominance. The results of the study emphasise the importance of collaboration between the government, the private sector, and the community in building a fair and equitable digital ecosystem for the welfare of all Indonesians.

Abstract

This study examines the influence of culture and social systems on hospitals as medical institutions and the importance of adjusting health laws to improve patient acceptance of health services. In a pluralistic society, cultural values and social structures are key factors that influence patients' perspectives, attitudes, and behaviour towards medical services. This literature review collects and analyses academic literature, legal regulations, and related case studies to identify the complex relationship between cultural, social, and health law aspects. The results of the study show that understanding and accommodating cultural diversity and social systems through inclusive and adaptive health law adjustments are essential to creating effective, humane medical services and increasing patient satisfaction and trust. This study provides recommendations for policymakers to develop health law regulations that are responsive to cultural and social diversity in order to support more equitable and equitable access to and quality of health services.
