Abstract

Pesantren, traditional Islamic boarding schools in Indonesia, play a crucial role in fostering religious moderation and promoting tolerance and peace in multicultural contexts. This study explores the teaching of Khilafiyah Fiqh, or jurisprudential disagreement, in Pesantren in South Kalimantan and its impact on cultivating an inclusive and peaceful environment. The concept of khilafiyah, derived from the Islamic legal tradition, reflects the diversity of interpretations of Islamic law and is respected as a sign of dynamism and flexibility. Pesantren teach khilafiyah through various methods, including the recitation of classic Islamic texts, discussion, and debate, which encourage critical thinking and openness to different opinions. The implementation of khilafiyah fiqh in Pesantren involves teaching differences of opinion in various aspects of Islamic practice, such as prayer, zakat, and fasting. Kyai and Pesantren scholars emphasize the importance of respecting different views and avoiding fanaticism. Understanding khilafiyah has a positive impact on supporting religious moderation, as it encourages santri (students) to be inclusive and open to diversity, both within the Muslim community and in interfaith relations. Case studies in South Kalimantan demonstrate the successful application of khilafiyah fiqh in promoting tolerance and peace. However, challenges exist, including internal differences among teachers and santri, resistance to changes in traditional teaching methods, and external resistance from the community and other Islamic organizations. To overcome these challenges, Pesantren employ various approaches, including interfaith and cross-cultural dialogue, which strengthen the understanding of khilafiyah and its role in fostering a harmonious society.

Abstract

The primary focus of this community service initiative is to improve the abilities of Halal Product Process facilitators (P3H) and to expedite halal certification acquisition for stakeholders in South Kalimantan through the self-declaration scheme. The methods used are mentoring and workshops, which are then carried out by holding a Focus Group Discussion (FGD). The number of P3H who participated in this event was 100 participants. The findings and outcomes of the event can be described through the enhancement of facilitators' competency, which has an impact on increasing the number of halal certificates issued in the South Kalimantan area. In 2022, 893 halal certificates have been issued, followed by 1,588 certificates from January 1st to July 14th, 2023. This number increased significantly to 3,286 certificates issued from July 15th to December 31st, 2023, after the implementation of community service. As a result, this community service has proven effective in accelerating halal certification for MSMEs.

Abstract

ABSTRACT The increasing development of property assets, especially the level of difficulty selling land quickly and in cash is not as easy as we imagine with the business of buying and selling 2x1 graves of alkah land in the Banjar community, this business is used as a livelihood to take as much profit as possible among people who can't afford it . This research is a field research using a descriptive qualitative approach, namely field research with a library research approach, library research and textual comparison of a contract. The object of this research is the perspective of the Imam Syafi'I madhhab in the mechanism of the business contract of buying and selling land alkah with the funeral gift system. Data collection techniques are observation, interview, documentation and literature study. The results of this study indicate that the business mechanism of buying and selling alkah land at the Mahabbah Cemetery according to Imam Syafi'I has been allowed with the fulfillment of the conditions and pillars. According to the MUI fatwa, the funeral business is allowed but in running the business there is no tabzir and israf element because it uses something appropriate but not excessive than appropriate. Abstract

This journal examines the customary practices of the Banjar community in conducting "sighat akad" (contractual declaration) during transactions, which involve not only using the phrase "sell" or stating the price of the item as "I sell this shirt for fifty thousand,"but also adding the phrase "sell as is". The purpose of this research is to understand the perspective of the Shafi'i school of thought regarding the legal status of the contract of sale using the phrase "sell as is" in the Banjar community's practices. The research methodology employed in this study is field research with descriptive analysis, where data is collected through interviews and literary sources regarding the contractual agreements of buying and selling, which are then compared with the theories from the Shafi'i perspective. Based on the findings of this research, it can be concluded that according to the Shafi'i school of thought, the contract of sale using the phrase "sell as is" is permissible due to the mutual agreement between the seller and the buyer. This perspective aligns with the main objectives of a contract, which include the presence of mutual agreement, clarity of the object and terms, rightful ownership, and immediate payment and delivery.

