Abstract

Introduction to the Problem: The Jiwasraya insurance scandal exposed major weaknesses in Indonesia’s legal oversight of state-owned enterprises, particularly in corporate governance, fiduciary responsibility, and regulatory enforcement. Despite multiple government interventions, the lack of accountability and transparency eroded public trust and questioned the integrity of legal policy. Purpose/Objective of Study: This article examines the government’s legal and policy measures in addressing the Jiwasraya crisis, focusing on how these efforts align with the principles of legal certainty, justice, and Good Corporate Governance (GCG). Design/Methodology/Approach: Employing a normative juridical method with statute and comparative approaches, the study analyzes statutory frameworks, court decisions, and administrative responses, supported by comparative insights from China, Germany, and the United Kingdom. Findings: The findings reveal that government measures, such as corporate restructuring, the establishment of IFG Life, and criminal prosecution, remain largely reactive and lack structural reform. The study argues for the codification of fiduciary duties, strengthening corporate criminal liability, and the selective imposition of severe penalties in corruption cases causing extensive state losses. Furthermore, the absence of transitional legal norms and enforceable state guarantees leaves non-migrated policyholders without legal protection. These findings highlight the urgency of reforming Indonesia’s corporate and financial governance system to restore legal certainty and uphold justice. Paper Type: Research Article

Abstract

The use of light attractors in light fishing is limited by bright moon phase, turbid water, large waves, strong currents, and lamp power regulations. Bait attractors are expected to optimize catch and address issues with boat lift nets. This study examines the use of bait attractors along with light attractors on boat lift nets, focusing on their impact on catch yield and species composition. Conducted in May 2024 over 12 trips using experimental fishing, treatments included green mussel attractors, sardinella attractors, and no attractors (control). The total catch over 12 trips was 2,480.69 kg. Boat lift nets with green mussel attractors produced 870.88 kg (average 72.57 kg ± 44.94), with sardinella attractors 839.49 kg (average 69.96 kg ± 44.87), and without attractors 770.32 kg (average 64.19 kg ± 45.48). A total of 23 species were caught, with green mussel attractors capturing 20 species (average 7.8), sardinella attractors capturing 20 species (average 7.9), and no attractors capturing 17 species (average 7.3). The main catch to by-catch ratio was 91.82% : 8.18% (sardinella attractors), 90.26% : 9.74% (green mussel attractors), and 87.46% : 12.54% (no attractors). Results indicate bait attractors do not significantly affect catch weight compared to no bait attractors. Key words: bait attractors, boat lift nets, catch yield, composition, Jakarta bay waters

Abstract

Squid fishing is traditionally done in Indonesia, especially in the Eastern region such as the Wakatobi Islands. Deep sea squid fishermen on this island use hand line fishing equipment (squid fishing rods) with the help of LED lights which are still quite limited, because they only use one mini LED light with a battery that can last for 4 days. This research aims to utilize used Polyethylene Terephthalate (PET) mizone bottle waste as a squid catching tool that can be used repeatedly, as well as reusing PET waste. The research used the experimental method of fishing in Wangi-wangi waters, the lamp design used a PET waste frame using blue-green LEDs, rechargeable batteries, and was operated in water. PET waste has a hard, strong and waterproof material, this waste is used to reduce waste of used mizone bottles. This test uses three boats with sixteen repetitions. The data were analyzed using the Randomized Block Design (RAK) method. Based on the test results, different catches were obtained, where blue light was 35% (1697 fish), control light (combination of red, white, blue) was 34%, and green light was 31% (1447 fish). The calculated F value > F Table (2.92 > 2.02) which means that there is a real influence of the use of LED lights made from PET waste on fishermen catches. Key words: fishermen, LED, PET waste, squid

Abstract

Abstract

This study aims to analyze the implementation of the principle of justice (al-‘adl) in mudharabah contracts within Islamic Microfinance Institutions (LKMS) in Indonesia. The rapid growth of the Islamic economy demands the application of contracts that align with Islamic values, one of which is mudharabah—a partnership between the shahibul maal (capital provider) and the mudharib (entrepreneur)—based on fair and transparent profit-sharing principles. The research employs a qualitative method using a library research approach and a comparative analysis between the concepts of fiqh muamalah and modern regulations such as the DSN-MUI fatwas and OJK regulations concerning LKMS. The findings reveal that, conceptually, the mudharabah contract reflects the value of justice through the balance of rights and obligations between capital owners and business managers. However, in practice, LKMS still face several challenges, including institutional dominance in determining profit-sharing ratios (nisbah), low transparency in business reporting, and weak sharia supervision. These issues indicate a gap between the normative principles of fiqh muamalah and their regulatory implementation in practice. This study recommends the formulation of maqashid sharia-based contract frameworks, the enhancement of human resource capacity in fiqh muamalah and Islamic accounting, and the strengthening of the Sharia Supervisory Board’s function to ensure comprehensive implementation of justice in every contract.