Abstract

Gaya hidup konsumtif secara sederhana dimaknai sebagai gaya hidup (lifestyle) dengan perilaku konsumsi yang berlebihan dalam membeli atau mengkonsumsi sebuah barang. Salah satu gaya hidup konsumtif yang banyak terjadi di masyarakat saat ini adalah perihal buy now pay later (BNPL). Islam memberikan pedoman tentang konsumsi, termasuk larangan terhadap perilaku boros (israf) dan pemborosan sumber daya (tabdzir), serta keharusan untuk mengonsumsi barang yang halal dan thayyib (baik dan bermanfaat). Artikel ini akan menganalisis konsep gaya hidup konsumtif perspektif QS. Al-Isra’ 26-27 dan menjelaskan implikasi Fenomena Buy Now, Pay Later (BNPL) di Indonesia. Metode penelitian menggunakan metode Studi kepustakaan atau literatur dengan pendekatan hukum normatif khususnya perspektif QS. Al-Isra’ 26-27 dari Tafsir Al Munir karya Wabah Zuhaili dan tafsir Al Misbah karya Quraish Shihab digunakan untuk analisa gaya hidup konsumtif dan kajian kasus BNPL dalam perspektif Islam. Penelitian terdahulu memang juga menyebutkan Shopee paylater mendatangkan kemudaratan kepada konsumen karena fitur ini memberikan keuntungan dari pengguna dan penundaan pembayaran ini bersifat riba karena salah satu syaratnya berisi ketentuan denda jika melebihi tempo yang telah disepakati sebelumnya Hasil penelitian ini menyebutkan gaya hidup konsumtif bukan hanya merusak diri sendiri tapi juga masyarakat dan BNPL yang tidak disikapi dengan bijak salah satu penyebabnya.

Abstract

AbstractThe high number of early weddings in South Kalimantan, including both hand-arranged marriages and those performed formally with court-provided marriage dispensation services, is the subject of this study. to more thoroughly investigate the legal factors that South Kalimantan religious court judges take into account while handling cases of marriage dispensation. This study attempts to address the issue of early marriage in relation to the court's ability to grant dispensation from marriage as a requirement for legalizing marriage for those who have not reached the legal marriageable age through a constitutional approach, legal sociology, and legal anthropology. The review revealed that the majority of the dispensation petitions submitted had been approved. The judge uses procedural and substantive factors based on laws and regulations to decide the marriage dispensation case, taking into account the facts of the case while also paying attention to the fiqh and the guiding principles of Islamic law, which are derived from the verses of the Koran and hadith. Although there is a perception that judges are quick to grant requests or are thought to play a role in South Kalimantan's legalization of early marriage.AbstrakFokus kajian ini adalah mengenai tingginya pernikahan dini di Kalimantan Selatan baik yang dilakukan dibawah tangan maupun yang dilakukan scara resmi dengan fasilitas dispensasi kawin dari pengadilan. Untuk selanjutnya menelaah secara mendalam pertimbangan hukum hakim Pengadilan Agama di Kalimantan Selatan dalam memproses perkara dispensasi Kawin. Melalui pendekatan konstitusional dan pendekatan sosiologi hukum dan antropologi hukum penelitian ini  mencoba menjawab persoalan pernikahan dini dikaitkan dengan kewenangan pengadilan dalam memberikan dispensasi kawin sebagai syarat untuk melegalkan perkawinan bagi  mereka yang belum mencapai usia minimal kawin. Dari telaah yang dilakukan mendapatkan temuan bahwa sebagian besar permohonan dispensasi yang diajukan adalah dikabulkan. Hakim dalam memutus perkara dispensasi kawin didasarkan kepada fakta persidangan dengan menggunakan pertimbangan prosedural dan substansial yang di dasarkan peraturan perundangan dengan tetap memperhatikan prinsip Hukum Islam yang bersumber dari ayat ayat al Quran dan hadis serta kaidah kaidah fikih. Walaupun ada kesan hakim begitu gampang mengabulkan permohonan atau dianggap ikut terlibat dalam legalitas pernikahan dini di Kalimantan Selatan.

Abstract

The principles of Qard Hasan and Ihsan in Islamic debt practices have great potential in strengthening the people's economy through an Islamic financial approach that is equitable and based on spiritual values. However, the integration of these principles in the regulation and practice of Islamic fintech in Indonesia still faces challenges, both in terms of policy, public awareness, and the sustainability of the business model. This study aims to analyze the role and implementation of the principles of Qard Hasan and Ihsan as reflected in QS. Al-Baqarah: 280-281, and evaluate its contribution to strengthening the digital Islamic financial system in Indonesia. The method used is Systematic Literature Review (SLR) with PRISMA approach through five scientific databases: Crossref, ScienceDirect, Semantic Scholar, SINTA, and Google Scholar. The results showed that Qard Hasan has a strategic role in encouraging financial inclusion and empowering MSMEs without usury. While the value of Ihsan strengthens the dimensions of ethics and social justice in economic interactions. In the context of Islamic fintech, the integration of Qard Hasan still requires the support of clear regulations, adaptive technology, and massive public education. This research recommends the development of Qard Hasan-based Islamic Fintech model as an ethical and inclusive financing solution based on maqashid sharia.

Abstract

Water resource management is a critical component of environmental sustainability, directly influencing the availability and quality of water for human consumption and ecological systems. Indonesia, as the world's largest Muslim-majority country, faces significant water management challenges, including resource mismanagement, inefficient water systems, and weak institutional framework. However, this study is unique as it develops the comprehensive Sharia-based framework for water governance in Indonesia, integrating Islamic principles particularly Maqashid al-Sharia (Islamic legal objectives) and Fiqh al-Bi'ah (Islamic environmental jurisprudence), as well as Islamic ethics into water resource management to achieve sustainability. Using a normative-juridical and interdisciplinary qualitative approach, the research analyzes Islamic texts, legal documents, environmental data, and expert opinions through content and comparative analysis. The findings reveal that Indonesia’s Water Quality Index (WQI) slightly improved from 53.88 in 2022 to 54.59 in 2023, yet water pollution persisted in 11,019 villages/sub-districts as of 2024, with Central Java being the most affected (1,366 cases). The integrated Islamic framework emphasizes the preservation of life, intellect, wealth, progeny, and religion, aligned with the principles of maslahah (public interest), ‘adl (justice), and khalifah (stewardship). This model offers both normative direction and practical solutions for policymakers, religious authorities, and environmental institutions to address water-related challenges through an ethical and faith-based lens.

Abstract

Abstract: This study aims to consider the impact of the pandemic on the teaching-learning process from the perspective of Early Childhood Education (PAUD) teachers. Not many studies have examined the effects of the pandemic on the teaching process with children, even at the PAUD level. This paper aims to gain a deeper understanding of the realization of the teaching and learning process during an emergency due to Covid-19 in Banjarbaru City, which came as a consequence of an unfavorable epidemiological situation. Teachers, children, and parents are recognized in this paper as the main determinants of the quality of education. The results of the attitude assessment of 40 teachers in the city of Banjarbaru there are important aspects of the educational process during an emergency. The data takes place, based on the results obtained, it can be concluded that the level of adaptability of teachers is considered capable enough to deal with new situations and is decreasing as it continues to be extended. face-to-face learning emergency. The results explain a high positive attitude in terms of cooperation between teachers and parents, which indicates that there is a lot of room to improve the quality of education in the future through blended learning. Abstract

This study discusses pronunciations used in marriage contracts in Indonesia with various types of pronunciation. The jurisprudence experts agree to use the words "Nikah and Kawin" in a marriage contract because it is based on Q.S Al-Azhab verse 37 which uses the word "Nikah". This study tries to compare the use of these words in the book of Fiqh al-Islam wa Adillatuh by Wahbah Zuhaili and Fiqh al-Sunnah by Sayyid Sabiq. The results showed that the marriage pronunciations used were based on meaning, not pronunciation, provided that there was an intention or indication for marriage and was understood by the witnesses. Therefore, according to Wahbah Zuhaili, using a word other than what has been stipulated in the text of the Al-Qur'an is still valid. Meanwhile, Sayyid Sabiq stated that the pronunciation of the contract must be in words that can be understood by each party and must not use vague words.
